HomeMy WebLinkAbout1972-10-2429.. Regular Meeting Euless City Council October 24, 1972 CALL TO ORDER The regular meeting of the Euless City Council was called to order at $:05 P. M. in the Council Chambers of Euless City Hall, with Mayor A. C. Krause presiding. Members present were Councilmen Harold Copher, B i I I Dunn, Darrel Benson, Harold Samuels, and Dwayne Wilcox. Also present were City Manager C. J. Griggs, City Secretary Vada Ferris, City Attorney James Cribbs, City Engineer Bill Ratliff, and Public Works Director John Bayuk. VISITORS Ms. Debbie Parrish, Mid - Cities Daily News, visited the meeting. I AIX/OrOT I MI The invocation was presented by City Attorney James Cribbs. APPROVAL CF MINUTES The minutes of the regular meeting dated October 10, 1972 were approved as written. CONSIDER PROPOSED AGREEMENT WITH TRINITY RIVER AUTHCRITY FCR EXPANSION OF AUTHORITY'S CENTRAL SEWAGE. TREATMENT PLANT City Attorney James Cribbs stated he had, at the request of the City Manager, reviewed the agreement proposed by the Trinity River Authority and that he cannot recommend the Council's approval of the agreement in it's present form, He commented the agreement, in his opinion, does not have sufficient "safe- guards" and there should be a built -in factor for expenses. He stated he has requested a copy of the proposed agreement submitted to the City of Irving and the City ctf Arlington; that he wants to know if those agreements are like the one submitted to Euless. Mr. Cribbs stated that the agreement restricts certain items into the sewer line. The Council agreed the agreement w i I I be taken under advisement and referred to the City Manager, City Engineer and City Attorney for further study. City Manager Griggs stated the City of Euless presently has a policy to control transmission into the sewer 1ines. Mr. Rat] i f f stated that the restrictions by Trinity River Authority are probably the same ones imposed by the Environmental Protection Agency and the Texas Water Qua i ty Board. The Council agreed the agreement w i I I be taken under advisement and referred to the City Manager, City Engineer and City Attorney for further study. 30 (Page Two, Regular Meeting of Euless City Council, October 24, 1972 fl, EASEMENT RIGHT -OF -WAY GRANTED TO TRINITY RIVER AUTHORITY FCR CONSTRUCTING A WATER LINE ACROSS CITY OF EULESS PROPERTY PRESENTLY BEING USED FOR WaTF SEWAGE TREATMENT PLANT City Attorney James Cribbs reviewed the easement right -of -way document and stated he recommends two changes: 1. that the City has the right to approve before assignment, and 2. that any time there are damages or repairs, it is not the City of Euless' expense unless the damage results from negligence by the City of Euless. Councilman Copher moved to concur with the recommendation of the City Attorney and approve the document with amendments. Councilman Benson seconded the motion and the vote is as follows: Ayes: Councilmen Copher, Benson, Dunn, Samuels, and Wilcox Nays: None Mayor Krause declared the motion carried. lII, P I PEL IN E AGREEMENT WITH CH ICAGO, ROCK I SLAND AND PAC IF IC RAILROAD COMPANY FCR BOYD BRANCH PARALLELING TRUNK SEWER City Attorney James Cribbs reviewed a proposed agreement, advising the Council this is a standard form and t h a t the o n l y change the Railroad Company w i l l agree to is the insertion of the clause "This agreement w i l l not be reasonably terminated by either party." (Paragraph 12). Mr. Cribbs recommended amending the agreement by adding this clause. Councilman Samuels moved to approve the agreement as amended by the City Attorney. Councilman Wilcox seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Wilcox, Copher, Benson, and Dunn Nays: None Mayor Krause declared the motion carried. IV. NOVEMBER 14, 1972 - COUNCIL MEETING CANCELLED Mayor Krause announced the cancellation of the November 14, 1972 City Council meeting, stating that the Council Members w i l l be attending the Texas Municipal League Annual Conference. (Page Three, Regular Meeting of Euless City Council, October 24, 1972) V. CIVIC CENTER AIR CONDITIONING Councilman Copher inquired about the report on the Civic Center Air Conditioning System.
