M. in the Council Chambers of the Euless City Hall, with Mayor A. C. Krause presiding. Councilmen present were Messrs. Frank Douglass, Dan Shull, Dwayne Wilcox, and Harold Copher. (Absent was Councilman Don Warren.) Also present were City Manager C. J. Griggs, City Attorney James Cribbs, Consulting Engineer William R. Ratliff and City Secretary Vada Ferris. VISITORS .Visitors in attendance are listed as follows: Messrs. Troy M. Fuller, Morton Rachofsky, Bobby C. Henson, Hugh Waite, Wayne W i dner, Lloyd R. Cook, Larry Scoma, Ed Sizemore, Bud Hale, Ray McCord, Bill Sumner, Frank E. Crumley, Gordon Swift, and David D. Arnold; Mesdms. APPROVAL OF MINUTES Minutes of the regular meeting dated January 26, 1971, were approved as written. PUBLIC HEARING: ZONING CASE NO. 206 REQUEST CF MR. FRANK CRUMLEY FCR REZONING 38 ACRES (PROPERTY LOCATED VEST CF TIMBERLINE ESTATES TO WEST CITY LIMITS AND ABUTTING WESTPARK WAY) Mayor Krause opened the Public Hearing and recognized Mr. Gordon Swift, representing Mr. Crumley. Mr. Swift reviewed a plat of the area and stated that Mr. Crumley requests rezoning, as follows: Tract 1 , from "R -1" Single Fam.i ly Dwelling District, to "R -4" r Multiple Family Dwelling District, Tract �2, from "R -1" Single Family Dwelling District, to "R -3" j Multiple Family Dwelling District, and L - Tract 3, from "R -1" Single Family Dwelling District, to "C -1" Neighborhood Business District. N (Pape Two, Minutes of Regular Meeting, Euless City Council, February 9, 1971) It was pointed out that the original request was revised at the Planning and Zoning Commission Public Hearing on January 5, 1971, ara'd the Planning and Zoning Commission recommends approval. -- Some concern was expressed about the right -of -way on Westpark Way from Pipeline Road north, and City Manager Griggs was instructed to advise the Council of the right -of -way at the next Council meeting. Mayor Krause inquired if there were opponents or proponents in this case, There being none, Mayor Krause declared the Public Hearing closed and advised Mr. Swift this case would be considered at the next regularly scheduled Council meeting. FIRST READING - ORIDNANCE REZONING PART C1= TRACT C, MUNICIPAL SERVICE COMPANY CF TEXAS SUBDIVISION, FROM "C -1" NEIGHBORHOOD BUSINESS DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT, WITH A SPECIFIC USE PERMIT FCR A METAL STRUCTURE FCR COVERED PARKING AND FCR OUTSIDE STORAGE TO BE USED FCR SOUTHWESTERN BELL TELEPHONE COMPANY SERVICE CENTER. (PROPERTY LOCATED AT NORTHEAST CORNER CF HIMES AND FULLER DRIVE.) (PUBLIC HEARING HELD JANUARY 26, 1971.) (ZONING CASE NO. 207) Councilman Shull made a motion to concur with the recommendation of th.e Planning and Zoning Commission and approve the rezoning as requested. Councilman Wilcox seconded the motion and the vote is as follows: Ayes: Councilmen Shull, Wilcox and Douglass Nays: Councilman Copher Mayor Krause declared the motion carried. Councilman Copher stated that he is of the opinion that the owner of the property should be aware of the possibility of extending Trojan Trail to North Main Street and should plan the construc- tion of the building accordingly. ORDINANCE NO. 392: SECOND AND FINAL READING. PROHIBITING OBSCENE LITERATURE Councilman Wilcox made a motion to approve second and final reading of Ordinance No. 392. City Manager Griggs stated that he recommends acceptance of the low bid submitted by Hyden Stiles, G. M. C. Councilman Shull made a motion to concur with the recommendation of the City Manager. CITY ATTORNEY'S REPORT V. AGREEMENT FCR ENGINEERING SERVICES CF BEDFORD - EULESS WATER PROJECT City Attorney James Cribbs stated he had reviewed the proposed agreement submitted by Knowlton - Ratliff - English - Collins, and recommends the Council accept the agreement. . Councilman Douglass made the motion to concur with the recommendation of the City Attorney and approve the agreement, as submitted. Councilman Wilcox seconded the motion and the vote is as 'follows: Ayes: Councilmen Douglass, Wilcox, Shull and Gopher Nays: None Mayor Krause declared the motion carried. FIRST READING - ORDINANCE CREATING JOINT AIRPORT ZONING BOARD FCR REG I ONAL A I RPORT City Attorney Cribbs stated he had reviewed the proposed Ordinance and suggests a few minor changes in wording - that he recommends the Council approve first reading of the Ordinance, pending action of other area cities. Councilman Copher made a motion to concur with the recommendation of the City Attorney and approve the fi rst reading of the proposed Ordinance. Councilman Douglass seconded the motion and the vote i s as follows: Ayes: Councilmen Copher, Douglass, Shull and Wilcox Nays: None ,-i Mayor Krause declared the motion carried. Mayor Krause reminded the Council to consider two persons to be appointed to this Board. 5 (Page Five, Minutes of Regular Meeting, Euless City Council, February 9, Jg71) VI. COUNCILMAN WILCOX REPORT ON FEBRUARY 4, 1971 MEETING CF NORTHEAST CITIES ADVISORY COUNCIL Councilman Wilcox stated that building codes had been discussed at the February 4th Northeast Cities Advisory Council Meeting and the member cities are asked their opinion for pursuing this project. Members of the Council were in agreement that the Northeast Cities Advisory Council should continue their work on Building Codes. VI I MAYOR KRAUSE REPORTS ON RECOMMENCATION CF THE TEXAS WATER QUALITY BOARD FOR IMPROVEMENTS TO THE CITY'S SEWAGE TREATMENT PLANTS Mayor Krause commented on the recent recommendations from Texas Water Quality Board for improvements to the City's sewage treatment plants. He stated that the City Engineer has outlined the improvements and Councilman Dan Shull is supervising the labor for the project. Mayor Krause stated that City officials cannot draw a salary or be paid for duties performed, but Councilman Shull agreed to secure local contractors for the improvements, without compensation for himself. Councilman Shull stated he has local contractors on the job, working seven (7) days weekly. Mayor Krause stated that every effort i s being made to correct the ineffectiveness of the I i ft stations and keep them operative until the Trinity River Authority lines are completed, at which time the City w i I I close the lift stations and sewage w i l l be routed by the Trinity River Authority line. Mayor Krause expressed appreciation to Councilman Shull for his time and efforts in attempting to correct the existing problems at the sewage treatment plants. The Mayor also announced that he and several of the Councilmen and City Engineer plan to attend the February 25th hearing of the Texas Water Quality Board in Austin in an attempt to show what the City of Euless is doing to correct the sewage treatment problems. ►Vile HEAVY TRUCK TRAFFIC ON NORTH AND SOUTH MAIN STREET Councilman Douglass expressed concern of the heavy truck traffic on North and South Main, stating the trucks traveling to the Regional Airport, heavily loaded, w i I I cause serious damage to the street. 6 (Page Six. Minutes of Regular Meeting, Euless City Council, February 9, 1A71) Members of the Council agreed the City Manager should present a recommendation to the Council. IX. CENSUS FIGURES Councilman Douglass inquired about official census figures, stating that he had recently observed final figures. City Manager Griggs stated the City had not been officially notified. The Council agreed the City Manager should obtain the official count and submit a report to the Council. X. BENEFITS FROM MEMBERSHIP IN THE COUNCIL CF GOVERNMENTS PLANNING COMMISSION Councilman Douglass requested the City Manager presen't a report to the Council of the benefits derived from Membership in the Council of Governments Planning Commission. Members of the Council concurred with Councilman Douglass' request. X1. ! I PIPELINE ROAD IMPROVEMENTS Councilman Wilcox stated that at noon, today,; paving of Pipe] ine Road was underway. XII. REQUEST FOR SPECIFIC LOCATION CF PROPERTIES - PLANNING AND ZONING MINUTES Councilman Copher requested that the Planning and Zoning Commission Minutes detail specific location of property, as well as surveys, in order for members of the Council to visit the property in question before the Council hearing. SOLID WASTE DISPOSAL Councilman Copher informed the Council he knows of a place that might be suitable for solid waste disposal. Mayor Krause requested that Councilman Copher investigate the area in question, cost of a bulldozer and other pertinent items relative to disposing of solid waste and present his report to the Council. 7 (Page Seven, Minutes of Regular Meeting, Euless City Council, February 9, 197)) XIV. PLAN PROFILE AND BASIC GRADE - NORTH MAIN STREET Councilman Copher made a motion to authorize the City Engineer to prepare a plan and profile for future paving of North Main Street from Harwood Road, extending North of L i tt I e Bear Creek. Councilman Douglass seconded the motion and the vote i s as follows: Ayes: Councilmen Copher, Douglass, Shull and Wilcox Nays: None Mayor Krause declared the motion carried. Xv. CITIZENS COMPLAINTS: GARBAGE, DISPOSAL AND SEWER CHARGES Mr. Sizemore stated he i s paying $50.00 a month for garbage disposal services under the present City policy and he could take care of the garbage himself for about seventy -five cents (750 - He also stated that a I I of his garbage is not picked up at the Chicken Hut; that he has more than w i I I go in the container and the portion placed beside the container is left by the hauler. Others who stated they wanted to haul their own garbage or use someone other that the City's franchised hauler were: Mr. Bud Hale, Mr. Ray McCord, and Mr. Van Brown. Councilman Wilcox stated that a Committee is presently working on an Ordinance which, hopefully, w i I I resolve some of the problems which seem to have arisen from the new garbage disposal procedure. He stated that he is hopeful this w i I I be finalized soon and requests the citizens patience u nti I that time. City Manager Griggs was instructed to investigate charges for garbage disposal at Mr. Sizemore's place of business. Mr. Sizemore also stated that charges for sewer services, at his car wash locations, are very high. City Manager Griggs was instructed to investigate the sewer charges at these locations. Mayor Krause recognized Mr. Ed Sizemore, who stated that he and several other citizens, wish to know why they cannot haul their own garbage - why they must have garbage disposal services as required by the City - and why they are "threatened" that water services to their establishments will be discontinued if they do not pay the garbage bill. Ratliff stated he had investigated the complaint of Mr. Hugh Waite concerning the dumping of waste materials on and near the Somerset Addition from the Trojan Trail construction project and was advised by the project superintendent that these materials were not dumped in the area mentioned by Mr. Waste. the matter further.
