Fuller called the Regular Meeting of the Euless City Council to or -der at 8:25 P. M. in the Council Chambers, 201 Ector Drive, with the following Councilmen prese -nt: Messrs. Don Warren, Frank Douglass, B i I I Byers and Bobby Fuller. (Absent: Councilman Harold Samuels.) APPROVAL OF MINUTES The Minutes of the Regular Council Meeting dated October 25, 1966 were approved a5 written. PUBLIC HEARING, REZONING REQUEST, MR, ANDY WINTERS, TIMBERLINE ESTATES Mayor Fuller opened the Public Hearing on a Rezoning Request b-y Mr.. Andy Winters, for the rezoning of a portion of his proper- ty in Timberl ine Estates from "A" .Residential to' "A -2" Duplex. It was pointed out that the Planning and Zoning Commission has recommended approval of this rezoning and that the Land Planner, Mr. Robert Caldwell, has not objected. ORDINANCE N0. 294, SECOND READING GARBAGE COLLECTION PERMIT TRANSFER City Manager Cowell presented Second Read- ing of- Ordinance 294, granting a garbage - collection permit transfer from the McCaffity Disposal Company to the Tarrant County Waste Disposal, Inc. • (Page Two, Minutes of Regular Meeting, Euless City Council, November 22, 1966.) Councilman Byers made the motion to approve the Second Reading of Ordinance No. 294. Councilman Douglass seconded the motion, and the vote is as follows: Ayes: Councilmen Byers, Douglass, Fuller and Warren Nays: None Mayor Full -er declared the motion carried. FIRST READING, ORDINANCE NO, 291, ANNEXATION City Attorney James Cribbs read Or'dinance No. 291, which is for the annexing of properties located between Highway 157 and North Main Street, and Harwood Road and Glade Road. Councilman Fuller made the motion to ap- prove the First Reading of Ordinance No. 291. Councilman Warren seconded the- motion and the vote i s as follows: Ayes: Councilmen Byers,, Douglass,. Fuller and Warren Nays: None Mayor Fuller declared the motion carried. (Second Reading of Ordinance No. 291, December 27, 1966.) IV. FIRST READING, ORDINANCE NO. 292, ANNEXATION (City Attorney James Cribbs read Ordinance No. 292, annexing certain properties South of Little Bear Creek and North of Har- wood Road and Fuller-Wiser Road. After discussion, Councilman Douglass made the motion to approve the First Reading of Ordinance No.. 292. Councilman Byers seconded the motion, and the vote is as follows: Ayes: Councilmen Byers, Douglass, Fuller and Warren :Nays; None Mayor Fuller declared the motion carried. (Second Reading of Ordinance No. 292, on December 27, 1966.) V. FIRST R_EAD_IAG, ORDINANCE NO. 293, ANNEXATION City Attorney James Cribbs read Ordinance No. 293, annexing certain properties between Little Bear Creek and Glade Road, and Fuller-Wiser Road and North Main Street. After discussion, Councilman Warren made the motion to approve First Reading of Ordinance No. 293. Councilman Fuller second- ed the motion, and the vote i s as follows: Ayes: Councilmen Byers, Douglass, Fuller and Warren Nays: None Mayor Fuller declared the motion carried December 27, 1966.) (Second Reading of Ordinance No. 293, 219 (Page Three, Minutes of - Regular Meeting, Euless City Council, November 22, 1966.) City Attorney James Cribbs explained that he and Mayor Fuller are making every effort to discuss the annexation of these properties with various peoples in the area desirous of an understanding with a I I persons involved. Mr. Cribbs stated that it is his understanding that some of the people in the encompassed area plan to petition the City. However, if some of the persons encompassed in Ordinance No. 293 do not petition into the City of Euless, then Ordinance No, 293 w i l l not be presented for Second Reading. Vi . GREEN HILLS PARK OUTFALL SEWER BID Mr. Kenneth English, representing Gregory, Knowlton and Ratliff, stated that the Engineers have evaluated the bids opened on November 21, 1966, for the Greenhills Park Outfall Sewer Line, and recommend the acceptance of the low bid by Kemp Construction of Irving, Texas, in the amount of $25,820.95. He stated, however, that the Engineers suggest that the award of a contract be conditioned and subject to the Developers depositing, with the City, ad- ditional funds required, since the bid price is considerably above the estimated 'cost of construction of $18,145.00. He commented that, based on the bid price of $25,.20.95, the - Beveloper's deposit is calculated to amount to $20,841.67. After discussion, Councilman Douglass made the motion to concur with the recommendation of the Engineers, and award the con - tract*to'the low bidder, Kemp Construction Company, in the amount of $25,820.95„ with the condition that the Developer deposit with the City, additional funds re- quired'for this project, as recommended by the Engineers. (Developer has previous= ly deposited funds in Escrow, for this project.) Councilman Fuller seconded the motion, and'the vote is as follows: Ayes:. Councilmen Byers, Douglass, Fuller and Warren Nays:' None Mayor Fuller declared the motion carried. (Copy of bid tabulation on file in the Office of the City Secretary.) (Copy of Engineer's letter of recommendation on file in the Office of the City Secretary.) VW RESOLUTION NO. 163, AUTHORIZING DISBURSEMENT FRCM ESCROW FUNDS City Secretary Vada Ferris presented Reso- lution No. 163, requesting approval of disbursement from the Water and Sewer System Capital Improvement Escrow Funds in the amount of $575.98, payable to Gregory, Knowlton and Rat1 i ff f o r water'and sewerage i n i t i a l improvements, as per t h e i r statement dated November 21, 1966. Councilman Fuller made the motion to ap- prove Resolution No. 163 and authorize the Mayor and City Secretary to sign certi- fication authorizing this expenditure. VIII. CONSTRUCTION OF NORTHNVEST BOULEVARD ADJACENT TO TIMBERLINE ESTATES LETTER - MR, ANDY WINTERS .City'Manager Cowell read a letter addressed to Mayor Fuller dated November 17, 1966, in which Mr. Andy Winters, Developer in Timberline Estates, expressed concern over the lack of construction of the Northwest Boulevard in Timberline Estates. City Manager Cowell stated that efforts are being made to secure the necessary Right -of -way from the property owners in this area, in order for the City to make improvements to this street in Timberline Estates. How- ever, City Manager Cowell stated that this is not a project in the Capital Improve- ment Program, and the City does not have the necessary funds; therefare, he needs the Council's consideration on this matter. The City Manager stated that the City Administrative Staff needs the Council's opinion of the purchase of Right -of -way, when it cannot be secured otherwise. The City Manager stated that there is.a �smal l creek in the area which w i l l probably require ti l e at the time of construction; however., that possibly the County may assist in this improvement. City Manager Cowell 'stated that on various occasions, the City has offered five cents *(50) a foot .f.or_.Right -of -Way, which is, in his opinion, a reasonable price. After considerable discussibn, Mayor Fuller stated that he recommends that the City Manager assign the Right -of -way Agent to contact the property owners in the area and determine if the necessary Right -of -way can be secured. Also, Mr, Winters' letter should be answered, advising that the City is making efforts to secure the necessary Right -of -Way in the area. 1[" SIDEWALKS , SOUTH MAIN STREET, NEAR SOUTH EULESS SCHOOL Councilman .Dougl.ass stated that-he requests that the Minutes reflect that the City Manager is requested to check into the side- walk situation on South Main Street, near the South Euless School, which is a matter that was discussed sometime ago, and in his opinion, should be given some consider- ation. Hle stated that the City Council promised that sidewalks would be construct- ed along certain blocks, and that he has had several citizens contact him inquiring the reasons the City has not proceeded with this sidewalk construction. INVITATION, LAYING OF CORNER STONE, MASONIC LODGE X. Councilman Byers stated t h a t a l l present City Attorney Cribbs stated that he was in- volved in the - negotiations pertaining to the purchase of the West Euless Park Site adjacent to this area, and that, in his opinion, every effort should be made to get this road under construction, which was agreed to at the time the City purchased the Park S i t e ; t h a t , p o s s i b l y , a f a i r offer shou,l.d,be made to the people in the area, in order for the City to proceed with the construction of the road. After considerable discussibn, Mayor Fuller stated that he recommends that the City Manager assign the Right -of -way Agent to contact the property owners in the area and determine if the necessary Right -of -way can be secured.
