HomeMy WebLinkAbout2020-02-27 CITY OF EULESS ZONING BOARD OF ADJUSTMENT FEBRUARY 27, 2020 MINUTES A regular meeting of the Zoning Board of Adjustment was called to order by Chairman Crites at 6:00 p.m. on February 27, 2020 in the Pre-Council Room of City Hall, 201 North Ector Drive. Those present included Chairman Ruby Anne Crites, Vice Chairman Clarence Moore, and Board Members: Charles Cinquemani, Steve Elliott, Ron Young, and Alternate Board Member: Carol Dufinetz. During the Pre-Session Meeting: • Director of Planning and Economic Development, Mike Collins reviewed the regular agenda. ZONING BOARD OF ADJUSTMENT CONSIDERATION OF SCHEDULED ITEMS — PRE-COUNCIL ROOM The Euless Zoning Board of Adjustment continued their meeting in the Council Chambers at 6:31 p.m. for consideration of scheduled items. STAFF PRESENT: Mike Collins, Director of Planning and Economic Development Jeanne Flores, Administrative Secretary VISITORS: George Ondarz Beverly Hawkins Scott Dennett INVOCATION Vice Chairman Moore gave the invocation. THE PLEDGE OF ALLEGIANCE Board Member Young led the pledge of allegiance. ITEM 1. APPROVED ZONING BOARD OF ADJUSTMENT MINUTES Vice Chairman Moore made a motion to approve the minutes for the regular meeting of October 24, 2019. Board Member Young seconded the motion. The vote was as follows: Ayes: Chairman Crites, Vice Chairman Moore and Board Members: Cinquemani, Elliot, and Young. HELD A PUBLIC HEARING FOR ZONING BOARD OF ADJUSTMENT CASE NO. 20-01-ZBA Chairman Crites opened the public hearing at 6:35 p.m. Director of Planning and Economic Development, Mike Collins, gave a brief description of the case. The applicant is requesting a variance of a twenty-five (25') foot building line established by Final Plat of the Arbor Glen Addition No. 2. Ms. Hawkins owns a residence located at 105 Arbor Creek Drive within the Arbor Glenn Addition No. 2. Approval of the Final Plat of this subdivision was granted in August 1994. A twenty-five (25') foot building line is established from the western boundary of the subdivision adjacent to Main St. Ms. Hawkins' residence is one of five (5) homes impacted by this building line. This requirement applies to the rear yard of Ms. Hawkins' property and to the rear yards of three other properties. This requirement had also applied to the side yard of the property located at 100 Arbor Park Drive. However, the Zoning Board of Adjustment in March 2018 granted a variance similar to Ms. Hawkins' request. Ms. Hawkins is requesting a variance from the twenty-five (25') foot building line requirement that would enable construction of an extension to a covered enclosed patio to the rear of her home. The home was permitted by the city to have a covered roof extension in 2000, which extended six foot, eleven inches (6' 11") into the building line to cover the porch. Now desiring to enclose the porch, the applicant is requesting to extend the roofline an additional three foot, one inch (3'1"). The patio will not be air conditioned, but since it is attached to the primary structure, it is considered part of the primary structure and not an accessory structure. The new porch would encroach ten (10') feet into the setback distance, leaving fifteen (15') feet separation from the rear property line to the new construction. We could speculate why the Arbor Glen developer proposed a twenty-five (25') foot building line. The line may have been established to maintain sight visibility or as a separation buffer between the homes and the traffic on N. Main Street. There is no road intersection adjacent to the property and a six (6') foot masonry screening wall was constructed on the west property line when the subdivision was developed. Therefore, there are no sight visibility issues created by the proposed addition. If granted a variance by the city, the applicant has received permission from the Home Owners Association of Arbor Glen to construct the patio enclosure. The applicant explains that the construction materials used will match the existing structure, the addition will be in scale with her home and other homes in the subdivision, and no drainage issues will be created. The applicant maintains that new single-family Zoning Board of Adjustment Page 2 February 27, 2020 residential subdivisions approved in recent years include fifteen (15') foot setbacks adjacent to thoroughfares. Staff has reviewed the information submitted by the applicant, and recommends approval of the variance. Chairman Crites asked if the applicant wished to speak. Ms. Beverly Hawkins, the homeowner, spoke to the commission. She stated that she was the original owner since 1996 and would like to have the above mentioned variance in order to add an in-closed porch to her backyard. Chairman Crites asked to hear from any proponents/opponents who wished to speak. Mr. George Ondarza, the builder, stated that he has known Ms. Hawkins for several years and worked with her to design a structure that will blend in with the aesthetics of her existing home. The porch enclosure will be built to look as if it was constructed when the house was built originally. He also mentioned that he intends to follow all codes and obtain the necessary permits with the City of Euless. Chairman Crites asked it there any other proponents/opponents who wished to speak. Seeing none, Chairman Crites closed the public hearing at 6:42 p.m. Vice Chairman Moore asked if the enclosure was going to look like a sunroom. Ms. Hawkins confirmed that the space will be used as a year round sunroom with windows all around and glass doors that will lead into the backyard. Board Member Elliott asked if the space would have heating and/or air conditioning. Ms. Hawkins answered that no heating or air conditioning will be added to the room. The windows that surround the room as well as the doors would be able to open to allow air circulation. There were no further questions or comments presented by the Board. Vice Chairman Moore made a motion to approve Case No. 20-01-ZBA for a Building Line Variance for Arbor Glen Addition No. 2, Block A, Lot 58, 105 Arbor Creek Drive. The applicant is requesting a variance to the minimum building line established by Final Plat of the Arbor Glen Addition No. 2. This property is zoned Planned Development (#93-12- ZC). Board Member Cinquemani seconded the motion. The vote was as follows: Zoning Board of Adjustment Page 3 February 27, 2020 Ayes: Chairman Crites, And Board Members: Cinquemani, Elliot, and Young.
