Fuller called the Regular Meeting of the Euless City Council to order at 8;15 P.M. in the Euless City pall Council Chambers, with'the following in attendance: Counci'l.men Bill, Byers, Bobby Fuller, Frank Douglass and Harold Samuels. (Aliserit.:, Co'unc i lman Don Warren,) ' Also present were City ,Attorney JaRies _ Cribbs and City Secretary Vada Ferris. (Mr. 'C. J. Griggs, C'ity Manager, was absent attending` the International City Managers' Association meeting in New Orleans.) Friurawlydrew The Invocation -was presented by City Attorney James Cribbs. VISITORS' Visitors in attendance were Mesdms. Betty Potthoff, representing the Mid - Cities Daily News and Martha Hand, representing the Fort Worth Star Telegram; Messrs. Gene Welch and Consulting Engineer Bill Ratliff. 1, PUBLIC HEARING, ZONING CASE NO, 162 REZONING PROPERTY WEST OF SHEPPARD DRIVE AND NORTH CF HUFFMAN DRIVE Mayor'Fuller opened the Public Hearing on a rezoning request by Mr. Gene Welch who requested rezoning from "A" Residential to "A -P Apartments, sixteen and one -half (16' -z) acres West of Sheppard Drive. Mr. Welch presented a plat depicting the apartment development and streets within the apartment complex'area, and in answer to a question, stated that the owners plan to dedicate, to the City,. the right -of -way along Municipal Way, which -wi 11 separate the new high school property from the apartment property. Mayor Fuller inquired as to the type of streets within the apartment development. Mr. Welch stated that the developers would prefer to have boulevard type streets, and Mayor Fuller commented that he would be in favor of this type street within an apartment deve 1 opment . Councilman Douglass inquired about the property line near the Baptist Church. He stated that he i s of the opinion that there i s not sufficient property to have a boulevard type Est -reet. I t was pointed out that this w i I I be determined at the time of the plat development presentation to the City. 204 (Page Two, Regular Meeting of the Euless City Council, October 10, 1967) Mr. Welch commented that his firm is attempting to buy some of the property on the West side of Sheppard Drive and if successful, w i l l have an access from the apartment develop- ment onto Sheppard Drive. Discussion followed concerning maintenance of the streets in the apartment development, and Mr. Welch stated that the owners hope to maintain the streets and not dedicate the streets to the City; however, he commented that his firm is desirous to work with the City in the matter of the maintenance of the streets, as well-as all other facets of this development. l Mayor Fuller commented that he -- would be inclined to permit the owners to maintain the streets. Mr. Welch commented that the streets wi I I be installed according to City specifications. Mayor Fuller inquired of the City Attorney the City's position if an accident should occur on streets not dedicated to the City. The City Attorney stated that in this instance, the City would not be liable. Councilman Samuels inquired if a police officer would be permitted to' investigate a `disturbance in the apartment development, if the streets were not dedicated to the City. The City Attorney stated that a disturbance might be investigated by the Police Officers if the agent or owners of the apartment development requested such an investigation. Mr. Welch stated that, in h'is opinion, all of these items are regulated by City Ordinances which the apartment owners intend to comply with. 11 Mayor Fuller stated that he, c e r t a i n l y thinks that i t should be understood that Police Officers w i l l be permitted to go into the apartment development whenever it seems necessary . Mr. Welch discussed the streets i n the apartment development and showed colored slides of apartments similar to the one planned in Euless. In answer to a. question, Mr. Welch Councilman Douglass inquired as to the time involved in this project, specifically, when the project is scheduled to begin. Mr. Welch stated that if the zoning is approved that the project, hopefully, w i I I be under way by January 1, 1968, and plans are for the first apartment units to be completed by May the first. The f i r s t section w i l l consist of one hundred and twenty (120) apartments. He stated that the f i rst apartments would be b u i It adjacent to Spur 350 and then the development would erxtend North on the site. He commented that the Developers are desirous of ut,i_1izi.ng the natural beauty of this tr -a,ct and therefore plan to remove, only two ,(2)„ four (411) . inchI 'trees. In answer to a question, Mr. Welch stated that the plans &all for si'ngle apartment units -- about two hundred (200) on sixteen 'and one -half (161) acres; however, it has been discussed that some two story units might be feasible and this would increase the number of units by forty (40) to fifty (50) apartments. In answer to a. question, Mr. Welch "I I,& (Page Three, Regular Meeting of the Euless City Council, October 10, 1967) Stated that the parking area allows for one and six - tenths (1.6) parking space per unit and that the apartments will consist of one, two and three bedrooms. He stated that the rental fees have not been definitely established at this time; however, it has been discussed that, possibly, the minimum would be $135.00 per month. There being no opponents to the rezoning of this tract, Mayor Fuller declared the Public Hearing closed. FIRST READING ORDINANCE REZQNI NG 11617 ACRES VEST CF SHEPPARD DRIVE The City Secretary presented an ordinance rezoning sixteen and one -half (161) acres from "A" Residential to "A -3" Apartments. Councilman Samuels made the motion to approve the First Reading of the Ordinance rezoning this tract of land, under the following conditions subsequent: 1. Final Site development plan shall be submitted to the City Council within'twelve (12) months, following - final passage of the o "rdinance effecting the requested changes. 2. Construction and substantial compliance with the final site development plan, as approved, shall be commenced within eighteen (18) months, following final passage of the ordinance effecting the requested changes. 3. Construction and substantial compliance with the final development plan as approved shall be substantially completed within thirty -six (36) months, following final passage of the ordinance effecting the requested changes. Councilman Fuller seconded the motion, and the vote is as follows: Ayes: Councilmen Douglass, Fuller and Samuels Abstained: Councilman Byers Mayor Fuller declared the motion carried. (Second Reading of Ordinance, October 24, 1967.) Mayor Fuller inquired if the thirty -six (36) months stipulation indicates that the final construction of the entire apartment development must be completed - - stating that, possibly, a change in economics would result in a change of plans on the part of the owners. Councilman Douglass commented that consideration for an extension of time would be granted by the council, at the owner's request . ►KIT'! AUTHORIZE CITY MANAGER TO PREPARE REPORT FOR ELEVATED STORAGE TANK Members of the Council have previously been furnished a letter from the Consulting Engineers, Knowlton -Rat] iff -Engl ish, in which it is pointed out that the Engineers and City Manager have discussed the feasibility of over -head storage for water in the City of Euless. , Mayor Fuller commented that he is of the opinion this is a very important matter and should be given consideration, in the immediate future. Councilman Byers stated that he is hopeful that this is indicative of, possibly, an over -head storage tank being made available by the corning summer. There was no formal action taken in t h i s matter; however, a l l members of the Council present, commented favorably, and it was agreed that the City Manager should be instructed to proceed to secure the report with the assistance of the Consulting Engineers. IV. RESOLUTION OF COMMENDATION TO POLICE OFFICERS I N RECENT HOLDUP ATTEMPT Councilman Douglass presented, as follows, a resolution commending Police Officer T. R. Eddings and other Euless Police Officers for their efforts in the attempted hold -up of the Buddies Super Market on Saturday, October 7th: RESOLUTION NO. 190 WHEREAS, on Saturday, October 7, 1967, there occurred, in Euless, an attempted armed robbery in a large retail grocery store, and WHEREAS, the 1 ives and personal safety of a substantial number of Euless citizens, and visitors to Euless, were placed K/YA (Page Five, Regular Meeting of the Euless City Council, October 10, 1967) in jeopardy during such attempted armed robbery, and WHEREAS, Euless Police Sergeant T. R. Eddings cha;l;lenged the armed and desperate felons to save the lives and property of others, and WHEREAS, the actions of Police Sergeant T. R. Eddings and other officers demonstrated a deep devotion to preservation of law and order and b total commitment to the .protect- ion of the lives and property of others, and WHEREAS, the said T. R. Eddings and other officers acted in com- plete and total disregard of their own personal safety in challenging the armed felons in the act of committing a most serious criminal offense, and WHEREAS, The Euless City Council deems it just, right and proper that due public recognition be taken of the brave and courageous action of Officer T. R. Eddings and the other officers . NOW THEREFORE, be it resolved that Euless Police Officer T. R. Eddings, and other officers, Commissioned Officers Richard Hann and Bi 11 Robinson, and Reserve Officers Russell Crawford, E. E. Jones, and Earl Rogers, be publicly commended for their unselfish acts of heroism and courage in disarming and apprehending the armed felons in the City of Euless on October 7, 1967, BE IT FURTHER RESOLVED, that a copy of this resolution be spread upon the minutes of these council proceedings and that a copy hereof be posted in a prominent place at the Euless City Hall. ADOPTED, this the 10th ' day of October , 1967 , at a regular meeting of the Euless City Council, by a vote of 4 ayes and 0 nayes. /&/ W. G. CONDOLATORY LETTERS The City Secretary was instructed by the Mayot, with the councils' approval, to send condolatory letters to Mrs. W. G. Burkhalter, a. hostage in the hold -up, and Mr. Larry Howard, a citizen who fought with and killed one of the hold -up men. Both Mrs. Burkhalter and Mr. Howard were wounded by the hold -up man.
