M. in the Council Chambers of Euless City Hall, with Mayor Pro Tern Dwayne Wilcox presiding. Members present were Councilmen Harold Copher, Harold Samuels, and Darrel Benson. (Absent were Mayor A. C. Krause and Councilman B i I I Dunn.) Griggs, City Secretary Vada Ferris, City Engineer B i I I Ratliff. VISITORS Also present were City Manager C. J. City Attorney Bob McFarland, and INVOCATION The invocation was presented by City Engineer Bill Ratliff. APPROVAL CF MINUTES Minutes of the Regular Meeting dated July 11, 1972 were approved as written. PLAT APPROVAL: LAKEWOOD ADDITION - REQUEST CF CENTENNIAL CONSTRUCTION COMPANY FOR APPROVAL CF PLAT CF PLANNED DEVELOPMENT DISTRICT CF LAKEW30D ADDITION. (PROPERTY LOCATED NORTH AND VEST CF LAi EW30D ELEMENTARY SCHOOL) Members of the Council had been presented, previously, a plat of the Lakewood Addition for study and were presented, this evening, a letter from the City Engineer dated August 3. City Manager Griggs stated he recommends approval of the plat as presented, subject to compliance with the Engineer's letter, excerpt as follows: 1. As we mentioned in the preliminary review, the drainage course on the West edge of this addition is not intended to be improved in a manner that would allow City maintenance; and therefore, a perpetual maintenance agreement should be furnished, which would establish the responsibility for such maintenance with the Owner's group. In addition, the West bank of this drainage course is located on the Visitors in attendance are listed as follows: Messrs. Gene Welch, Walter A. Elliott, John C. Benson, Norman Harper, T. Thompson, James A. Evans, Alfonso Vega, G. W. Winter, Jr., D. L. Geary, Allen Duchasne, George Barrowcliff, W. W. McCormick, and Fred Stewart; Mesdms. James A. Evans, Victor A. Vt would recommend the addition of one valve on the 6 -inch line in Willow Lane where it intersects with the 12 -inch line at its North end. 3 . Sewer l i n e designated "H" has a distance between man- holes which we consider too great for proper maintenance and we would recommend an additional manhole located near the center of this line. Counciman Samuels moved to concur with the City Manager's recommendation and approve the plat as presented, subject to compliance with the Engineer's letter. Councilman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Copher, Benson, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. REPLAT OF BLOCK 45, MIDWAY PARK ADDITION - PLAT SUBDIVIDING BLOCK 45 INTO LOTS 2 AND 3, BLOCK 45, MIDWAY PARK ADDITION, (PROPERTY LOCATED ON SOUTH SIDE OF MIDWAY DRIVE AND THE WEST SIDE OF ECTOR DRIVE,) Mayor Pro Tern Wilcox recognized Mr. Walter W11 iott, representing Reverend Benson and the congregation of the United Pentacostal Church, who plan to locate their church on Lot 2. Replying to a question by Councilman Samuels, Reverend Benson stated that adequate parking facilities have been planned for future growth of the church. Councilman Copher moved to approve the plat as presented. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Benson, Samuels, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tern Wilcox declared the motion carried. (Page Three, Minutes of Regular Meeting, Euless City Council, August 8, 1972) PUBLIC HEARING: IMPROVEMENTS FOR A PORTION OF HARWOOD ROAD FROM THE EAST PAVEMENT LINE OF STATE HIGHWAY 157 TO 125.2 FEET EAST OF THE EAST RIGHT -OF -WAY LINE OF ECTOR DRIVE Mayor Pro Tern Wilcox opened the Public Hearing and recognized Mr. Evans, 1012 Fayette, who inquired why his property should be assessed. It was explained that all property abutting improvements of this nature can be and, usually, are assessed. Councilman Samuels reviewed the assessment roll, individually, with Mr. Evans and several others. There were no further questions from opponents or proponents. Mayor Pro Tern Wilcox declared the Public Hearing closed. ORDINANCE N0. 431: CLOSING PUBLIC HEARING AND LEVYING ASSESSMENT Councilman Copher moved to suspend the requirement for two readings of the Ordinance and approve Ordinance No. 431 on first and final reading. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Benson, Samuels, and Mayor Pro Tern Wilcox -- Nays: None Mayor Pro Tem Wilcox declared the motion carried. IV. REQUEST OF MR. DAVID GEARY - REGARDING THE TRAFFIC SIGNAL LIGHT AT THE INTERSECTION OF F. M. 157 AND HARWOOD ROAD Mayor Pro Tern Wilcox recognized Mr. David Geary, who stated he represents 300 parents who are concerned about students crossing Highway 157 at Harwood Road to reach the new Harwood Road Junior High School in Bedford, scheduled to open in a few weeks. He stated that the flashing light located at this intersection presently is inadequate to permit students, walking, riding bicycles or driving cars to safely cross Highway 157 and he requested the Council's immediate persuit for installation of a better traffic signal. He stated that until a traffic signal is install- ed, he requests that stop signs be placed on Highway 157 and the speed I i m i t reduced, especially traffic from Grapevine; also, during the first few weeks, place a Police officer at this intersection to assist students crossing Highway 157• Mayor Pro Tern Wilcox explained that the City cannot place stop signs on Highway 157, which is the jurisdiction of the Texas Highway Department; also, that attempts are being made to meet with Mr. Crook, Texas Highway Department District Engineer, who has been i I I_ However, a meeting seems imminent in the next week or two, at which time several members of the Council and the City Manager w i I I continue their efforts, with the Texas Highway Department, to improve the traffic signal at this location. E (Pape Four, Minutes of Regular Meeting, Euless City Council, August 8, 1972) Mr. George Winter inquired if a signed petition requesting a traffic signal might help, and was advised by Mayor Pro Tem Wilcox that the City has good relations with the Texas Highway Department. However, a petition might help emphasize the matter. City Manager Griggs stated that the City has requested lowering the speed l i m i t . However, after a Texas Highway Department survey, the City was advised reducing the speed I i m i t on Highway 157 was not warranted. for his presentation. Mayor Pro Tem Wilcox thanked Mr. Geary a EXTENSION OF TEMPORARY PERMIT GRANTED TO MRS. DOROTHY EDGE Mrs. Dorothy Edge requested an extension of a temporary permit for quarters for caretakers at 2800 W. Euless Blvd. (Permit to expire September 1, 1972.) Councilman Samuels stated he had reviewed the Council minutes dated August 24, 1971, Item III, and several stipulations were attached to the temporary permit. He was advised that those stipula- tions also apply to the extension of the permit. Councilman Copher moved to approve the extension of the temporary permit for one year, with stipulations as follows: 1. a letter is furnished from the doctor, stating that Mrs. Edge's husband w i I I be in the hospital from ten to twelve months, and 2. a letter is furnished from the property owner, stating that he does not object to placement of a mobile home on his property, and 3. the letters (Item 1 and 2) are submitted to the Office of the City Secretary no later than September 1, 1972, and 4, Mrs. Edge agrees to remove the mobile home from the property immediately upon notice of suit against the City for allowing the mobile home to be placed on her property. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Benson, Samuels, and Mayor Pro Tem Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. (Temporary permit extension to expire September 1, 1973.) (Page Five, Minutes of Regular Meeting, Euless City Council, August 8, 1972) VI. ORDINANCE NUMBERS 323, 368, AND 404 - CONDITIONS SUBSEQUENT EXTENDED (REQUESTED BY MESSRS. A. H. PETERSON AND HARRY HUNSICKER) Mayor Pro Tem Wilcox recognized Mr. Gene Welch, representing Messrs. Peterson and Hunsicker, who explained that the owners had purchased three tracts of land at different times, each rezoned by a different ordinance on different dates resulting in different expiration dates of conditions subsequent. He stated that circumstances beyond their control prompts this request for extension of conditions subsequent. He stated Mr. Hunsicker had presented a letter dated July 14, 1972 requesting the extension as follows: Site Plan - 27 August 1973 Commence Construction - 27 February 1974 Substantially Completed - 27 February 1975 Councilman Samuels moved to approve the request for extension of conditions subsequent, as requested, for Ordinance numbers 323, 368, and 404, with common expiration dates as follows: Site Plan - 27 August 1973 Commence Construction - 27 February 1974 -- Substantially Completed - 27 February 1975 Councilman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Copher, Benson, and Mayor Pro Tem Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. VII. RATE ADJUSTMENT REQUESTED BY LCNE STAR GAS COMPANY Mayor Pro Tem Wilcox announced this item is tabled pending receipt of the decision of the Railroad Commission in the Lewisville -- Lone Star Gas Company Case. VIII. PURCHASE OF CLOSED CIRCUIT TELEVISION FOR MONITORING POLICE DEPARTMENT City Manager Griggs stated that he recommends the Council approve the purchase of this equipment from Concord Communications Systems, Arlington, in the amount of $5,671.95 which is funded as follows: Texas Criminal Justice Council $4,253.96 City $1,417.99 (Page Six, Minutes of Regular Meetinq, Euless City Council, August 8, 1972) He stated this equipment is recommended and approved by the Criminal Justice Counc i 1. Councilman Samuels moved to concur with the recommendation of the City Manager and approve the purchase of closed circuit television equipment in the amount of $5,671.95. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Benson, Copher, and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. BOYD BRANCH PARALLELING SANITARY SEWER BID Mr. B i I I Ratliff presented a letter recommending that a contract be awarded to Feazell Construction Company in the amount of $253,433.50, subject to approval of the Texas Water Quality Board and the Environmental Protection Agency, because Federal Funds are --� to be used in this project. (Bids were opened at Euless City Hall, August 2, 1972 and a copy of tabulation of bids are on f i le as Council Exhibits in the Office of the City Secretary.) Counc i man Benson moved to concur with the recommendation of the City Engineer.
