Regular Meeting
of the
Euless City Council
May 13, 1965
CALL TO ORDER
The regular meeting of the Eulesss City
Council was called to order at 8 :25 P. M. by Mayor Pro Tern Bobby Fuller,
with the following councilmen present: Councilmen B i I I Byers, Frank Doug-
lass, and Don Warren. (Absent: Mayor W. G. Fuller and Councilman Harold
Samuels were out of the city.)
Also present were City Manager Lee
Cowell , City Attorney James Cribbs and City Secretary Vada Ferris.
INVOCATION
The invocation was presented by City
Attorney James Cribbs.
APPROVAL CF MINUTES
The minutes of the regular council meet-
ing April 27, 1965, were approved as written with the following correction:

FIRST READING: ORDINANCE NO, 251
RECREATION AND PARK ORDINANCE
City Manager Cowell 1 stated that he was
desirous of the councils opinion of the proposed Recreation and Park Ordi-
nance which had been provided for each councilman a few days following the
last regular meeting - this ordinance having been submitted to the council
members in order for them to have time to study before this meeting. After
discussion, and questions by the council members, and answers and clarifi-
cation by the City Attorney, Councilman Douglass made the motion that the
First Reading of the proposed Recreation and Park Ordinance be approved as
submitted. Councilman Warren seconded the motion which carried unanimously.
(Second reading of Ordinance No. 251 - May 25, 1965).
FIRST READING: ORDINANCE NO, 252
SIGN AND BILLBOARD ORDINANCE
City Manager Cowell stated that he was

WILSHIRE VILLAGE DRAINAGE
EAST CLIFF DRIVE
City Manager Cowell read a letter dated
December 21, 1963, addressed to M r . B i l l Condron, former City Manager of the
City of Euless, from Mr. Jim Davies, the city's engineer in 1963. This let-
ter explained the drainage situation in Wilshire Village (specifically
East C l i f f Drive). Mr. Cowell explained that Mr. Davies letter stated that
a study had been made of the area based on the preliminary plans of Wil-
shire Village revised October 1, 1961, on the street plans and profiles that
had been presented to the City of Euless by the developer. Mr. Cowell further
explained that, at the councils request several months ago, the Counsulting
Engineers, Gregory, Knowlton and Rat] iff had surveyed the drainage situation
in this area and had submitted a recommendation to correct the situation at
an estimated cost of $4,822.51. He further commented that Mr. Herman Smith,
the developer, has stated that he can not put any money in the corrective
situation - he considers that he has designed the area to comply with the City
of Euless standards. However, he w I I donate any easement necessary for
additional street drains. After considerable discussion, City Manager Cowell
stated that reports relating to this problem are vague and since this problem
dates back several years ago during a different administration and council,
he considers it might be wise for the city to assume the responsibility of
correction.
Several Wilshire Village citizens were pre-
sent. The following comments were made: Mr. Marvin D. Spiller, 605 East C I i ff
Drive, stated that during the heavy rains in the early part of this week, he
had waded into water waist deep in his back yard to knock out a portion of his
stockade fence in order to permit the water to drain from his back yard and
prevent it from entering his home. Mr. Tommy Sparks, 604 East C I i f f Drive,
made comments about high water in that area. Mr. Richard S. Lawson, 603 East
C l i f f Drive, stated that the creek or drainage ditch in the back of his home
has fi I led up with sand and s i It and that the water rises very rapidly in that
area - the drainage d i t c h cannot carry a l l of the water adequately due to the
fact that each time the water rises additional sand and debris builds up in the
drainage ditch. Mr. Ernest Addington, 606 East C I if f Drive stated that in his
o p i n i o n , a l l o f the water from W i l s h i r e Drive, Toplea Drive, East C l i f f Drive
and Sagebrush Drive drains into a drainage pipe that is not adequate to carry
the water flow in that area. Mr. Addington stated that, during the heavy rain r.
earlier this week, water entered his home and considerable damage had been
done, and his wife had attempted to protect valuable articles in their home
(an organ and other furniture); she had fallen and as a result, is in the
hospital. Mr. Addington stated that he enjoys living in Euless very much,
however, this is the second time that his home has been flooded and that he is

most anxious that the drainage problem in this area be corrected immediately.
He stated t h a t he had been apprised t h a t there is a c e r t a i n time l i m i t on
filing suit for damages for restitution. He was referred to Article 11,
Section 8, in the charter which explains a claim must be filed within 30
days i n the Office of City Secretary. Dr. Flory, 608 East C I i f f Drive,
inquired as to when the drainage problems on East C I i f f Drive and other
sections of Wilshire Village were scheduled in the Capital Improvement
Program that was voted in July, 1964. City Manager Cowell referred to the
formal Capital Improvement Program and advised that a contract had been
awarded to S. R. 0. Asphalt Company, in Arlington, which would help to cor-
rect these existing problems. However, according to the schedule that had
been presented by the engineers, this was not scheduled in the very near
future. City Manager Cowell stated that similar problems are in existence
in many parts o f the City o f Euless and t h a t a l l of these cannot be coP
rected in the fi rst year of the Bond Program. He stated that he realizes
the seriousness of these drainage problems and i s most anxious that they are
corrected as soon as possible. City Manager Cowell explained that the drain-
age inlets on Sagebrush Drive and other streets had been cleaned several
months ago. At that time baseball bats, t i n cans and various other items
were found to be blocking the drains which would prevent proper drainage of
water from the streets. He stated that, perhaps, the inlets were in need of
cleaning at this time and would schedule this for Street Department crew as
soon as possible. After considerable discussion Councilman Byers made the
motion that the engineers' proposed correction in the amount of $4,822.14,
be approved at the city's expense, if the engineers are certain that this
correction will be adequate to carry drainage water during heavy rains as
were experienced in the City of Euless in this week, May 10, 1965, and if
the engineers p l a n is determined inadequate, t h a t a plan t h a t w i l l be ade-
quate to eliminate this problem on East C I i ff Drive be presented at the next
regular council meeting, and further that the drainage situation in the
Wilshire area (Sagebrush Drive, Windlea Drive, Toplea Drive, East C1 iff Drive,
etc.) be investigated by the engineers and report presented to the City
Manager for evaluation; if this report will be ready before the next regular
council meeting to be held May 25, 1965, that the City Manager schedule a
called meeting for this report to be presented before the council members to
be discussed in order to evaluate costs and improvements to this serious
drainage problem. Councilman Warren seconded the motion which carried unan-
imously.
I V.
PROPERTY ADJACENT TO POLICE STATION
AND FIRE STATION NO. I
(MR. ROSS CANNON AND MRS. ANN LAWTHER)
City Manager Cowell stated that he had been
approached by Mrs. Ann Lawther, owner of property adjacent to the present
Police Station and Fire Station No. I, concerning the use of her property for
a driveway and parking lot for city vehicles. Mr. Cowell stated that he in-
formed Mrs. Lawther that city vehicles had been using this area and inquired
if she might be interested in selling it_ She stated that she would be agree-
able to sell the property to the City, Mr. Cowell stated that Mr. Ross Cannon,
owner of property adjoining the Police Station and Fire Station Number 1, had
expressed a desire to sell a portion of his property to the city and at this
time M r . Cowell asked M r . B i l l Pasteur, a member of the City's real estate
committee, to explain the details of the proposed sales,

Mr. Pasteur informed the council that
Mr. Cannon's property is as follows: being a tract of land out of the
A. J. Huitt Survey, Abstract 684, and adjacent to the North side of lots
2 and 3 of the Ross Cannon Addition to the City of Euless, Texas. Said
tract being approximately 30' by 100' joining lot 3 of said addition on the
north side another tract being approximately 20' by 176.4 joining the
West side of the Euless Fire Hall property and running 176.4 from the south
right -of -way line of State Highway 183 to the north side of Lot 2 of the
Cannon Addition as shown on the attached plat. (This property adjacent to
present police and fire station.) Mr. Cannon's price is $2,725.00.
Mr. Pasteur stated that Mrs. Lawther had
not placed a price on her property but was desirous of the City making an
offer.
V.
COMMERCIAL BUILDING PERMIT NO. 16
(MR. HOMER FULLER)
City Manager Cowel 1 advised the council
that Mr. Homer Fuller had requested a commercial building permit for a
walk -in freezer at the E -Z Way Market. Mr. Cowell read Planning and Zoning
Commission minutes dated May 4, 1965, Item ID, in which the Planning and
Zoning Commission recommended approval of Mr. Homer Fuller's request for a
commercial building permit. After discussion, Councilman Douglass made
the motion that the council concur with the recommendation of the Planning
and Zoning Commisssion and approve Commercial Building Permit Number 16.
Councilman Warren seconded the motion which carried unanimously.
VI.
IMPROVEMENTS TO WILSHIRE D R I V E
City Manager Cowell informed the council
that he had been contacted by Mr. Newell Odell, Superintendent of the
Hurst - Euless- Bedford Public Schools, concerning improvements to Wilshire
Drive near the Wilshire Village Elementary School. Mr. Cowell stated that
Mr. Odell had stated that he would submit a letter from the school board
relating to the condition of Wilshire Drive, and stating that the school
district is requesting improvements due to the fact that this street is so
heavily traveled by parents and students. However, the letter had not been
received in the city offices prior to this council meeting. Mr. Herman
Smith, a visitor to the council meeting and developer in that area, stated
that the street is under contract, at this time, for paving and should be
completed by September 1, 1965.
Mayor ProTem Bobby Fuller thanked Mr.
Smith for this information and his appearance before the council.
Mr. Pasteur stated
that he had
been con-
tacted by
Mr. Edgar Hogg owner of Lot 13, Block C, of
the Sheppard
Addition.
Mr. Hogg
plans to dispose of
this property and will sell it to the
City for
$7,625.00.
(This property is
adjacent to the Civic Center
Site.)
After considerable
discussion,
it was
agreed by
the members of the
council that this matter
be tabled until
the
next regular council meeting
May 25, 1965.
V.

City Manager Cowel 1 advised the council
that Mr. Homer Fuller had requested a commercial building permit for a

VII.
BOND FUND EXPENDITURES
City Manager Cowell presented the fol-
lowing statements for consideration:
(1) Dalworth Slurry Seal, Inc.
(Estimate No. 5 and Final - Street Contract
No. 1) $ 1,884.07
(2) Jarvis, Putty and Jarvis (Prorated
supervision fee - Fire Station No. 2) $ 215.53
(3) KAS Construction Co. - Euless Fire Station
No. 2 $ 10,591.47
(4) S. R. 0. Asphalt, Inc. (Estimate No. 2,
Contract No. 2) $ 16,452,74
(5) Gene Schrickel and Associates
$ 716.40
City Manager Cowell stated that these statements were in order and recom-
mended approval for same. Councilman Douglass made the motion that the
council concur with the City Managers recommendation and approve the bond
fund expenditures and pay same. Councilman Warren seconded the motion which
carried unanimously.
VIII.
CONCESSIONS AT MIDWAY PARK
City Manager Cowell stated that the
Euless Jaycees and Sertoma Club had expressed a desire to lease the con-
cessions at Midway Park and Mr. Cowell read Article V from the proposed
Recreation Ordinance (Ordinance Number 251) which regulates concessions in
park areas. It was discussed that perhaps advertisements should be placed
in the city's official newspaper in order for other organizations to sub-
mit a proposal for the operation of concession stands in the park area.
However, after discussion, Councilman Douglass made the motion that the
City of Euless enter into a contractural agreement with the Euless Jaycees
and the Sertoma Club for a period of one year for operation of concession
stands in Midway Park with a percentage (to be determined) of the money to
be paid to the City of Euless. (The contract to be prepared by City Attorney
James Cribbs.) Councilman Byers seconded the motion which carried unanimously.

IX
COMPREHENSIVE - LIABILITY INSURANCE
City Manager Cowell stated that it is
very important that the city have an insurance program in relation to the
Park and Recreation facilities. Mr. Cowell stated that he would have a rec-
ommended policy for comprehensive - liability insurance for the council's
consideration at the next regular meeting May 25, 1965.

ALL - AMERICAN CITY PARADE
City Manager Cowell
informed the council
that Mr. W. G. Fuller had been the recipient of a letter
from Mayor Willard
Barr, City of Fort Worth, inviting the City of Euless
to have an entry in
the All- American City Parade to be held in the City of
Fort Worth on Monday
May 17, 1965. Mr. Cowell stated that arrangements had
been made w it h Ted
Arendale Ford Agency for a convertible and that a sign
w i I I be attached on
each side of the convertible to have "Mayor William G.
Fuller, City of Euless."
Mr. Cowell stated that Mayor Fuller had requested that
as many councilmen and
city officials as possible plan to participate in this
parade, and Mr. Cowell
requested that members of the council who could ride in
the parade notify Mrs.
Vada Ferris, City Secretary, at the earliest possible
date.

JOHN BARFIELD PLAT
City Manager Cowell stated that Mr. John
Barfield had presented a revised plat of the Wilshire Village West with a
request 'for plat approval and rezoning. City Manager Cowell stated that
Mr. Barfield's Zoning Case No. 133 had a Public Hearing on February 23,
1965, for the rezoning of this tract of land (rezoning from "A" Residential
to "C" Commercial) and that this matter had been tabled for future consider=
at ion. Mr. Barfield stated that at the February 23rd meeting, when he
appeared before the council requesting approval of a plat of this area, he
had been asked by the c o u n c i l if he would be w i l l i n g to delay the approval
of this plat at this time. He stated that at that time he was agreeable
to the delay, however, business matters of the last few weeks have neces-
sitated the resubmission of this revised plat and he is desirous of the
councils immediate consideration of same. After considerable discussion,
Councilman Douglass made the motion that the rezoning request be approved
as submitted previously from "A" Residential to "C" Commercial. Further
discussion followed; Councilman Byers reminded the council members that a
mouratorium had been declared on all rezoning cases and after further dis-
cussion, Councilman Douglass withdrew his motion. Council members agreed
to table this matter of plat approval until the next meeting May 25, 1965,
and rezoning until the new zoning ordinance is approved. City Manager
Cowell stated that he would attempt to have a Developers Street Participa-
tion Policy prepared for the next regular council meeting. (It was dis-
cussed that a joint meeting of the Council and Planning and Zoning Com-
mission should be scheduled some time soon to discuss the new proposed
zoning ordinance.)

RECREATION PROGRAM
W. J. "DOC" HYDE
Mr. Hyde stated .that several meetings
ago he had requested the council's consideration of aid in the Pee Wee
League Football program, and at that time City Manager Cowell and he (W. J.
"Doc" Hyde) had been requested to meet with Hurst City Manager Don Edmonds
to discuss the Pee Wee Program. He stated that he had attended a meeting
with Mr. Cowell and Mr. Edmonds and that he was inquiring if any additional

evaluation had been made in this program. City Manager Cowell stated
that he had attended a four hour meeting and that, after considerable
discussion, no decisions were made.
Mr. Hyde inquired if there is any informa-
tion on additional park sites. City Manager Cowell stated that negotia-
tions were s t i I I under way, but pending, concerning the property near the
South Euless Elementary School. He stated that the Midway Park Improve-
ments have a deadline of June 1st and that concentrated efforts are being
put forth at Midway Park to meet this deadline. He further commented
that sites have been viewed and that consideration is being given to cer-
tain sites and that soon after June 1st a more concentrated effort will be
made to locate additional park sites for the council's consideration.

MID - CITIES ADVISORY COUNCIL REPORT
(MR, FRANK DOUGLASS)
Mr. Frank Douglass reported that at the
Mid - Cities Advisory Council held in Bedford on May 6, 1965, had a very in-
formative meeting concerning water needs and supplies.
