M., i n the City Hall Council Chambers with the following i n attendance: Councilmen Harold Copher, Frank Douglass, Don Warren, Dwayne Wilcox and Dan Shull. Griggs, City Attorney James Cribbs, City Secretary Vada Ferris. INVOCATION Also present were City Manager C. J. Consulting Engineer B i l l Ratliff, and The invocation was given by Mr. David Crow, at the request of Councilman Copher. APPROVAL CF MINUTES The City Secretary presented Council Minutes for regular meetings of February 24, 1970, and March 10, 1970. The Minutes were approved, as written. IN-191 ROME (Pape Two, Regular Meeting of the Euless City Council, March 24, 197 0) PUBLIC HEARING: ZONING CASE NO. 198 - CONSIDER REQUEST FOR REZONING 26.946 ACRE TRACT SITUATED IN THE B. F, CROWLEY SURVEY, ABSTRACT 320, FRCM "R -1" SINGLE FAMILY DWELLING DISTRICT 10 "R -3" MULTIPLE FAMILY DWELLING Dt S1R ICT. (PROPERTY LOCATED ON EAST SIDE OF NORTH MAIN STREET AT OAK LANE) REQUESTED BY DR, HAROLD HALL Mayor Krause opened the Public Hearing, and advised that fifteen (15) minutes would be allowed for proponents and opponents in this caei�, with five (5) minutes for rebuttal. Councilman Copher informed the Mayor he would not participate i n the discussion, as he owns property adjacent to the subject property. Dr. Harold Hall, applicant, was recognized by the Mayor, Dr. Hall presented printed material to members of the council and the audience and called reference to several items. Mayor Krause inquired if proponents were present. Mr, W. W. McCormick, resident on North Main Street, 'stated he favors Dr. Hall's proposal. Mayor Krause inquired if there were opponents and the following expressed opposition: Mr. , Dr, Hall stated. that he is of the opinion this property is located too close to the airport for private homes; that Euless needs industrial areas and he wants to put money into Euless. However, since people in the area are so concerned, he proposes to change his original plan and designate the first three hundred (300) feet in depth on North Main, as Single Fami4y Dwelling District (R -1) and the rest of the property as (R-3) Multiple Family,Dwelling District. 207 Ash Lane Mayor Krause inquired if proponents were present. Mr, W. W. McCormick, resident on North Main Street, 'stated he favors Dr. Hall's proposal. Dr. Hall stated taxes w i I I be increased with or without the airport; that his proposal offers more industrial area, which Euless needs. Dr. Hall presented a letter from Dr. Richard Thomes, addressed to the City Council. The letter, as read by the City Secretary, expressed a favorable opinion in this case. (Copy of letter on fi I e as Council Exhibit in Office of City Secretary.) The City Attorney advised that two petitions have been presented in opposition to this case; one with one hundred eighty -one (181) names listed as persons living in the area; the other list, names of persons owning property or living within two hundred (200) feet of the subject tract. Mr. Cribbs stated a three - fourths (3/4) affirmative vote of the council is required when a petition is presented listing twenty (20) percent of the property owners within two hundred (200)- feet of the subject property.. Mayor Krause declared the Public Hearing closed, and stated consideration would be given to this case at the next regular council meeting. RECOGNITION OF COUNCIL CANDIDATES AND ANNOUNCEMENT OF TON HALL MEETING Mayor Krause recognized candidates for the April 11, 1970, City election, as follows: Incumbents Frank Douglass, Don Warren and Dan Shull. The Mayor announced that the Euless Jaycees is sponsoring a Town Hall Meeting, Thursday, March 26, 1970, at 7:30 P. M. i n the Community Building, for the purpose of presenting council candidates to the citizens. 52 (Page Four, Regular Meeting of the Euless City Council, March 24, 1970) PUBLIC HEARING: ZONING CASE NO. 200 - CONSIDER REQUEST FCR REZONING 1.6 ACRE TRACT SITUATED IN THE J. H. HAVENS SURVEY._ ABSTRACT 685; FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "SPECIFIC USE "_ ALLOWING THE IMPROVEMENTS OF EXISTING STRUCTURES FCR USE AS OFFICES, STORAGE, CONSTRUCTION. FABRICATION AND OUTSIDE DISPLAY CF PORTABLE BUILDINGS, (PROPERTY LOCATED AT SOUTHWEST CORNER OF GLADE ROAD AND HIGHWAY 157.) Mayor Krause opened the Public Hearing, and recognized Mr. A. T. Sellers, the applicant in this caee. In answer to a question by Councilman Wilcox, Mr. Sellers stated the property will be used for the construction and assemblying of portable buildings. Councilman Wilcox stated, in his opinion, this tract is more suitable as commercial property. Mayor Krause called for proponents or opponents. There being none, he declared the Public Hearing closed and advised Mr. Sellers the council, in accordance with policy, will consider this case at the next regular meeting. IV. FIRST READING: ORDINANCE REZONING LOTS 1 AND 2, BLOCK 3, EULESS GARDENS NO, 1 Mayor Krause announced that the Public Hearing of Zoning Case 199 was held March 10, 1970, for the rezoning of Lots 1 and 2, Block 3, Euless Gardens No. 1, from "C -1" Neighborhood Business District to "C -2" Community Business District, as requested by Mr. George Gordon. (Property located at Northeast corner of North Main Street and Town Creek Drive.) Councilman Wilcox made a motion to concur with the recommendation of the Planning and Zoning Commission and approve the rezoning as requested. - ;(Page Five, Regular Meeting of the Euless .City Council, March 24, 197 0) Councilman Warren seconded the motion and the vote is as follows: Ayes: Councilmen Wi Icox, Warren, Douglass, Copher'and Shull Nays: None Mayor Krause declared the motion carried. M FURTHER CONSIDERATION OF APPLICATION FCR TAXICAB FRANCHISE SUBMITTED BY MESSRS. WORKMAN AND COBLE, CITY CAB COMPANY 53 Members of the council had been presented information, described as a council communication, pertaining to taxicab rates in the City of Arlington. (Copy filed as Council Exhibit in Office of City Secretary. ) Mayor Krause recognized Messrs. Workman and Coble, doing business as City Cab Company, applicants for the taxicab franchise. Mr. Coble inquired if the City of Euless has a franchise with Tri Cities Cab Company, stating that his firm wants to be certain their expendi- ture to place cabs i n Euless w i l l be justified. The City Manager advised that a permit does exist, granted to Brown Limousine Service, doing business as Tri Cities Cab Company. However, the City cannot grant an exclusive franchise. It was agreed the City Manager and City Attorney should review the permit held by Brown Limousine Service to determine it's validity and report back to the council. VI. FIRST READING: ORDINANCE REGULATING PEST CONTROL OPERATORS City Attorney Cribbs reviewed the ordinance, which was presented to the council on February 24, 1970, for cons deration. Mayor Krause recognized several persons from the Morrisdale area, who made inquiries about the Ordinance. 54 (Page Six, Regular Meeting of _the Euless. Ci.t.y_Counc_i_1, March 24, 1970) designated for the permit fee at Fifty ($50.00) Dollars. the permit fee be set at Fifty Ordinance be approved. and the vote is as follows: The Council members discussed the amount City Manager Griggs recommended the fee be set Councilman Douglass made the motion that ($50.00) Dollars and the first reading of the Counc i man Wilcox seconded the motion Ayes: Councilmen Douglass, Wilcox, Warren, SW I and Copher Nays: None Mayor Krause declared the motion carried. Mayor Krause stated that he recommends that a l l pest control firms, presently operating in the City, be notified of this Ordinance. 13" SECOND AND FINAL READING - ORDINANCE No. 370 REGULATING TRANSPORTATION, HANDLING AND STORAGE OF GASOLINE AND OTHER VOLATILES Councilman Copher made the motion to approve second and final reading of Ordinance regulating transportation, handling and storage of gasoline and other volatiles. Councilman Warren seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Warren, Douglass, Shull and Wilcox Nays: None Mayor Krause declaved the motion carried. VIII. CITY ENGINEER'S REPORT PIPELINE ROAD IMPROVEMENTS Mr. Ratliff reported that plans and specifications for the Pipeline Road improvements have been sent to the City of Bedford for consideration; the cost of the project, without sidewalks, is estimated at One Hundred Forty -Eight Thousand ($148,000.00) Do] tars. 55 (Page Seven, Regular Meeting of the Euless City Council, March 24, 1970) Councilman Warren made the motion to approve the plans and specifications as submitted by the Consulting Engineer, subject to approval by the City of Bedford. Councilman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Warren, Copher, Shull, Douglass and Wilcox Nays: None Mayor Krause declared the motion carried. STATUS OF TRINITY WELL DRILLING CONTRACT Mr. Ratliff advised that construction of the North Main Street well is progressing nicely. MUNICIPAL WAY - REVISED ESTIMATE (FROM HIGHWAY 157 10 ECTOR DRIVE) Members of the council reviewed the Engineers' estimate in the amount of Seventy -Four Thousand Nine Hundred Eleven ($74,941.00) Dollars for improvement of proposed Municipal Way from F. M. 157 to Ector Drive and a council communication listing names of abutting property owners, with the estimated cost for each owner. Councilman Shull made the following motion: (1) notify property owners, as listed in council .communication, to escrow their portion with the City by May 15, 1970, and the City w i I I award a contract and start construction within forty -five (45) days; and (2) to accept item one, School District letter dated February 10, 1970, ie - 1. agreed to accept the informal offer of the City to assess the School District Eighteen Thousand Seven Hundred ($18,700.00) Dollars as it's share of the installation of curb, gutter, paving and culvert in proposed Municipal Way adjacent to Trinity High School. Councilman Wilcox seconded the motion and the vote is as follows: Ayes: Councilmen Shull, Wilcox, Copher, Douglass and Warren Nays: None Mayor Krause declared the motion carried. PROCLAMATION- C LEAN -U P, PAINT -UP, FIX -UP WEEK A proclamation was presented designating Clean -Up, Paint -Up, Fix -Up Week i n the City of Euless. Mayor Krause appointed Mr. A. 0. Berg, as Co- Chairman, w i t h Councilman Copher, i n t h i s campaign. X, REPORT OF PLANS FOR SEEKING ,LONG RANGE WATER SUPPLIES Cot ncibman Douglass reported several area cities are concerned about future water supply and -have agreed to explore the availability of surface water. He stated that representatives from Euless and Bedford will apply for surface water rights with the Tarrant County Water Control District, and Hurst,and Richland Hills wi 11 apply for the purchase of treated water from the City o f Fort Worth; t h a t each group w i l l support the plans. XI. REQUEST FOR PRINTING AGENDA IN LOCAL NEWSPAPER Mr. David Crow requested that the local newspaper be furnished a copy of the council agenda in order for citizens to be informed of matters to be considered by the council. Mr. Crow was informed that a copy of the agenda is sent to the local paper,-and agenda for this particular meeting was i n last Sunday's edition. XI I. STATUS CF APPLICATION - OPEN SPACE AND LAND Mr. Charles Hunt inquirhd the status of the open space and land application on the tract recently discussed by the Park and Recreation Committee as a pool and park site. He was advised by the City Manager 57 (Page Nine, Regular Meeting of the Euless City Council, March 24, 197 0) that additional engineering information is needed and it w i I I be approximately three (3) weeks before this information is available.
