M., i n the City Hall Council Chambers with the following i n attendance: Councilmen Harold Copher, Frank Douglass, Dwayne Wi Icox and Dan Shull. (Councilman Warren arrived during the meeting.) Griggs, City Attorney James Cribbs, City Secretary Vada Ferris. INVOCATION Dwayne Wi Icox. VISITORS Also present were City Manager C. J. APPROVAL OF MINUTES The City Secretary presented Council' Minutes for t'he Called Meeting of April 11, 1970, and the Regular Meeting of April 14, 1970, which were approved as written. FIRST READING: ORDINANCE REZONING 1.65 ACRES IN J. H. HAVENS SURVEY, FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT WITH A SPECIFIC USE PERMIT FOR SALE AND DISPLAY OF BOATS (PROPERTY LOCATED 325 FEET SOUTH-OF GLADE ROAD WEST SIDE OF F.M. 157 - MR. CYRUS H. HOLLAND (ZONING CASE NO. 201) Councilman Wilcox made the motion to 74 (Page Two, Regular Meeting of the Euless City Council, April 28, 1970) approve First Reading of Ordinance Rezoning 1.65 acres in J. H. Havens Survey, from 11R -1" Single Family Dwelling District to "C -2" Community Business District, with a specific use permit for sale and display of boats (property located 325 feet south of Glade Road, West side of F.M. 157) requested by Mr. Cyrus H. Holland (Zoning Case No. 201). Councilman Shull seconded the motion and the vote i s as follows: Ayes: Councilmen Wilcox, Shull, Copher and Douglass Nays: None ,Mayor Krause declared the motion carried. ORDINANCE No. 374: SECOND AND FINAL READING: REZONING 1.6 ACRE TRACT SITUATED I N J. H. HAVENS SURVEY, ABSTRACT 685. FROM , "R-1 " S I NGL E FAM I LY DWELL I NG D I STR I CT TO "SPECIFIC USE ". ALLOWING IMPROVEMENTS OF EXISTING STRUCTURES FOR USE AS OFFICES, STORAGE, CONSTRUCTION, FABRICATION AND OUTSIDE DISPLAY CF - PORTABLE BUILDINGS, REQUESTED BY MR. A, T. SELLERS, (PROPERTY LOCATED AT SOUTHWEST CORNER OF GLADE ROAD AND F.M. 157) (PUBLIC HEARING HELD MARCH 24, 1970). ZONING CASE NO. 200 Councilman Shull made the motion to approve second and final reading, Ordinance No. 374, rezoning 1.6 acre tract situated in J. H. Havens Survey, Abstract 685, from "R -1" Single Family Dwelling District to "Specific Use ", allowing improvements of existing structures for use as offices, storage, construction, fabrication and outside display of portable buildings, requested by Mr. A. T. Sellers. (Property located at Southwest corner of Glade Road and F.M. 157) (Public Hearing held March 24, 1970) Zoning Case No. 200. Councilman Wilcox seconded the motion and the vote i s as follows: Ayes: Councilmen Shull, Wilcox, Douglass and Copher Nays: None Mayor Krause declared the motion carried. (Councilman Warren arrived at this time.) 75 (Page Three, Regular Meeting of the Euless City Council, April 28, 1970) LOT REVISION: LOTS ONE AND TWO, BLOCK H, SOMERSET PLACE ADDITION, SECOND INSTALLMENT Mayor Krause recognized Mr. Hugh Waite, Developer of Somerset Place, who stated he requests a revision in size of Lots 1 and 2, Block H, Somerset Place No. 2. Members of the council reviewed the plat, discussed by Mr. Waite. Councilman Douglass made the motion to concur with the recommendation of the Planning and Zoning Commission and approve the lot revision, as requested. Councilman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Douglas, Copher, Shull, Warren and Wilcox Nays: None Mayor Krause declared the motion carried. IV. CITY ENGINEERS' REPORT Pipeline Road - Status Report Consulting Engineer, Mr. B i I I Ratliff, sta ,ted that he had been advised by City Manager Griggs that County participa- tion in Pipeline Road improvements, expected, anticipated and planned for, had been withdrawn. Therefore, the project is endangered, and bids prepared for advertising w i I I have to be revised. City Manager Griggs informed the Council that early last week, representatives of Euless and Bedford met with Mr. Dick Lewis, County Commissioner, to discuss the Pipeline Road project, and the following day, he had been advised by a telephone call from Mr. Lewis, that County equipment and men could not be "tied up" indefinitely on this project. Mayor Krause stated that several years ago, Mr. Lewis had informed Euless Officials, the County would furnish equip- ment and men to aid in the improvements of Pipeline Road, which, if contracted, would cost approximately Fifty Thousand ($50,000.00) Dollars, and as a result Ii1, (Page Four, Regular Meeting of the Euless City Council, April. 28, 1970) of Mr. Lewis' withdrawal, the Public Hearing on the Pipeline Road Project w i I I have to be rescheduled from May 26 to June 9. Mayor Krause stated that he recommends the City of Euless dis -avow from Mr. Dick Lewis and advise him of their displeasure of his withdrawing promised participation in the project. Also, that the City o f Euless w i I I not be the recipient of the meager token offered by Mr. Lewis (approximately $3,600.00). Councilman Shull stated he is of the opinion the citizens of Euless should, be advised of Mr. Lewis' action in this matter. Mayor Krause advised that the Mayor's Newsletter is scheduled for distribution soon and w i I I inform the citizens of this action. Councilman Douglass inquired about the County Road Fund -- how i t i s used, where, how much -- i s i t used f o r church parking lots -- has the City of Euless benefitted from County taxes collected? Mayor Krause requested the City Secretary present a report of County taxes collected and County funds spent, in Euless, as soon as possible. Pub] is Hearinct (Pixel ine Road) Rescheduled Councilman Shull made the following motion �1) reschedule the Public Hearing on Pipeline Road Assessments to be held June 9, 1970. (2) City Engineer revise plans and specifications, pending notification from the Bedford City Council of time for the Public Hearing. Councilman Wilcox seconded the motion and the vote is as follows: Ayes: Councilmen Shull, Wilcox, Warren, Douglass and Gopher Nays: None Mayor Krause declared the motion carried. The Council concurred with the recommendation of the Engineer, Mr. Ratliff, to proceed on the bridge project, as it is not scheduled with the Pipeline Road project. Letter to Commissioner Dick Lewis Councilman Douglass made a motion that a 77 (Page Five, Regular Meeting of the Euless City Council, April 28, 197 0) letter be drafted, for signing by all members of the Council, expressing the Councils' displeasure of Mr. Lewis' action of withdrawal from the project, declining the small "token" offered (to be sent by registered mail). Councilman Wilcox seconded the motion and the vote i s as follows: Ayes: Councilmen Douglass, Wilcox, Shull, Warren and Copher Nays: None Mayor Krause declared the motion carried and instructed the City Secretary to draft a letter for Council consideration. Proposed Park Site - North of Little Bear Creek, Vicinity of North Main . Mr. Ratliff presented a drawing of the proposed park and pool site, stating that this drawing is to show that this area can be used for a park and swimming pool. (Copy of drawing submitted by Mr. Ratliff on file in Office of City Secretary.) V. CITY MANAGER'S REPORT West Fork Sanitary Sewer interceptor - Status Report . . Mr. Griggs reviewed information, previously submitted to the Council, from the Trinity River Authority, which informed that the West Fork Sanitary Sewer Interceptor Project is proceeding, as scheduled. (Copies of Trinity River Authority letters on file as Council Exhibit in Office of City Secretary.) Storage Building and Restroom Facilities - Midway Park City Manager Griggs informed the Council Mr. Griggs informed the Council that, after studying the drawing submitted by Mr. Ratliff, he is of the opinion that he, Mr. Ratliff and Mr. Cribbs can proceed with negotiations. It was discussed that if the entire twenty (20) acres could not be purchased at this time, perhaps, the four (4) acres for the pool could be. Members of the Council agreed that negotiations should proceed, and the City Manager repott to the Council. (Copy of drawing submitted by Mr. Ratliff on file in Office of City Secretary.) V. CITY MANAGER'S REPORT West Fork Sanitary Sewer interceptor - Status Report . . Mr. Griggs reviewed information, previously submitted to the Council, from the Trinity River Authority, which informed that the West Fork Sanitary Sewer Interceptor Project is proceeding, as scheduled. (Copies of Trinity River Authority letters on file as Council Exhibit in Office of City Secretary.) Storage Building and Restroom Facilities - Midway Park City Manager Griggs informed the Council • (Page Six, Regular Meeting of the- Euless City Council., April 28,_ 1970) that plans and specifications for the'storage'building and restroom facilities at Midway Park are ready to consider, in the amount of $9,651.95. Mr. Griggs stated he needs the Councils' direction to advertise for bids or negotiate the project. It was pointed out that, possibly, negotiating for bids would not delay the project, but advertising for bids would take longer. Councilman Douglass made the motion that theCity Manager be instructed to advertise for bids for this project. Councilman Shull seconded the motion and the vote i s as follows: Ayes: Councilmen Douglass, Shull and Warren Nays: Councilmen Copher and Wilcox Mayor Krause declared the motion carried. VI. DISCUSSION: SIGNALIZATION Letter from Texas Highway Department concerning Signalization — G nn 197 Councilman Douglass inquired and was in- formed by Mr. Griggs that the letter from the Texas Highway Department, dated April 23, 1970, is in reply to a letter from the City concerning signal plans. Mr. Griggs stated this letter confirms plans, previously discussed, for a signal light at F.M. 157 and Spur 350, and a flashing beacon at the F.M. 157 and Hal-wood Road Intersection. Main Street and S.H. No. 183 Councilman Douglass inquired about the actuated signals to be located at S.H. 183 and Main Street, stating the agreement with the Texas Highway Department directed these signals to be installed soon after approval of the one -way service roads. Councilman Shull stated a recent Construction Report stated that special equipment had been ordered, and it would probably be about six (6) months before the project is final. Mayor Krause informed the Council he would check with Mr. Crook, Texas Highway Department. VII. CLEAN UP CAMPAIGN Councilman Copher informed the Council that the Clean -Up Project had been delayed due to the recent rains. However, the Clean Up- Fix -Up- Paint -Up Parade is re- scheduled for 10;00 A.M., =- Saturday, May 2, and w i I I "kick -off" Clean -Up Week. He urged participation of a I I citizens i n this project. ICJ (Pape Seven, Regular Meeting of the Euless City Council, April 28, 1970) The City Secretary, as requested by Mayor Krause, read a Resolution from the Hurtt- Euless- Bedford Chamber of Commerce, commending the City Council for their efforts in the Clean -Up Campaign. VIII. STRIPING OF STREETS . , I Councilman Shull stated that several main arteries in the City need to be re- striped. City Manager Griggs advised that streets have been scheduled for re- striping several times and delayed because of the rain. However, as soon as the weather permits, this project wi I I be resumed. IX. CITIZEN REQUESTS Fence Repair Needed at Royal Terrace Apartments City Manager Griggs was instructed to investigate this situation. Residential Yard - Mowing Mr. George Barrowcliff, 300 East Fuller, inquired if a resident' can be required to mow a yard. He stated that his neighbor's yard needs mowing badly. The City Attorney advised that the City Ordinance governs mowing of vacant l o t s and there is Ii t t I e that can be done to require a resident to mxv his yard. Mayor Krause stated he would investigate this matter and see what can be done. Street Repair - 300 East Fuller Mr. Barrowcliff informed the Council that the street has been patched numerous times, during the past few years, at 300 East Fuller, but, the patching is temporary. I-le inquired if repair could be made that would be permanent and solve this problem. Mayor Krause recognized Mr. Tom Genzel, 312 Martha, who requested the City's assistance in advising the owner of the Royal Terrace Apartments of the needed repair of the fence separating the apartments and residences. Mr. Genzel stated that bottles, papers and various items are deliberately thrown over the fence into his yard by persons at the apartment complex and he would appreciate any assistance from the City. Bridge Crossing Sulphur Branch (Pebble Creek) on Pipeline Road Mayor Krause recognized Mr. Bill McCray who advised the council of his observations of the bridge crossing Sulphur Branch (Pebble Creek), just east of the entrance to the Morrisdale Subdivision. Fie stated that the bulkhead is cracking on the southeast corner of the bridge and is becoming increasingly dangerous. M r . B i l l Ratliff stated that this bridge is scheduled for widening and repair soon, but, an investigation would be made immediately to determine the seriousness of Mr. McCray's report. Mayor Krause expressed appreciation to Mr. McCray for his report to the council. X. RECOGNITION OF INFANT .2.7f.75M. Mayor Krause stated that Councilman and Mrs. Wilcox recently became parents of a baby girl, by adoption. All present in the council chambers joined in extending congratulations to Councilman Wilcox.
