Euless City Council
June 12, 1973
CALL TO ORDER
Mr. Harold Samuels called the regular
meeting of the Euless City Council to order in the City Hall Council Room at
8:00 P. M. with the following members present: Mrs. Willie Mae McCormick,
Messrs. B i l l Dunn and Darrel Benson. (Absent were Mayor A. C. Krause and Mr.
Harold Copher.)
Also present were City Manager C. J.
Griggs, City Secretary Vada Ferris, City Attorney James Cribbs and City
Engineer B i l l Ratliff.
VISITORS
Visitors present were as follows:
Messrs. G. C. Farmer, Bob Childers, Phil Peterson, Richard Parks, Troy Fuller,
Wayne Terry, Charles Reaves, Dan Baldwin, Bart Bradford, and John J. Freiberger;
Mesdms. G. C. Farmer, and Debbie Parish, representing Mid - Cities Daily News.

APPROVAL CF MINUTES
. Minutes of the regular meeting dated
May 22, 1973 were approved as written.
ORDINANCE NO. 445-A: SECOND AND FINAL READING
REZONING FRCM "C -1" NEIGHBORHOOD BUSINESS

Mr. Benson moved to approve second and
final reading of Ordinance No. 445.
Mrs. McCormick seconded the motion and
the vote is as follows:
Ayes: Mr. Benson, Mrs. McCormick, and Messrs. Dunn and Samuels
Nays: None
Mr. Sarnuels declared the motion carried.

PUBLIC HEARING: REQUEST CF PHIL PETERSON FCR
CHANGE CF ZON ING FROM "C -1" NEIGHBORHOOD
BUSINESS DISTRICT TO "C -2" COMMUNITY BUSINESS
DISTRICT WITH A SPECIFIC USE PERMIT TO
OPERATE A COMMERC IAL AMUSEMENT CENTER. (PROPERTY
LOCATED ON WEST MIDWAY DRIVE, ADJACENT TO
EAST SIDE OF MIDWAY PARK) ZONING CASE NO. 231
Mr. Samuels opened the Public Hearing
of Zoning Case No. 231 and recognized Mr. Phil Peterson. Mr. Peterson stated
that he and several members of his family are partners in a family fun center
in the City of Hurst, "Sir and Sons ", and that he is proposing to establish a
similar center in the City of Euless. He stated that this will be a recreation
center w i t h b i l l a r d tables, foosball tables, and other pieces o f s i m i l a r
equipment which w i l l cater t o a l l members of a family. He stated that 30 to
40% of the people who visit the amusement center are young married couples
and families. Sir and Sons is just what it implies, it is father and son and,
in many instances, the mother participates or is an observer. He commented
that the building located on Midway Drive where he is proposing to house the
amusement center has forty -five parking spaces and is an ideal location. Mr.
Peterson presented photographs of the interior of the Hurst establishment and
stated that s i m i l a r decor w i l l be applied to the Euless Amusement Center.
He commented that there are two
ordinances in the City of Euless which, a t some future date, he w i I I request
an amendment pertaining to the age of participants and hours of operation in
certain establishments.
Mr. Samuels advised Mr. Peterson that
the Council could not consider amending- these ordinances at this time since
this was a zoning case.
Mr. Samuels inquired if there were
proponents or opponents. There being none, he declared the Public Hearing
closed. Mr. Samuels advised Mr. Peterson that the Council's policy is to
consider a zoning request at the next meeting following the Public Hearing.
TAX ASSESSORS REPORT
Mr. Samuels recognized Mr. Richard
Parks, Tax Assessor - Collector, who advised the Council that the Tax Office
has finished the re- appraisal of the property in the City of Euless. He
stated that the Board of Equalization w i l l begin its hearings on Wednesday morn-
ing, June 13, 1973.
Mr. Parks presented a copy of "Tax
Roll Collection Data dated June 1937 (copy on f i l e as Council Exhibit in
Office of City Secretary). Mr. Parks explained the procedure for handling
del inquent accounts.

He commented that, in the City of Euless,
thirty seven people, age 65 and over, have filed an affidavit for exemption
and 36 qualified. He stated that 273 affidavits have been filed in the Cities
of Hurst and Euless and 6 had definitely been turned down. He stated that the
loss to the City of Euless in revenue is $918.00 this year.

RESOLUTION NO. 326: CALLING PUBLIC HEARING -
REQUEST CF MR, JCI-N J. FRE IBERGER FOR CHANGE
CF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT
TO "PD" PLANNED DEVELOPMENT FOR THE PURPOSE
CF BUILDING MINI - WAREHOUSES, OFFICE AND CARE-
TAKER'S- QUARTERS. (PROPERTY LOCATED ON THE
NORTH SIDE CF SH183 BETWEEN WESTERN HILLS INN
AND WILSHIRE SHOPPING CENTER.). ZONING CASE NO.
232.
Mr. Samuels recognized Mr. John J.
Freiberger, appl i-darit in Zoning Case No. 232. Mr. Samuels stated that
normally the City Council does not set a Public Hearing until an action
recommendation is received from the Planning and Zoning Commission. However,
in this case, the Planning and Zoning minutes stated that the applicant is
requesting that the Council set the P u b l i c Hearing although the case is s t i l l
pending before the Planning and Zoning Commission.
Mr. Freiberger stated that the Planning
and Zoning Commission was presented with the letter from the City's Consulting
Engineer which stated several recommendations for compliance by the applicant,
Mr. Freiberger stated that he had not seen this letter nor did he know of these
recommendations until he appeared at the Public Hearing before the Planning
and Zoning Commission on June 5, 1973. He commented that the request for the
Council to set the date of the Public Hearing is because if the case is delayed
until the Planning and Zoning Commission has an opportunity to again consider
the case and then present it to the City Council, his firm will miss the
closing date on the property.
Mr. Samuels advised Mr. Freiberger
that it would be to his best interest to have all of these matters resolved by
the Planning and Zoning Commission before the City Council hears this case.
Mr. Freiberger stated that he realizes
it will be in his best interests and that he is hopeful that these areas of
concern can be resolved with the Planning and Zoning Commission before the
Public Hearing is held by the City Council.
He was advised that the earliest possible
date for the Public Hearing of the City Council is july 10, 1973.

Mr. Benson moved to set July 10 as
the date for the Public Hearing before the City Council providing the City
Council has received from the Planning and Zoning Commission their decision
and recommendation on a I I questionable matters in this case.
Mr. Duna seconded the motion and the
vote is as follows:
Ayes: Messrs. Benson, Dunn, and Samuels. and Mrs. McCormick
Nays: None
