G. Fuller. The following Councilmen were present: Messrs. Bill Byers, Bobby R. Fuller, Frank Douglass, Don Warren and Dan Shull. (Councilman Harold Samuels arrived at 9 :05 P.M.) Also present were City Manager C. J. Griggs, City Attorney James Cribbs and City Secretary Vada Ferris. I N\ /nrr A TI nrx 1 The invocation was presented by City Attorney James Cribbs. APPROVAL OF MINUTES The minutes of the regular meeting dated March 26, 1968 and the called meeting dated April 2, 1968, were approved as written. 1. FIRST READING OF ORDINANCE REZONING 26.103 ACRES FCR PROPOSED MEDICAL HOSPITAL, DCCTCR BURT HYDE. (ZONING CASE NO. 172) Mayor Fuller stated that previously a Public Hearing had been held on this rezoning case, and at this time, the Council would discuss the rezoning of this property foom "A" Residential to "C" Commercial, to accommodate a medical hospital, as requested by Doctor Burt Hyde. • 1 (RaR Two, Rog6llar Maul-ing of the teuleSS r—ty C06lncil- ,Apply) 1 -' It was pointed out that a letter pertain- ing to this zoning case had been received from Mr. Robert Caldwell, the City's Land Planner. Councilman Bobby Fuller made the motion t o approve First Reading of this rezoning ordinance, with the stipulation that the owners comply with the land planner's recommendation that the use of the land throughout the strip. along the East side of the proposed complex be devoted to multiple family housing, to properly buffer the medical complex from the extensive single family neighborhood to the East, and with the following cond i.t i ons subsequent: A. A fina-1 site development plan shall be submitted to the City Council within 18 months following final passage of the ordinance effecting the requested changes. B. Construction in substantial compliance with the final site development plan as approved shall be commenced within 24 months following fi n a I passage of the ordinance effecting the requested changes. C. Construction i n substantial compliance with the final site development plan as approved shall have been substantially completed within 36 months following final passage of the ordinance effecting the requested changes. . Councilman Douglass seconded the motion, and the vote is as follows: Ayes: Councilmen Douglass, Byers and Fuller Nays: None Abstained: Councilman Don R. Warren Mayor Fuller declared the motion carried. Doctor Hyde was asked the question if Mr. Caldwell's suggestion pertaining to the apartments extending the fu I I strip, to properly buffer the residential zone, would be satisfactory to his group, and he answered affirmatively. (Doctor Burt Hyde was furnished a copy of Mr. Caldwell's letter dated April 8, 1968, which pertains to this zoning case.) , ZONING CASE NO. 173, PROPOSED REZONING CF 7.17 ACRES AND 5.13 ACRES, FROM "A" RESIDENTIAL-TO "A -3" MULTIPLE FAMILY DWELLING, AND 25.12 ACRES, FROM "A" RESIDENTIAL TO "C" COMMERCIAL FOR PROPOSED MEDICAL HOSPITAL, MR, 0. S. DOBKI NS Mayor Fuller stated that recently a Public Hearing had been held on the rezoning of these tracts, as requested 61 ('Page Three, Regular Meeting of the Euless City Council, April 9. 1968) Hy Messrs. 0. S. Dobkins and Frank Crumley, to accommodate a proposed medical hospital and multi - family site, Mayor Fuller advised that the City's Rand Planner, Mr. Robert Caldwell, had evaluated the site, with the rezoning request in mind, and the Council is now prepared to discuss this matter. Councilman Douglass stated that Mr. Caldwell's letter expresses an opinion that future problems of considerable magnitude in traffic movement would be created in this area and that his letter does not state his opinion as to whether this is good or bad zoning that he is of the opinion that Mr. Caldwell should clarify these remarks. Councilman Byers stated that, perhaps, the Land Planner and /or City Engineers might check into the traffic problems and make a recommendation to assist in eliminating same. Councilman Douglass stated t h a t he s t i l l would like to have the Land Planner's recommendation, as to whether or not this is good or bad zoning. Councilman Douglass expressed concern as to the use of the property if the Hospital Authority should fa i I to meet all requirements and cease to exist as an authority. Mayor Fuller stated that he is of the opinion that this zoning case should not be denied at this time, but should be evaluated further with a study of the traffic situation, by the Land Planner and Engineers, and that a better presentation for the use of the site should be submitted to the Council for their consideration. The City Manager pointed out that there is a portion of the tract which is unplatted. Mr. Crumley stated that the property Owners have made every effort to cooperate with the City, and at the time the City purchased the.West Euless Park Site, street right -of -way was donated to the City, and that they are prepared to donate street right -of- way adjacent to the hospital site. Councilman Douglass made the motion to concur with the Mayor's recommendation that this zoning case be tabled to permit the Land Planner and City Engineers to evaluate the traffic situation and discuss the same with the property owners -- that the property owners submit a more acceptable presentation and proposed use of the site. Councilman Fuller seconded the motion, and the vote is as follows: Ayes: Councilmen Byers, Douglass, Fuller and Warren Nays: None Mayor Fuller declared the motion carried, Mr. Crumley expressed his appreciation to Members of the Council for their consideration in this rezorpiR'' 8j §p. (Mr. Crumley was presented a copy of the letter from Mr. Robert Caldwell, the City's Land Planner, dated April 8, 1968, which pertains to this zoning case.) 62 (Pape Four, Regular Meeting of the Euless City Council, April g, 196 8) FIRST READING CF ORDINANCE REZONING PROPERTIES AT NORTHWEST CORNER OF NORTH MAIN AND HARWOOD (ZONING CASE NO. 175) Mayor Fuller stated that recently a Public Hearing had been held on this zoning request of Euless Developers to consider the zoning of the following: 6.2 acres, from "A" Residential to "B" Local Business 12.6 acres, from "A" Residential to "B" Local Business 10 acres, from "A" Res i deat i al to "A -3" Apartments 0.5 acres, from "A" Residential to "C" Commercial It was recalled that, at the Public Hearing, mention was made that Shelmar Street will become Oak Forest Trail in the Royal Oaks Addition. City Manager Griggs atated that bhis matter had been worked out with the developer, and the street will be named Shelmar. Councilman Byers made the motion to concur with the recommendation of the Planning and Zoning Commission and approve rezoning, of this property, with the conditigns subsequent, as follows. A. A final site development plan shall be submitted to the City Council within 18 months following final passage of the ordinance effecting the requested changes. B. SECOND READING. ORDINANCE NO. 330. REZONING 9 ACRES FCR SOTOGIRANDE DEVELOPMENT (ZONING CASE NO. 174) City Secretary Vada Ferris presented Second Reading of Ordinance No. 330, which rezones approximately nine (9) acres in the Sotogrande Development, from "A" Residential to "A -3" Multiple Family Dwellings. Councilman Fuller made the motion to approve Second Reading of Ordinance No. 330 as presented. Councilman Warren seconded the motion, and the vote is as follows: Ayes: Councilmen Fuller, Warren, Douglass and Byers Nays: None Mayor Fuller declared the motion carried. V. PRELIMINARY PLAT APPROVALY PROPERTY AT NORTH MAIN AND HARWOOD Mr. Snyder, a representative for Euless Developers, was recognized by Mayor Fuller and proceeded to discuss the preliminary plat with the Council. Councilman Douglass made the motion to approve the plat, as presented. Councilman Byers seconded the motion, and the vote i s as follows: Ayes: Councilmen Douglass, Byers, Warren and F u l l e r Nays: None Mayor Fuller declared the motion carried. Mr. Snyder thanked the Members of the Council for their consideration in approval of this preliminary plat. VI. FINAL PLAT, MORRIS DALE ESTATES City Manager Griggs informed the Council that soon after the last City Council meeting, a conference had been held with Mr. Huffhines and his engineer, Mr. Walter Elliott, and the City's Engineer, M r . B i l l Ratliff, and that an agreement has been reached in this matter, as follows: 64 (Page Six, Regular Meeting of the Euless City Council, April g' 1968) The Developer ( M r . Huffhines) w i l l completely clear and grade the entire width surface to carry calculated drainage area, provide sufficient width and proper slope not to exceed three (3) to one (1) on'the east side of the channel, and finish with mulch seeding. and sodding. The maintenance of the channel w i l l continue to be the responsibility of the owner. Mr. Griggs stated that Mr. Huffhines is in agreement with the City Engineers' original recommendation of June, 1964, pertaining to the channel improvements. Mr. Griggs advised that a document per- taining to the maintenance of the channel has been reviewed by City Attorney Cribbs and, basically, relieves the City of responsibility for maintenance of the channel. In answer to a question, Mr. Griggs stated that the channel will not be concrete lined, at this time. Mr. Huffhines stated that the months of July and August are about the only time that this work can be done. Councilman 'Fuller made the motion, that the Morrisdale Final Plat be approved, subrp'ect to the accomplishment of the stipulations stated by the City Manager and substantial compliance of these stipulations by September fir,st.. .Councilman Byers seconded the motion, and the vote is as follows. Ayes: Councilmen Byers, Douglass, Fuller and Warren i Nays: None Mayor Fuller declared the motion carried. Mr. Bright, a Morrisdale resident, inquired' about 'the maintenance of the creek, stating that he understood from the City Manager's comments that the property owners on the East side of Pebble Creek wi I I maintain the creek bed, and he wonders about the maintenance on the West side of the creek. 'Councilman Byers stated that it is his onderstanding the property owners on the East side of the creek will have to maintain the creek bed to the property line on the West side. Mr. Bright stated that he lives on the West side of the creek and that his property is beginning` to-erode -- that more water coming into this channel will cause more erosion. (Councilman Warren left the Council Chambers in answer to a telephone call, a t 8:45 P.M.) 65 (Page Seven, Regular Meeting of the Euless City Council, April 9, 1968) Mayor Fuller stated that some of the property owners in this area had constructed retaining walls, to prevent erosion -- that Uis, possibly, would be a solution for Mr. Bright. .Mr. Fred Bowers presented pictures of the channel, depicting the flood waters and erosion along Pebble Creek and stated that the families on the West side of the creek have lived there for several years, have landscaped their property and several have swimming pools, and that he is of the opinion that the channel improvements should be made before other houses are built in this area -- that there definitely should be a time limit on the channel construction. Mr. Bowers stated that several years ago a large l o g washed against one of the sewer l i n e s and s t i l l remains there, and that the flood waters continue to cause mass erosion. Mayor Fuller advised Mr. Bowers to contact the City Manager any time he i s aware of logs or other debris near a sewer I i n e o r manhole. Mr. Bowers stated that he has contacted the City several times in this matter; however he has not contacted Mr. Griggs about it -- in the past, when he has contacted Mr. Griggs,rMr. Griggs has been most cooperative. (Councilman Warren returned to, the Council Chambers at this time.) Mr. Huffhines expressed appreciation to the Mayor, Members of the Council and City Staff for their cooperati'on over the past years, in the development of, the - Morrisdale Subdivision. (Councilman Harold Samuels arrived at the council meeting at this time.) IMI OATHS CF OFFICE City Attorney James Cribbs administered the oath of office to the councilmen elected to office in the City Election on April 2, 1968. Warren The Mayor, Members of the'Counci 1, City Manager, City Secretary and City Attorney expressed appreciation to Mr. Bobby F u l l e r who served as Euless City Councilman for ten (10) years and, at this time, is vacating hU council position. ELECTION OF MAYOR PRO TEM Mayor Fuller announced that, at this time, nominations were in order for election of a Mayor Pro Tem. Councilman Warren nominated Councilman B i I I Byers. Councilman Samuels seconded the motion and moved that the nomination cease and Councilman Byers be elected by acclamation. Councilman Byers requested that his name be withdrawn, stating that his business w i I I not permit the time which, possibly, would be required for this position. Councilmen Warren and Samuels agreed to Councilman Byers' request that his name be withdrawn. Councilman Byers norm nated Councilman Frank Douglass to serve as Mayor Pro Tem. Councilman Samuels seconded the motion, and the vote i s as fobbows;- Ayes: Councilmen- Byers, Samuels, Warren and Shull Nays: Councilman Douglass Mayor Fuller declared the motion carried. RM COMMERCIAL BUILDING PERMIT NO. 61, PARK CENTER HOSPITAL Mayor Fuller and Members of the Council reviewed a plat of the area for the.proposed Park Center Hospital, specifically being a ten (10) acre tract South of Highway No. 183 and East of Raider Drive. In answer to a question, Mr. Chuck Bell, Hospital Administrator, stated that the building plans are basically the same as in their previous request. Counc i Iman Samuels made the motion to concur with the recommendation of the Planning and Zoning Commission and approve Commercial Permit No. 61, Councilman Shull sedonded the motion, and the vote is as follows: Ayes: Councilmen Douglass, Samuels, Warren and Shull Nays: None (Councilman Byers was absent from the Council Chambers at the time of the vote) Mayor Fuller declared the motion carried. 67 (Page Nine, Regular Meeting of the Euless City Council, April 9, 1968) . X. ORDINANCE NO, 331, SPEED ZONE ORDINANCE City Manager Griggs informed the Council that the Texas Highway Department requests an ordinance reducing a l l speeds over forty (40) miles per hour to a maximum of forty (40) miles per hour during the construction period, on Highway 1S7 North of Highway 183. Councilman Warren stated thtit he has noticed that numerous cars, possibly belonging to the construction workers, are parked on both sides of the highway adjacent to the apartment development on Highway 157, which in his opinion, creates a traffic problem. City Manager Griggs stated that the Texas Highway Department can issue tickets in this area; however, that he recommends that the Council pass a speed zone ordinance as requested by the Texas Highway Department. Councilman Byers made the motion to concur with the City Manager's recommendation and approve Speed Zone Ordinance No. 331. Councilman Warren seconded the motion, and the vote is as follows: Ayes: Councilman Byers, Warren, Douglass, Samuels and Shull Nays: None Mayor Fuller declared the motion carried. XI. RESOLUTION NO, 209, SETTING DATE FCR PUBLIC HEARING, ZONING CASE NO, 176 City Secretary Vada Ferris presented Resolution No. 209, to establish a Public Hearing date in Zoning Case No. 176, for consideration of the rezoning of 7.202 acres North of Highway 183 and South o f East C l i f f , frrom "A" Residential to "A -3" Multiple Family Dwellings, as requested by Mr. Terry Davis. Members of the Council were informed that the first, possible date for this Public Hearing is May 14, 1968. Councilman Douglass made the motion to approve Resolution No. 209 and establish May 14, 1968 as the Public Hearing date for Zoning Case No. 176. Councilman Shull seconded the motion, and the vote is as follows: Ayes: Councilmen Douglass, Shull, Byers, Samuels and Warren Nays: None Mayor Fuller declared the motion carried. n8 (Pape Ten, Regular Meetirrq of the Euless City Council, April 9, 1968) XI I. COMMERCIAL BUILDING PERMIT N0. 62, MESCO METAL BUILDING MR. DWAYNE S I TTON Mayor Fuller recognized Mr. Dwayne S i tton, who discussed a site plan and building plans for a structure to house a welding business located at 118 West Euless Boulevard. Councilman Byers made the motion to approve Commercial Building Permit No. 62, as recommended by the Planning and Zoning Commission. Councilman Warren seconded the motion, and the vote i s as follows: Ayes: Councilmen Byers, Warren, Samuels, Douglass and Shull Nays: None Mayor Fuller declared the motion carried. A 0 0 VO-OCK/E OF NEW COUNCILMAN Councilman Douglass stated that he would like to welcome Councilman Dan Shull as the newly elected member of the council. Other members of the council and City administrators expressed a similar welcome to Councilman Shull. XIV. DISCUSS ION: MORRIS DALE DRAINAGE CHANNEL Mayor Fuller recognized Mr. Gerard, who lives on Pebble Creek Drive. Mr. Gerard inquired i'f the drainage channel w i l l be lined at some future date. Mayor Fuller stated that lining of this channel was not considered in the present Capital Improvement Program, and that, at some future date, under a new Capital Improvement Program, the lining of this channel might be included; however, citizens of Euless would be given an opportunity to vote on this improvement.
