149 Regular Meeti ng of the Euless City Council J u l y 22, 1969 CALL TO ORDER The regular meeting of the Euless City Council was called to order at 8;05 P. M. i n the Council Chambers of Euless City Hall, with Mayor Pro Tern Frank Douglass presiding, in the absence of Mayor A. C. Krause. Councilmen present were Messrs. Dan Shull, Harold Copher, Don R. Warren and J. Dwayne W Icox. (Mayor Krause was out of the City) Also present were City Attorney James Cribbs, 'City Manager C. J. PUBLIC HEARING ON ZONING CASE 189, REQUEST CF MR, PIERS CHANCE FCR REZONING 7.914 ACRES IN J_ P_ HALFORD SURVEY, FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO °1R -3" MULTIPLE FAMILY DWELLING DISTRICT Mayor Pro Tem Douglass opened the Public 15.0 (Page Two, Regular Meeting of the Euless City Council, July 22, 1969) Hearing on Zoning Case 189, a request by Mr. Piers Chance for rezoning 7.914 acres out of the J. P. Halford Survey, Abstract 711, from "R -1" Single Family Dwelling District to "11-3" Multiple Family Dwelling District, property being located on the South side of West Midway Drive and the West side of Ector Drive. Mayor Pro Tern Douglass announced that the proponents in this case would be permitted to present their case for a period of ten minutes, then opponents would be allowed ten minutes, then a five minute rebuttal period for proponents. The Mayor Pro Tern asked if there were proponents in this case and recognized Mr. Carlo Farina, who stated. he is the Broker for the property in this case. Mr. Farina stated that the owners are not present; however, if the Council has any questions, he w i 11 make an effort to answer. There being no questions by Members of the Council, Mayor Pro Tern Douglass inquired if there were opponents in this zoning case. Comments from opponents were, as follows: Mrs. Gene Morelock stated that on Friday, 'July 18, 1969, she had presented, to the City Secretary, a list of petitioners in opposition to this zoning case.' Mayor Pro Tern Douglass advised Mrs. Morelock that the Council had been informed by the City Secretary that the l i s t contained twenty -one (21) names of persons who reside within two hundred (200) feet of the property in question and one hundred -six (106) names of persons who reside in the vicinity of the property. Mayor Pro Tern Douglass informed the City Secretary that this list of petitioners should be made a part of the Council Minutes. (Lists on file as Council Exhibit, in Office of the City Secretary.) 'Mrs. Doyle Ricks, 510 Ector, stated that at the Planning and Zoning Public Hearing, it was pointed out that school problems are not City problems. Mrs. Ricks commented that when schools become over - crowded, which occurs when an apartment development locates in developed area, the School District increases taxes which is a burden on the'tax payers; therefore, she cannot see that it is just a school problem. Mrs. Ricks.stated that the traffic on Midway and Ector is terrible now,and, in her opinion, would be greatly increased if an apartment complex is constructed in the vicinity. 151 (Paae Three. Reg6lar Meetina of the Euless City Council, July 22 Mr. Calvin Sorrells, 610 Aransas, stated that he did not see that there is room for an apartment complex in that area -- that several years ago, when he purchased his house, he was led to believe the neighborhood would be strickly single family dwellings, and he agrees with Mrs. Ricks, that the traffic is a serious problem and would be moreso if an apartment complex is built in the area. Mr. Jbmes 0. Payne, 605 Aransas, stated that he lives within two hundred (200) feet of the property and is definitely opposed to the apartments. Mrs. J. D. Baccus, 608 Midway, stated that the intersection at Ector and Midway is very dangerous and has caused great concern for parents of children who cross at this intersection enroute to the elementary school -- that she is of the opinion the traffic problems would be greatly increased, and i t would be much more dangerous in the area if the apartments are located near the school. Mr. Steve Stephenson, 705 Fayette, stated that Euless has many beautiful features -- Trinity High School, the Civic Center Buildings, the new modern elementary schools -- and he is at a loss to understand why apartments should be built in this vicinity, which would detract from these buildings. There being no further opposition, Mayor Pro Tem Douglass recognized Mr. Paul Henderson, who stated that several years ago, he sold homes to some of the people present who are in opposition to this rezoning, and he wants them to be aware that he is not attending the council meeting in reference to this zoning case and public hearing -- that he is interested in another item on the Agenda. Mayor Pro Tem Douglass inquired if Mr. Farina had further remarks in rebuttal, and Mr. Farina stated that apparently the people 6f Euless are oot interested in the growth of the City of Euless -- that, if this zoning request is denied, Euless will stay at its present population and no future growth can be anticipated. I n answer to a question from the audience, City Attorney Cribbs stated that if this zoning case is denied, one year must elapse before a new a p p l i c a t i o n f o r zoning w i I I be accepted by the City. Mayor Pro Tem Douglass stated that the Council will give consideration to this rezoning request at its next regular council meeting on August 12, 1969. 152 (Page Four. Regular Meeting of the Euless City Council, July 22, 1969) I SECOND AND FINAL READING OF ORDINANCE 359, REZONING LOTS 11 THROUGH 19, BLOCK A, SHEPPARD ADDITION, FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "R -3" MULTIPLE FAMILY DWELLING DISTRICT (ZONING CASE NO. 191 Councilman Copher made a motion to approve Second and Final Reading of Ordinance No. 359, rezoning Lots 11, 12, 13, 14, 15, 16, 17, 18 and 19, Block A, Sheppard Addition, from "R -1" Single Family Dwelling District to "R -3" Multiple Farhily Dwelling District, with the following conditions subsequent: A. A final site development plan shall be submitted to the City Council within 18 months following final passage of the ordinance effecting the requested changes. B. Construction in substantial compliance with the final site development plan as approved shall be commenced within 24 months following final passage of the ordinance effecting the requested changes.' C. Construction in substantial compliance with the final site development plan as approved shall have been substantially completed within 36 months following final passage of the ordinance effecting the requested changex. Councilman Wilcox seconded the motion, and the vote is as follows: Ayes: Councilmen Copher, Wilcox, Shull and Douglass Nays: Councilman Warren Mayor Pro Tern Douglass declared the motion carried. LOT REVISION, LOTS 1 AND 2, BLOCK 2, OAK FOREST A D D I T I O N Mayor Pro Tern Douglass recognized Mr. B i 1 I Pasteur. Mr. Pasteur stated that he is represent= ing the owner of the property, Mobil 0 i I Company, who requests a Lot Revision of Lots 1 and 2, Block 2, Oak Forest Addition. (Property located at the northwest corner of Harwood and North Main.) Mr. Pasteur stated that this Lot Revision is considered necessary because of the turning radius at this locat ion . i'"'}�l 5 V (Paae Five. Regular Meeting of the Euless City Council, July 22. lg(;q) City Manager Griggs advised the Council that the Planning and Zoning Commission recommends approval of this revision. Councilman Shull made a motion to concur with the recommendation of the Planning and Zoning Commission and approve the revision of Lots 1 and 2, Block 2, Oak Forest Addition. Councilman Warren seconded the motion, and the vote is as follows: Ayes: Councilmen Shull, Warren, Copher, Wilcox and Douglass Nays: None Mayor Pro Tern Douglass declared the motion carried. IV. PRELIMINARY AND FINAL PLAT, CRIPPLE CREEK ADDITION .Mayor Pro Tem Doug lasssrecognized Mr. Ran Holman, who informed the Council he is representing Mr. Bill Skipping, owner of the property in the proposed Cripple Creek Addition, consisting of approximately fourteen (14) acres located on the East side of Ector Drive, across the street, East of the Civic Center. Mr. Holman stated that his client requests Preliminary Plat approval for Cripple Creek Addition and approval of Tract 2, Final Plat. Mr. Holman informed the.Council that Texas Power and Light Company plan to construct a new office building on Tract 2 for their own use. Mr. Holman stated that the owner of the property is agreeable to installing tend connecting the water lines, but is of the opinion that the City should be responsible for the cost of a portion of the l i n e , since there w i l l not be a pro -rata• re- imbursement. Councilman Warren made the motion for approval of the Preliminary Plat and Tract 2, Final Plat, with the stipulation that the owner tie into the eight (8) inch existing water line to the East, following the procedure for pro -rata re- imbursement established by the-City. Mayor Pro Tern Douglass declared the motion died for lack of a second. Members of the Council agreed to postpone a decision on the water line until a report on the City's water program is submitted by the Consulting Engineers. 154 (Pape Six. Regular Meeting of the Euless City Council, July 22, 1969) Councilman Warren made the motion to approve the Preliminary Plat and Tract 2, Final Plat, Cripple Creek Addition, subject to the recommendations of the City Planning and Zoning Cornmission, the City's Consulting Engineer and the City Attorney's approval of parkway easement for utilities and sidewalk. Councilman Shull seconded the motion, and the vote i s as follows: Ayes: Counci Imen Warren, Shull , Copher, Wi Icox and Douglass Nays: None Mayor Pro Tern Douglass declared the motion carried. Mayor Pro Tern Douglass extended a welcome to Texas Power and Light Company for planning to relocate in the vicinity of the Civic Center. V. AUTHORIZATION 10 ADVERTISE FCR WATER TANK B I D S Oouncilman Wilcox stated that he is desirous that steps be taken immediately to insure future water supply for Euless citizens. City Manager Griggs informed the Council that the Trinity River Authority had recently approved a contract whereby Trinity River Authority shall pay $300,000.00 to the City of Euless for use of the City's existing sewage treatment and disposal facilities as per Ordinance No. 357• In answer to a question, Mr. Griggs advised that the City should have these funds about August- 15, Councilman Copher inquired about the site for the tank and was advised by the City Manager that negotiations are progressing toward acquiring a site in the vicinity of Harwood and North Main Street. Councilman Shull stated that a site should be acquired befoee taking bids, in order for. the tank company to make'site bor ings . City Manager Griggs stated that the information needed by the tank company would be included in the Consulting Engineers' report on the City's water program and would be made available to the tank company. 155 f o I lows: Councilman Shull made the motion as (1) Consulting Engineers authorized to advertise for bids on one million (1,000,000) gallon capacity water tank as soon as site is acquired; and (2) City Manager and City Attorney authorized to proceed with condemnation of site for water tank if negotiations are not to nsurrmated within sixty (60) days. Councilman Warren seconded the motion, and the vote is as follows= Ayes; Councilmen Shull, Warren, Wilcox, Copher and Douglass Nays: None Mayor Pro Tern Douglass declared the motion carried. VI. _. AUTHORIZATION FCR VAATEP, SURVEY Members of the Council agreed that a survey should be made of the City's water system and was informed by Mr. Ratliff, Consulting Engineer, that his firm previously proposed to make a survey for $7,000.00; that his firm recommends a survey to project the City's water needs for a five year period. Councilman Shull made the motion that Knowlton, Ratl iff and English, be authorized Eo .make a survey of the City's water needs for a minimum of five (5) years, and present their report of the survey within forty -five (45) days, in an amount not to exceed $7,000.00; report to include the following: (1) Study of pressure simulation (2) Survey of water wells (3) Weak sppts in system marked in red and how to eliminate (4) Recommendation Of water for the future and other pertinent data. Councilman Wilcox seconded the motion, and the vote i s as follows: Ayes: Councilmen Shull, Wilcox, Copher, Warren and Douglass Nays: None Mayor Pro Tern Douglass declared the motion carried. 156 (Page Eight, Regular Meeting of the Euless City Council, July 22, 1969) V1 I. PIPELINE ROAD DISCUSSION Councilman Shull inquired of the progress of the Pipeline Road improvements and was informed by City Manager Griggs that the portion of Pipeline Road adjacent to the Sotogrande Development will be under reconstruction within a few days. Councilman Shull inquwred about the rest of Pipeline Road and was informed by the City Manager that the City of Bedford has not finalized their plans for the Bedford portion of Pipeline Road; however, a study is being made and a meeting with Bedford officials will, possibly, be held during the next week, for further discussion on the matter. Councilman Shull stated that he had recently been informed by two (2) Bedford Councilmen that they did not under- stand why this project is being delayed. City Manager Griggs advised the council t h a t t h e C i t y o f Bedford has i n d i c a t e d a possible adjustment o f t h e i r c i t y l i m i t line on Pipeline Road. Mr. Bill Ratliff stated a study of require- ments on a bridge, with possible participation by the County, is one reason for the .delay on this project. Counci lman. Shul 1 made the motion bbat City Manager Griggs meet with Bedford officials and present,a progress report on the reconstruction of Pipeline Road at the next council meeting, August 12. Councilmen Wilcox seconded the motion, and'the vote is as follows: Ayes: Councilmen Wilcox, Shull, Copher, Warren and Douglass Nays: None Mayor Pro Tem Douglass declared the motion carried. Councilman Shull stated he "would attend, with City Manager Griggs, a meeting with Bedford officials for the`purpose of discussing the Pipeline Road improvements. 15-7 (Pape Nine, Regular Meeting of the Euless City Council, July 22, 1988) AREA MEETINGS VIII. Council of Governments Business Meeting City Secretary Vada Ferris advised the c o u n c i l t h a t the C i t y of Hurst' wi 1 1 host a Council of Governments business meet- ing, on Wednesday, J u l y 23, 1969. Councilman Shull recommended, and the other members of the council concurred, that the City Manager and City' Secretary attend the Council of Governments meeting in Hurst. Region 8 Meeting of Texas Municipal League City Secretary Vada Ferris informed the c o u n c i l members t h a t the C i t y of Denton w i l l host the Texas Municipal League Region 8 meeting on Monday, August 4, and reservations are to be made in advance. Councilman Shull stated he will plan to attend the meeting. The City Secretary was requested to contact other council members on Friday, July 25. i IX. CLARIFICATION CF ORDINANCE NO. 35 - WATER RESTRICTIONS Mayor Pro Tern Douglass recognized Mr. French Dunaway, 1801 Toplea, who requested information on use of water at the various car washing businesses in the City. City Attorney Cribbs advised that this ordinance, recently passed in an effort to reserve water for emergency purposes, does not apply to businesses of this type. 158 (Page Ten, Regular Meeting of the Euless City Council, July 22, 1860 ADJOURNMENT ATTEST: City Secretary X.
