M. in the Council Chambers of Euless City Hall, with Mayor Pro Tern Dwayne Wilcox presiding. Members present were Councilmen Harold Copher, Harold Samuels, B i I I Dunn, and Darrel Benson. (Absent was Mayor A. C. Krause.) Griggs, City Secretary Vada Ferris, City Engineer B i 11 Ratliff. VISITORS Also present were City Manager C. J. City Attorney Bob McFarland, and Visitors in attendance were Messrs. W. M. Calhoun, Jr., Jack Avinger, James Fleming, and Ed VanSant. MARSHALL (ZONING CASE NO. 223 - PUBLIC HEARING HELD MAY 23, 197 2) Councilman Samuels moved to approve second and final reading of Ordinance No. 426, with stipulations as follows: (1) thirty (30) foot setback. along the line of the existing res idences ; (2) fifteen (15) foot setback behind the apartment complex; and (3) preliminary site plan presented to City Council for approval. Councilman Dunn seconded the motion and the vote is as follows: Ayes: Councilmen Dunn, Benson, and Samuels, and Mayor Pro Tern Wilcox Nays: None Abstained: Councilman Copher Mayor Pro Tetra Wilcox declared the motion carried. 236 (Page Two, Minutes of Regular Meeting, Euless City Council, June 27, 1972) ORDINANCE NO. 427, SECOND AND FINAL READING - REZONING TRACT A, BLOCK 1, AND TRACT A, BLOCK 2, W I LSH I R E V 1 LLAGE, FRCM "R -5" MULTI - FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT DISTRICT, FOR OFFICE BUILDING AND RETAIL SHOPS. (PROPERTY LOCATED AT THE SOUTHEAST CORNER OF SPUR 350 AND WILSHIRE DRIVE). REQUEST OF VANTAGE PROPERTIES, INC., (ZONING CASE NO. 224 - PUBLIC HEARING HELD MAY 23, 1972) Councilman Copher moved to approve second and final reading of Ordinance No. 427 with the stipulation that the developers erect an eight (8) foot masonry fence, with a brick face, along the South and East boundaries of the property, with said brick face to be facing the single family residences. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Copher, Benson, Dunn, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tern Wilcox declared the motion carried. FIRST READING OF ORDINANCE, REQUEST OF CENTENNIAL HOMES, INC. FOR CHANGE OF ZONING DISTRICT, FROM "R -2" TVVO -FAMILY DWELLING DISTRICT AND "PD" PLANNED DEVELOPMENT FOR APARTMENTS TO "PD" PLANNED DEVELOPMENT FOR TOWNHOUSES. PROPERTY LOCATED ON TRACT C, LAKEWOOD ADDITION, WEST AND NORTH OF BOCOWOOD DRIVE AND WEST AND NORTH OF LAI0A00D ELEMENTARY SCHOOL (ZONING CASE NO. 225 - PUBLIC HEARING HELD JUNE 13, 1972) Councilman Dunn moved to concur with recommendations of the Planning and Zoning Commission and approve first reading of Ordinance with the following stipulations: (�) approve maintenance covenant with deletion of Section 3, Article XV as follows: "Section 3. Amendment to Plat: Notwithstanding any provision herein to the contrary, so long as Declarant shall own any Lot it shall have the unrestricted right, from time to time, without the consent, vote or approval of any Owner, Member, Associate or the Association to amend, alter, change, redefine, resubdivide and replat the size, location, configuration, layout and boundaries of any Lot or Lots; provided that the same not increase by more than ten percent (10 %) the total number of Lots in the Properties.'' and (2) Developer submit a maintenance covenant for drainage ditch to be approved by the City Manager and City Engineer. 237 (Pape Three, Minutes of Regular Meeting, Euless City Council, June 27, 1972) Councilman Samuels seconded the motion and the vote i s as follows: Ayes: Councilmen Dunn, Samuels, Copher, Benson, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. IV. CONSIDERATION OF RATE ADJUSTMENT REQUESTED BY THE LCNE STAR GAS COMPANY Councilman Samuels moved to take the rate adjustment request under advisement for further study. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Benson, Dunn, Copher, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tern Wilcox declared the motion carried. V. REPLAT OF DAY CARE CENTER, LOT A - PLAT SUBDIVIDING LOT A, DAY CARE CENTER PLAT, INTO LOTS A -1 AND A -2. (PROPERTY LOCATED BETWEEN DAVID DRIVE AND RAIDER DRIVE, 350 FEET NORTH OF NEEDLES STREET AND 580 FEET SOUTH OF PIPELINE ROAD). (PROPERTY ZONED C -2) Mr. Griggs advised the Council that the re- platting is requested in order to subdivide Lot A into Lots A -1 and A -2, to allow Messrs. Midgeley and Parker to obtain a building permit to construct a fourplex apartment unit on proposed Lot A -2. Councilman Copher moved to concur with the recommendation of the Planning and Zoning Commission and approve the replat as requested. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Benson, Dunn, Samuels, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. 238 (Page Four, Minutes of Regular Meeting, Euless City Council, June 27, 1972) CITY ENGINEER'S REPORT VI. Status of Swimming Pool Construction Mr. Ratliff reported that the major portion of the pool is complete, however, he cannot estimate a completion date. North Main Street Well Mr. Ratliff reported that the pump and cable are enroute for the well on far North Main Street. However, there is no water supply problem at this time. be resumed on this project soon. Ector Drive Construction Between SH 183 and Spur 350 Mr. Ratliff reported that work should DISCUSSION: TRAFFIC SIGNAL AT HARWOOD AND FM 157 Councilman Dunn expressed concern about the hazardous condition at FM 157 and Harwood Road. City Manager Griggs was instructed to arrange a meeting for Members of the Council with Mr. Crook of the Texas Highway Department. VIII. (Councilman Copher l e f t the meeting IX, RESOLUTION N0. 308 - REGIONAL LAW ENFORCEMENT COMMUNICATIONS City Manager Griggs reported that he and Chief Sustaire recommend approval of this resolution which authorizes the North Central Texas Council of Governments to solicit bids in connection with the Criminal Justice Grant for participation in the regional law enforcement communications system.
