Regular Meeting
Euless City Council
January 12, 1971
CALL TO ORDER
The regular meeting of the Euless City
Council was called to order at 8:05 P. M. in the Council Chambers of
the Euless City Hall, with Mayor A. C. Krause presiding. Councilmen
present were Messrs. Frank Douglass, Dan Shull, Dwayne Wi 1cox,and
Don Warren.
Mayor Krause announced that Councilman
Harold Copher i s i n Tennessee due to the serious illness of his mother.
Also present were City Manager C. J.
Griggs, City Attorney James Cribbs, Consulting Engineer William R.
Rat] iff and City Secretary Vada Ferris.
VISITORS
Visitors i n attendance are listed as
follows: Messrs. W. B. Matney and E. W. Berry, representing Humble
0 i I & Refining Company; Jim Hannah, representing Texas Power & Light
Company; Hugh Waite; R. V. Trammell, representing Metro Engineering
and Surveying Inc.; Lawrence Scoma; Mike Allen; Norman Harper;

INVOCATION
The invocation was presented by
Councilman Frank Douglass.
APPROVAL CF MINUTES
Minutes of the regular meeting dated
December 22, 1970, were approved as written.
CONSIDER PRELIMINARY PLAT - LAKEWOOD ADDITION
70 ACRES LOCATED VyEST CF OAKLAND ESTATES AND
NORTH CF GREEN HILLS PARK NO. 6) - MR. MIKE
ALLEN. REPRESENTING KEN GOOD AND ASSOCIATES
Mayor Krause recognized Mr. Mike Allen,
who presented and reviewed the preliminary plat of the Lakewood
Addition. Mr. Allen stated he had consulted with Mr. B i I I Ratliff,
City Engineer and intends to follow the City's policy for improvements.

Mr. Ratl iff's letter dated January 11,
1971, was presented, stating these recommendations are presented after
several meetings with Mr. Allen. (Copy of letter on f i I e as Council
Exhibit in Office of City Secretary.)
KAr. Allen commented on the funds escrowed
w i t h the C i t y by Janann, I n c . , f o r Green H i l l s Park No. 6, stating that
he requests the City apply these funds to street and drainage improvements
i n the area. He commented that h is f i r m w i I I bear the excess of the
cost after the City applies the funds for the street and drainage improve-
ments.
Councilman Warren inquired about the abandoned
right -of -way. City Attorney Cribbs stated that Mr. Allen w i I I be furnished
forms for the adjacent property owners to sign in order for the road
to be closed; that this must be done by Ordinance. Mr. Cribbs stated
that Mr. Allen should understand that if this street is not closed,
at some later date, property owners on both sides of the street can
be assessed f o r improvements. I t was pointed out the C i t y w i l l not
have to pay for these street improvements.
Mr. Allen stated the School District
has agreed to pay for one -half of the street.
Councilman Wilcox made a motion to
approve the preliminary plat, subject to owner furnishing documents for
abandonment of the Cummings Road right -of -way and require compliance
w i t h City p o l i c y f o r a l l improvements.
Councilman Shull seconded the motion
and t h e vote is as f o I ows :
Ayes: Counc Imen Wilcox, Shull, Warren and Douglass
Nays: None
Mayor Krause declared the motion carried.
Mr. Ratliff stated he recommends paving
escrow funds be used as far as possible and the Developer bear the rest
of the expense.
Mr. Allen stated that the School
District is interested in discussing the proposed School and park
site with the City. Mr. Griggs stated this matter w i I I be considered
by the Park and Recreation Committee at their regular meeting Monday
night January 18.

CONSIDER APPEAL CF MR. KENNETH C. WHITELEY, ATTORNEY,
REPRESENTING MR, GARY GILES, BUILDER, REQUESTING THAT
THE SIDEWALK REQUIREMENTS BE WAIVED AS IT APPLIED TO
CERTAIN LOTS IN THE SOTO GRANDE SUBDIVISION, (SINGLE
FAMILY LOTS IN THE VEST SIDE CF THE ADDITION)
Mayor Krause announced this item is
tabled until the next regular Council meeting, January 26, 1971, at
the request of Mr. Kenneth Whiteley.
CONSIDER REQUEST FOR FINAL PLAT APPROVAL - LANCE ADDITION,
LANCE, INC., WILLIS E. ROYAL, ASSISTANT VICE PRESIDENT.
(PROPERTY LOCATED ON PIPELINE ROAD SOUTH, AND 496 FEET
EAST CF RAIDER DRIVE.) (PLAT BY METRO ENGINEERING AND
SURVEYING COMPANY)
Mayor Krause recognized Mr. Wi 1 1 i s
Royal, who reviewed the plat previously presented to members of the
Counci 1.
City Manager Griggs stated that the
area is properly zoned and the Planning and Zoning Commission
recommends approval of the request.
Councilman Warren made a motion to
concur with the recommendations of the Planning and Zoning Commission
and approve the request as submitted.
Councilman Wilcox seconded the motion
and the vote is as follows:
Ayes: Councilmen Warren, Wilcox, Shull and Douglass
Nays: None
Mayor Krause declared the motion-carried.

CONSIDER REQUEST FOR FINAL PLAT APPROVAL - B & B ADDITION
G & C PROPERTIES, INC. (PROPERTY LOCATED ON NORTH SIDE OF
HIGHWAY 183 - 1500 FEET EAST CF HIGHWAY 157.) (PLAT BY
CARL SMITH ENGINEERING)
Mayor Krause recognized Mr. Jim Lemons,
representing G & C Properties, who reviewed the plat previously presented
to the Council. I t was noted that Park Drive i s not a dedicated street.

Councilman Warren made a motion to concur
with the Planning and Zoning Commission and approve the final plat, a5
submitted.
Counc Iman Douglass seconded the motion
and the vote is as follows:
Ayes: Councilmen Warren, Doug ass, Wilcox and Shull
Nays: None
Mayor Krause declared the motion carried.

CONSIDER BIDS RECEIVED BY MR. WALTER ELLIOTT, ENGINEER,
FOR WATER AND SEWER EXTENSIONS TO SERVE EULESS SQUARE.
(PROPERTY LOCATED AT S.H. 183 AND RAIDER DRIVE) (BID
TIME: MONDAY, JANUARY 11, 1971, 11:30 A.M., CITY HALL.)
Mayor Krause announced this item is
tabled until the next regular meeting at the request of Mr. Walter
Elliott, Engineer of this project.
VI.
CONSIDER BIDS ON HIGH VELOCITY SEWER
CLEANING MACHIKE
Members of the Council had been
presented tabulation of the bids received and opened at City Hall on
January 8, 1971.
City Manager Griggs presented a resume
of the machines included in the bid and recommended the Council consider
accepting the bid submitted by F. E. Myers & Brother, in the amount
of $8,419.75, terms are 2°j, net thirty (30) days.
Councilman Shull made a motion to concur
with the recommendation of the City Manager.
Councilman Douglass seconded the motion
and the vote i s as follows:
Ayes: Councilmen Shull, Douglass, Warren and Wilcox
Nays: None
Mayor Krause declared the motion carried.

CITY ATTORNEY'S REPORT
STATUS OF PROPERTY PURCHASE AT CIVIC CENTER SITE
City Attorney Cribbs informed the Council
that negotiations to purchase the property at 116 Sheppard Drive are
finalizing, which w i I I be an addition to the present Civic Center Complex.
He stated that City Manager Griggs had stated the City will pay cash for
the property in the amount of $13,113.00, Mr. Cribbs stated that plans
to final the purchase are scheduled for Thursday, January 14, 1971.
Councilman Shull made a motion to approve
plans for purchase of 116 Sheppard Drive as presented by City Attorney Cribbs.
Councilman Warren seconded the motion and
the vote is as follows:
Ayes: Councilmen Shull Warren, Wilcox and Douglass
Nays: None
Mayor Krause declared the motion carried.

RESOLUTION NO. 268: CALLING PUBLIC HEARING:
ZONING CASE 206, REQUEST OF MR. FRANK E.
CRUMLEY FCR REZONING ALONG PROPOSED WESTPARK
WAY. (PROPERTY LOCATED NORTH OF PIPELINE ROAD)
Councilman Douglass made a motion
approving Resolution No. 268, calling a Public Hearing: Zoning Case
206, request of Mr. Frank E. Crubley for rezoning along proposed
Westpark Way. (Property located North of Pipeline Road)
Councilman Wilcox seconded the motion
and the vote is as follows:
Ayes: Councilmen Douglass, Wilcox, Warren and Shull
Nays: None
Mayor Krause declared the motion carried.
IX.
RESOLUTION NO. 269: CALLING REGULAR CITY
ELECTION FCR THE PURPOSE CF ELECTING A
MAYOR, COUNCILMAN PLACE 2 AND COUNCILMAN
PLACE
Councilman Douglass made a motion
approving Resolution No. 269, cal 1 ing a Regular City Election for
the purpose of electing a Mayor, Councilman Place 2 and Councilman
Place 4.

Councilman Warren seconded the motion
and the vote is as follows:
Ayes: Councilmen Douglass, Warren, Shull and Wi Icox

Mayor Krause declared the motion carried.
X.
OBSCENE LITERATURE
Mayor Krause instructed the City
Attorney to prepare an Ordinance prohibiting Obscene and "Smut"
Literature to be displayed or sold in the City of Euless.

SIDEWALKS
Councilman Warren requested a study
of movement patterns near the Euless schools. He stated he thinks
this information would help determine if sidewalks are necessary, and
if it would be feasible to include sidewalks in future bond programs.
XII.
COUNCIL OF GOVERNMENT'S MEETING
Mayor Krause announced the Counci 1 of
Government's meeting for Wednesday, January 20, 1971, with Senator
John Tower as speaker. He requested those planning to attend to
advise the City Secretary by Friday, January 15, 1971.
CITY ENGINEER'S REPORT
King
TROJAN TRAIL
Mr. Ratliff reported that Austin
Road Company, contractor, has begun construction of Trojan Trail
(formerly Municipal Way).
XIV.
APPRECIATION CF MAYOR KRAUSE
Mr. John Jones expressed appreciation
for the accomplishments of Mayor Krause during his two year term as
Mayor.

MR. JAMES WADDLE CONCERNING
POLICY OF STRAY DOGS
Mayor Krause recognized Mr. Waddle,
who stated his dog had been shot by a City employee and he requests
explanation of the City's policy concerning stray dogs and shooting
dogs.
Mayor Krause stated City Ordinance
prohibits dogs running at large and fire arms are not to be used in a
r e s i d e n t i a l area. He stated t h a t a t r a n q u i l i z e r gun w i l l be used in
animal control.
Mayor Krause expressed apology to
Mr. Waddle for the shooting of his dog, advising that such an incident
w i l l not occur again, as the Animal Control personnel w i l l not carry
fire arms in the future.
Mr. Waddle stated that a veterinary
b i l l had been incurred by him for treatment of his dog.
City Attorney Cribbs explained the
Charter procedure f o r f i l i n g a claim, and that City employees cannot
obligate the City or accept a claim - a claim must be filed with the
City Secretary, as set forth in the City Charter.
Mr. Jones stated that he had been
cited for permitting his dog to run at large, and he did not think
an injustice occurred; that it was his fault - he had been in
violation of the law.
XVI.
UNSIGHTLY APPROACHES
I N COMMERCIAL AREAS
Mayor Krause recognized Mr. Hugh Waite
who commented he is of the opinion that commercial areas should be
required to have curb and gutter as required in residential areas.
He mentioned Harwood Road, F. M. 157, and Ector near Highway 183.
Mr. Waite was advised that these
areas are scheduled for improvement in the near future.
