RESOLUTION NO. 277. SETTING DATE FOR PUBLIC HEARING ON ZONING CASE NO. 211, REQUEST CF MR. HARRY B. HUNS I CKER FOR REZONING 6.4 ACRES IN THE T. A. CASH SURVEY, FFZCM ''R -5" MULTIPLE FAMILY DV\aLING DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT. (PROPERTY EAST CF THE WEST CITY LIMITS) Councilman Copher made a motion to approve Resolution No. 277, setting July 13, 1971, as the date for Pub] is Hearing on Zoning Case No. 211. Councilman Wilcox seconded the motion, and the vote i s as follows: Ayes: Councilmen Copher, Wilcox and Douglass Nays: None Mayor Krause declared the motion carried. 79 The regular meeting of the Euless City Council was called to order at 8 :.10 P. M., in the Council Chambers of Euless City Hall, with Mayor A. C. Krause presiding. Councilmen present are listed as f o l lows: Messrs. Frank Douglass, J. Dwayne Wilcox, and' Harol d Copher. Councilman Don R. Warren arrived later in the evening. (Councilman Dan Shull was absent because of an illness requiring him to be hospitalized.) Also present were City Manager C. J. II. RESOLUTION NO. 278, SETTING DATE FOR PUBLIC HEARING ON I ZONING CASE NO. 212, REQUEST OF MR. CLAUDE R. MCCLENNAHAN FOR REZONING 63.13 ACRES IN THE J. E. FIELD SURVEY,FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO THE FOLLOWING: 9.47 ACRES - "R -3" M DENSITY MULTIPLE FAMILY DWELLING DISTRICT, 8.63 ACRES - "R -3" LOW DENSITY MULTIPLE FAMILY DWELLING DISTRICT, 1.2 ACRES - "C -2" COMMUNITY BUSINESS DISTRICT. 16.64 ACRES - "C -1" NEIGHBORHOOD BUSINESS DISTRICT, 18.93 ACRES - "R -5" HIGH DENSITY MULTIPLE FAMILY DWELLING DISTRICT AND 8.26 ACRES - "R -4" MEDIUM DENSITY MULTIPLE FAMILY DWELLING DISTRICT. Councilman Douglass made a motion to approve Resolution No. 278, setting July 27, 1971, as the date for the Public Hearing on Zoning Case No. 212. Councilman Wilcox seconded the motion, and the vote is as follows: Ayes : Councilmen Douglass, Wilcox and Copher Nays: None Mayor Krause declared the motion carried. RESOLUTION NO. 279, AUTHORIZING APPLICATION FCR A GRANT TO ASSIST IN CONSTRUCTION CF BOYD BRANCH PARALLELING SANITARY SEWER. City Manager Griggs stated that the City Engineers are prepared to make application for a grant to assist in.the construction of Boyd Branch Paralleling Sanitary Sewer, when authorization is received from the City Counc "i 1 Councilman Wit cox made a motion to approve Resolution No. 279, authorizing the Engineers to submit an application for a grant to assist in construction of the Boyd Branch Paralleling Sanitary Sewer. Councilman Douglass seconded the motion, and the vote i s as follows: Ayes: Councilmen Wilcox, Douglass and Copher Nays: None Mayor Krause declat -ed the motion carried. The Crty�Manager advised that Boyd Branch is located in the East, Southeast part of the City and runs through the East Sewage Treatment Plant and behind Del Paso Apartments. He reported that the Engineers advised that the Federal Grant coup possibly be 55 % part icipation in the project, if the application is approved. Councilman Wit cox made a motion to approve Resolution No. 279, authorizing the Engineers to submit an application for a grant to assist in construction of the Boyd Branch Paralleling Sanitary Sewer. REPORT ON WASTE DISPOSAL SURVEY AND DECISION REGARDING TYPE OF SERVICE Mayor Krause requested the City Secretary to report on the ballots tabulated from the Mayor's Newsletter on Waste Disposal Methods. The City Secretary reported, as follows: As of June 8, 1971, the following i s a current count of the garbage survey: 1. Curb and Plastic Bags - $2.00 356 total 2. Curb and Cans o r Bags - $2.50 977 t o t a l 3. Side -of -House - Cans or Bags - $5.00 57 total 1390 TOTAL Members of the Council agreed that, as a result of the Mayor's Newsletter, the method for waste disposal service now being used will remain in effect, with the use of curbside pickup in cans or bags. The Mayor instructed Councilmen W-i lcox and Copher to meet with Mr. McCaffity of Tarrant County Waste Disposal C'ompany and proceed with p ans for extra pickup service of items not included in the regular pickup Councilman Wilcox stated that he would contact Members of the Committee who had worked on the garbage disposal problems and set a meeting date for discussion with Mr.McCaff]ty. V. CITY ENGINEER'S REPORT: NEGOTIATIONS WITH TARRANT COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. ONE FCR PURCHASE OF RAW WATER Mr. B i I I Rat] iff reported that the City of Euless is scheduled'to meet with Tarrant County Water Control and Improve - ment District No. One on June 22, 1.971., to discuss the'possibility of Euless entering into agreement with the District through the Trinity River Authority to obtain water. Mr. Ratliff reported that the Engineers are very optimistic at this time, and if the Water Control District approves this request, it is possible the Cities of Euless and Bedford will hold ratifying elections in the near future. V1. REPORT ON YOUTH ETC., COUNCILMAN HAROLD COPHER Councilman Copher reported that remodeling of the building located at 134 Sheppard Drive, which is to be used as a Teen Center, is progressing, and the Grand Opening is scheduled for June 18, 1971. MUNICIPAL COURT JUDGESHIP Councilman Douglass stated that the City Cauncil received a letter of resignation from Mr. Gordon Morrison, who has served as Municipal Court Judge for several years. Councilman Douglass advised that he and other members of the Council recognize the long and distinguised service of Mr. Morrison to the City and citizens of Euless, as Municipal Court Judge, and appreciate his services in this City function. Councilman Douglass moved to accept the resignation of Mr. Gordon Morrison as Municipal Court Judge and appoint the Alternate, Mr. Bruce Ebert, to serve as Judge of the Municipal Court. Councilman Copher seconded the motion, and the vote is as follows: Ayes: Councilmen Douglass and Copher Nays: Councilman Wilcox Councilman Wilcox stated that he appreciates Judge Morrison very much, and the services he has rendered to the City of Euless, therefore, tie would have to vote negatively. Mayor Krause announced the motion did not carry. (See Item IX.) DISCUSSION OF PROPOSED EXCHANGE OF WEST EULESS PARK FOR 26 ACRE SITE BOUNDED BY TIMBERLINE ESTATES ON THE EAST AND WESTPARK WAY ON THE WEST Mayor Krause recognized Mr. Joe Thompson, who inquired of the City's consideration of the petition presented at the last City Council meeting request ing the Counci 11's action on exchanging the twenty (20) acre site knaNn as West Euless Park for the twenty -six (26) acre site presently owned by Mr. Frank Crumley. a letter from Mr. Crumley the City for the sum of $ Mr. Crumley's letter does have been verbal requests property. He stated that should be given an opportunity to have a Mayor Karuse stated that the City Manager and City Engineer have been instructed to meet with Mr. Crumley and discuss possible negotiations in this matter. IX. RESIGNATION OF MUNICIPAL COURT JUDGE AND APPOINTMENT CF REPLACEMENT Councilman Douglass stated that, with the arrival of another member of the Council, he requests further considera- tion of the resignation of the Municipal Court Judge, which was previously discussed, because the resignation was submitted approximately three weeks ago, and he is of the opinion consideration should be given at this time. Councilman Douglass made a motion to accept the resignation of Mr. Gordon Morrison as Municipal Court Judge and to elevate Mr. Bruce Ebert from the position as Alternate Judge. Councilman Copher seconded the motion, aril the vote is as follows: Ayes: Councilmen Douglass, Copher and Warren Nays: Councilman Wi 1 cox Mayor Krause declared the motion carried. X.
