CALL TO ORDER
The Regular Meeting of the Euless City
Council was called to order by Mayor W. G. Fuller, in the Council Chambers of
Euless City Hall at 7:40 P.M., with the following Councilmen present: Councilmen
Don R. Warren, Frank Douglass and Harold Samuels. (Counci ]men W -1 Byers and
Bobby R. Fuller were absent from the meeting.)
Also present were City Manager Lee Cowell,
City Attorney James Cribbs and City Secretary Vada Ferris.

DRAINAGE PROBLEMS
GREENHILLS PARK
Mr. Dave Austin stated that his associate,
Mr. Summerford, represents Messrs. Gregg and Butler in the Claim against the City
of Euless for damages to their property during the recent floods. (Their property
being located in Greenhi l is Park on Glenn Drive.) Mr. Gregg's Claim i s i n the a-
mount of $2,362.00 and Mr. Butler's claim in the amount of $2,412.00. (Claims
filed in Office of City Secretary.)
Mr. Austin stated that his associate was
unable to be present tonight, and that he is speaking on behalf of Messrs. Gregg
and Butler. He commented that, i n the last three (3) years, these homes have been
flooded four (4) times, and that his clients are of the opinion that they must take
legal action against the City, if their claims are not given consideration by the
Council; Mr. Austin stated that the plans for drainage in this area were planned
by the City and installed by the Developer and that, if there are forms i n the
drainage ditch, as has been indicated, the City Inspector is responsible for these
forms not havieng been removed. He stated further that his clients want the claims
paid and corrections made to the drainage ditch, to insure against future flooding.
Comments were-made by Members of the Coun-
cil that the City had been unable to secure the necessary Easements, in order to
remove the top from the drainage ditch and attempt corrective measures.
Mr. Austin stated that these people wi I I
grant the Easement, if qualified engineers will correct this drainage problem.
City Attorney Cribbs stated that the Coun-
ci.l, is not in a position, at this time, to give an answer to this problem; that he
has not given his opinion to the Council; therefore, this matter will have to be
given consideration at the next Council Meeting. The City Attorney inquired why
portions of the drainage ditch had been covered, and Mr. Austin stated that he has
information that the Veterans Administration required this several years ago.
Councilman Douglass comment6d that, some-
time ago, the City requested permission, from the property owners; to remove the
cover from the drainage ditch and make an effort to correct this drainage problem;
l owever, that the property owners refused to-grant the City permission and neces-
sary Easements.
Mayor Fuller informed the group that this
matter w i I I be discussed at the next Regular Council Meeting, after the City

Attorney has had an opportunity to submit his opinion in this matter, and the
Engineers have had time to study the drainage problem and submit plans for correc-
tion and cost estimates.

IV.
ADJUSTMENTS TO CIVIC CENTER BUILDING CONTRACT
(Second Reading on June 28, 1966.)
City Manager Cowell requested that this
item be tabled until the next Regular Council Meeting, in order for the architects
to secure more information on the adjustments to the Civic Center Contract.
V.
FIRST READING, ORDINANCE ABANDONING CITY EASEMENT
(EU LESS GARDENS, SAFEWAY STORE)
City Manager Cowell r6ad a letter from
Fred L. Vance and Associates, requesting that the City abandon old Easements and
establish new Easements on the property - proposed for the erection of the Safeway
Store at Simmons Drive and Highway 183.
City Attorney Cribbs informed the Council
t h a t i t i s customary t h a t the a p p l i c a n t i s responsible f o r e s t a b l i s h i n g the uncon-
tested nature o f the request t o abandon Easements, and t h a t a l l property Owners
must consent, in writing, to the abandonment of Utility Easements or the closing of
streets. He stated that, due to the fact that this is a new procedure for the City,
he recommends that this Ordinance be given First Reading, at this time; however,
before Second Reading, on June 28, 1966, Mr. Brummett, representing Fred L' Vance
and Associates, must complete and submit to the City the forms entitled APPLICATION
FCR THE VACATION OF UTILITY EASEMENTS LOCATED AT THE PROPERTY IN QUESTION. -Mr.
Cribbs further suggested that the City follow the procedure which'he has outlined
in the letter of June 16, 1966, requesting that the City place the burden of
establishing the uncontested nature of similar rqquests on the applicant.

Councilman Samuels made the motion to ap-
prove First Reading of this Ordinance, subject to the appli cant Is`compl'iance, as
set forth i n said Ordinance. Councilman Douglass seconded the motion, 'and'the vote

VI.
PRELIMINARY LAY -OUT AND COST ESTIMATE,
GREENHILLS PARK OUT FALL SEWER, GRAVITY FLOW
SEWER MAIN AND UTILITY ADJUSTMENTS, GREENHI LLS PARK
Mr. Bill Ratliff read a letter dated June
7, 1966; M' wfiicN he'stated that the Developer's portion of the construction cost
for the Greenhills Park Outfall Sewer will be $13,1944.17, which includes engineer-
ing, and the City's portion - $5,814.00. It was pointed out Mr. Robert Spies, of
the Greenhills Park Subdivision (Fantastic Homes Developers), has requested tempo-
rary sewering of eight lots in Increment No. 3, which must drain through Increment
No. 4 and, eventually, into the new out fall line which will be extended from the
Trailwood Addition; however, that several of the houses have. been sold and sewer
service is necessary at this time. Therefore, Mr. Spies is requesting the City's
permission to use the services of a septic tank company and drain the sewage into a
manhole in'the street, until the manhole can be served by the new out fall line.
The C i t y ' Manager intaoduced a' l e t t e r from
Mr. Vernon Roberts, President of Janann, Inc. requesti'ng the City to init:611 'a
gravity flow sewer main to the Northwest corner of Greenhills -Park Addition, stat-
ing that the Developer wi I I pay for the cost of a six inch (611) sewer main, to
serve this addition.*
After considerable discussion, Councilman
Douglass made the motion to concur with the recommendation of the Consulting Eng-
gineer and approve the layout and cost esti'mate of the out fa I I sewer in Greenhills
Park, requesting that the Developer deposit $1.3,194.17 with the City, to be placed
in escrow, and that the City appropriate its fee of $5,814.00 from Capital Improve-
ment Funds, for the City's portion; that further building permits not be granted
until this project is completed, and that the Developer be granted permission to
use Septic Tank Service, as requested. Councilman Samuels seconded the motion, and
the vote i s as follows:

VII.
SUPPLEMENTAL AGREEMENT NO. 1
SHULL CONSTRUCTION COMPANY
HURRICANE CREEK-OUT ,FALL SEWER LINE
(TIMBERLINE ESTATES)
Mr. B i I I Ratliff presented Supplemental
Agreement Number One to the,Contract with Shull Construction Company fo,r Water and
Sewer Extensions in Timberline Estates, which is an addition in the ,amount of
$2,785 .00,
Hr. Ratliff stated that the Engineers re-
commend this addition, and after discussion, Councilman Douglass made the motion to
approve Supplemental Agreement No. 1, as recommended by the Consulting Engineers,
which is an addition, in the amount of $2,785.00, to the Contract with Shull Con-
struction Company. Councilman Warren seconded the motion, and the vote is as

IX.
GREENHILLS PARK DRAINAGE
(DISCUSSION BY CITIZENS IN GREENH'ILLS PARK
Mayor Fuller recognized several 'persons
from the Greenhills Park Addition, as follows: Mrs, James E. Norris of 1108 Aransas
Drive, Mr. George Moore of 1104 Aransas, Mrs. M. C. Boardway, 1110 Aransas and

I . I Mrs. Norris stated that these families live

at the bottom of the hill, below the drainage ditch adjacent to the homes of Messrs.
Gregg and Butler, which was discussed earlier in the meeting, and 'that the correc-
tion of the problem of the drainage ditch would not correct the problem of the flood
waters which endanger her property arid'the others in this area, at the bottom of
this hill.
Mr. Bishop stated that the property owners
have been promised that, in due time; the drainage problems in the area would be
corrected, and he considers that "due time" is now; that it is very harrassing to
stand and watch flood waters rise "on your property and be unable to stop them. Mr.
Bishop stated that the City had promised that proper drainage would be provided i n
the area, and that the Veterans Administration had been assured, by the City, that
the City would'fulfill this promise. Mr. Bishop inquired if the City removes the
cover from the drainage ditch, will it be placed on, after the drainage problem is
corrected.
City Attorney Cribbs stated that an Ease-
ment must be obtained before corrective measures can be made. However, he would
recommend that the Engineers male a thorough study of the drainage in the area.
Mayor Fuller concurred with this recommen-
dation; that the Engineers should be authorized, immediately, to proceed to find a
solution to this drainage problem.
Mr. Bishop stated that he would like to
have a date for the Engineers' findings to be completed and submitted to the City
Council; that the property owners have been waiting three years for a solution to
this problem, and they do not feel they can wait another three years. He stated
that the homes in this area are in the $11,000 .00 range, and that he considers the
$16,000.00 estimate submitted by the Engineers several months ago, as the amount
for improvements to this drainage ditch, is a small amount compared to the amount
the prope_rty'owners have invested in their property. Mr. Bishop inquired as to
method of informing the Council of problems of this nature. i . .
Mayor Fuller stated that a letter should
be submitted to the City Manager, of any problems, and that they w i I I be brought
before the Council,-
Mr. Bishop stated that Mr. Cowell had been
contacted several times and' informed of the drainage problem i n th is area; however,
their plea had not been in waiting. It had been verbal. -
Mayor Fuller stated that a letter to the
Mayor and Members of the City Council would be given consideration and filed with
the City Secretary; however, a letter at this time would not be necessary, as all
of the comments would be made a part of the Official Minwtes.-
City Attorney Cribbs informed Mr. Bishop
that the City Manager has many problems which come across his desk each day, and
that he must consider each of them, not only attempting to find a solution to them
but a means of financing for the correction of the various problems.

Mrs. Norris stated that, during .the floods,
she had contacted the Police Department for sand bags and was informed that the
City was out of sand bags. She stated that, in her opinion, the City should fur -
niish sand bags to the property owners, until such time as the drainage problem can
be solved in that area.
Mayor Fuller stated that the,Ci,ty cannot
furnish sand bags for everyone and that, perhaps, she should make arrangements to,
secure sand bags from another source.
Mrs. Norris stated that she was not about
to purchase sand bags when she considers this the City's problem, _and, that the City
should assist in protecting homes from flood waters..
Mayor Fuller stated that he recommends.
that the Counci 1 authorize the Engineers to study the drainage problems' in this en-
tire area and present •a cost estimate and possible solution, as soon as possible.
All Members of the Counci1 were in agree-
ment with the Mayor's recommendation, and the citizens present agreed that Mr.
George.. Moore of 1104 Aransas Drive should be contacted and informed when this item
wi I I- appear on the Council Agenda, and that he i n turn w i I I contact the others i n
the area.
Mayor Fuller stated that, .,in; -Lis ppinion,
the Council has used good judgment i n carrying out the Capital Improvemeqt Program,
and that this drainage problem, although nmt considered in the early stages of the
Capital Improvement Program, w i l l be given considerable consideration, in an effort
to find a method for correction. r
TAX ROLL ADJUSTMENTS
Mr. Richar.d.Parks, Tax'Assessor- Collector,
presented a Re -cap of Tax Roll 'Adjustments, in the amount of $905.99. After dis-
cussion, Councilman Samuels made the motion to approve deductions of $905.99 from
the Tax Roll. Councilman Warren seconded the motion, and the vote is as follows:
Ayes: Councilmen Douglass, Samuels and Warren
Nays: None

COMMERCIAL PERMIT No. 37
CONTINENTAL OFFICE BUILDING
City Manager Cowell read Minutes of Plan-
ning and Zoning Commission dated June 7, 1966, . Item B, in which the Planning and
Zoning Commission recommends approval of Commercial Permit.No. 37.
Members of the Council reviewed the plans

submitted by Mr. H. E. Woodard, for this two -story office building, to he construct -
I ed at Highway 183 and Highway 157. A check -list submitted by the Building
Inspector's Office advised that all' requirements have been met.

cur with the recommendations of Planning and Zoning Commission and approve Commer-

COMMERCIAL PERMIT N0, 38
COMMERCIAL'CAR WASH
City Manager Cowell read Planning and Zon-
ing Minutes dIated June 7, 1966, Item C, in which the Planning and Zoning Commission
recommends approval of Commercial Permit No. 38. Mr. Walker Petty presented a bro-
chure, showing pictures of the Commercial Car Wash, which he is requesting permis-
sion to construct at Ridgecrest Drive and Highway 183. Mr'. Petty informed the
Council that this Car Wash is self- operated and has proved to be very successful in
other parts of the country. A check - list'; signed by the Building Inspector, was
presented, indicating that al 1 requireme'nts' have been met.
After discussion, Councilman Warren made
the motion to concur with the recommendation of the Planning and Zoning Commission
and approve Commercial Permit No. 38. Councilman Douglass seconded the motion, and
the vote is as follows:

COMMERCIAL PE.RM.I.T ..NO . 39
EU'LESS ELECTRI-C BUILDING (NORTH MAIN STREET)
C i ty Mahager Cowel 1 read Planning. and Zon-
ing Minutes dated June 7, 1966, Item D, in which the Planning and Zoning Commission
recommends .approval of Commercial Permit No. 39, subject to the Council's consider-
ation of the sewer service to this building.
Mr. Cowell informed the Council that
Euless Electric Company is desirous of a septic tank installation because it is be-
yond -the recfuired'distance for extending sewer service, according to a City Or'di-
nance.
Considerable discussion followed, and Mr.
Thomas, representing Messrs. Owens and Gordon - owners of Euless Electric Company,

stated that the owners have agreed to tie 'on to a sewer line when it is'availabile in
this area.
Members of the Council viewed the con-
struction plans and were i n genera? agreement that septic tanks should be prohibit-
ed in this area (North Main 'Street).
Councilman Warren stated that; in hi -s
opinion, the sewer line should be installed now, rather than permit further in-
stallation of septic tanks.
Councilman Samuels seconded 'the'motion,
and the vote is as follows:

SEWER RODDING MACHINE
City Manager Cowell 1 informed the Council
that Mr. Sam Knight has requested the Council's consideration for' the purchase of
a sewer rodding machine, which is very badly needed by the City's dewage crews.
In answer to a question by Councilman
Samuels, Mr. Knight stated that considerable time can be saved by the use of this
machine and that the machine used by the City at this time requires a minimum of
three (3) men; whereby, the proposed machine would require only ,two, (2) men. He
stated that this machine is force -fed and would be most'adequate'to 'fT l 'the City's
needs. Mr. Knight further commented that the machine poesently used will extend
only 250 .feet into a line; whereby, the proposed machine will extend approximately
800 feet. Mr. Knight further commented that the machine presently used could still
be used on Easements and in areas where a machine must be hand - carried. (Approxi-
mate cost $3,900.00)

work; however, he is concerned that the City does not use some of the equipment
which it has purchased. He stated that the street sweeper sat in one place twenty -
one (21) days, without being used while the streets were un -swept and littered with

Councilman Douglass stated that he con-

dirt and rocks, and he does not believe the Council should spend the tax payers'
money -in sums .as large as was necessary for the street sweeper and then fail to
utilize this equipment.
City Manager Cowell stated that, in his
opinion, the street sweeper was a good investment and badly needed by the City, and
that the lack of a competent operator has prohibited the use of the machine.
After further discussion, Councilman
Warren made-the motion that the City Manager be authorized to advertise for bids

Mr. Bill Ratliff presented a letter dated
June 14, 1966, i n which the engineers comply with a request by Mr. Sam Knight, for
an estimated cost of re- locating the water main at Sulphur �B ranch `dn Pipe]ineIR'oad,
i n Morrisdale. The estimated cost i s $4,361.50. Mr. Ratl ifs- explained that the
engineers propose to lower the line and place it under 9vound, and that it is pos-
sible this expenditure can be paid from the Capital Improvement Fund.
Mayor Fuller stated that the City Manager
and-Consutt ing Engineers should determine a method for payment of this expenditure.
After discussion, Councilman WarrerY made
the motion that the Engineers be authorized to advertise for bids for the reloca-
tion of this water line, with the project cost at $4,361.50. Councilman Douglass
seconded the motion, and the vote is as follows:

presented °each member of the Council a copy of a report on a section of the Pebble
Creek Drainage Channel and recommended improvements, as set forth in the report.

Mr. Ratliff stated that he had furnished sufficient copies, i n order for the Mayor
and Engineers of the City of Hurst to be apprised of the problem i n this area and
the proposed solution to this problem, due to the fact that' a portion of this
drainage channel lies within the City of Hurst.
Mayor Fuller stated that he _had discussed
this. problem with the Mayor of the City of Hurst and has been assured 'that Hurst
w i l l co- operate i n this matter. He further stated that 'he w i l l contact Mr. Rickel,
owner of a portion of the property which is required for correcting this drainage
problem, but he must have a I I items detailed and complete before approaching Mr.
Rickel. Mayor Fuller stated that Mr. Rickel. is a very fine person, but does not
like to be bothered, and that he wi l l give a yes or 'no and does not wi -sh to discuss
the matter more than once. Mayor Fuller stated that, in his opinion, the Mayor of
Hurst and their engineers should co- ordinate with Engineers from the City of Euless
before contacting Mr. Rickel.
Mayor Fuller presented a letter from Mrs.
Lorr, who lives in the Morrisdale Addition, stating that her property IS" flooded
frequently and requesting the C i t y ' s consideration. M r . B i l l Ratliff explained the
situation and, after considerable di.scussion, Councilman Douglass recommended, and
the Council agreed, that the City Attorney should write a letter to Mrs. Lorr, ex-
plaining that this is not the City's problem, and it should.be discussed with the

XVI I.
City Attorney Cribbs presented Amendment
to Ordinance No. 147, which more clearly defines Subdivision Rules and Regulations.
Councilman Douglass made the motion to
approve First Reading of this Ordinance. Councilman Samuels seconded the motion,
and the vote is as follows:

City Secretary Vada Ferris read a letter
addressed to Mayor Fuller, dated May 25, 1966, from W i l l i a m E. Wolf, Mayor of the
Town of Bedford, advising that the Bedford Council has appointed a Negotiating Team
to work with the City of Euless on the feasibility of purchasing a water and sewer
system. The team is as follows:

MAYOR'S REPORT: WATER AND SEWER
SYSTEM NEGOTIATIONS
Mayor Fuller reported that he had recently
met with Consulting Engineers, Gregory, Knowlton & Ratliff, and the Negotiating Team
from the Town of Bedford to discuss the feasibility of Bedford's purchasing a por-
tion of the Water and Sewer System from the City of Euless.
Mayor Fuller stated that this had been a
very congenial meeting and that Plan Two (2) had been discussed at length. It
seems t o be the most desirable f o r a l l parties concerned.
XX .
MOWING LOTS
CITY CF EULESS
Councilman Samuels inquired of the City's
procedure for mowing lots in the City of Euless.
The City Manager stated that the City
sends notices to property owners requesting that they comply with the City Ordi-
nance for mowing lots and, if they fail to do so, the City mows and bills the own-
ers. The City Manager stated that the City Offices receive numerous calls daily,
of over -grown lots, and these are processed as rapidly as possible.
