HomeMy WebLinkAbout2020-11-10 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, November 10, 2020 A regular meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:30 p.m. on Tuesday, November 10, 2020, in the Council Chambers of City Hall, 201 North Ector Drive. Mayor Linda Martin, Mayor Pro Tern Jeremy Tompkins, Council Members Tim Stinneford, Eddie Price, Perry Bynum, Harry Zimmer, and Salman Bhojani were present in the Council Chambers. During the Precouncil meeting: ➢ Mayor Linda Martin introduced Community Outreach Coordinator Kathryn Rotter representing Tarrant County Judge Glen Whitley. Ms. Rotter advised that the annual fundraiser for United Way is being conducted online this year due to the ongoing COVID-19 pandemic and includes an online auction. Auction items include an opportunity to shave Judge Whitley's head and a golfing day with Judge Whitley. Donations will be accepted through a charity auction site and a link will be provided to the City Council and staff. ➢ City Manager Loretta Getchell advised that a tour of the renovated library for the City Council will take place at 3:30 p.m. on November 24, 2020, prior to the Precouncil session. Additionally, she advised that in light of the pandemic, staff is proposing an alternative to the January in-person Town Hall meeting format. Discussion ensued regarding prerecording a video to include answers to questions routinely raised by the residents. ➢ City Manager Getchell reviewed the regular agenda. ➢ Emergency Management Coordinator Suzanne Hendrickson provided an update regarding the COVID-19 pandemic, including the current statistics worldwide, statewide, and locally as well as hospitalization rates and the status of potential vaccines. Additionally, she advised that during the Tarrant County Commissioners Court meeting held earlier today, Judge Whitley called for schools and cities to suspend athletic events but acknowledged he does not have the power to order that to happen. He stated that the countywide mask order and local disaster declarations that were set to expire on November 30, 2020, will most likely be renewed. Discussion ensued regarding vaccine distribution. ➢ Director of Planning and Economic Development Mike Collins advised of the Community Development Block Grant funding through the CARES Act (CDBG-CV) in an estimated amount of$268,000 and stated that a public hearing will be held at the November 24, 2020 City Council meeting to consider an improvement project at the Euless Family Life Senior Center. Council Minutes Page 2 of 7 November 10, 2020 > Finance Director Janina Jewell provided the Financial update and advised that car rental tax collection was down 41 percent over the same period last year(September). CLOSED SESSION The City Council convened into closed session at 5:32 p.m. for deliberation regarding the following: Seek legal advice from the City Attorney as authorized by Section 551.071 of the Texas Government Code related to pending or contemplated litigation or a settlement offer, including: • Mid City Inn • Riverwalk Planned Development • Deborah Tabor v. Pavement Services Corporation The purchase, exchange, lease or value of real property as authorized by Section 551.072 of the Texas Government Code related to: • Cresthaven Addition The appointment, employment, evaluation, reassignment, duties discipline or dismissal of a public officer or employee as authorized by Section 551.074 of the Texas Government Code related to: • Municipal Court Judge Evaluation Mayor Martin recessed closed session at 6:56 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:00 p.m. for consideration of scheduled items. PLEDGES OF ALLEGIANCE Council Member Salman Bhojani led the pledges of allegiance to the flags of the United States and Texas. CONSENT AGENDA (items 1 through 3) Mayor Martin asked Deputy City Manager Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 1 through 3. Mayor Pro Tern Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Tompkins, Council Members Stinneford, Price, Bynum, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 1. AUTHORIZED PURCHASE OF PUBLIC SAFETY SUPPLIES Authorized the purchase of Fire Department public safety supplies through Casco Industries, Inc., 1517 West Carrier Parkway #118, Grand Prairie, Texas, utilizing an Interlocal Agreement with the City of North Richland Hills, BuyBoard Cooperative Purchasing Program, and Casco as a sole source vendor. The total estimated expenditure is $70,000. ITEM NO. 2. APPROVED RESOLUTION NO. 20-1593 Approved Resolution No. 20-1593, authorizing the City Manager to enter into an agreement with the Texas Department of Transportation (TxDOT) — Fort Worth District, for a Local On-System Improvement Project (LOSA) related to the construction of a pedestrian bridge and sidewalks to connect a walking trail from State Highway (SH) 10 / Council Minutes Page 4 of 7 November 10, 2020 Del Paso to 300 linear feet east of Del Paso Street. The agreement is necessary since the proposed improvements are to be constructed within TxDOT right-of-way. ITEM NO. 3. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the regular meeting of October 27, 2020, with corrections. REGULAR AGENDA ITEM NO. 4. HELD PUBLIC HEARING REGARDING PLANNED DEVELOPMENT 20-05-PD AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2263 Mayor Martin opened the public hearing at 7:07 p.m. Director of Planning and Economic Development Collins presented the item to the City Council and advised that the owner is seeking to rezone the North Texas Event Center Planned Development (PD) to a Planned Development which would allow the existing restaurants and indoor recreation facilities to remain while adding other commercial office and retail uses as allowed in the original Neighborhood Business (C-1) zoning district. The uses within the PD ordinance would be the only uses allowed. Additionally, the Planning and Zoning Commission held a public hearing on October 20, 2020, and recommended approval of the Planned Development ordinance by a vote of 7-0-0. Mayor Martin asked to hear from any proponents followed by opponents of the item. There being none, Mayor Martin closed the public hearing at 7:10 p.m. Council Member Bynum expressed concern regarding the availability of parking for events and referenced a nearby neighborhood with previous parking issues related to the facility. Mr. Collins advised that the owner was made aware of the issues and has entered into private agreements with nearby property owners for overflow parking as well as working with potential retail tenants to manage parking. Council Member Bhojani motioned to approve Ordinance No. 2263, changing the zoning on 16.36 acres in the Somerset Place Addition, Block C, Lot 27ER at 100 East Midway Drive from Planned Development (PD) zoning district to Planned Development (PD) zoning district to allow for commercial uses. Council Member Stinneford seconded the motion. ITEM NO. 5. APPROVED SITE PLAN NO. 20-03-SP Director of Planning and Economic Development Collins presented the item to the City Council and advised that the applicant, Diwan-E-Khaz Venture Partners, LLC, is seeking to construct a 5,980 square foot structure containing a convenience store with drive through food and beverage service and a leasable space. There will also be four fuel islands with eight pumps and a canopy. A new trailhead to the Euless Trails system is proposed on the southwest side of the development. The City of Euless will work with the developer to bring a paved trail connection from the existing trail and install a trailhead marker and signage which will provide directions for the City's trail system. The convenience store will also feature a walk-up window for trail users. The developer intends to install a bicycle repair station, and bicycle and dog wash areas. Additionally, the Planning and Zoning Commission held a public hearing on October 20, 2020, and recommended approval of the Site Plan by a vote of 7-0-0. Council Member Price motioned to approve Site Plan No. 20-03-SP, for Commercial Development proposed to be located on 1.15 acres within the Franklin Levy Survey, Abstract No. 513, remainder of Tract 2 at 101 West Mid-Cities Boulevard. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Tompkins, Council Members Stinneford, Price, Bynum, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 6. APPROVED SITE PLAN NO. 20-07-SP Director of Planning and Economic Development Collins presented the item to the City Council and advised that the applicant, Accelerated Development Services on behalf of Dutch Bros Coffee, is seeking to construct an 862 square foot coffee shop with drive through service only. A double drive through lane will be developed around the east and north sides of the building. The required amount of parking is minimal, due to the size of the building. With the double lane, there are 23 queueing spaces available for the business. Ordering will be through employees with order tablets in the vehicle queue. A pre-order information board will be installed on the north side, but will not have a speaker attached to the board. Additionally, the Planning and Zoning Commission held a public hearing on October 20, 2020, and recommended approval of the Site Plan by a vote of 7-0-0. Ami Chmielik, Regional Project Manager, Dutch Bros Coffee, 1180 NE Beacon, Grants Pass, Oregon, provided a brief overview of the company as well as its charity endeavors. Council Minutes Page 6 of 7 November 10, 2020 Mayor Pro Tern Tompkins challenged Dutch Bros Coffee to save at least one of the larger trees currently on the property. Ms. Chmielik advised that she will see what can be done and hopes to be able to save the larger trees. Council Member Bynum inquired if this location would be corporate owned or a franchise. Additionally, he asked what drew the company to Euless. Ms. Chmielik advised that Dutch Bros Coffee no longer offers franchise opportunities, so this site would be corporate owned. She also stated that the site was the first one they visited after leaving DFW Airport and she was pleased to have a location near DFW Airport. Jake Palmer, Associate Vice President, Accelerated Development Services, 2415 East Camelback Road, Suite 400, Phoenix, Arizona, expressed his appreciation to the City Council for their consideration. People registered to speak in favor of the item who did not speak: Mandy Hurst, Lead Construction Coordinator, Dutch Bros Coffee, 110 SW 4th, Grants Pass, Oregon; and Andrew Pik Hau Yeoh, Civil Engineer, Triangle Engineering, LLC, 1784 West McDermott Drive, Suite 110, Allen, Texas. Council Member Bynum motioned to approve Site Plan No. 20-07-SP, for Commercial Development proposed to be located on 0.773 acres within the James P. Hallford Survey, Abstract No. 711, portion of Tract 7C6 at 714 North Industrial Boulevard. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Tompkins, Council Members Stinneford, Price, Bynum, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 7. City Council Mayor Martin announced the employee service awards and expressed her congratulations to the following employees on reaching an employment milestone with the City of Euless: November 2020 Senior Police Officer Josh Abedraboh — 10 years of service; Water Quality Specialist Rod Williams — 10 years of service; and Signal Tech II Pat Perrault— 25 years of service. Mayor Martin expressed her appreciation to City Secretary Kim Sutter for her hard work and dedication during the recently held election. She advised that Euless had an incredible turnout with more than 20,000 voters in Euless participating. Mayor Martin extended her congratulations to Mayor Pro Tem Jeremy Tompkins and Council Member Perry Bynum on their reelection to the City Council following the November 3, 2020 election. She expressed her appreciation to the citizens for her reelection as well. ITEM NO. 9.
