M. in the Council Chambers of the Euless City Hall with Mayor Pro Tem Dwayne Wilcox presiding. Members present were Councilmen Harold Copher, B i l l Dunn, Darrel Benson and Harold Samuels. (Mayor A. C. Krause was absent.) Also present were City Manager C. J. Griggs, City Secretary Vada Ferris, City Attorney James Cribbs and Public Works Director John Bayuk. V I S ITORS Visitors in attendance are listed as follows: Messrs. Grant Mabe, Lloyd Cook, Jerry Brackman, Ben Lankfer, Bob Eden, L. G. Goeke, L. C. Smith, Kenneth Beaver and W. W. McCormick; Mesdms. Fay Mabe, W. W. McCormick and Debbie Parish, representing the Mid - Cities Daily News and Miss Mary Ann Ingrain. INVOCATION The invocation was presented by Councilman Harold Samuels. APPROVAL CF MINUTES Minutes of the regular meeting dated February 13, 1973, were approved as written. (ZONING CASE NO. 228) Councilman Copher moved to call a Public Hearing on Zoning Case No. 228 on March 27, 1973. 68 (Page Two, Regular Meeting of the Euless City Council, February 27, 1973) Councilman Dunn seconded the motion and the vote i s as follows: Ayes: Councilmen Copher, Dunn, Samuels, Benson and Mayor Pro Tern Wilcox Nays: None Mayor Pro Tern Wilcox declared the motion carried. Councilman Samuels requested that Mr. Smith consider a Planned Development District and Mr. Smith stated he had cons i•dered this approach and would be prepared to answer questions at the Pub) i c Hearing. 109 PLACE ADDITION PRELIMINARY PLAT (PROPERTY LOOTED 2500' EAST CF NORTH MAIN STREET EXTENDING FROM HARWOOD ROAD TO SPUR 350) Mrr, Carl Smith was recognized by Mayor Pro Tern Wilcox, who located the property on the Preliminary Plat. The Council reviewed the City Engineer's letter dated February 19, 1973 and replying to a question by Councilman Dunn, Mr. Smith stated he has talked with the Texas Highway Department staff and necessary adjustments have been made at Midway Drive (item 2, Engineer's Letter). Councilman Copher inquired about item 5, Engineer's l e t t e r , and M r . Smith stated he w i l l place fire hydrants where needed -- that it is ill -timed to try to determine their location presently. Councilman Samuels inquired and was advised by M r . Smith that he i s in agreement of a l l items in the City Engineer's letter and he assumes the City will participate in the cost of oversized water lines at the time of final platting. Councilman Samuels moved to concur with the recommendation of the Planning and Zoning Commission and approve the preliminary plat, subject to the City Engineer's letter. Councilman Dunn seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Dunn, Benson, Copher and Mayor Pro Tem Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. WEINBAUM FCR ABANDONMENT CF EASEMENT FCR SANITARY SEWER LIFT STATION ON REAR LOT LINE CF 307 SIXPENCE The council had previously been presented a letter from Mr. Weinbaum requesting the council to abandon the easement for the sanitary sewer I i ft station and allow him to construct a building on the location. Mayor Pro Tem Wilcox requested the opinion of the City Manager, aid Mr. Griggs stated the City does not object to abandonment of the sewer Iift station easement as it is no longer needed, but the easement is located beyond the fifteen (15) foot building Tline and the request for the building should not be approved. Councilman Dunn commented that he is of the opinion the City cannot grant this request for a building outside the building line. However, he does feel the City should abandon the easement. Councilman Benson moved to concur with the recommendation of the City Manager and approve the abandonment of the easement and deny the request for a building to be constructed at this locat ion. Cmunci lman Copher seconded the motion and the vote is as follows: Ayes: Councilmen Benson, Copher, Dunn, Samuels, and Mayor Pro Tem Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried and City Manager Griggs was instructed to notify Mr. Weinbaurn of the council's decision. Iv. CONSIDER RECOMMEND AT ION CF CITY PLANNING AND ZONING COMMISSION FOR REVISION OF FUTURE LAND USE MAP TO REFLECT LIMITED INDUSTRIAL ZONING NORTH OF HARW00D ROAD AND EAST OF FULLER-WISER-ROAD AND NAME OF "EULESS FORUM" TO BE CONSIDERED FOR IDENTIFICATION OF FUTURE DEVELOPMENT CF SUBDIVISION ADJACENT TO NEW A IRPORT Members of the council discussed the recommendation submitted by the Planning and Zoning Commission for revision of the future land use•map to reflect the limited industrial zoning north of Harwood Road and eastiof Fuller -Wiser Road. Mayor Pro Tem Wilcox suggested the Council approve the recommendation to revise the future land use map. Members of the council concurred with this suggestion. However, Councilman Benson suggested that property owners should be contacted before approving 70 (Page Four, Regular Meeting of the Euless City Council, February 27, 1973) a name for identification purposes. Councilman Copher stated he suggests that City Manager Griggs contact the property owners to determine their opinion in naming the new subdivisions adjacent to the airport. Councilman Dunn moved to approve ,the recommendation of the Planning and Zoning Commission to revise the future land use map to reflect limited industrial zoning north of Harwood Road and east of Fuller -Wiser Road. Councilman Copher seconded the motion and the vote i s as follows: Ayes: Councilmen Dunn, Copher, Benson, Samuels and Mayor Pro Tem Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. City Manager Griggs was instructed to contact the owners in the area and determine their opinion in naming the area adjacent to the airport. V. ORDINANCE NO. 440 - FIRST AND FINAL READING, CALLING ELECTION TO CONSIDER CHARTER AMENDMENTS City Attorney James Cribbs reviewed the Ordinance, calling the election to be held April 14, 1973, to consider Charter Amendments as follows: to provide that the regular city election shall be held on the first Saturday in April add an article providing for the creation of a six (6) member Parks and Recreation Board add an article providing for the creation of a six (6) member Library Board. Mr. Cribbs explained that members of the Parks and Recreation Board and the Library Board shall be appointed by the City Council and duties and responsibilities shall be defined by Ordinance. The City Attorney reminded the Council that the Charter can only be amended every two years. Councilman Dunn stated the Council should be certain there are no other amendments to be considered at this time - that the next two years can bring many changes in the City of Euless. Mayor Pro Tem Wilcox stated the amendments to be considered in Ordinance No. 440 are basically a request of the "Goals for Euless" Committee and, therefore, a request from the citizens of Euless. 71 (Page Five, Regular Meeting of the Euless City Council, February 27, 1973) Councilman Samuels moved to suspend the requirement of two separate ordinance readings and approve Ordinance No. 440 calling an election on April 14, 1973 to ballot on Charter Amendments. Councilman Dunn seconded the motion and the vote is as follows: Ayes: Councilmen Samuels, Dunn, Copher, Benson, and Mayor Pro Tem Wilcox Nays: None Mayor Pro Tem Wilcox declared the motion carried. VI. EULESS JAYCEES REQUEST AMENDING ORDINANCE NO. 162 TO PERMIT USE OF BB GUNS AT JAYCEE SPONSORED EVENT Mayor Pro Tem Wilcox recognized Mr. Jerry Brackman, President of the Euless Jaycees, who requested the Council consider amending Ordinance No. 162 which would allow the use of BB guns at a State Championship event. Mr. Brackman stated the Jaycees desire to bid for the event in an effort to have it in the City of Euless; that the event will be well supervised and the participants will be instructed in use and handling of guns. Councilman Dunn inquired and was informed by Mr. Brackman that seventy -four (74) children have enlisted in the program and w i l l have classroom instruction as well as handling a BB gund on the rifle range. Members of the Council agreed that time should be allowed to study the ordinance before considering an amendment. However, in order to permit the Jaycees to bid for the State event, the council instructed the City Manager to meet with Chief Sustaire and attempt to work out a solution. VII. DISCUSSION: CITY CIVIL SERVICE Councilman Copher inquired about the countil's request on February 13, 1973 for an ordinance establishing City Civil Service. City Attorney Cribbs stated he is working on the proposed ordinance and w i l l present it for the council's consideration soon. However:, he stated that, tenatively, he is of the opinion that all city employees cannot participate and legislation is pending in Austin which would have a definite bearing on what action the City could take. 72 (P.age Six, Regular Meeting of the Euless C ity Council, February' 27, 1973) _ADJOURNMENT ATTEST : C ity Secretary VIII.
