Regular Meeting of the Euless City Council March 26, 1968 CALL TO ORDER Mayor Fuller called the regular meeting of the Euless City Council to order in the Council Chambers of Euless City Hall at 8:10 P.M., with the following Councilmen present: Messrs. Bobby R. Fuller, Bill Byers, Frank Douglass, Harold Samuels and Don R. Warren. Also present were City Manager C. J. Griggs, City Attorney James Cribbs and City Secretary Vada Ferris. INTRODUCTION CF COUNCIL CANDIDATES Mayor Fuller recognized and introduced Mr. Fred Hughes, Candidate for Councilman in the election to be held on April 2, 1968. ZONING CASE NO. 172 - DOCTCR BURT HYDE, REZONING REQUEST FRCM "A" RESIDENTIAL TO "C" COMMERCIAL - PROPOSED MEDICAL HOSPITAL Mayor Fuller announced this item is tabled due to the lack of anticipated information being delayed. Regular Meeting of the Euless City Council, March 26, 196 8) ZONING CASE NO. 173 - REZONING REQUEST, FROM "A'' RESIDENTIAL TO "A -3" APARTMENTS AND FROM "A" RESIDENTIAL TO "C" COMMERCIAL, PRO.POS.ED MULTI - .FAMILY AND HOSPITAL SITES, MR, 0. S, DOBKINS Mayor Fuller announced this item is tabled due to the lack of anticipaged information being delayed. PRESENTATION OF PETITION OPPOSING RE- ZONING OF Q. S. DOBKINS PROPERTIES IN ZONING CASE NO. 173 Mr. Fred Hughes presented a petition with two hundred, forty six (246) signatures, pertaining to Zoning Case No. 173, which is the rezoning request submitted by Mr. Searcy Dobkins for a proposed hospital and multiple family site. This petition is in opposition to the rezoning in this case. In answer'to a question, Mr. Hughes stated that the people in this area want a hospital in Euless, but not in their neighborhood and they oppose any commercial zoning in the area. Mayor Fuller informed Mr. Hughes that the - Public Hearing had been held and closed in this rezoning request; therefore no action could be taken on this petition; however, when the Council schedules this zoning case for discussion, the petition will be given consideration. IV. FIRST READING OF ORDINANCE REZONING PROPERTIES IN SOTOGRANDE DEVELOPMENT (ZONING CASE NO, 17 4) Mayor Fuller recognized Mr. Ran Holman, who stated that.Sabre. Realty desires the rezoning of this property, consisting of approximately nine' (9) acres, which is the final increment in the Sotogrande Development. Councilman Samuels made the motion to concur with the Planning and Zoning Commission's recommendation for rezoning nine (9) acres from "A" Residential to "A -3" Multiple Family Dwelling, with the following conditions subsequent: 49 (Pape Three, Regular Meeting of the Euless City Council, March 26, 1968) A. A final site development plan shall be submitted to City Council within 18 months following final passage of the ordinance effecting the requested changes. B. - Construction in substantial compliance with the final site development plan as approved shall be commenced within 24 months following final passage of the ordinance effecting the requested changes. C. Construction in substantial compliance with the final site development plan as approved shall have been substantially completed within 36 months following final passage of the ordinance effecting the requested changes. Councilman Byers seconded the motion, and the vote is as follows: Ayes: Councilmen Byers, Fuller, Douglass, Samuels and Warren Nays: None _ Mayor Fuller declared the motion carried. V. PUBLIC HEARING. ZONING CASE NO. 175. REQUESTED BY EULESS DEVELOPERS NORTHWEST CORNER OF NORTH MAIN AND HARWOOD) Mayor Fuller recognized Mr. Wayne Swearingen, who stated that he represents Mayflower Investment -and Euless Developers, who desire to rezone four tracts, located at the Northwest corner of North Main and Harwood Road, as follows: 6.2 acre tract from "A" Residential to "B" Local Business 12.6 acre tract from "A" Residential to "B" Local Business 10 acre tract from "A" Residential to "A -3" Multilple Family Dwel 1 ings 0.5 acre tract from "A" Residential to "C" Commercial . Mr. Swearingen presented a plat of the area and stated that he would answer any questions the Council might wish to ask. Several comments were made concerning the streets proposed in this case, specifically that Shelmar will become Oak Forest Trail in the Royal Oaks Addition. 50 (Page Four, Regular Meeting of the Euless City Council, March 26, 1968) Mr. Swearingen stated that he is aware the street names do not coincide; however, it was pointed 9ut that this is a matter which can be worked out with the City Manager before presenta- tion of the Preliminary Plat. Councilman Fuller asked Mr. Swearingen about apartments being located adjacent to a school site. . Mr. Carl Smith, Engineer for Mayflower Investment and Euless Developers, stated that some cities do not wish to have apartments adjacent to school sites; however, the apartments were placed in this area pending the City consideration of their proposal. Mayor Fuller inquired if there were others who desire to speak as proponents in this rezoning case. There being none, he asked if there were those present in opposition. There being none, Mayor Fuller declared the Public Hearing closed and advised Mr. Swearingen the Council will give consideration to this zoning case at the next regular meeting. VI. FINAL PLAT, MORRISDUE ESTATES Mayor Fuller announced that this item was not scheduled on the agenda; how$ver, at this time he would recognize Mr. Paul Huffhines, Developer in the Morrisdale subdivision. Mr'. Huffh'ines read excerpts from' the Euless City Council meeting minutes dated July 26, 1966 and August 9, 1966, in which the Council discussed the Morrisdale plat and drainage channel. Mr. Huffhines stated he was prepared, in August, 1966, to furnish a letter of credit in the amount of $20,000.00 for the channel improvements, with a time I i m i t of eight (8) years to be specified for these improvements, and that he has complied with a I I of the City's requests. Considerable discussion, followed, and City Attorney James Cribbs stated that the City Council is of the opinion that the entire channel should have a concrete bottom. Mr. Huffhines stated that he is willing to give $20,000.00 to the City, and the City can concrete line the bottom of the drainage channel . -- 51 (Page Five, Regular Meeting of the Euless City Council, March 26, 196 8) It was pointed out that this project is not in the present - Capital Improvements Program and, at some future date, another Capital Improvements Program might be voted to concrete the sides of the channel. It was noted this is a Final Plat and it is extremely important that all matters pertaining to this plat be finalized before approved. Mr. Cribbs statdd that'the City Council is not asking any more at this time than they asked of the Developer in 1966, and that the minutes of the 1966 meetings state that the Engineers recommend that the entire channel be concrete lined. Mr. Cribbs stated that the Council wants a concrete bottom in the drainage channel -- that if the construction w i I I cost Iess than $20,000.00, Mr. Huffhines may keep the balance of the money. Mr. Leonard Weber was recognized by Mayor Fuller, who stated that, in his opinion, the Council cannot s it at the council table and be fully aware of the problems existing in this drainage channel and that the Engineer, Mr. Bill Ratliff cannot sit in his office and be cognizant of the drainage channel problems -- that all of the water from Bedford w i l l wash considerable dirt and s i It into this drainage channel. Mr. Huffhines statdd that his Engineer, Mr. Elliott, dmes not agree with the City's Engineer, Mr. B i I I Ratliff, that the channel should have a concrete bottom. Mr. E I I i ott stated that he is reluctant to discuss this matter at this time, due to the fact that Mr.' Rat] iff i s not present.; however, in his opinion, that he does not believe a concrete lined bottom w i l l hold in this particular channel -- that he prefers the $20,000.00 be placed in a fund and the City vote a Capital Improvements Program to concrete l i n e the entire channel, sides and bottom. Mr. Huffhines stated that he definitely opposes the maintenance agreement which Mr. Cribbs presented at the last regular council meeting -- thet the property owners should.not be asked to maintain the channel. Councilman Bobby Fuller stated that a few months ago he was required' by the City to spend $40,000.00 for a concrete lined channel through his subdivision, and the property owners in the area own property to the middle of the creek, and it is their responsiblitty (bo maintain it_ Councilman Byers stated that, seemingly, there are two competent engineers who disagree on-the channel improvements and that he is not willing to see $20,000.00 gsdd to concrete line a channel which will be destroyed by 161ood waters and s i It in a period of years. 52 (Page Six, Regular Meeting of the Euless City Council, March 26, 196 8) Mr. Elliott stated that Mr. Huffhines does not object to the easement, but he does object to the maintenance agreement and the�re'are very few cities imposing maintenance agreement on property owners. Councilman Warren stated that he recalls the motion at the last council meeting was for the City Manager, City Engineers, Mr. Huffhines and his engineer to meet and discuss this matter and present a proposed solution to the council. I n answer to a question, Mr. E I I i ott stated he has not discussed this matter with Mr. Ratliff. Mayor Fuller stated that he is still of the opinion the two engineers, the City Manager and Mr. Huffhines should meet and make every effort to find a solution to this problem and present it to the council. Councilman Byers stated that there is no doubt i'n his mind that the City will not concrete line this channel. Mr. Cribbs stated that the City's engineer, Mr. Rata iff had evaluated the situation, and he recommends a concrete 1 ined bottom. After still further discussion, Council- man Warren made the motion that the City Manager, 'City Engineer, Mr. Huffhines and his engineer meet and discuss a solution to this problem and present a recommendation at the next regular council meeting. Council- man Samuels seconded the motion, and the vote is as follows: Ayes: Councilmen Warren, Samuels, Fuller, Byers and Douglass Nays: None Mayor Fuller declared the motion carried. VII. SECOND READING, ORDINANCE NO. 328, BOUNDARY LINE ORDINANCE (CO- TERMINUS LINE OF EULESS AND BEDFORD) City Secretary Vada Ferris presented Second Reading of Ordinance No. 328, which dlarified the co- terminus line of Euless and Bedford. Mr. Bowers, who resides at 1409 Pebble Creek, in Morrisdale, stated that his property is adjacent to Pebble'Creek, and is concerned about the flooding in the area and the effect the f additional development on the, East side of the channel w i I I have on the existing sites'already developed on the West side of the channel. Mr. Cribbs stated that the City's engineer, Mr. Rata iff had evaluated the situation, and he recommends a concrete 1 ined bottom. After still further discussion, Council- man Warren made the motion that the City Manager, 'City Engineer, Mr. Huffhines and his engineer meet and discuss a solution to this problem and present a recommendation at the next regular council meeting. SECOND READING, ORDINANCE NO. 328, BOUNDARY LINE ORDINANCE (CO- TERMINUS LINE OF EULESS AND BEDFORD) City Secretary Vada Ferris presented Second Reading of Ordinance No. 328, which dlarified the co- terminus line of Euless and Bedford. 53 (Page Seven. Councilman Fuller seconded the motion, and the vote. is as follows: Ayes: Councilmen Douglass, Fuller, Byers, Samuels and Warren Nays: None Mayor Fuller declared the motion carried. VIII. SECOND READING, ORDINANCE NO. 329, AVETDAIENT TO ELECTRICAL ORDINANCE NO. 206 City Manager G ri ggs presented Second Reading of Ordinance No. 329, which amends Electrical Ordinance No. 206. Councilman Fuller made the motion to approve second reading of Ordinance No. 329, as presented. Councilman Samuels seconded the motion, and the vote is as follows: Ayes: Councilmen Fuller, Samuels, Byers, Douglass and Warren Nays: None Mayor Fuller declared the motion carried. IX. COMMERCIAL PERMIT No- 60. S OTOG RAN CE APARTMENTS (F IN61 PHASE). Mr. Ran Holman discussed a plat of the Sotogrande Development, stating that the first phase of the development will be composed of approximately one hundred sixteen (116) units of various sizes. In answer to a question concerning parking, Mr. Holman stated that one and one -half (ta} parking places per unit has been allowed, or approximate -ly one hundred seventy -four (174) parking places. Mr. Holman stated that the architecture is Cal ifmrnia Modern and t h a t each phase of the Sotogrande Development w i l l be of different design. Mr. 'Holman stated that he had colored slides of an apartment development i n Dallas which Sotogrande w i l l resemble. However, members of the Council agreed to dispense with the viewing of the slides, stating that they were satisfied with Mr. Holman's presentation. Councilman Byers made the motion to approve Commercial Permit No. 60, as requested by Sotogrande Development. Councilman Warren seconded the motion and the vote i s as follows: Ayes: Councilmen Byers, Warren, Douglass, Samuels and F u l l e r Nays: None 54 (Page Eight. DISCUSSION CE PARKING SPACES Councilman Douglass stated that, in his opinion, the City should check to determine the number of parking spaces per unit at apartment developments in other cities -- that he believes that the one and one -half (12) spaces proposed by Sotogrande i s less than other cities have. Mr. Holman stated that apartment developments in the City of Dal as have one and one - half. (12) spaces per unit; however, i f the f i r s t phase of the Sotogrande Development does not' prove satisfactory, he w i l l be g I a d t o recommend more space i n t h e n ext phase. X. PRELIMINARY PLAT APPROVAL BASIL GEORGE'S INVESTMENT COMPANY AN APARTMENT COMMUNITY (SOUTHEAST CORNER OF HIGHWAY NO. 157 AND HUFFMAN 1 Mayor Fuller recognized Mr. Walter Elliott, who commented that he represent? the developers of the proposed apartment development. Mr. Elliott introduced Mr. RaleighVBlakely, who presented a colored plat. Mr. Blakely stated that the architects for the Sotogrande also designed his apartment units -- that one and one -half (12) spaces per unit is allowed; there is a greenbelt in this development, which in his opinion, will afford a home -like atmosphere. The Council was reminded that the Planning and Zoning Commission recommends approval of the plat, Councilman Fuller made the motion to concur with the recommendation of the Planning and Zoning Commission and approve the preliminary plat for an apartment community to be located at the Southeast Corner of Highway No. 157 and Huffman, Councilman Douglass seconded the motion, and the vote is as follows: Ayes: Councilmen Fuller, Douglass, Byers , Samuels and Warren Nays: None Mayor Fuller declared the motion carried.
