M. in the Council Chambers of Euless City H a l l , w i t h the f o l l o w i n g Councilmen present: Messrs. B i l l Ryers, Harold Samuels, Don Warren, Dan Shull and Frank Douglass. Also present were City Attorney James Cribbs, City Manager C. J. Griggs and Recording Secretary Florence Murr. IAI\ /r)r' ATIllAI The invocation was presented by Councilman B i l l Byers. VISITORS Visitors in attendance are listed as follows: Mr;- and Mrs. - Harold Copher, Messrs. Troy M. Fuller, Gordon A. Harris, Ivan Gregory, Dorn Lincoln, Bi 11 Ratliff; Ci'ty's Consulting Engineer, Don White, representing Hank Dickerson and Company, and Mrs. Betty Potthoff, representing the Mid- Citoies Daily News. APPROVAL OF MINUTES Minutes of the regular meeting dated February 25, 1969, were approved subject to the correction of Item II, Page 4, Paragraph 1, as follows: ''Councilman Samuels made the motion to grant a one year extension of the temporary permit for operation o f a Heating and A i r Conditioning, Appliance Sales and' Service Center located at 501 North Main, providing Mr. Lance improves the peemises as follows: 1. Installs outside lighting, 2. Paves the driveway, and 3. Paints the outside of the building. Councilman Shull seconded the motion." FINAL PLAT APPROVAL, i HARWOOD PLAZA, MR, GEORGE NOKES_ DEVELOPER (LOCATED 1 AT SOUTHEAST CORNER OF HIGHWAY 57 AND HARWOOD ROAD Mayor Fuller recognized Mr. Don White, of Hank Dickerson and Company Realtors, who stated that he is present as a rep- resentative for Mr. George Nokes, who requests final plat approval for Harwood Plaza. 22 (Page Two, Minutes of Regular Metting, Euless City Council, March 11, 1969) Councilman Warren stated that the installa- tion of curb_ and gutter was discussed at the time Euless Medical and Dental Arts Building was cons tructed,,at $.0.0- North Industrial -- that he and his associates contacted the State Highway Department concerning the matter and were advised not to make these improvements at that time. Councilman Shull stated that he is aware of Developers' having installed curb and gutter and, in a short time changes-were made in the highways which required removal of the installations. ' CounciTman Shull stated that, in his opinion, this is a waste of money. Councilman Warren advised that he and his associates installed reverse curb and gutter on their property -- that this was necessary to prevent erosion. Mr. White stated that this matter has been discussed with Mr, Jack Hmm of the Highway Department in Fort Worth, who indicated that Highway 157 w i I I be widened and improved, at some future date. Mr. White commented that a cut w i I I probably be made at the intersection of Highway 157 and Harwood Road, and in his opinion, the installation of curb and gutter, at this time, would be throwing money away. I n a discussion of the State Highway De- partment's policy, it was determined that the installation of curb and gutter along a Farm to Market Road is done at the property owners' expense.,. City Manager Griggs stated••that the Plan- ning and Zoning Commission recommends the installation of curb and gutter along Highway 157 be left to the discretion of the Developer. In reply to a question, Mr. White advised that Mr. Nokes is from Waco, Texas -- that he owns several Gibson Stores and proposes to construct a building to house a Gibson Store on the property in question. Mayor Fuller asked if an exit is proposed on Highway 1S7, ,Mr. White replied affirmatively that the structure w i l l front on Highway 157. Mayor Fuller advised that p'ropose"d exits and entrances on the Highway must be approved by the State Highway Department. City Manager Griggs advised-that the Planning and Zoning Commission recommends approval of this final plat, subject to approval of the plans for paving and drainage -- that the City has not received the plans at -this time; however, he would recommend approval, subject Councilman Shull referred to the minutes of the regular meeting of the Planning and Zoning Commission dated March 4, 1969, stating that, in his opinion, the Developer of Harwood Plaza should not be requirdd to install curb and gutter on Highway 157, Councilman Shull stated that other developers were not required to do this, and in his opinion this re- quirement would be unfair to Mr. Nokes. Councilman Samuels made the motion to concur with the recommendation of the Planning and Zoning Commission and approve the Final Plat of Harwood Plaza, subject to approval of plans for paving and improvements to Harwood Road by the City's Consulting Engineer. Councilman Shull seconded the motion, and the vote is as follows: Ayes: Councilmen Byer, Douglass, Samuels, Warren and Shull Nays: None Mayor Fuller declared the motion carried. II. FIRST - READING. ORDINANCE N0. 350 REZONI NG LOT D AND THE EAST' _ .9 FEET OF LOT E. BLOCK 20. MIDWAY PARK ADDITION NOS 2, FR UM "C -1" NEIGHBORHOOD BUSINESS DISTRICT 10 "C -2" COMMUNITY BUSINESS DISTRICT B4NI NG CASE NO. 185) Councilman Douglass moved to concur with the recommendation of the Planning, and Zoning Commission and approve First Reading of - Ordinance No. 350, rezoning Lot D and the East 48.9 feet of Lot E, Block 20, Midway Park Addition No. 2, from "C -1" Neighborhood Business District to "C -2" Community Business District. Councilman Shull .seconded the motion and the vote is as follows: Ayes: Councilmen Byers, Douglass, Warren and Shull Nays: None (Councilman Samuels was absent from the room at the time of the vote,) Mayor Fuller declared the motion carried. AUTHORIZATION TO CLEAR VOTING MACHINES USED IN SPECIAL ELECTION ON FEBRUARY 18, 1969 Councilman Byers made the motion that the City Manager be authorized to request the clearing of voting machines used in the Special Charter Amendment Election held on February 18, 1969. Councilman Warren seconded the motion, and the vote is as follows: Ayes: Councilmen Byers, Douglass, Samuels, Warren and Shull Nays: None Mayor Fuller declardd the motion carried. 24 (Page Four. DI SCUSS ION 0 f' IMPROVEMENTS TO PIPELINE ROAD Ina discussion of the status of Pipeline Road improvements, Mayor Fuller advised that the City of Euless is still waiting for the City of Bedford -- that plans for paving are still in the hands of their Council Committee. Mr. Bill Ratliff stated that, possibly, action on this matter has been delayed, pending Separation of the Water and Sewer Systems between the Cities of Bedford and Euless. Mr. Ratliff advised that the separation will necessitate quite a bit of work within the street itself -- that the separation should be accomplished in the immediate future, Mr. Ratliff stated that this, possibly, could be finalized within ninety days, if Bedford has their plans ready to go into contract. Mayor Fuller advised that the money for improvement o f P i p e l i n e Road was set aside by the C i t y o f Euless and w i l l not be spent for any other project -- that the delay_ in the program was caused by the time required for the two Cities to work out an agreement. Mr. Ratliff stated that all of the funds which were voted for this project have been set aside; however, he is of the o p i n i o n the construction cost w i l l be greater than was estimeted at that time and, possibly, more funds w i l l have to be obtained. Counci Iman tion by the City of Bedford was not considered voted and, possibly, one wi I I off -set the other V. REPORT ON BEAR CREEK SEWER PROJECT, MR. BILL RATLIFF Byers commented that pa'rt'i c i pa- at the time these funds were Mr. Ratliff advised that his engineering firm is doing a portion of the engineering on the, Pear C.ree_k .Sew,er .Proj.ec.t. -- that their plans were delivered to Forest and Cotten on this date and will be submitted to the Trinity River Authority Board around the first of April. Mr, Ratliff advised that, in his opinion, the contract should be let and con- struction started within sixty or seventy days. City Manager Griggs advised that Trinity Piver Authority has been approached by the Cities of Bedford, Hurst, North Richland Hills, Colleyville and Grapevine for a further extension of this line. Mr. Griggs stated that Trinity River Authority indicated that they would be amenable; however, these requests w i l l not interfere with the con- struction now being planned. (Pape Five, Minutes of Regular Meeting, Euless City Council, March 11, 1969) VI. INTRODUCTION OF COUNC I L CAND I DATES Mayor Fuller recognized Messrs. Ivan Gregory and Don Lincoln, candidates for Councilman, Places 4 and 2 respectively, i n the City Election to be held on April 12, 1969. VII. REPORT ON TORT CLAIMS LEGISLATION, CITY ATTORNEY JAMES CRIBBS City Attorney James Cribbs reported that he and the City Manager worded a telegram which was sent to Austin, urging our Legislators to vote for amendments to the proposed Tort Claims Act. Mr. Cribbs advised that the message was signed by Mayor Fuller and each Councilman, individually. Mr. Cribbs advised that similar action was taken by the Hurst - Euless- Bedford Independent School District, the City of Arlington and the Arlington School District. Mr. Cribbs stated that there may be a necessity for a delegation to travel to Austin when this legislation receives final hearing. A DJOURNVENT ATTEST: &Zttj Lt� City N6wo-mtra ry VIII.
