M. i n the Council Chambers of Euless City Hall, with Mayor A. C. Krause presiding. Councilmen present are listed, as follows: Messrs. Frank E. Douglass, Dan L. Shull, Harold L. Copher and Don R. Warren. (Absent: Councilman J. Dwayne Wilcox) Also present were City Manager C. J. Griggs, City Attorney James A. Cribbs, Consulting Engineer W. R. APPROVAL CF MINUTES Minutes of the regular meeting, dated June 9, 1970, were approved as written. CONSIDERATION OF SEWAGE BACK -UP PROBLEMS Mr. Robert Montgomery, 1902 Mary Drive Mayor Krause recognized Mr. Robert Montgomery, who read a letter summarizing incidents of sewage problems at his residence at 1904 Mary Drive. (Copy of letter on file in Office of City Secretary.) Mr. Montgomery presented Members of the Council a copy of the letter, with attachments listed as follows: 116 (Base Two, Regular Meeting, Euless City Council, July 14, 1970) 1. Copy of a letter from City Manager Lee Cowell, dated June 23, 1966 2. Copy of a letter from Floyd West and Company, dated June 25, 1970 3. Copy of the Water Superintendent's report on the latest incident, which occurred on June 13, 1970 4. Copy of the claim filed with the City as the result of the latest incident, dated June 19, 1970 (received by City Secretary, June 22, 1970) (Copy of each on f i l e with Council Exhibits, in Office of City Secretary) Mr. Montgomery stated that there are other homes in this general area which have had sewage back -up problems. Mr. Montgomery advised that, in 1966, he had been assured by the Mayor and Members of the Council that something would be done to prevent a recurrence, but nothing had been done, and he doesn't really expect this Council to do anything. In a discussion, it was determined that Mr. Montgomery was advised by the City of Euless in 1966 that an over -flow valve would be installed in his yard, if a sewer line clean -out is provided by Mr. Montgomery. The Council was informed that City crews were unable to locate the clean -out fo lowing the most recent incident and Mrs. Montgomery was advised that a clean -out is necessary before an over -flow valve can be installed. Mrs Montgomery stated that she would have a plumber install a clean -out and notify the City. In reply to a question from the_ City Attorney, Mr. Montgomery stated that the clean -out has not been'installed. Councilman Shull stated that he was not serving on the City Council in 1966, and he would I i ke to have the opportunity to check into this problem. Mayor Krause directed that action be taken, as follows: 1. Consulting Engineer Bill Ratliff is to check into this matter very thoroughly, and make a recommendation for solving the problem, 2. City Attorney James Cribbs is to check into the legal technicalities of this case, and 3. The City Manager is to check on the Insurance Company's procedure for handling claims. These reports are to be submitted by each at the next regular council meet i ng . (Page Three, Regular Meeting, Euless City Council, July 14, 1970) Mr. William J. Weiland, 1808 Sagebrush Mr. William J. Weiland, 1808 Sagebrush, recognized by the Mayor, stated that he has experienced sewage problems at his residence -- that the over -flow valve does assist in the prevention of sewage getting into his house; however, the waste from the main sewer line accumulates in his backyard and he has to clean it up, which is not very pleasant. Mr. Weiland stated that he does not want to get an attorney to represent him because he has been told that it is impossible to sue the City because of governmental immunity; however, he does appeal to the City to do anything possible to remedy this problem. Mayor Krause instructed Messrs. Ratliff, Cribbs and Griggs to take action on Mr. Weiland's problem as instructed in Mr. Montgomery's case. REPORT ON SEWER INVESTIGATION AT 1115 CRANE. MR. BILL RATLIFF Mr. B i l l Ratliff presented a letter dated July 9, 1970, reporting on the Consulting Engineers' investigation of the sewer problems at 1115 Crane (previously discussed at the May 2E and June 9, 1970 Council Meetings). Mr. Ratliff advised that personnel from his staff have talked with several people in this neighborhood and the trouble seems to be in this general area. He stated that his firm recommends construction of a manhole-in the area. Councilman Shull made the motion to concur with the recommendation of the Consulting Engineer and install a manhole at the location. Councilman Copher seconded the motion, and the vote is as follows: Ayes: Councilmen Shull, Copher, Douglass and Warren Nays: None Mayor Krause declared the motion carried. (Copy of Engineer's letter, dated July 9, 1970 on file in Office of City Secretary, as Council Exhibit) DISCUSSION OF DRAINAGE PROBLEM AT 300 TRAILWOOD Mr. B i I I Ratliff presented a letter 117 118 (Page Four, Regular Meeting, Euless City Council, July 14, 1970) i dated July 9, 1970 to Members of the Council, reporting on his. investi- gation of the drainage problem at 300 Trai lwodd. Councilman Copher commented that he is of the opinion there is a need for a larger inlet on Trailwood. Mr. Ratliff advised that another inlet might help the situation. City Manager Griggs recommended depress- ing the lip of the gutter at the two storm sewer inlets lo4cated south of 300 Trailwood, and cleaning of the outfall end of the pipe. Members of the Council were in agree- ment with the City Manager's recommendation, and he was instructed to advise the residents, Mr. and Mrs. Knott, of the, Counci l.'s decision. SECOND AND FINAL READING OF ORDINANCE NO. 379, REZONING LOT 17, BLOCK 1 AND LOTS 17 THROUGH 31, BLOCK 2, SOTOGRANDE NO. 2, FROM "R -2" TWO- FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT (PROPERTY LOCATED ON EAST SIDE OF EL CAM I NO REAL) (ZONING CASE NO. 203) Councilman Douglass moved to approve Ordinance No. 379 on Second and Final Reading, rezoning Lot 17, Block 1, and Lots 17 through 31, Block 2, Sotogrande No. 2, from "R -2" Two - Family Dwelling District to "PD" Planned Development. Councilman Shull seconded the motion, and the vote i s as follows: Ayes: Councilmen Douglass, Shull, Copher and Wareen Nays: None Mayor Krause declared the motion carried. Mr. Ratliff reported that a team of men from his firm entered the storm drains in question and made a thorough investigation of the interior -- that they found no restriction in the pipes or inlets; however, some channel restriction was found at the discharge point, which could be causing a reduction in storm drain capacity. Mr. Ratliff stated, further, that he had reviewed plans and design criteria used for this storm drain, which conforms to accepted municipal storm drain design methods. Councilman Copher commented that he is of the opinion there is a need for a larger inlet on Trailwood. Mr. Ratliff advised that another inlet might help the situation. A. CASH AND T. JASPER SURVEYS - ZONING CASE NO. 204) Councilman Douglass moved to concur with the recommendation of the Planning and Zoning Commission and approve Fi rst Reading of an ordinance rezoning property located i n T. A. Cash and T. Jasper Surveys, as follows: 4.4 acres from "R -1" Single Family Dwell- ing District to "C -2" Community Business District and 6.18 acres to "R -3" Multiple Family Dwelling District, with conditions subsequent, as follows: A. A final site development plan shall be submitted to the City Council within 18 months following final passage of the ordinance effecting the requested changes. B. Construction in substantial compliance with the final site development plan as approved shall be commenced within 24 months following final passage of the ordinance effecting the requested changes. C. FIELD SURVEY FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT AND 7.717 ACRES FROM "R -1" 10 "R -3" MULTIPLE FAMILY DWELLING DISTRICT. (PROPERTY LOCATED AT SOUTFNVEST CORNER OF NORTH MAIN AND GLADE ROAD. APPROVAL OF REVISION OF LOTS 23R AND 24R, BLOCK 17, MORRISDALE ESTATES, SECTION TWO, SECOND FILING Members of the Council reviewed the plat indicating the proposed revision in size of -Lots 23R'and 24R, Block 17, Morrisdale Estates, Section Two, Second Fi 1 ing,'and it was pointed out that the Planning and Zoning Commission had recommended approval of the revision, as requested. Councilman Shull moved to concur with the recommendation of the Planning and Zoning Commission and approve the revision of Lots 23R and 24R, Block 17, Morrisdale Estates, Section Two, Second Filing, contingent upon receipt of the certificate of ownership. Councilman Douglass seconded the motion, and the vote is as follows: Ayes: Councilmen Shull, Dougl'ass, Copher and Warren Nays: None Mayor Krause declared the motion carried. VIII. CONSULTING ENGINEER'§ REPORT Status of Contract with Chicago Bridge and Iron M r . B i l l Ratliff advised that the first materials for construction of the overhead water storage tank will be moved onto the site on North Main later i n the week. Status of Layne Texas Company Drilling Contract Mr. Ratliff reported that the test pump was placed on the well on North Main Street at 6 :00 P.M. on this date, and the work on the Meaasco well is completed, and ready for testing. 121 (Pape Seven, Regular Meeting, Euless City Council, July 14, 1970) IX. SELECTION OF PAINT AND LETTERING FOR OVERHEAD WATER STORAGE TANK AT NORTH MAIN WELL SITE Councilman Shull advised that he has been contacted by several local civic organizations, interested in printing 'Nome of the Trinity Trojans" on the overhead water storage tank, at their expense. Councilman Shull advised that they would like to know the cost for such a project. M r . Ratliff reported t h a t there w i l l be l e t t e r i n g in three ( 3 ) places on the tank, and he w i l l inquire concern- ing the cost. Members of the Council discussed colors which might be used for the tank and lettering. The City Manager recommended that the tank be painted white, w i t h red l e t t e r s and black shadows around a l l of the lettering. The Council was in agreement with this recommendation. The Consulting Engineer was instructed to obtain a cost estimate for the lettering. COUNCIL AUTHORIZATION TO PROCEED WITH S I TE PLANNI NG AND SPEC I FI CATI ONS FCR ADDITION OF ONE TRINITY WELL TO THE WATERWORKS SYSTEM City Manager Griggs reported that he and Mr. B i I I Ratliff have examined several sites for an additional Trinity well, and he requests the Council's authorization to proceed with investigating and negotiating for a site for a Trinity well. Mr. Griggs reported that this well would also have a 350,000 gallon storage tank. Councilman Shull made the motion that the City Manager and Consulting Engineer be authorized to proceed with the location of a site for a Ti -inity well and storage tank and present recommenda- tions to the City Council. Councilman Copher seconded the motion, and the vote i,s as follows: Ayes: Councilmen Shull, Copher, Douglass and Warren f Nays: None Mayor Krause declared the motion carried. 122 (Page Eight, Regular Meeting, Euless City. APPROVAL OF ORDINANCE NO. 380 " ON FIRST AND FINAL READING., AUTHORIZING AN AGREEMENT BETWEEN CITY OF EULESS AND TEXAS HIGHWAY DEPARTMENT FOR S I GNAL I ZAT I ON AT F.M. 157 AND HARWOOD An ordinance, authorizing execution of an agreement to exist between the City of Euless and the Texas Highway Department, was presented for Council's consideration. It was determined that a flashing yellow light on F.M. 157 and a flashing red light on Harwood are proposed by the Highway Department. Members of the Council expressed concern that the light might not be seen by persons traveling South on F.M. 157 because o f the h i l l at this location. City Manager Griggs advised members of the c o u n c i l t h a t these w i l l be hanging signals, easily seen from a distance. Councilman Douglass moved to waive the regulation requiring that an ordinance be read on two separate occasions and approve Ordinance No. 380 on First and Final Reading. Councilman Warren seconded the motion, and the vote is as follows: Ayes: Councilmen Douglass, Warren, Shull and Copher Nays: None Mayor Krause declared the motion carried. CONSIDERATION CF ,PLANNING AND ZONING COMMISSION'S RECOMMENDATIONS CONCERNING DENSITY REQUIREMENTS FCR MULTIPLE FAMILY DWELL I NG D I STR I CTS City Manager Griggs advised that the Planning and Zoning Commission recommends that Zoning Ordinance No. 347 be amended as follows: 1 to include "R -4" and "R -5" zoning classifications, restricting apartment density for each category to the following: "R -3" not to exceed ten (10) units per net developable acre "R -4" not to exceed fourteen (14) units per net developable acre "R -5" not to exceed eighteen (18) units per net developable acre, 2. that acreage presently zoned "R -3" be re- classified as "R -51', effective this date, and any apartments constructed within "C -1" and "C -2" Zoning Districts also fall under the restrictions of "R -5" zoning. 123 (Pape Nine, Regular Meeting, Euless City Council, July 14, 1970) Councilman Douglass inquired as to how this recanmendation compares with density requirements in the City of Hurst, stating that he would like to be able to visualize a complex which meets these requirements before voting on this matter. The City Manager recommended t h a t Members of the City Council review the recommendations presented by Planning and Zoning Commission and make recommendations of ,their own. Councilman Shull asked if the existing apartment density requirements in the City of Euless could be presented to Members of the Council, so that a study could be made. The City Manager advised that this information will be transmitted to Members of the Council within a few days. Members of the Council were in agreement that each member should make a recanmendation at thelnext council meeting. The City Attorney advised that recommenda- tions from the City Council must be submitted to the Planning and Zoning Commission and i t w i l l be necessary to hold a public hearing, in order to amend the ordinance. XIII. CONSIDER APPOINTMENT 10 PLANNING AND ZONING COMMISSION, UNEXPIRED TERM OF MR. JACK NOWNE, RESIGNED Members of bhe City Counc i.l . accepted the resignation of Mr. Jack Browne from membership of the Planning and Zoning Commission and agreed adequate time should be given to consider someone to fill this vacancy. Mayor Krause advised t h a t this vacancy w i l l be filled at the next regular meeting of the City Council. The City Secretary was instructed to write Mr. Browne, expressing the Council's appreciation for his services as a member of the Planning and Zoning Commission. XIV. ASSIGNMENT OF PROJECTS TO COUNCILMEN BY MAYOR KRAUSE Mayor Krause advised that, in his opinion, more work can be accomplished by the Council through the assign- ment of various projects to specific Councilmen. The Mayor made assign- ments, as follows; 11 i (Page Ten, Regular Meeting, Euless City Council, July 14, 1970) Councilman Dan Shull - Water Study (future well sites f and consultation with Mr. B i I I Ratliff on Cedar Creek Lake water supply). Councilman Wi Icox - Make recommendations on the disposal of solid waste and location of a garbage dump (sanitary land f ill). Councilman Douglass - Work with the Park and Recreation Committee on present and future projects. (Doctor Warren left the council room, in response to a telephone call.) Councilman Copher - Find a location to be used for a Youth Center. Councilman Copher suggested that persons interested in the Youth Center contact him or the City Secretary. Mayor Krause commented that he would also be available to take calls on this subject. Mayor Krause stated that, from time to time, he would continue to assign various projects to Members of the Council, in an effort to provide Euless' citizens with the best possible services. Xv. SUGGESTIONS FROM COUNCILMAN DOUGLASS Councilman Douglass stated that at the recent Mayor and Commissioners' Institute in Austin, he was very impress- ed with services offered by other cities and requests the Council's consideration of the following: 1. Installation of tape recorders in police cars, which w i l l enable the officer to tape the pertinent facts in a case, and the Officer's report can be typed from the tape at City Hall, thus saving time for the Officers. 2. Providing Neighborhood Dumps, which would be large dumpsters placed throughout sections of the City for collection of grass cuttings, tree limbs and things of this nature. It would be the City's responsibility to maintain these dumpsters. Councilman Douglass also suggested that the use of a camera in sewer lines might be advantageous to the City; however, a camera for this purpose is very expensive, and he would suggest that several cities might participate in the purchase of this camera. 125 (Page Eleven, Regular Meeting, Euless City Council, July 14, 197 0) Councilman Shull commented a camera for this purpose can be rented, and possibly would be less expensive than purchasing one. Members of the Council agreed that this . item should be given consideration by the Northeast Cities Advisory Council and, perhaps, the area cities might want to participate in'the purchase of such a camera. Counc'ilman Douglass also recommended that the Council consider placing utilities underground in all future developments. Members of the Council agreed these suggestions should be referred to the City Manager for discuss i- ac;.with the proper departments, and the Planning and Zoning Commission should be advised of the desirability of placing utilities underground in the future. (Councilman Warren returned to the Council Room) XVI. REPORT FROM ENGINEER CONCERNING CONSTRUCT10N OF PEBBLE CREEK BRIDGE AND PIPELINE ROAD PROJECT Mr. Ratliff informed the Council he had been advised that the City of Bedford is considering paying additional cost above that presently contracted and asking the City of Euless to add two other barrels to the Pebble Creek Bridge, as previously discussed. He also advised that the Contractor i s ready to proceed with pipe and inlet work on Pipeline Road, and he recommends the Council's approval of this portion of the project. Rat iffIs recommendation. Members of the Council concurred with Mr. XVII. MR. TOM GENZEL - CONCERNING FENCE AT ROYAL TERRACE APARTMENTS Mayor Krause recognized Mr. Tom Genzel, who stated that several meetings ago he had requested that the City take necessary steps for repairing and painting the fence which separates the Royal Terrace Apartments and his property, located at 312 Martha. Mr. Genzel stated that the weeds are at least eighteen (18) inches high on the apartment side of the fence, and the debris i n the area could be a health problem. 126 (Page Twelve, Regular Meeting, Euless City Council, July 14, 1970) The City Attorney explained to Mr. Genzel that the City cannot force a person or developer to paint a fence; however, the City does have an ordinance to control health problems, if one exists, The City Manager was instructed to investi- gate the status of this work to have been performed by the owner of the apartments, and the City Secretary was instructed to write Mr. Genzel, advising him of the City's investigation. APPROVED: Mayor The City Manager advised Mr. Genzel that, immediately after his request at the April 28, 1970 meeting, the Owner of the apartment complex was contacted, and stated he would make the necessary repairs to the fence as soon as possible if it is determined repairs are needed. Mr. Griggs also stated that the City Secretary tried on several occasions to contact Mr. Genzel to advise him of the action taken by the City in this matter. The City Manager was instructed to investi- gate the status of this work to have been performed by the owner of the apartments, and the City Secretary was instructed to write Mr. Genzel, advising him of the City's investigation.
