M., i n the City Hall Council Chambers, with the fbllowing in attendance: Councilmen Harold Copher, Dan Shull and Dwayne Wilcox. (Mayor A. C. Krause and Councilman Don Warren were absent.) Also present were City Manager C. J. Griggs, City Attorney James Cribbs, Consulting Engineer Kenneth English and City Secretary Vada Ferris. 1r\R1nrrnTnrn1 The invocation was given by Mr. Charles Hunt, at the request of Councilman Copher. GENE V\ELCH FCR REZONING 4.4 ACRES FROM "R-l" SINGLE FAMILY DWELLING DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT AND 6.18 ACRES TO "R -3" MULTIPLE FAMILY DWELLING DISTRICT (PROPERTY LOCATED ON SPUR 350, 1500 FEET EAST CF CITY LIMIT) ZONING CASE NO. 204 Mayor Pro Tem Douglass opened the Public Hearing of Zoning Case No. 204, and recognized Mr. Gene Welch, who reviewed a plat of the subject property. Density was discussed and Mr. Welch stated that his client will consider anything reasonable; he mentioned density of fifteen (15) to eighteen (18). i 106 (PAge Two, Regular Meeting, Euless City Council, June 23, 1970) There was some discussion of an area for a park and Mr. Welch stated that the owner is aware there is an area that could he used as a park site. Mayor Pro Tern Douglass inquired if there were other proponents or opponents. There being none, Mayor Pro Tern Douglass declared the Public Hearing closed and advised Mr. Welch the Council would take this case under advisement for consideration at the next regular meeting. FIRST READING: ORDINANCE REZONING LOT 17, BLOCK 1 AND LOTS 17 THROUGH 31, BLOCK 2, SOTOGRANDE NO, 2, FROM "R -21' TWO - FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT (PROPERTY LOCATED ON THE EAST SIDE CF EL CAM INO REAL)_ LAND USE PROPOSED FOR 'TOWNHOUSES ". PUBLIC HEAR I NG HELD JUNE 9, 1970: ZONING CASE NO. 203. Councilman Copher made the motion to concur with the recommendation of the Planning and Zoning Commission and approve rezoning of Lot 17, Block 1 and Lots 17 through 31, Sotogrande No. 2, from "R -2" Two - Family Dwelling District to "PD" Planned Development (property located on the east side of El Camino Real), land use proposed for "Townhouses ", with a solid six (6) foot fence on the west of the property (as suggested by Sotogrande Development). Councilman Shull seconded the motion and the vote i s as follows: Ayes: Councilmen Copher, Shull and Wilcox and Mayor Pro Tern Douglass Nays: None Mayor Pro Tern declared the motion carried. CONSIDER ZONING CASE NO. 202 - REQUEST CF MR. CLAUDE R._ MC CLENNAHAN, JR TRUSTEE, FCR REZONING 6.293 ACRES I N J. E. FIELD SURVEY, FROM "R -1 " S1 NGLE FAM I LY DWELLING DISTRICT TO "C -2" COMMUNITY BUS I NESS DISTRICT AND 7.717 ACRES "- FROM "R -1 " S INC-LE FAMILY DWELLI NG DISTRICT TO "R-3 " MULTI PILE FAM I LY DWELLI NG D I STR I CT (PROPERTY LOCATED AT SOUTHWEST CORNER CF NORTH MAIN AND GLADE ROAD). PUBLIC HEARING HELD JUNE 9. 1970. Mayor Pro Tern Douglass announced that 107 (Page Three, Regular Meeting, Euless City Council, June 23, 1970) this case will be considered at a later date, following consultation with the applicant, representing the owners. (This decision was made follow- ing the recent death of one of the owners.) IV, MIDWAY PARK STORAGE AND RESTROOM FACILITIES BID Councilman Wilcox reported that discussion with professional estimators on the bid submitted for the Midway Park Storage and Restroom Facilities in the amount of $15,025.00 (considered at previous meeting, June 9, 1970) results in his recommenda- tion to reject the bid and request the matter be reconsidered by the Park and Recreation Committee. Mr. Wilcox stated that the $15,025.00 bid is considerably more than the cost estimated; that he has consulted with Mr. Charles Hunt, Chairman of the Park and Recreation Committee, who advised that a new member recently appointed to the Park and Recreation Committee is a Design Engineer and might be capable in assisting in the design of the facility. Mr. McNair (new member recently appointed to the Park and Recreation Committee) stated he had reviewed the original plans and, possibly, could recommend a few revisions within the funds available. Councilman Shu -1 stated that he is of the opinion that this should not be turned over to a non - professional; that he does not oppose rejecting the bid, but just "throwing up" four walls is not exactly what the City needs. Councilman Copher made the motion to reject the bid submitted by B and B Construction Company in the amount of $15,025.00. Councilman Wilcox seconded the motion and the vote is as follows: Ayes: Councilman Copher and Wilcox, and Mayor Pro Tern Douglass Nays: Councilman Shull Mayor Pro Tern Douglass declared the motion carried. Members of the Council agreed to refer this matter to the Park and Recreation Committee for further consideration, to be re- submitted to the Council at a later date. 108 (Page Four, Regular Meeting, Euless City Council, June 23, 1970) V. DISCUSSION OF LETTER FROM PARK AND RECREATION COMMITTEE, DATED JUNE 22, 1970 Councilman Wilcox read a letter distributed to members of the council by Mr. Charles Hunt, Chairman of the Park and Recreation Committee, and then commented on the eight (8) points as follows: (items numbered are from the Park and Recreation Committee letter and the comment following each is by Councilman Wilcox): "A preliminary engineering plan for the area proposed for Park and Pool Development along Little Bear Creek." Comment: This recommendation has been completed, although altered to now include land of a higher potential cost per acre. Councilman Wilcox stated preliminary engineering work has been done. 2. "Secure twenty (20) acres of land for a park i n area of projected population growth." (Federal assistance available on a 50 -50 basis, upon completion of application through the Open Space Land Program, Department of Housing and Urban Development.) Comment: Negotiation for land purchase, to this Committee's knowledge, has not yet begun, i n spite of the fact that land costs are soaring in this area. Councilman Wilcox commented that the City is trying to locate a suitable site, but must consider funds available. 3. Purchase three (3) acres of land as a part of, or adjacent to, the above mentioned park land for a swimming pool site. Councilman Wilcox stated that the City is attempting to negotiate with the property owners; but he recommends delaying the building of the pool for another year. 109 (Pape Five, Regular Meetmnq, Euless City Council, June 23, 1970) 4. The building of a fifty (50) meter multi - purpose swimming pool on the above mentioned three (3) acre site. Construction to begin at the earliest possible date. Comment: A reasonable timetable would indicate this pool facility to be completed by the - beginning of the 1971 summer swimming season. To the Park and Recreation Commi ttee!s knowledge, no action has been taken during these past nine (9) weeks on this project. VM would like to help get the ball rglling. Councilman Wilcox stated 8 suitable site for a pool needs to be located. 5. "Construction of a utility building housing much needed restrooms, a maintenance workshop and park equipment storage area. " Comment: The Committee recommended a building costing $7,000.00, $2,000.00 of cost to be borne by the Euless Athletic Association through a lease arrangement of storage space. This would have been within our capital improvement budget. The $15,000,00 plus bid received last week, clearly i s not. Councilman Wilcox stated that this matter has been referred to the Park and Recreation Committee. (Item IV, Council Minutes, June 23, 1970) 6. Two baseball diamonds in Midway Park to be relighted at a cost of $4,000.00. Comment: Although this recommendation was approved by a motion at the April 14th Council meeting, the project is still only half completed and has caused undue hardship on the summer baseball program. The contractor chose to wait until night games had been scheduled before starting work on the lights. Councilman Wilcox stated that this work is 50 %complete; that due to a truc'k strike, there has been some difficulty in delivery of the poles. City Manager Griggs was instructed to contact the contractor in an effort to finalize this project. 110 (Page Six, Regular Meeting, Euless City Council, June 23, 1970 { Recommendation to participate in a Federal Assistance Program for "Open Space" parks. Comment: Our Committee's information is that the application has not yet been submitted, although the City Manager was authorized to proceed at Council Meeting, February 24th. Councilman Wilcox stated that the City Manager has been working on this recommendation, and will continue to do so. 8. The sale of $110,000.00 in bonds authorized for 1970 for Capital Improvements Program. Comment: The Committee realizing the bond market fluxuation could, if properly handled, save money, but we believe the facilities herein proposed for the citizens establish and recommended by their needs, plus the rapidly rising cost of construction, far outweigh, the fraction of a percentage point "gained by waiting ". The bonds should be sold as soon as the need arises for the funds and at no time should construction of these facilities be held up awaiting a "better bond market" . Councilman Wilcox stated bonds cannot be sold until plans and specifications are ready and the bond market is right. Mayor Pro Tern Douglass stated that he thinks the council agrees it would be foolish to build a $100,000.00 pool (North Main Street site north of Little Bear Creek) and have to spend $100,000,00 to construct a bridge in order to reach the pool. Mr. Hunt stated there is lack of communication between the council and the Park and Recreation Committee; that the Park and Recreation Committee does not know what the council is doing; projects are being delayed. He stated that it does not make sense to spend 1969 bond funds in 1971 or 1972. Mayor Pro Tern Douglass stated that items for consideration should be submitted to the City Secretary for distribution, allowing time for study; that the council has many projects to consider and receiving information the day of the council meeting or, even the day before, does not permit sufficient! time for study. III (Page Seven, Regular Meeting, Euless City Council, June 23, 1970) Mrs. Martin commented that the Park and Recreation Board is the most important Board in the City, and their work should not be delayed, but taken very seriously. Mayor Pro Tern Douglass thanked the members of the Park and Recreation Committee and expressed appreciation for their time and efforts. CONSIDER REQUEST FOR EXTENSION CF TIME APPLIED TO CONDITIONS SUBSEQUENT IN ORDINANCE NO. 341 (ZONING CASE NO. 179, ''L -1" LIMITED INDUSTRIAL DISTRICT AND "R -3" MULTIPLE FAMILY DWELLING DISTRICT LOCATED EAST OF CARTER DRIVE._ EXTENDING FROM S.H. 183 TO HARWOOD ROAD), MR, ROBERT POWER Members of the Council had been presented a letter from Mr. Robett Power requesting an extension of time applied to Conditions Subsequent in Ordinance No. 341 (Zoning Case No. 179) "L -1" Limited Industrial District and 1111-3" Multiple Family Dwelling District located East of Carter Drive, extending from S.H. 183 to Harwood Road. City Manager Griggs suggested that Mr. Power consult with Mr. Ratl iff,on this matter, since the Co6nci 1 recently approved up- dating the Zoning Map, which may affect the subject property. Members of the Council concurred with the recommendation of the City Manager, and agreed this matter would be considered after a conference of Messrs. Power and Ratliff. VII. C ITY MANAGER'S REPORT Overflowing Water, 300 Trailwood, Mr. and Mrs. Ron Knotts City Manager Griggs advised the Council that Mr. Ratliff, Consulting Engineer, will submit a report on this case at the next regular meeting. (Previously discussed at the June 9, 1970 meeting) . Sewer Back -up at 1115 Crane, Residence of Mr, and Mrs. Bill W. Cotton City Manager Griggs reported that the Consulting Engineers, Knowlton - Ratliff - English - Collins, w i l l submit a report on this case at the 'next regular meeting. 112 (Page Eight, Regular Meeting, Euless City Council, June 23, 1970) Signalization at Highway 183 and Main City Manager Griggs advised the Council that the turn signals at Main Street and S.H. 183 are scheduled for installation within the next few weeks. Members of the Council expressed concern that the islands would not be cut enough, and the City Manager was instructed to check to determine if the plans had been followed, as approved. In answer to a question, the City Manager stated atteppts would be made to educate the public of the one -ray service roads. Warni ng Signs City Manager Griggs advised that "dip signs" had been placed on Marlene Drive at Canyon Ridge Drive. (This was discussed at council meeting, May 26, 1970, Item X). Estimate: Layne Texas Company City Manager Griggs presented Estimate No. One, in the amount of $73,225.50 for work in connection with drilling, completing and testing Trinity Well on North Main Street, and recommended payment. Councilman Shull made the motion to concur with the recommendation of the City Manager and approve payment to Layne Texas Company in the amount of $73,225.50. Councilman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Shull, Copher and Wilcox and Mayor Pro Tem Douglass Nays: None Mayor Pro Tem Douglass declared the motion carried. ENGINEER'S REPORT Well Status VIII. North Main Street Site Mr. English, Consulting Engineer, report- ed that the North Main Street well should be pumping by Thursday, June 25, and the tank construction is proceeding as scheduled. In answer to a question, City Manager 69iggs stated t h a t use o f the North Main Street w e l l w i l l help in increasing the water pressure. 113 (Page Nine, Regular Meeting, Euless City Council, June 23, 1970) Menasco Site (Pipeline Road) Mr. English reported that a I I indications are the well will be in service within the next week. IX. ORDINANCE NO. 378: ADJUSTING WATER AND SEWER RATES (FIRST AND FINAL READING) City Manager Griggs presented Ordinance No. 378, adjusting water and sewer rates (amending sections of Ordinance No. 258). Councilman Wilcox made the motion to suspend the rule requiring two (2) separate readings of an Ordinance and approve Ordinance No. 378 on f i r s t and f n a I reading. Counc i man Shull seconded the motion and the vote i s as follows: Ayes: Councilmen Wilcox, Shull and Copher and Mayor Pro Tern Douglass Nays: None Mayor Pro Tern Douglass declared the motion carried. (Information and materials of water and sewer rates in neighboring cities had been presented to members of the Council and are on f i I e i n the Office of City Secretary as Council Exhibits). Councilman Shull stated that nonworking water meters are being changed as rapidly as possible and very few are functioning inadequately at this time. ADJOURNMENT X. The meeting adjourned at 9:25 P.
