CALL TO ORDER

The regular meeting of the Euless City
Council was called to order at 8:05 P. M. in the Council Chambers of Euless
City Hall, with Mayor A. C. Krause presiding. Members present were Councilmen
Harold Copher, B i l l Dunn, Darrel Benson, and Dwayne Wilcox. (Absent was
Councilman Harold Samuels.)
Also present were City Manager C. J.
Griggs, City Secretary Vada Ferris, City Attorneys James Cribbs and Dixon
Holman, and C i t y Engineer B i l l Ratliff.
VISITORS
Visitors in attendance are listed as
follows: Messrs. C. M. Swadley, W. R. Campbell, C. G. Ferrell, R. J. Ozebek,
G. W. Winter, Jr., William R. Olds, Charles Belew, Thomas P. Ligon, John M.
Duhon, Earl L. Holcomb, Bobby G. Black, Michael R. Allen, S. R. Valentino,

The invocation was presented by
Councilman Darrel Benson.
APPROVAL OF MINUTES
The min rtes of the regular meeting
dated September 12, 1972 were approved as written.
PUBLIC HEARING: AMERICAN DIVERSIFIED PROPERTIES, INC.
REQUEST FCR CHANGE CF ZONING DISTRICT, FROM "R -1"
SINGLE FAMI LY DVVELLING DISTRICT 10 "C -2" COMMUNITY
BUSINESS DISTRICT. (PROPERTY LOCATED SOUTH OF
S.H. 183 AND EAST CF CULLUM DRIVE)
Mayor Krause recognized M r . B i l l
Campbell, who informed the Council that the applicant in this case requests
a postponement of the Public Hearing to allow time to prepare a more detailed
plan. Also, the applicant requests a council directive that the plan be
presented to the Planning and Zoning Commission.
City Attorney Cribbs stated that all
property owners will have to be notified of the Public Hearing date and
notice wi l l again be published in the newspaper, at the expense of the
applicant.

Mr. Campbell agreed to bear this expense.
Councilman Dunn moved to concur with the
request of American Diversified Properties, Inc. to postpone the Public
Hearing and refer this case to the Planning and Zoning Commission.
Councilman Benson seconded the motion
and the vote is as follows:
Ayes = Counci !men Dunn, Benson, and W i !cox
Nays: None
Abstained: Councilman Copher
Mayor Krause declared the motion carried.
CERTIFICATE OF OCCUPANCY:
MRS. VIOLET BROOME MILLER,
,318 NORTH INDUSTRIAL BLVD.
Mayor Krause recognized Mrs. Violet
Broome M i l l e r and M r . B i l l Meier. Mrs. Miller explained she is requesting
a Certificate of Occupancy to operate a real estate office at 318 North
Industrial Blvd.
The Council had been advised by a
Council Communication from the City Manager that:
Mrs. Violet Broome Miller was refused a Certificate of Occupancy
for a business to be.located in the frame residence at 318 North
Industrial Boulevard (FM 157) for the following reasons:
1. Sewer service is not available to the property, and
no plans were submitted for extension.
2 The water line is inadequate for commercial develop-
ment. (Plans and assurance for improvement were not
submitted by applicant.)
3. Ingress, egress and parking facilities do not comply
with the City's present standards and no guarantee
of correction was offered.
M r . B i l l Meier stated that it is not
feasible at this point for his client to bring this property up to sub-
division standards; however, she is agreeable to pay her pro rata portion
of improvements when the property is developed.
City Manager Griggs stated that he can
appreciate the plea of Mrs. Miller and Mr. Meier, but, in this case, q
Certificate of Occupancy cannot be granted administratively and the
City Attorney has stated that the Council cannot violate its own rules.

Councilman Dunn inquired if the Council
can legally grant this Certificate of Occupancy; that he is concerned about
setting a precedent and upgrading the subdivision.
Replying to a question, Mr. Meier stated
his client is agreeable to a time limit on the Certificate of Occupancy.
Councilman Wilcox moved to approve
a Certificate of Occupancy for twelve (12) months at 318 North Industrial.
Councilman Dunn seconded the motion
and the vote is as follows:
Ayes: Councilmen Wilcox, Dunn, Benson, and Copher
Nays: None
Mayor Krause declared the motion carried.
III.
PERMANENT ZONING OF PROPERTY PRESENTLY ZONED ON CONDITIONS
SUBSEQUENT BY ORDINANCE NO. 333 - REQUEST CF AUBRY G. GOOD
FCR PERMANENT ZONING ON 13.25 ACRES LOCATED AT THE NORTI -MEST
CORNER OF NORTH MAIN STREET AND HARWOOD ROAD
Mayor Krause recognized Mr. Sellers,
who, representing Mr. Aubrey G. Good, stated that Mr. Good requests permanent
zoning of this property and plans development of a portion of the property within
the next two years. He stated that the zoning is suitable to development of this
property.
Councilman Dunn moved to concur with the
recommendation of the Planning and Zoning Commission and approve the request
for permanent zoning of the property conditionally zoned by Ordinance No. 333.
Councilman Benson seconded the zoning
and the vote is as follows:
Ayes: Councilmen Dunn; Benson, Copher, and Wilcox
Nays: None
Mayor Krause .declared the motion carried.
IV.
EXTENSION OF TIME ON ZONING ORDINANCE NO. 395 - REQUEST OF
THE UN I VEST CORPCR AT I ON FOR EXTENSION OF TIME ON ZONING
ORDINANCE NO. 395. (PROPERTY LOCATED WEST OF WESTPARK
WAY AND NORTH OF WEST PIPELINE ROAD)
Mayor Krause recognized Mr. Mike Allen,
who advised the Council he purchased this property in July and his firm,
Univest Corporation, requests a twenty -four (24) month extension of time
allowed for development of this property conditionally zoned in Ordinance
No. 395. M r . A l l e n stated t h a t h i s f i r m w i l l dedicate the right -of -way
for Pipe] ine Road improvements.

Councilman Wilcox made a motion as
follows:
(1) Concur with the.Planning and Zoning Commission
and approve a twenty -four (24) months extension of
Conditions Subsequent in Ordinance No. 395;
(2) Univest furnish field notes for dedication of
right -of -way on Pipeline Road.
Councilman Benson seconded the motion
and the vote is as follows:
Ayes: Councilmen Wilcox, Benson, Copher, and Dunn
Nays: None
Mayor Krause declared the motion carried.
V.
FIRST READING: ORDINANCE REZONING APPROXIMATELY 65.4045 ACRES I N
THE A. BRADFORD SURVEY, ABSTRACT 152, FROM "R -1" SINGLE FAMILY
DWELLING DISTRICT TO "I-1" LIGHT INDUSTRIAL DISTRICT. (REQUEST
WAS TABLED NOVEMBER 23, 1971, AFTER DISCUSSION OF PLANNED
DEVELOPMENT.) (PROPERTY LOCATED NORTH CF S.H. 183 APPROXIMATELY
500 FEET VEST OF MINTERS CHAPEL ROAD) , REQUESTED BY MR. CHARLES
BELEW, ZONING CASE NO. 218
City Manager Griggs stated that, at the
Public Hearing in November, 1971, the Council requested a more definite plan
and a determination from the Federal Aviation Agency on height restrictions.
Mayor Krause recognized Mr. Ray Olds,
who stated that the Council's request has been met. He presented a detailed
plan and a letter from, the Federal Aviation Agency. He presented an artist's
lay -out of the Planned Development, stating there is approximately 1.860
million square feet in the project. Replying to questions by members of the
Council, Mr. Olds stated that tenants will be varied -- national and inter-
national, and transportation related businesses; that the Federal Aviation
Agency has advised the development w i l l be i n a zone of practically no
noise; that buildings will be constructed of materials that will not create
e l e c t r o n i c problems; t h a t s i t e development w i l l begin by January 1, 1973 --
that major development will begin in 1974 and that some leases will be made
by the middle of 1973.
City Manager Griggs stated that this
area is proposed in the land use for Limited Light Industrial, but the
request is for Planned Development to allow taller buildings.
Councilman Wilcox moved to approve
first reading of Ordinance rezoning 65.4045 acres, as a Planned Development
District and acceptance of the Federal Aviation Agency's letter on height
restrictions.

VI.
TAX ROLL CERTIFICATE AND CORRECTIONS FOR 1972,
MR. RICHARD PARKS, TAX ASSESSOR - COLLECTOR
Mayor Krause recognized Mr. Richard
Parks, Tax Assessor - Collector, who read the Tax Assessors Certificate,
certifying total 1972 taxes receivable in the amount of $793,175.19.
Councilman Wilcox moved to accept the
Tax Assessor's Certificate, as presented.
Councilman Copher seconded the motion
and the vote is as follows:
Ayes: Councilmen Wilcox, Copher, Dunn, and Benson
Nays: None
Mayor Krause declared the motion - carried.
Mr. Parks presented Tax Roll changes
through August 31, 1972, a total net addition in the amount of $21.38.
Councilman Wilcox moved to accept tax
roll changes as presented.
Councilman Copher seconded the motion
and the vote is as follows:
Ayes: Councilmen Wilcox, Copher, Benson, and Dunn
Nays: None
Mayor Krause declared the motion carried.
VI I.
ORDINANCE NO. 433: SECOND AND FINAL READING
ADJUSTING LONE STAR GAS COMPANY RATE SCHEDULE
Councilman Wilcox stated that Lone Star
Gas Company has presented a proposal setting $1.75 for the first 1,000 cubic
feet, which will also be the minimum bill; that a I I other steps will remain
as presented in the Ordinance on fi rst reading.

APPO I NTMENT OF CERT IF I ED PUBLIC ACCOUNTANT
FOR 1971 -72 ANNUAL AUDIT

City Manager Griggs recommended appoint -
Fort Worth, for the 1971 -72 Annual Audit.
Councilman Dunn moved to concur with
the recommendation of the City Manager.

Mayor Krause declared the motion carried.
IX.
CITY ENGINEER'S REPORT
South Euless Swimming Pool Bid
M r . B i l l Ratliff, City Engineer,
presented a Ietter recommending a contract be awarded to Seaside Pools
of Texas, Inc. in the amount of $151,772.00 and 180 consecutive calendar
days, subject to approval of the Texas Park and Wildlife Commission.
,Councilman Dunn moved to concur with
the recommendation of the City Engineer.

Wilshire Pool
Mr. Ratl iff stated that inspectors
of the Texas Park and Wildlife Commission reported that the Wilshire Pool
is one of the finest in the State; that the workmanship if very good.
Mr. Swadley, builder of the pool,
was introduced. He stated that he is aware of the Council's concern of the
time involved in buidling the Wilshire Pool; however, it takes time to build
a good pool and, in his opinion, the Wilshire Pool is one the City of Euless
can be proud of. Mr. Swadley stated that 180 days is adequate time for his
firm to build the South Euless Pool.
Mayor Krause expressed appreciation to
Mr. Ratliff and his staff for their patience in the construction of the
Wilshire Pool.
X.
CITY MANAGER'S REPORT
City Manager Griggs reported that he
has talked with Mr. Dean of the Regional Airport Authority concerning use
of some of the airport land for park end recreation facilities. He advised
t h a t M r . Dean stated the Airport Authority w i l l not make plans without
contacting the City of Euless.
XI.
AI RCOND IT I ON I NG OF CIVIC CENTER BUILDINGS
Mayor Krause instructed the City Manager
to check into adequately airconditioning the three buildings in the Civic
Center Complex.
XII.
MR. EHRLER, DENTON PARK AND RECREATION
DIRECTOR - COMMENTS ON POOL CONCEPT
Councilman Copher reported that recently,
Mr. Ehrler, Park and Recreation Director for the City of Denton, spoke to the
City of Euless Park and Recreation Committee. Mr. Ehrler stated that the City
of Denton had made an error in building a large pool; that the neighborhood
concept should be first.
