CALL TO ORDER
The Regular Meeting of the Euless City
Council was called to order by Mayor W. G. Fuller in.the Council Chambers of
Euless City Hall at 7:10 P. M., with the following Councilmen present:
Messrs. Don Warren, Dan Shull, Frank Douglass, Harold Samuels and Bill Byers.
Also present were City Manager C. J.
Griggs, City Attorney James Cribbs and City Secretary Vada Ferris.

The minutes of the called meeting dated
August 29, 1968, were approved as written. Minutes of the regular meeting
dated September 10, 1968, were approved as written.
However, Councilman Shull stated that he
has several remarks' to make concerning the September 10, 1968, meeting.
Councilman Shul'I apologized for not attending the September 10th meeting,
stating that he was out of the City on business; but, he would have to have
voted negatively on the garbage increase rate had he been present, due to

the fact
that sometime
ago a
request for a Certified Public Accountant's
report on
the operating
status of the Tarrant County Waste Disposal had been
requested
by the City,
in an
effort to determine if a rate increase was
justified.
Councilman
Shull
stated that he had not seen such a report and
therefore
did not feel
that
he could have voted affirmatively on this request.
He further stated that the minutes noted
the City Council had accepted a gift at the September 10th meeting and that
he would remind the Council that the City Charter stipulates that Council
Members cannot accept gifts; therefore, he would have had to decline his
portion of the gift presented.
Mayor Fuller inquired if Councilman Shull
was referring to the snake which was presented by Mrs. Martin. Councilman
Shull stated that he was not present and could not say definitely what the
gift was. Councilman Shull was advised that the gift was presented to the
waste disposal operator, Mr. McCaff i ty.
PROCLAMATION HONORING NATIONAL DOG HERO
Mayor Fuller requested the City Attorney
to read a proclamation honoring the national dog hero, ''Ringo ''.
Mr. Cribbs read t'he proclamation, which
is as follows:
WHEREAS = ON APRIL 30, 1968, THE FAITHFULNESS 'AND DEVOTION
'OF "RINGO" - A MINIATURE SAINT BERNARD DOG,
POSSIBLY SAVED THE LIFE CF YOUNG RANDY SALEH, BY

BLIND CURVE, AND
WHEREAS - RINGO "S COURAGE TRULY EMPHASIZED THE CLD ADAGE "A
DOG IS MAN'S BEST FRIEND ", AND

Mayor Fuller intaoduced Mr. and Mrs. Saleh
and their children and "Ringo ". Mayor Fuller presented the proclamation,
designating September 25th as "Ringo Day's in the City of Euless, and a sterling
silver life -time dog tag.
PUBLIC HEARING ON ANNUAL BUDGET,
OCTOBER 1, 1968 - SEPTEMBER 30, 1969
Mayor Fuller opened the Public Hearing on
the proposed budget and inquired if there were comments.
"Councilman Samuels stated that he is
appreciative of the budget, noting the increase in salaries for City employees,
without an increase in the ad valorem tax rate. He expressed his appreciation
to the City Manager for his presentation of the budget.
Councilman Douglass made the motion to
approve Ordinance No. 340 which adopts the official budget for the City of
Euless for the Fiscal Year beginning October 1, 1968 and ending September
30, 1968, stipulating that the rule requir!Ag an ordinance to be read and
passed on two separate readings be suspended and the ordinance be passed on
first and fi n a I reading. Councilman Byers seconded the motion, and the vote
is as follows:
Ayes: Councilmen Byers, Douglass, Samuels, Warren and Shull
Nays: None
Mayor Fuller declared the motion carried.
PUBLIC HEARING, MOBILE HOME
DEVELOPMENT, ZONING CASE NO. 178
Mayor Fuller opened the Public Hearing on
the zoning request presented by Mr. B i I I Pasteur, for rezoning Lots 4, 5, 28,
29, 30 and the West 65 feet of Lots 6 and 27, Block 2 of the J. E. Whitener
Estates from "A" Residential to "C" Commercial for a mobile home development.
Mr. Bi 11 Pasteur was recognized by Mayor
Fuller. Mr. Pasteur introduced Mr. and Mrs. Harold Albright and-Mr. Chester
Smith, owners of the property. Mr. Pasteur presented information on the
development of mobile homes, stating that Mobile Home Parks are not a tax
burden nor a burden to the School System -- property and improvements are
taxed and the Owner of the development pays the taxes; there is an average
of one school -age child for every seven'mobile homes.

Mr. Pasteur presented colored slides of
mobile home developments in the surrounding area and of the tract in question.
In answer to a question, Mr. Pasteur stated
that the owner plans to maintain the streets and w i I I not dedicate them to the
City.
Mr. Walter Elliott stated that all City
requirements have been met, based on the criteria of the proposed zoni'ng
ordinance. However, the owners request a waiver i n the f i f t y (50) foot set-
back requirement. Mr. Elliott stated that he is of the opinion this is
excessive and requests this be reduced to twenty -five (25) feet.
Mr. E I I i ott stated that the development
will have thirty -six (36) foot streets, with on- street parking.
Mr. Pasteur thanked the Council for
their consideration and stated that this mobile home development is plannedd
to be an asset to the City of Euless.
Mayor Fuller inquired if there were
proponents or opponents in this zoning case. There being none, Mayor
Fuller declared the Public Hearing closed, and advised Messrs. Elliott and
Pasteur t h a t t h i s case w i l l be given consideration at the next regular
council meeting October 8th. ?
Mayor Fuller recognized Mr. "Blackie"
Miller, who stated that, about two years ago, the council had tabled his
request to enlarge his " trailer court" on Highway No. 183.
City Attorney Cribbs informed Mr.
M i I le r that, upon adoption of the new zoning ordinance, the rezoning
procedure can be instigated, if Mr. Miller desires to make application
for rezoning.
It was noted that the council minutes
would have to be reviewed to determine the action taken previously in Mr.
Miller's case.
IV.
PUBLIC HEARING, SOTOGRANDE
REZONING CASE NO. 180
Mayor Fuller opened the Public Hearing
on the Sotogrande rezoning Case No. 180 and recognized Mr. Ran Holman who
stated that Sotogrande is desirmos of rezoning 5.36 acres from "A" Residential
to "A -2" Duplex and 21.63 acres from "A" Residential to "A -3" Multiple Family
Dwelling. Mr. Hortiman presented a colored plat of the area and pointed out
Phase One of the Sotogrande Apartment Development, which is under construc-
tion at this time. Mr. Holman stated this request covers the last

phase of the Sotogrande Development.
Mr. Holman informed the council that the
Developer is desirous of constructing and operating a golf course to be
located in the development "green belt" -- to be operated on a membership
basis, planned primarily for Sotogrande tenants.
Mr. Midgley inquired if a street would
open onto Pipeline Road and was advised by Mr. Horhman that the streets in the
area would be presented on the street profile.
There being no other proponents and
opponents, Mayor Fuller declared the Public Hearing clrosed, and advised
Mr. Holman, this case will be considered at the next regular meeting on
October 8th.
Councilman Douglass expressed apprecia-
tion for the presentation by Mr. Holman.

RESOLUTION NO. ' 219 -
CANVASS ELECTION RETURNS
FCR ELECTION CF WATER AND SEWER
SALE TO CITY OF BEDFORD
Members of the Council canvassed the
election returns of the election held on September 14, 1968, the proposal
being to sell a portion of the water and sewer system to the City of Bedford.
Mayor Fuller announced that 606 votes
were cast: 471 For; and 135 Against.
Councilman Byers made the motion to approve
the Resolution canvassing the election returns as presented. Councilman Warren
seconded the motion, and the vote is as follows:
Ayes: Councilmen Byers, Warren, Douglass, Samuels and Shull
Nays: None
Mayor Fuller declared the motion carried.
VI .
CHARTER COMMITTEE APPOINTEES
Mayor Fuller announced that the members
of the council had agreeld to appoint ten citizens to serve on the Citizens'
Charter Committee for the possible updating or amending of the Euless City -
Charter. Those appointed are as follows:

Mayor Fuller stated that these ten persons
will elect their own Chairman and select a meeting time. Their proposals will
be presented to the Euless City Coyncil for consideration.
VI I.
PLAT REVISION,
OAKWOOD TERRACE NO. 1
Mayor Fuller recognized Mr. Tom L'ittle who
stated that he represents the Champlin 0 i I Company, who are desirous of a plat
revision in Oakwood Terrace No. 1. Mr. Little stated that the developers
are desirous of subdividing into .three lots to be designated as Lots A -1, A -2
anddA -3, Block l of Oakwood Terrace No. 1, and that Champlin's Service Station
i s located on Lot A -3.
Councilman Douglass made the motion to
approve the Plat Revision as requested. Councilman Shull seconded the motion,
and the vote i s as follows:
Ayes: Councilmen Douglass, Shull, Samuels, Byers and Warren
Nays: None
Mayor Fuller declared the motion carried.

CERTIFICATE OF OCCUPANCY
GANN CONSTRUCT10N COMPANY
CRESTHAVEN ADDITION
Mayor Fuller recognized Mr. Dwight Gann,
who stated he is requesting a Certificate of Occupancy in order to use an
existing house for office space on property presently zoned commercial on
Lot 12, Block 1 of the Cresthaven Addition. Mr. Gann states that he plans
to brick veneer the front and side of the existing house, a roof has already
been installed and interior remodeling is planned.
Councilman Shull stated that he would
remind the Council that in a recent request of this nature a six month permit
#nad been granted.
Councilman Byers stated that, in his
opinion, the two cases were different, in the fact that the property on
North Main Street was leased property and Mr. Gann owns the property on
which his request is predicated.

Mr. Gann stated that he has consulted with
Mr. Bullard and other City Officials and has complied with all the City require-
ments -- that he would not be opposed to a six months permit.
Fie was advised that he would not have to
apply for an additional permit after the six months expiration, if at the end
of the six months he has remodeled the house as indicated.
Councilman Shull made the motion to approve
Certificate of Occupancy for Gann Construction Company, and grant a six months
permit providing a l l commercial standards for the City of Euless' are met.
Councilman Samuels seconded the motion, and the vote is as follows:
Ayes: Councilmen Shull, Samuels, Douglass, Byers and Warren
Nays: None
Mayor Fuller declared the motion carried.
IX.
AUDIENCE REQUESTED BY MR, GEORGE D.
M I DG LEY, REGARDING S I DEVV4KS
Mayor Fuller recognized Mr. Midgley,
resident of the Morrisdale Subdivision, who stated he is very concerned about
the school children (80°1) who must get to school by walking or by bicycles or
parents hauling them -- that he would_,1 ike to know what the City Council can
do to get sidewalks for the children,' especially along the very hazardous
streets such as Pipeline Road.
Councilman .Shull stated that he recalls
that the new zoning ordinance, if approved, wi I I require the developer to
construct sidewalks within fifteen hundred (1500) feet of schools.
City Attorney Cribbs advised Mr. Midgley
that sidewalks have been discussed many times by the City Council.
Mayor Fuller stated that citizens must
bring these matters to the City Council's attention and if it is evident
that ,a capital improvement program is needed, then the citizens may vote
for capital improvements which could include sidewalks.
Mr. Midgley stated that he would I i ke
to see new subdivisions have sidewalks.
In answer to a question by Councilman
Shull, Mr. Midgley stated that he would favor a bond issue. Mr. Midgley
inquieed about the improvements to Pipeline Road and Mayor Fuller advised
that the City has plans for Pipeline Road improvements but these improve-
ments do not include sidewalks.

'Mr. Midgley stated that he requests that
the Council Members visit the schools And observe the children attempting to
get to schools where there are no sidewalks.
Mayor Fuller thanked Mr. Mi,dgl.ey for his
interest and his presentation to the City Council,

APPOINT AUDITING FIRM FCR
1967-68 AUDIT
City Manager Griggs advised the Council that
he and City Secretary Vada Ferris recommend Arthur Young & Company to be employed
for the City's annual audit for 1967 -68.
Councilman Byers made the motion to concur
with the City Manager's recommendation and employ Arthur Young & Company of
Fort Worth as auditors. Councilman Warren seconded the motion, and the vote
is as follows:
Ayes: Councilmen Byers, Douglass, Samuels, Shull and Warren
Nays: None.
Mayor Fuller declared the motion carried.
XI.
AGREEMENT PERTAINING TO
CONSTRUCTION OF TRANSMISSION WATER
LINE I N EULESS TO SERVE REGIONAL AIRPORT
City Attorney James Cribbs presented an
agreement concerning the proposed oonstruction of a transmission water line and
sale Of treated water to the Regional Airport, advising that this agreement
must be ratified by the Cities of Dallas and Fort Worth. Mr. Cribbs stated
that he recommends approval of this agreement.
Councilman Samuels made the motion to con-
cur with the recommendation of the City Attorney and approve the agreement
as presented, subject to the approval of the Cities of Dallas and Fort Worth.
Councilman Douglass seconded the motion,
and the vote i s as follows:
Ayes: Councilmen Byers, Douglass, Samuels, Shull and Warren
Nays: None

The meeting recessed at 8:30 P. M. for
fifteen minutes prior to the Public Hearing on the proposed zoning ordinance.
XIII.
PUBLIC HEARING: PROPOSED
ZONING ORDINANCE
Mayor Fuller opened the Public Hearing
on the proposed zoning ordinance at 8:45 P. M. in the Euless City Hall Council
Chambers, with the following in attendance: Councilmen Bill Byers, Frank
Douglass, Dan Shull, Don Warren and Harold Samuels. Planning and Zoning
Canmission Members Jack Browne, Doctor Harold Hall, Doctor Richard Lande and
M r . Leonard Weber. (Absent: M r . B i l l Tench),
Mayor Fuller introduced Mr. Robert Caldwell,
advising that Mr. Caldwell and Associates have planned the proposed zoning
ordinance with corresponding maps.
Mr. Caldwell introduced Mts aohy-Mr.
Charles Caldwell, who has recently joined the firm of Caldwell and Associates.
City Attorney James Cribbs explained that
the proposed zoning ordinance will encompass eleven (11) zoning classifications
and amend the temporary zoning ordinance No. 33, presently used in the City
of Euless.
Mayor Fuller stated that Members of the City
Council and Planning and Zoning Commission have discussed the proposed ordinance
several times and suggestions and revisions were formulated for consideration.
Mayor Fuller requested Mr. Caldwell to ex-
plai'n the proposed ordinance.
Mr. Caldwell stated that this ordinance is
proposed to up -date the one in existence and encompasses a l l modern concepts of
zoning. Mr. Caldwell stated that he and his staff have carefully studied the
development of the City of Euless and are of the opinion that this zoning
ordinance w i l l assist the City in its growth for a decade, possibly more, and
he commends it to the City.
Councilman Samuels inquired about having
three or four classifications for multiple family dwellings, based on density,
etc.

Mr. Caldwell stated that, in some instances,
the minimum standard housing ordinance has taken care of this; however, in
others it has been handled through a zoning ordinance such as the one he proposes
for the City of Euless.
Mayor Fuller recognized Doctor Thomes who
inquired approximately how long this ordinance has been under consideration.
Mayor Fuller answered that several years have been given to the study of a
proposed ordinance, Doctor Thomes inquired if the regional airport had been
taken into consideration during the work phase of this ordinance. He was
advised by Mayor Fuller that the regional airport had been given much considera-
tion and had been encompassed in this zoning ordinance. Doctor Thomes inquired
if other airports, such as O'Hara and Idlewilde, had been studied in order to
integrate different ideas.. He was advised by Mr. Caldwell and Mayor Fuller
that numerous airports had been studied.
Mayor Fuller recognized Mr. Bill Pasteur who
stated that, in the past, the Planning and Zoning Commission and City'Council
had placed a time l i m i t (condi ti(bns subsequent) on rezoning requests. Mr.
Pasteur inquired if the adoption of the new zoning ordinance w i I I affect the
conditions subsequent ordinances which are presently inexistence.
The City Attorney stated this ordinance w i I I
not affect the' existing condition subsequent ordinances -- that they still
w i l l be i n existence. Mr. Pasteur stated that the conditions subsequent clause
i s very cumbersome. Mayor Fuller explained that this time I i m i t is imposed i n
order to assure that the property is not rezoned merely for speculative purposes.
Mr. Pasteur stated that i n many cases the property i s sold contingent on the
zoning. City Attorney Cribbs'explained that the purpose of zoning is to have
a proper plan and that the time I i m i t imposed i s to protect the people.
Doctor Hall stated that he feels that the
"conditions Subsequent" is unjust_
Doctor Thomes stated that it appears that
the placing -of the conditions subsequent on the rezoning is placing a burden
on the people.
Mr. Caldwell stated that in the preparation
of the Comprehensive Plan for the City of Euless a vast study has been made and
the land use map has been projected for approximately the next twenty (20)
years.
In answer to a question, Mr. Caldwell stated
that he feels that the City should be considerate of the conditions subsequent.
Mr. Caldwell stated that on any zoning change submitted after the adoption of
the zoning ordinance, the land -use plan should definitely be referred to before
granting this rezoning.

Doctor Hall stated that he agrees with Mr.
Caldwell t h a t a time l i m i t should be placed on larger developments but on the
small requests, he feels it is unjust to impose the "conditions subsequent"
stipulation.
City Attorney Cribbs inquired of Mr. Pasteur
exactly how he determines that the conditions subsequent is binding on the
- developers. Mr. Pasteur stated that he i s of the apinion that if a man wants to
sell his property, he should be able to sell it. Also that he, as a citizen of
Euless, is acquainted with the Council Members and is of the opinion that if he
came in to request an extension on a conditions subsequent ordinance, the same
would be granted; however, out of town land purchasers, who are not acquainted
with the Members of the City- Counci 1, are hesitant to purchase property, for
fear that their request for an extension would not be granted. It was pointed
out that the City Council can control zoning with site plans and building plans.
Councilman Douglass stated that the City
Council has placed the conditions subsequent in an effort to accomplish what is
best for Euless.
City Attorney Cribbs stated that the conditions
subsequent is a matter of policy and not actually incorporated in the proposed
oon ing ordinance.
Mayor Fuller recognized Mr. Don Reams of
Fort Worth who inquired if the adoption of the zoning map means that the
property w i I I be zoned as the map indicates. Mr. Caldwell stated that the
land -use plan is the goal that the City hopes to reach and that the zoning
district map will govern the zoning -- that each time property is zoned, the
zoning district map must indicate the zoning change.
Mayor Fuller recognized Mr. Troy Fuller who
stated that he was advised by City officials that, in conjunction with the
adoption of the new zoning ordinance, a property owner can request a zoning
change at the Public Hearing. Mr. Troy Fuller stateld that therefore he requests
a zoning, change on property located on North Main, north of Harwood Road, 321
feet deep and 330 feet wide, adjacent to property presently owned by Doctor
Thorne s. He stated that the property is presently residential and he requests
that it be reclassified to C -2. Mr. Caldwell, in gnswer to a question by Mayor
Fuller, stated that such a request can be granted at this Hea4ing, or if the
Council so desires, the usual procedure for rezoning may be fd)dlowed.
Mr. Cribbs stated that the City Council and
Planning and Zoning Commission w i I I study a I I requests submitted before adopt-
ing! the zoning ordinance -- that the zoning ordinance cannot be adopted at
this time.

Mr. Troy Fuller presented a plat of the area
depicting the location of the property in his rezoning request, and colored
slides of a Veterinary Clinic and Hospital in the City of Irving owned by Doctor
Thomes -- a very attractive structure, adjacent to a residential area of
$25,000.00 to $30,000.00 homes. Mr. Fuller stated these slides are presented
in, an effort to show that the attractive Veterinary Clinic and Hospital does not
detract the neighborhood. Mr. Troy Fuller explained that Doctor Thomes has
a contract to purchase the property adjacent to property he presently owns.
Mayor Fuller stated that he recalls, several
years ago, that Doctor Thomes requested rezoning to accommodate a Veterinary
Clinic and was met with much opposition, especially from the person owning the
land which Doctor Thomes now has under option. Mayor Fuller stated that he
would strongly recommend that Doctor Thomes proceed on this zoning request
through the proper channels and that he is of the opinion that Euless does need
a fine veterinary clinic and hospital.
Mayor Fuller recognized Mr. David Glidden,
406 Franklin, who inquired of the effect rezoning would have on a neighborhood
if the rezoning is from R -1 to C -2.
Mr. Caldwell stated that it would have much
effect; that to change a portion of an R District to a Commercial District
w i l l create many objections because you w i l l be affecting many other properties
i n the area,
Mr. Glidden inquired about the commercial
zoning along Highway 183. He stated that he objects to the property being
zoned commercial i n the area on both sides of Franklin, between Simmons and
Norman. I t was pointed out that this area is not i n the 300 foot zone and
that, possibly, the map has infringed erroneously.
Mr. Jack Browne stated that the Planning
and Zoning Commission had issued a memorandum on the various categories in
the new proposed ordinance. He stated that he would like to know if the
ordinance includes the changes and recommendations submitted by the Planning
and Zoning Commission Members -- that he is unable to find in the ordinance
where his ideas were used. He inquired if a revised ordinance with. all of
these suggested changes had been issued.
Mayor Fuller stated that all of the
changes submitted were considered -- t h a t a l l the changes w i I I be consolidat-
ed and would be incorporated in the new ordinance.after careful study.
City Manager Griggs stated that the changes
recommended by the Planning and Zoning Commission and the City Council w i I I
be evaluated along with the items mentioned by citizens during the Public
Hearing and w i l l be incorporated in the ordinance when it is finalized.

who stated that he is desirous that the City Council and Planning and Zoning
Commission, upon the adopt i-on of the new zoning ordinance, w i l l not emphatically
say that this is the way that the property is zoned and w i I I not be considerate
of rezoning requests -- that if the City does not feel that this ordinance is
final, he is of the opinion that the proposed zoning ordinance wi I I serve the
City w e l l -- t h a t he hopes the City Council w i l l permit the :rezoning procedure
used in the past to continue in the future. Mr. Elliott stated that he commends the
Planning and Zoning Commission and City Council for their work on the zoning
ordinance -- that he has several comments pertaining to the ordinance which
are minor and he wi I I discuss at a later date.
Doctor Hall inquired concerning the sound
in the residential area adjacent to the proposed regional airport. Mr.
Caldwell stated that the land -use study and zoning ordinance is based on the
latest public plan issued by the airport and that consideration definitely
was given to the noiee factor in planning this rezoning map. =Mr. Cdldwell
stated t h a t he has been advised t h a t a new plan w i l l be forthcoming sometime
this week.
Mr. Weber made a motion to close the Public
Hearing. Councilman Shull stated that he recalls that it was announced just
several weeks ago that the Public Hearing could be recessed and reconvened
at a later date, if the Council agreed that further consideration should be
given to the zoning ordinance and that, in his opinion, the Public Hearing
should be recessed in order for the public and the Council and Planning and
Zoning Members to have additional time for study of this most important
ordinance.
Mr. Weber stated that, in his opinion, the
public has been notified by the legal notice in the paper and those who
were interested are present tonight to voice their opinions.
Councilman Byers stated that no one can
be certain that the plan to be released by the Airport Authority this week
wi I I have any effect on the zoning in this area, but that if there is a
p o s s i b i l i t y t h a t such a plan w i l l be available, possibly, it would be best
to recess the Public Hearing in order for this plan to be given considera-
tion.
