Other members pre- sent are listed, as follows: Councilmen Harold Copher, Dan Shull, Don R. Warren and J. Dwayne Wi,lcox. (Absent'was Mayor A. C. Krause.) Also present were City Manager C. J. Griggs, C i t y Attorney James Cribbs, C i t y Engineer B i l l Ratliff, Public Works Director John Bayuk and City Secretary Vada Ferris. Ratliff, . APPROVAL OF MINUTES Minutes of the regular meeting dated August 10, 1971, were approved as written. CONSIDERATION OF ZONING CASE NO. 212, REQUEST CF MR. CLAUDE R. MCCLENNAHAN FOR REZONING 63.13 ACRES IN J.E. FIELD SURVEY, ABSTRACT 540, (PROPERTY LOCATED AT SOUTHWEST CORNER OF NORTH MAIN STREET AND GLADE ROAD) (PUBLIC HEARING DATE: JULY 27, 1971) Councilman Shull advised that he would not participate in this case because of a personal interest. He left the Council table at this time. Mayor Pro tem Douglass requested City Engineer B i l l Ratliff to explain the request of Mr. Claude R. McClennahan for a Planned Development in Zoning Case 212. 111 112 (Page Two, Minutes of Regular Meeting, Euless City Council, Auqust 24, 1971) Mr. Ratliff stated that, as instructed by the City Council, he had discussed this case with the owner's representa- tives to ascertain if a planned development approach might be used to good advantage in providing the City with the controls which the Council indicated might be essential. ' V. Aubrey 'Hal lum, representing Mr. a drawing of the developmelit which proposed for Planned Development. Messrs. Ran Holman, Selser Pickett and McClennahan, were present and presented designated the portion of the property The City Attorney informed the Council that he had reviewed documents which are standard copies of bylaws governing greenbelts and although these particular documents are not completely ap- plicable, they can be modified to control the greenbelt section of this development. The City Attorney stated that documents covering maintenance of the greenbelt in this development should be signed and recorded, to re- lieve the City of any responsibility -for maintenance of the greenbelt. Mr. Pickett stated that this development w i l l be a f i r s t class project and t h e greenbelt w i l l be maintained by the developer until such time as 90% of the property is sold, at which time a home owners' organization w i l l take over the maintenance of the g.reenbel t. Mr. Pickett advised that since these homes wi I I range from $30,000 to $50,000 he is of the opinion the home owners would not be neglectful of maintaining the greenbelt as a beautiful area. He stated further that the developers agree to dedicate the portions of GladeRoad and Main Street as requested by the City, and to meet all requirements as set for -th -in -the City Engineer's letter dated August 19.1971. Councilman Wilcox moved to approve the request for rezoning as presented in the plat, providing signed documents covering maintenance of the greenbelt are prepared to meet the City Attorney's recommendation and recorded. Councilman Warren seconded- the motion, and the vote is as follows: Ayes: Mayor Pro tem Douglass, Councilmen Warren, Wilcox and Copher Nays: None Mayor Pro tem Douglass declared the motion carried. FINAL READING CF ORDINANCE No. 4o8, PROVIDING FOR PARTICIPATION IN SUPPLEMENTAL DISABILITY BENEFITS FUND OF THE TEXAS MUNICIPAL RETIREMENT SYSTEM Councilman Wilcox moved to approve Second and Final Reading of Ordinance No. 408, Councilman Copher seconded the motion, and the vote is as follows: Ayes: Mayor Pro tem Douglass, Councilmen Wilcox, Copher and Shull Nays: None Mayor Pro tem Douglass declared the motion carried. (Councilman Warren was absent from the room during discussion of this item.) SPECIAL USE PERMIT FOR MOBILE HOME ON PROPERTY OF MRS. DOROTHY EDGE Mayor Pro tem Douglass recognized Mrs. Dorothy Edge, who stated she lives on approximately twenty -five (25) acres at 2800 West Euless Boulevard (S.H.183) -- that, she is requesting a special use permit allowing a mobile home to be located on her property to house a couple to serve as caretakers. She stated that her husband is in the hospital and she needs this couple to live on her property especially to discourage vandalism. In reply to questions directed to Mrs. Edge, she stated that her husband w i I I probably be confined to the hospital from ten (10) to twelve (12) months -- that she leases the property on which she resides -- that the owner of the property does not object to placement of a mobile home at this location -- that she needs the permit for at least a year. Councilman Warren moved to approve Mrs. EdgeAs request 'and grant the special use permit. Councilman Wilcox stated he is in sympathy with Mrs. Edge; however, he is concerned that permitting a mobile home to be placed on this property would be setting a precedent. The City Attorney suggested that this matter be tabled to allow Mrs. Edge time to obtain a letter from the doctor, advising that her husband w i I I probably be in the hospital for another year, and a letter from the property owner, advising that he does not object to the locating of a mobile home on these grounds. Mrs. Edge stated that the mobile home would be located behind the house, among some trees, and would not be seen 114 (Page Four, Minutes of Regular Meeting, Euless City Council, August 24, 1971) from the highway -- that time is most important in this case, as the couple she has engaged to serve as caretakers must make arrangements for moving from their premises in Burleson, Texas. Councilman Warren, stated he f e e l s t h i s is a case where a special use permit should be granted. The City Attorney advised that the City Council cannot l e g a l l y waive an ordinance, which i s what they w i l l be doing if they approve this special use,permit. Councilman Warren Withdrew his motion for approval. Councilman Shull made a motion to approve a special use permit for a mobile home to be located at 2800 West Euless Boulevard for a period of one year, from September 1, 1971, to September 1, 1972, subject to the following provisions: 1. a letter is furnished from the doctor, stating that Mrs. Edge's husband w i l l be in the hospital from ten to twelve months, and 2. a letter is furnished from the property owner, stating that he does not object to placement of a mobile'home on his property, and 3.. the letters (Item 1 and 2) are submitted to the Office of the City Secretary no later than September 1, 1971, and 4. Mrs. Edge agt-ees to remove the mobile home from the property immediately upon notice of suit against the City for allowing the mobile home to be placed on her property. Councilman Copher seconded the motion, and the vote is as follows: Ayes: Councilmen Shull, Copher, Warren and Wilcox Nays: Mayor Pro tem Douglass Mayor Pro tem Douglass declared the motion carried, stating that he could not vote for something that would be in violation of a City Ordinance. ,.. IV. all : 11 [may_1:71►Ce3I■1.111Biel: I M: 'O:7 FISCAL YEAR FRCM OCTOBER 1, 1971 THROUGH SEPTEMBER 30, 1972 FIRST AND FINAL READING OF ORDINANCE No. 409, ADOPTING BUDGET FOR FISCAL YEAR 1971 -72 Public Hearing Mayor Pro tem Douglass opened the Public Hearing on the 1971 -72 Budget. 0 (Page Five, Minutes of Regular Meeting, Euless City Council, August 24, 1971) City Manager Griggs explained that the Budget is in line with programs as specified by the City Council -- that the major expenditure is for debt service, however, there is no ad valorem tax t ncrease. Mayor Pro tem Douglass inquired if there were opponents or proponents to the proposed Budget. Mr. George Barrowcl iff was recognized. He inquired if the Library portion of the Budget includes the $1200.00 for the summer programs in the elementary schools recently approved by the City Council . Mr. Barrowcl i f f was informed' off i rma- t ivel y, • and he stated that he was a proponent for the Budget. There were no opponents, and Mayor Pro tem Douglass declared the Public Hearing closed. Ordinance No. 409 Councilman Shull made a motion to waive the requirement that an ordinance be read at two separate council meetings and approve Ordinance No. 409, adopting the Budget for the Fiscal Year 1971 -72 on First and Final Reading. Councilman Wilcox seconded the motion, and the vote is as follows: Ayes: Mayor Pro tem Douglass, Councilmen Shull, Wilcox, Copher and Warren Nays: None Mayor Pro tem Douglass declared the motion carried. V RESOLUTION NO. 285, SETTING' SEPTEMBER 14, 1971 AS DATE FOR PUBLIC HEARING ON ZONING CASE 214 REQUEST OF MR. H.H. FULLER FOR REZONING 1.42 ACRES' I N A. J. HUITT SURVEY. ABSTRACT 709, FROM "111-1" TO "C -2" (PROPERTY LO- CATED ON EAST SIDE CF MAIN STREET, APPROXIMATELY 300 FEET SOUTH OF S.H 183) Councilman Copher made a motion to approve Resolution No. 285, setting September 14, 1971, as the date for Public Hear- ing on Zoning Case No. 214. VI. APPROVAL OF AUTHORIZATION TO GRANT EASEMENTS AND RIGHTS-OF -WAY TO TRINITY RIVER AUTHORITY City Manager Griggs presented easements and right -of -way documents requested by Trinity River Authority for the in- stallation,of the West Fork Sanitary Sewer across City Property. Mr. Griggs stated he recommend approval of these documents. Councilman Copher made a motion to concur with the recommendation of the City Manager and approve easement and right - of -way documents for the West Fork Sanitary Sewer Project. Councilman Shull seconded the motion, and the vote i s as follows: Ayes: Mayor Pro tern Douglass, Councilmen Copher, Shull, Warren. .and W i 1 cox Nays: None Mayor Pro tern Douglass declared the motion carried. VI 1. ACCEPTANCE OF RESIGNATION OF MR. BILL TENCH FROM MEMBERSHIP OF PLANNING AND ZONING COMMISSION Mayor Pro tern Douglass announced that a letter of resignation from Mr. B i I I Tench, who has served as a member of the Planning and Zoning Commission for several years, has been received by the City Offices. Councilman Wit cox moved to accept 'Mr. Tench's resignation and that a letter for the Councilmen's signatures be presented to Mr. Tench expressing appreciation for his loyal service to the City as a member of the Planning and Zoning Commission. (Page Seven, Minutes of Regular Meeting, Euless City Council, August 24, 1971) STATUS REPORTS, CITY ENGINEER T Standpipe on Central Drive Mr. B i I I Rat] iff reported that work has begun on the standpipe located on Central Drive. Well and Booster Pump Staion No. Six Mr. Rat] iff reported that work on the well and Booster Pump Staion No. Six Project is virtually complete -- that the well is pumping water at 1100 gallons per minute, which w i I I have to be reduced to approximately 800 gallons per minute.. RN DISCUSSION: BOYD BRANCH PARALLELING SEWER LINE Councilman Shull a,s,ked what progress is being made for the fifteen (15) inch sewer line. The City Manager explained that the City is in the process of securing easements, also that as soon as the City re= ceives approval from Austin, they w i I I be i n a position to take bids. X. CITIZEN'S REPORT OF FLOODING CONDITIONS RESULTING FROM PIPELINE ROAD IMPROVEMENTS Mayor Pro tem Douglass recognized Mr. J. T. Heflin, who resides at 2953 Pipeline Road. The City Manager and City Engineer were instructed to check into this matter to determine the problem and to resolve same. icy Mr. Heflin stated that during the past few weeks his yard has been flooded several times -- that his garden and yard have been washed out -- that, fortunately, water did not get in his house -- that apparently this has occurred due to the reconstruction of Pipeline Road, as this has not occurred previously.
