Calhoun, Troy M. Fuller, James Henson, Danny Washmon, Hugh Waite, George Barrowcliff, and W. W. McCormick; Mrs. John Bayuk and Ms. Jan Nichols. INVOCATION The invocation was presented by Mayor Pro Tern Dwayne W i Icox. APPROVAL OF MINUTES Minutes of the Regular Meeting dated June 27, 1972, were approved as written. ORDINANCE N0. 428: SECOND AND FINAL READING: REZONING FFUM "R -2" TWO -FAMI LY DWELLING DISTRICT AND "PD" PLANNED DEVELOPMENT FOR APARTMENTS TO "PD" PLANNED DEVELOPMENT FOR TOWN HOUSES. PROPERTY LOCATED ON TRACT C, LAKEWOOD ADDITION, WEST AND NORTH OF BOCOWOOD DRIVE AND WEST AND NORTH OF LAKEWOOD ELEMENTARY SCHOOL, REQUESTED BY CENTENNIAL HOMES, INC. (ZONING CASE NO. 225 - PUBLIC HEARING HELD JUNE 13, 1972) Councilman Copher moved to approve second and final reading of Ordinance No. 428, with the following stipulations: (1) approve maintenance covenant with deletion of Section 3, Article XV as follows: The regular meeting of the Euless City Council was called to order at 8:00 P. M. in the Council Chambers of Euless City Hall, with Mayor Pro Tern Dwayne Wilcox presiding. Members present were Councilmen Harold Copher, Harold Samuels, B i I I Dunn, and Darrel Benson. (Absent was Mayor A. C. Krause.) Also present were City Manager C. J. Griggs, City Secretary Vada Ferris, City Attorney James Cribbs, and City Engineers B i I I Ratl iff and B i I I Flowers. Amendment to Plat: Notwithstanding any provision herein to the contrary, so long as Declarant shall own any Lot it shall have the unrestricted right, from time to time, without the consent, vote or approval of any Owner, Member, Associate or the Association to amend, alter, change, redefine, resubdivide and replat the size, location, configuration, layout and boundaries of any Lot or Lots; provided that the same not increase by more than ten percent (100%) the total number of Lots in the Properties.'' (2) Developer submit a maintenance covenant for drainage ditch to be approved by the City Manager and City Engineer. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Benson, Dunn, Samuels, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tern Wilcox declared the motion carried. CONSIDERATION OF RATE ADJUSTMENT REQUESTED BY THE LCNE STAR GAS COMPANY Councilman Dunn moved to postpone consideration of the rate adjustment request until the August 8, 1972 meet ing. Councilman Samuels seconded the motion and the vote is as follows: Ayes: Councilmen Dunn, Samuels, Copher, Benson, and Mayor Pro Tem Wi Icox Nays: None Mayor Pro Tern Wilcox declared the motion carried. ORDINANCE N0. 430: FIRST AND FINAL READING: APPROVING A RESOLUTION BY TRINITY RIVER AUTHORITY OF TEXAS AUTHORIZING THE ISSUANCE OF TRINITY RIVER AUTHORITY OF TEXAS REVENUE BONDS, SERIES 1972A, $1,200,000 Councilman Dunn moved to suspend the rule requiring two readings of Ordinances and approve Ordinance No. 430 on first and final reading. (Page Three, Minutes of Regular Meeting, Euless City Council., July 11, 1972) Councilman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Dunn, Copher, Benson, Samuels, and Mayor Pro Tern W i 1 cox Nays: None Mayor Pro Tern Wilcox declared the motion carried. IN ORDINANCE NO. 429: FIRST AND FINAL READING: DEFINING THE FREEWAY; RESTRICTING FREEWAYS TO USE OF MOTOR VEHICLES AND PROHIBITING USE THEREOF OF PEDESTRIANS, CYCLISTS AND OTHERS Councilman Samuels moved to suspend the rule requiring two Ordinance readings and approve Ordinance No. 429 on first and final reading. Councilman Dunn seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Dunn, Benson, Copher, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tern Wilcox declared the motion carried. V. RESOLUTION NO. 309: APPROVING AND ADOPTING ENGINEER'S ESTIMATE OF COST10F IMPROVING A PORTION OF HARWOOD ROAD, FROM,THE EAST PAVEMENT LINE OF FM 157 TO 125.2 FEET EAST CF THE EAST RIGHT - OFAAAY LINE OF ECTOR DRIVE; AND CALLING A PUBLIC HEARING Councilman Dunn moved to approve Resolution No. 309 setting August 8, 1972 as date for the Public Hearing. Councilman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Dunn, Copher, Benson, Samuels, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tern Wilcox declared the motion carried. V1. ENGINEER'S REPORT Resolution No. 310 authorizinq application for federal funds on extension of Cheek - Sparger Road 243- 244 (Page Four, Minutes of Regular Meeting, Euless City Council, July 11, 1972) Councilman Dunn moved to concur with the recommendation of the City Manager and approve Resolution No. 310. Councilman Benson seconded the motion and the vote i s as follows: Ayes: Councilmen Dunn, Benson, Copher, Samuels, and Mayor Pro Tern W i 1 cox Nays: None Mayor Pro Tern Wilcox declared the motion carried. Progress of Ector Drive Construction Mr. Ratliff stated that delay of paving was due to storm drain construction problems which were now resolved and construction should resume soon. North Main Street Well Mr. Ratl iff reported that the pump is back on the site and the well should be pumping water by July 12 even i ng. VII. TRAFFIC SIGNAL AT HARWOOD ROAD AND FM 157 .The Council concurred with a suggestion by Councilman Samuels that a meeting should be arranged with Mr. Crook of the Texas Highway Department, Mayor Krause, Councilman Dunn, and City Manager Griggs to discuss the hazardous condition at this intersection.
