M. i n the City Hall Council Chambers with the following i n attendance: Councilmen Harold Copher, Frank Douglass, Dan Shull and Dwayne Wilcox. (Absent - Councilman Don Warren) Griggs, City Attorney James Cribbs, and City Secretary Vada Ferris. INVOCATION Harold Copher. VISITORS Also present were City Manager C. J. Consulting Engineer Kenneth English The anvocatbn;; was given by Councilman Visitors in attendance are listed as follows: Messrs. W. W. McCormick, Ivan Gregory, Carl Tyson, Wind. Tidwell, Jerry Brackman, Dan Engesser, Jim O'Connor, Walter A. Elliott, Jr., and D. A. Martin. SECOND AND FINAL READING ORDINANCE No. 368, REZONING 10.78 ACRE TRACT LOCATED N T. A. CASH SURVEY. (ZONING CASE NO. 196) (PROPERTY PRESENTLY OWNED BY WILLIAM C. MARTIN METHODIST CHURCH Councilman Shull made the motion to approve second and final reading of Ordinance No. 368, rezoning property as follows: The North 3.6 acres from "R -1" Single Family Dwelling District to "C -2" Community Business District and the South 6.4 acres from "R =1" Single Family Dwilling District to "R -3" Multiple Family Owel1 ing District, with the following conditions subsequent becoming effective on the date the property is vacated by the William C. Martin Methodist Church: IL"i (Page -Two? Regular Meeting of the Euless City Council, January 27, 1970) A. A final site developmnt plan shall be submitted to the City Council within 18 months following final passage of the ordinance effecting the requested changes. B. Construction in substantial compliance with the final site deve4opment plan as approved shall be commenced within 24 months following final passage of the ordinance effecting the requested changes. C. Construction in substantial compliance with the final site development plan as approved shall have been substantially completed within 36 months following final passage of the ordinance effecting the requested changes. Councilman Douglass seconded the motion and the vote i s as follows: Ayes: Councilmen Shull, Douglass, Copher and Wilcox Nays: None Mayor Krause declared the motion carried. (Property located approximately nine hundred (900) feet east of west city I i m it line on Spur 350.1 SPECIAL PERMIT GRANTED TO EULESS JAYCEES TO OPERATE WILD LIVE ANIMAL SHOW, FEBRUARY 20 AND 21, 1970) Mayor Krause recognized Mr. Wink Tidwell, President of Euless Jaycees, who had presented a written request to. the Council for permission to operate a Wild Life Animal Show on the grounds east of the Wilshire Shopping Center, on February 20 and 21, 1970. Mr. Tidwell stated that an admission fee gill be charged to aid in a Jaycee Project for the Mentally Retarded. I n answer to a question, the owner of the show, Mr. Don Engesser, stated that the show has $173,000.00 Public Liability Insurance Policy, and the animals are caged. Fie stated he has other animals (camels, elephants, etc.) and his show has been a part of the Shrine Circus. Mr. Engesser statdd that all the shop owners in Wilshire Village have consented to this show if a permit is acquired from the City. 15 (Page Three, Reqular Meeting of the Euless City Council, January 27, 1970) Councilman Douglass inquired and was advised by City Manager Griggs that the Council, by a provision in the Zoning Ordinance, can grant a special permit for a specffic time, which in this case, i s two (2) days. Councilman Wilcox made the motion to grant a Special Permit to the Euless Jaycees to operate a Wild Life Animal Show, February 20 and 21, 1970, as per letter of request dated January 22, 1970. Councilman Douglass seconded the motion and the vote is as follows: Ayes: Councilmen Wilcox, Douglass, Shull and Copher Nays: None Mayor Krause declared the motion carried. MAYOR'S REPORT ON LETTER FROM TEXAS HIGHWAY DEPARTMENT REGARDING "TOPICS" Members of the Council had previously been presented a copy of a letter from Mr. R. W. Crook, District Engineer, Texas Highway Department, regarding "Topics"- which is a program of partici- pation, involving matching state and federal funds to increase traffic capacity and safety. Mayor Krause stated he recommends the City Manager be instructed to study the materials on this subject and report to the Council at a later date. Members of the Council agreed with the Mayor's recommendation. IV. CONSULTING ENGINEER'S REPORT Water Well Bids Mr. Kenneth English, representing the Consulting Engineers, presented a tabulated report of the well bids and a 16 (Page Four, Regular Meeting of the Euless City Council, January 27, 1970) letter of recommendation. The well b&dls, opened on January 23, 1970, at 11:00 A. M., at the Euless City Hall, ave as follows: Layne Texas Company Dallas, Texas $284,995.00 Texas Water Wells, Inc. Houston, Texas $299,653. 00 Katy Drilling, Inc. Katy, Texas $365,200. 00 Mr. English stated that the bids had been checked and evaluated by his firm, and they recommend awarding the contract for the two Trinity Wells, scheduled to be completed by June 1, and July 1, 1970, to Layne Texas Company, Dallas, Texas, in the amount of $273,995.00, which is deducting $11,000.00 as per letter attached to bid tabulation, (based on allowing the use of City -owned equipment for test ppmp, but not providing for partial payments). Mr. Jim O'Conner, representing Layne Texas Company, informed the Council his firm is prepared to begin the well construction as soon as a contractt is signed and a work order issued; they are pleased t o be awarded the contract and w i l l make every effort for a good job. Mr. English stated that contract documents should be prepared and signed within a week. In answer to a question, City Manager Griggs stated he concurs with the Engineers' recommendation. Councilman Shull made the motion to concur with the recommendation of the Consulting Engineer and City Manager and award the contract for the construction of two water wells to Layne Texas Company. Councilman Copher seconded the motion and the vote i s as follows: Ayes: Councilmen Shull, Copher, Wilcox and Douglass Nays: None Mayor Krause declared the motion carried. 17 (Page Five. Stand Pipe Inspection Located at Central Drive Warehouse Site Mr. English, Consulting Engineer, presented a report for standpipe inspection, requested by the Council on November 25, 1969. The report is t h a t Water Tank Service Company w i l l inspect the inside of the tank for two hundred ($200.00) dollars, and, if the inspection determines repairs are necessary and the City agrees to proceed with the repairs, the two hundred ($200.00) dollars for inspection will be deducted. City Manager Griggs stated he recommends the Council atuhorize this inspection. Councilman Shull stated that he is of the opinion the inspection should be made within the next thirty (30) days. Councilman Shull made the motion to concur with the recommendations of the City Manager and authorize the standpipe inspec- tion by Water Tank Service Company, as per quotation letter, dated December 16, 1969. Councilman Copher seconded the motion and the vote i s as follows: Ayes: Councilmen Shull, Copher, Douglass and Wilcox Nays: None Mayor Krause declared the motion carried. CITY ATTORNEY'S REPORT Resolution No. 252 City Attorney Cribbs presented Resolution No. 252, determining the necessity for the City of Euless to execute a contract with the City of Bedford for the improvement of Pipeline Road. and the assessment of Bedford property owners on the north side of Pipeline Road. (A copy of the contract documents and Mr. Cribbs' letter of transmittal attached to proposed r e s o l u t i o n , a l l of which are on fi I e as a Council Exhibit in the Office of City Secretary). Mr. Cribbs stated that he has been informed that the Bedford City • (Page Six. Reaular' Meetina of the Euless City Council, January 27, 197 0) Council will discuss a similar resolution at their meeting tonight. Councilman Copher made the motion to approve Resolution No. 252, as presented by the City Attorney, w i t h the under- standing t h a t the Bedford City Council w i l l pass a similar resolution. Councilman Wilcox seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Wilcox, Douglass and Shull Nays: None Mayor Krause declared the motion carried. Tort Claims Act City Attorney Cribbs presented a letter, dated January 27, 1970, evaluating the Texas Tort Claims Act, previously requested by the City Council. Mr. Cribbs stated that the City Manager is working with the Insurance Agent i n evaluating the City's position i n relation to this Act. Mr. Griggs reported he is checking with the Insurance Agent on several items and w i I I present a report to the Council i n the near future, UM CITY MANAGER'S REPORT Letter from Tarrant County Water Control Board City Manager Griggs briefly discussed a letter from the City of Fort Wotth pertaining to a water line being planned by the Tarrant County Water Control and Improvement District No. 1, to be built by the City of Fort Wotth; and the awareness of the City of Fort Wotth, of cities i n the area, needing to purchase water from the City of Fort Wott-h. (Members of the Council had been furnished a copy of this letter, dated January 12, 1970.) Information from Trinity River Authority Delayed Mr. Griggs informed the Council that information on the bids, recently received by Trinity River Authority for (Page Seven,. Regular' Meeting of the Euless City.Counci 1, January 27, 1970) the Bear Creek Interceptor, is expected tomorrow from Mr. Bob Tharp. Mr. Griggs stated this information will be presented to the Council as soon as possible. VI I. RESOLUTION NO. 253:_ SETTING PUBLIC HEARING DATE ON REZONING REQUEST CF MR, TOM PURVIS (ZONING CASE NO. 197) City Manager Griggs informed the Council that this request is for rezoning of 41.896 acres situated in the J. Doss Survey, from "R -1" Single Family Dwelling District to "PD" Planned Development District (property located at the Northwest corner of F. M. 157 and Cummings Road.) Mr. Griggs stated the suggested date is February 24, 1970. Councilman Douglass made the motion to approve Resolution No. 253, calling a Public Hearing on February 24, 1970, of Zoning Case No. 197. Councilman Wilcox seconded th6 motion and the vote is as follows: Ayes: Councilmen Douglass, Wilcoxy Copher and Shull Nays: None Mayor Krause declared the motion carried. VIII. TRAFF I C PROBLEMS ON HIGHWAY NO. 157 19 Mayor Krause stated he is concerned about the increased traffic on Highway No. 157, and is of the opinion there should be a clarification of installation of traffic signals at the busy intersections on Highway Na 157 (Spur 350 and S. H. 157, and Midway and S. H. 157) . Members of the Council agreed there is need for concern, mentioning'the numerous accidents and several deaths at these intersections. City Manager Griggs suggested that the Mayor be autborized to write a letter to Mr. Crook, District Engineer, Texas Highway Department, advising him of the problems on Highway No. 157, and invit- ing Mr. Crook to visit Euless and survey the situation. 20 (Page Eight, Regular Meeting of the Euless City Council, January 27, 1970) suggestion, stating, possibly , to discuss the situation. CTRFFT C1r KI klum r-klIIVIV The Council members agreed with this the Council members might meet with Mr. Crook IX, Councilman Shull stated that the Texas Highway Department should be notified of the incorrect street signs -- that Huffman Road has been spelled "Hoffman ". City Manager Griggs informed the Council that Mr. Crook i5 aware of the error. X. - UIDWAY AND ECTOR CROSSWALKS Councilman Copher stated he has received several complaints concerning the Midway and Ector Intersection and wonders if crosswalks might help the situation. City Manager Griggs stated that a traffic survey is not warranted at this location and he suggested crosswalks, as mentioned by Councilman Copher. The Council concurred and the City Manager was instructed to execute this Council directive. X1. MEETING PLANNED ON GARBAGE DISPOSAL SERVICES Councilman Wilcox stated, that, several months ago, he had consented to research the garbage disposal services in the City and, at the next regular meeting, w i I I suggest a date for a public meeting onrthese services. Mayor Krause informed the Council that a news letter, from the Mayor to the Citizens, is scheduled for distribution on Friday, January 30, and, if possible, he would like to have the date of the meeting. on garbage disposal sdrvices .to include in his newsletter. 21 (Page Nine, Regular Mee,ting of the Euless City Council, January 27, 1970) Councilman Wilcox stated he would inform the Mayor of the date, prior to finalizing the newsletter. an CITIZEN CONCERN ON USE OF PEST CONTROL INSECTICIDES Councilman Wilcox informed the Council that, several residents. of the Morrisdale Sub Division, have contacted him concerning the deaths of pets, apparently poisoned by strychnine in the wooded area between Morrisdale and the Sotogrande Apartment Development; the poison reportedly placed for skunks, by Allied Pest Control. Councilman Wilcox stated that people are concerned by the loss of family pets, but, more deeply disturbed for the safety of the children who play i n this area. Fie stated that he had been informed that an autopsy on one of the animals resulted i n evidence of strychnine sufficient t o kill a horse. City Attorney Cribbs stated that, possibly, a State Statute governs this situation, and that he would prepare an Ordinance for presentation at the next meeting, if a Statute was not in existence. XIII. TAX REFUND STATUS OF MR. W. W. MC CORMICK City Attorney Cribbs informed the Council that he had been contacted by Mr. McCormick, concerning the reimbursement of taxes, provided i n the Settlement Ordinance passed i n 1968. Mr. McCormick i s concerned because it appears that an easement across his property w i I I be needed by the Trinity River Authority for their improvements in the area, and the Settlement Ordinance states that any change i n the property (selling, sub- dividing, etc.) would affect the tax status. City Manager Griggs stated that the granting or selling of an easement would indicate a change in the property, as he interprets the Ordinance. Mr. McCormick stated that, if this is the case, then he would have to try to recover damages from Trinity River Authority. Councilman Shull stated that Mr. McCormick' cannot tie -on to the Trinity River Authority sewer main. City Manager Griggs stated that any plans for a tie -on must be approved by the Euless City Council. 22 ,,(Page Ten, Reqular Meetinq of the Euless City Council, January 27, 1970) I n answer to a question by the City Attorney, Mr. McCormick stated that he i s uncertain whether or not he w i I I grant an easement to Trinity River Authority, unless he knows what the City w i I I do. Fie stated he would consider giving Trinity River Authority one -half of the right -of -way, if the sawer line is to be on his south property line. City Attorney Cribbs stated that he suggests that the City Manager and City Attorney discuss this matter with Mr. Bob Tharp, of Trinity River Authority, and work with Mr. McCormick, and report to the Council at their next regular meeting.
