The regular meeting of the Euless City
Council was called to order at 8 :05 P. M., in the Council Chambers of Euless City
Hall, with Mayor W. G. Fuller presiding. Councilmen present are listed as follows:
Messrs. B i l l Byers, Frank Douglass, Harold Samuels, Don Warren and Dan Shull.
Also present were City Attorney James Cribbs,
City Manager C. J. Griggs and Recording Secretary Florence Murr.

INTRODUCTION OF MISS LINDA
MONTGOMERY MISS EULESS -HURST
FCR THE YEAR 1969)
Mayor Fuller recognized Mr. Richard Parks,
President of the Hurst - Euless Chamber of Commerce, who introduced Miss Linda
Montgomery, who will represent the Cities of Euless and Hurst at the Miss Texas
Contest and Pageant this year.
Mr. Parks also introduced Mrs. June Graves
of Hurst, who is serving as Manager for Miss Montgomery and w i I I accompany her, as
chaperone, to the Miss Texas Contest.
Mr. Parks recognized Mr. Audie L. Morris,
who served as Chairman of the local Pageant Committee, and commended Mr. Morris for
his fine work.
Mayor Fuller expressed appreciation to Miss
Montgomery for her appearance and wished her luck in her campaign for the Miss Texas
title.

Mayor Fuller announced that the Council had
given consideration to Mrs. Sam Harrington's request for rezoning a 1.0 acre tract
out of the -B. Harrington Survey, Abstract 808, from 11R -1" Single Family Dwelling
District to "C -2" Community Business District, which is identified as Zoning
Case No. 186. (Public Hearing held on March 25, 1969).
Councilman Shull made the motion to approve
First Redding of an ordinance, rezoning the west one hundred,,fifty (150) feet
of the one acre tract owned by Mr. and Mrs. Sam Harrington, providing the building
is set back fifty (SO) feet from the front property line. Councilman Byers
seconded the motion, and the vote is as follows:
Ayes: Councilmen Byers, Douglass, Samuals; Warren and Shull
Nays : None
Mayor Fuller declared the motion• carried.

apartments in this area of the City are not conducive to,our schools. Mayor Fuller
stated further, that he is aware the City does not have enough apartments; however,
he considers there are other locations more suitable as apartment sites.

Councilman Shull made the motion to deny the
rezoning request submitted by Mayflower Investment Company (Zoning Case No. 187).
Councilman Samuels seconded the motion, and the vote is as follows:'
Ayes: Councilmen Byers, Douglass, Samuels, Warren and Shull
Nays: None
Mayor Fuller declared the motion carr'ied.
Councilman Douglass stated that he is in
agreement with Mayor Fuller -- that he has talked with school officials earlier on
this date, who advised that it is their preference that the property in question
is not rezoned for apartments. Councilman Douglass advised that he talked with one
Counselor from MacArthur, in Irving, who told of many problems created by children
going to the apartments , adjacent to the school. Councilman Douglass said he
understands that another Developer, who proposed an apartment development in the
vicinity of a school in the City of Irving was turned down because of the problems
experienced at MacArthur.
Councilman Samuels commented that rezoning
this property would be in conflict with the Master Plan.

DISCUSSION OF IMPROVEMENTS TO
LITTLE SULPHUR BRANCH THROUGH
MORRISDALE ESTATES, MR. PAUL
HUFFH I N E S . DEVELOPER
Mayor Fuller recognized Mr. Paul Huffhines,
who stated that he is present to discuss the drainage channel through Morrisdale
Estates. Mr. Huffhines referred to minutes of the regular meeting of the Euless City
Council dateCApri 1 9, 196$, which states in part as follows:
"The Developer ( M r . Huffhines) w i l l completely clear and grade the entire
width surface to carry calculated drainage agea, provide sufficient width
and proper slope not to exceed three (3) to one (1) on the east side of
the channel, and finish with mulch seeding and sodding. The maintenance
of the channel will continue to be the responsibility of the owner,
Mr. Griggs advised that a document pertaining to the maintenance of the
channel has been reviewed by City Attorney Cribbs and, basically, relieves
the City of responsibility for maintenance of the channel.
In answer to a question, M r . Griggs stated t h a t the channel w i l l not
be concrete lined, at this time.
Mr. Huffhi-nes stated that the months of July and August are about the
only time that this work can be done."

In reply to a question, Mr. Huffhines stated � it
he was of the opinion he was supposed to slope the banks, trim the trees and sod thel
banks. Mr. Huffhines agreed that the channel was discussed at the March 26, 1968,
meeting, stating that at that meeting he had expressed opposition to the requirement
for concrete lining of the channel.
Mayor Fuller stated that a $20,000.00 expendi-
ture was discussed in a previous meeting. The Mayor asked Mr. Huffhines what the
$20,000.00 was to be spent for.
Mr. Huffhines advised that the City proposed
to concrete line the' entire channel -- that he was supposed to pay one -half of what
four (4) foot 'pipe would cost. Mr. Huffhines stated further that the money was in
the bank, and he was waiting for the City to send him something to sign -- that his
attorney wrote Mr. Cribbs, the City Attorney. Mr. Huffhines stated that the agree-
ment was that the money would be put up for eight (8)' years =- if improvements
were not made during that' time, the money-was 'to 'be 'returned to the 'Developer.
Mayor Fuller advised that the discussion
concerning the $20,000.00 occurred in the year 1966 -- and was referred to again
at the regular City Council meeting held on March 26, 1968.
Mr. Huffhines advised that he agreed to
make the channel eight (8) feet deep, straight through, and to dead end the
channel.
Mayor Fuller stated that, in his opinion,
Mr. Huffhines owns the creek between Woodvine Drive and Pipeline Road,
Mr. Huffhines stated that he is of the
opinion it was agreed that the City would end up with that part.
Councilman Shull asked Mr. 'Huffhines when
the sides of the channel were mulched.
Mr. Huffhines replied that there was no
emulsion, advising that it is impossible to get a piece of equipment into the
channel. Mr. Huffhines stated that he had it sodded with St. Augustine, and that
bermuda seed has a l s o been sowed. He commented t h a t they s t i 11 have to f i 1 1- in.
Councilman Shull inquired concerning the
feelings of the property owners of that area.
Mr. Huffhines replied that there i s one
or two who are in the political campaign; however, the rest of the property owners
are satisfied. He commented that two persons have threatened to sue if he does
anyth ing.
The Ci,ty Attorney asked if the lots extend
across the creek.

Mr. Huffhines rep] ied affirmatively,
stating that the purchaser of the lots is responsible for them.
Mr. Huffhines presented colored snapshots
of the area, to point out the difficulty of keeping the area clean. Mr. Huffhines
called attention to one snapshot, stating that one property Owner trimmed his
shrubbery and threw the c l i p p i n g s over the fence, where they s t i l l lay.
Mayor Fuller inquired concerning maintenance
of the property North of the creek.
Mr. Huffhines advised that it wi I I , in his
opinion, be the City's responsibility -- that it is a public creek.
Mr. Huffhines stated that he thought they
woald appreciate our going i n there and cleaning out the trees -- that i t was a
difficult operation. Mr. Huffhines stated, further, that he feels he has met his
obligation -- that he widened the channel to an estimated thirty (30) foot width
at the bottom.
Councilman Samuels asked the City's Consulting
Engineer, M r . B i l l Ratliff, if a concrete bottom would make the channel easier to
maintain and eliminate erosion,
Mr. Ratliff replied that a concrete bottom
will make it possible to maintain -- that in its present state, you can go down in
the bottom only about two months of the year, and track machinery would be necessary
to do that, Mr. Ratliff stated that his firm recommended a concrete bottom last
year and that their recommendation still stands -- that they are of the opinion the
channel cannot be maintained without some kind of bottom in it-
. In reply to• a question from Councilman
Samuels, Mr. Huffhines stated boat, in his opinion, twelve feet is not good.
Mr, Ratliff stated that he has heard statements
that the bottom would not be any good; however, he has seen, and the Council saw
pictures presented by I. C. Deal, which showed a ditch with a six foot bottom. Mr.
Ratliff advised that the secret is that the sides must be grassed -- without grass
you will get under — mining of the channel.
Councilman Byers stated he recalls that the
Council required a concrete bottom in the channel from Pipeline Road to Mr. Huffhine's
bridge -- that the statement was made that the sides would not be concrete lined at
this time.
Councilman Shuml asked Mr. Huffhines what
concrete lining means.
Mr. Huffhines replied that it meant two sides
and a bottom.

Councilman Shull stated that, in his opinion,':
Mr. Huffhines stated that he would put a bottom in the channel and would mulch the
sides on a three to one slope.
City Attorney Cribbs stated that, in his
opinion, the final plat would not have been approved without Mr. Huffhines'
agreement. to put a concrete bottom in the creek.
Councilman Byers said he recalls that Mr.
Huffhines stated he would put up $20,000.00 and let the City do the work -- that he
was advised the City was not in that type of business -- that Mr. Huffhines could
retain the balance,' if the improvements cost less than $20,000.00. Councilman
Byers stated further that this discussion concerned the creek from the bridge to
Pipeline Road -- that the City's Consulting Engineers recommended that the bottom
be concrete lined.
Mr. Huffhines stated. that this was not the
agreement and referred to the minutes of the meeting when the Final Plat was approved.
Mr. Huffhines stated that this requirement came as a complete surprise to him about
ten days ago,
Councilman Byers stated that he also was
surprised when he learned that Mr. Huffhines did not intend to line the bottom
of the channel.
Councilman Shull asked Mr. Huffhines why he
gave up the idea of mulching the sides of the channel.
Mr. Huffhines replied that he could not get
a piece of equipment into the channel -- that the banks were hand -raked and squares
of grass were set out approximately every two feet -- that bermuda seed was sowed
all over the banks and it was fertilized.
Councilman Shull asked Mr. Huffhines which
would be the cheaper way of getting grass on the banks -- emulsion or hand - sowing
and sodding.
Mr. Huffhines stated that the estimated cost
for emulsion was $5,000.00, if you could get equipment in to blow it on the area;
however, it is impossible to get the equipment into the area.
Councilman Shull stated he recalls that it
was pointed out during the discussion that there would be a concrete bottom to travel
on.
Mr. Huffhines said that it might have. been
discussed in the meeting before, but that he was opposed to it,
In reply to a question from Councilman Shull,
Mr. Huffhines advised that between eight and ten thougand dollars has been expended
on improvement of the creek, and he considers that 90% of it has been completed.

Councilman Shull refdrred to discussion in a
previous meeting when it was determined that a twelve (12) foot concrete bottom
would enable maintenance of the channel and allow access of equipment in order to
mulch the sides, Councilman Shull stated he thought this was the interpretation of
what was going to happen -- that the banks cannot be mulched from the property.
Mr. Huffhines repeated that it was his
understanding there was to be no concrete bottom in the channel.
City Attorney Cribbs addressed Mr. Huffhines,
stating that he (Mr. Huffhines) was going to spend $20,000.00 for improvement of the
channel and was concerned about being able to do the job for that amount of money.
Councilman Shull stated that on the night this
matter came before -the Council he was s i t t i n g i n the audience -- t h a t M r . B i l l Ratliff
asked him if the improvements to the creek could be done for $20,000.00. Councilman
Shull advised that he calculated that it could not be done for that amount.
Mr. Huffhines stated that he did not agree
to any concrete -- that he was opposed to putting a twelve foot bottom in the channel.
Councilman Shull stated that he recalls that
Mr. Huffhines said for the City to take the $20,000.00 and do what they wanted to.
Councilman Warren'advised that the City
Council did not agree to what Mr. Huffhines is doing to the creek.
I n reply toe question, Mr. Huffhines re-
peated that he is 90% through with -the work and that he did not mulch the sides.
Councilman Shull asked Mr. Huffhines if he
did not agree to mulch the sides.
Mr. Huffl#bines stated that he agreed to mulch
the banks or have them sodded with grass -- that he could not get equipment into the
creek bed to spray the emulsion on the banks, so he sodded the banks with grass and
sowed bermuda seed.
Councilman Shull advised that the banks could
have been mulched, if the bottom of the creek was concrete lined.
Mr. Huffhines referred to the minutes of the
council meeting held on March 26, 1968, and it was suggested that all of the minutes
be taken into consideration -- not just portions of them.
City Attorney Cribbs read a portion of the
minutes of the March 26, 1968, meeting, as follows:
"Considerable discussion followed, and City Attorney James Cribbs stated that the
City Council is of the opinion that the entire channel should have a concrete bottom."

Mr. Cribbs stated that the minutes do not
say that it will be dirt lined or concrete lined; however, he is of the opinion Mr.
Huffhines said he would put i n the concrete bottom and mulch the sides.
Mr. Huffhines stated that he does not think
'the City Council agreed to it_
City Attorney Cribbs suggested that Mr.
Huffhines poll each Councilman and see what they thought they agreed to.
In a discussion, it was determined that
the creek was not included in the first installment -- that it was not included in
the second one until the City Council mentioned it_
Mayor Fuller asked Mr. Walter Elliott,
Engineer, who owns the land.
Mr. Elliott replied that it i s not dedicated
to the City, therefore, he is of the opinion it belongs to the original owner.
Councilman Warren asked if the original plat
included the creek.
Mr. Huffhines replied affirmatively -- that
it was included in 1961.
At the suggestion of City Attorney James
Cribbs, t h i s item was tabled. M r . Cribbs, M r . B i l l Ratliff, the City's Consulting
Engineer, Mr. huffhines and his attorney, Mr. Wright, and Mr. Walter Elliott,
'Engineer, retired to the Conference Room for discussion.

ORDINANCE. N0. 351, SPEED ZONE
ORDINANCE REGULATING SPEED ON
HIGHWAY 157 WITHIN THE CITY OF

City Manager Griggs stated that, previously,
the City of Euless requested that the State Highway Department make a further study
of traffic on Highway 157, within the corporate City Limits. Mr. Griggs advised
that a traffic study was made and the Texas Highway Department recommends certain
changes in the speed limit.
Mr. Griggs presented Ordinance No. 351,
regulating the speed limits on Highway 157, within the corporate limits of the City
of Euless, as follows:
From the South City Limits (Pipeline Road) North, just beyond Trinity High School,
a speed I i m it of 45 miles per hour; Continuing North to a point South of Little
Bear Creek, the speed l i m i t of 60 miles per hour, and from there to GladE Road, a
I i m i t of 70 miles per hour.

Councilman Samuels made the motion to
suspend the rule requiring that ordinances be read at two regular council meetings,
and approve Ordinance No. 351 on First and Final Reading, as an emergency measure.
Councilman Warren seconded the motion, and the vote is as follows:
Ayes: Councilmen Byers, Douglass, Samuels, Warren and Shull
Nays: None

VI.
INTRODUCTION CF CANDIDATES
Mayor Fuller recognized candidates in the
Municipal Election to be held on April 12, 1969, as follows: Mr. Audie Morris,
candidate for Councilman, Place 4, Mr. Harold Copher, candidate for Councilman,
Place 2, Mr. Don Lincoln, candidate for Councilman, Place 2, and his wife, Kathy.
Mr. Jim R. Michaels, who was recently elected
to the Hurst - Euless- Bedford School Board of Trustees was in.tr.oduced at this time.
VII.
APPOINTMENT CF REPRESENTATIVES TO
HURST- EULESS- BEDFORD HOSPITAL AUTHOR I TY
Mayor Fuller announced that the City's
representatives to the Hurst - Euless- Bedford Hospital Authority have been contacted
concerning their acceptance of reappointment to serve in this capacity, and each
advised that he would accept this responsibility.
For new terms to expire May 1, 1971, Mayor
Fuller reappointed representatives listed as follows:
Mr. 131ease Tibbets, Doctor Burt Hyde and Mr. S. H. Osborne.

DISCUSSION OF GARBAGE SERVICE
Councilman Samuels advised that he has
received several telephone calls this week concerning commercial trash pick -up.
Councilman Samuels stated that the first calls were received from businessmen in
Wilshire Shopping Center, and more recently, he received a call from Shields
Pharmacy. Councilman Samuels stated that one of the persons has received a summons
because trash was strewn on the ground -- it was necessary to hire someone to come
i n and clean up trash which was not removed by the garbage men from whom he con-
tracted service =- that the f i r m he hired was not franchised to operate i n the City
and was told that he could not operate.
Mayor Fuller commented that the City wants
the merchants to keep it clean, but won't let them. The Mayor stated further that he
has not been pleased with the service offered by Tarrant County Waste Disposal for

some time, and he has brought it to the Council's attention on several occasions.
Mayor Fuller advised that he also had a call from a gentleman in the Wilshire
area who does not know what to do -- that they pick up the garbage but drop most
of it on the ground, and he has to hire another contractor to clean up after them.
The
Mayor stated
that he
has always been of
the opinion that heavy waste disposal is a
part of the
City's
function which
we
should do ourselves -- that in his opinion
the City can
do it
after a survey
is made
to determine if it is profitable. Mayor Fuller
stated
that, in
his opinion,
if the
present contractor does not live up to his
agreement, the City
should make a
change.
In a discussion of garbage service within
the City, it was determined'that the City does receive complaints from citizens.
The Mayor advised that this should be included in the survey concerning the service.
- Councilman Shull advised that several citizens,
including himself, haul off their own trash and he asked if it would not be practical
for the City to find a place for them to dump. I

Councilman Byers stated that he has received
numerous calls concerning the lack of a City dump -- that many of the citizens are
unhappy with their garbage service, and he considers it would be helpful if the City
had a designated area i n which to dump.
A discussion followed, and Councilman Shull
advised that the Arlington dump can be used for a fee of $15,00. He pointed out
that the citizens of Arlington can dump free.
Councilman Byers suggested that the Cities
of Grapevine and Euless might work together -- that the Grapevine dump is located
out North Main Street, and it might accommodate both cities.
IX.
DISCUSS ION .CONCERN ING FURCHASE

Councilman Shull proposed that the City
Manager be instructed to investigate the cost of equipment for recording City
Council minutes .
Members of the Council were' in a'greement
that an investigation should be made.
Mayor Fuller instructed the
City Manager
to
make a study of heavy waste
disposal -- possibly, to appoint a committee
to see
how
other cities are handling
it_ The Mayor advised that a survey can
be made on
the
efficiency of every waste
disposal, and a recommendation should be
made to the
City
Council, as to whether or
not the City should handle the operation
or continue
with
the present contractor.

X.
REQUEST FOR INFORMATION FROM
.CITY LAND PLANNER, MR. ROBERT
CALDWELL
Councilman Samuels stated that, at the
regular Council Meeting on February 11, 1969, he requested the City Manager to
secure information from Mr. Robert Cal.dwell, Land Planner, concerning recommended
density of apartments, i n terms of people per acre or units per acre, and a recom-
mendation of total ultimate ratio of apartment units to individual dwelling units
when Euless is fully developed.
Councilman Samuel's advised that the request-
ed information has not been furnished at this time, and he would like for the minutes
to reflect that he considers it important in City planning and is desirous that the
information be obtained.

DISCUSSION OF TRAFFIC ON

Mrs. Anthony Veal, who resides at 803 Ector
inquired concerning the procedure to be followed in petitioning the Council for
investigation of dangerous traffic traveling on Ector Drive. Mrs. Veal reported
that autoinobi les travel at excessive speeds and that she has tire marks in her yard,
where cars have run up over the curb into the yard.
Mayor Fuller asked if the Police Department
has been notified.
'Mrs. Veal' replied affirmatively -- that the
only thing they have heard is that the Police Department is under - staffed.
Councilman Samuels asked if Mrs. Veal has
seen a radar unit in the vicinity.
Mrs. Veal replied negatively and asked if
there is a physical object which can be placed in the street. In reply to a question,
Mrs. Veal advised that the problem is mostly between the hours of 3;.00 and 4; 00 p.m.,
when school is dismissed -- that the cars come down Midway Drive and turn North on
Ector.
Mayor Fuller suggested that Mrs. Veal con-
tact the City Manager, advising him of the situation and telling him that the
Police have been notified -- and, if conditions have not been improved, a petition
be submitted.

CALLING TOM HALL MEETING FCR
THURSDAY, APRIL 10, 1969
Mr. C. J. Soles stated that he was dis-
appointed that a Town Hall Meeting has not been called, giving the citizens an

opportunity to meet all candidates for election in the Municipal Election to be t
held on April 12, 1969.
After considerable discussion, it was sug-
gested that the City Manager make necessary arrangements for a Town Hall Meeting,
to be held in the Community Building of the Civic Center Complex, at 7;30 P. M. on
Thursday, April 10th.
The Recofding Secretary was instructed to
motify all candfdates of the meeting, advising them that their speeches will be
limited to five (5) minutes -- that all candidates will speak in the order of their
appearance on the b a l l o t , and t h a t a question and answer session w i l l be conducted
following the speeches.
Councilman Frank Douglass (Mayor Pro tem)
was appointed as moderator for the meeting.
Mr. Soles recommended that Town Hall Meetings
be scheduled each year. He suggested 'that the meetings be scheduled early enough for
c i t i z e n s to meet a l l of the candidates and suggested that one be held ,soon after all
candidates have filed, with a second meeting scheduled for the week of -the election.

FURTHER ACTION CONCERNING
MORRISDALE DRAINAGE IMPROVEMENTS
(CONTINUATION OF ITEM IV)
City Attorney Cribbs returned to the Council
Chambers from the Conference Room, a d v i s i n g t h a t the meeting is s t i l l in progress
that they are attempting to work out an agreement with Mr. Huffhines concerning the
lining of the ditch north of the bridge. Mr. Cribbs advised that they wi I I try to
have a definite commitment at the rText regular council meeting.
Mr. Eberhart stated that the problem is
the bank of the channel.
Mr. Cribbs stated that he is aware of that --
that, possibly, in some future capital improvements program the channel will be lined
completely; however, at this time the City has a potential law suit -- that Mr.
Huffhines' attorney is with him this evening, and he, as City Attorney, is, attempting
to avoid litigation.
Mr. Eberhart requested that the City Attorney
determine whose responsibility it, is to maintain the channel.
Councilman Byers stated that the responsi-
bility is set out in the maintenance contract which was mentioned- previously.
Councilman Douglass made the motion to table
the matter concerning improvements to Little Sulphur Branch through Morrisdale
Estates. Councilman Byers seconded the motion, and the vote is as follows:
