Regular Meeting Euless City Council August 14, 1973 CALL TO ORDER Mayor Pro Tem Harold Copher called the regular meeting of the Euless City Council to order in the City Hall Council Room at 8 :05 P. M. with the following members present: Mrs. Willie Mae McCormick, Messrs. B i l l Dunn, Darrel Benspn and Harold Samuels. (Absent was Mayor A. C. Krause.) Also present were City Manager C. J. Griggs, City Secretary Vada Ferris, City Attorneys' James Cribbs and Bob McFarland, and City Engineer B i l l Ratliff. VISITORS Visitors present were as follows: Messrs. Don Perkins, Robert Pippin, Richard Leggett, Carl Tyson, Ray Ozebek, Ray Spooner, Jerry Brackman, Luther Berstein, Noah Cureton, Troy Fuller, Wallace Craig, Huey Ball, Ronnie Meer, John W. McNary, V. L. Jennings, John Freiberger, F. Freiberger, George Boring, Dan Belden, Bart Bradford, William Goddard, Cl iff Davidson, Daniel Coffee, Cletis McAI bster, and Howard McDaniel, and Mesdms. Debbie Parish, Mrs. R. W. Barton, and Cathie Wincovitch. INVOCAT ION The invocation was presented by Mr. Harold Samuels. APPROVAL OF MINUTES Minutes of the regular meeting dated July 24, 1973, were approved with corrections as follows: ITEM 14 TRAFFIC SIGNALS ON P IPEL INEI ROAD Mr. Benson stated the motion should be that the City of Euless will participate in one half of the cost of three timed traffic signals located at Wade and Pipeline, Driftwood and Pipeline and Forest Ridge and P i p e l i n e , and the City w i l l maintain the signals at Wade and Pipeline and Driftwood and Pipeline. ITEM 13 LETTER COMMENDING SGT. R O N N I E FOSTER Mr. Dunn stated that the incident referred to was in the Reaves Royal Oaks Estates. 150 (Page Two, Regular Meeting Euless City Council, August 14, 1973) ORDINANCE NO. 450: SECOND AND FINAL READING FCR CHANGE CF ZON ING FROM "C -2" COMMUN ITY BUSINESS DISTRICT TO "PD" PLANNED DEVELOPMENT FCR THE PURPOSE CF BUILDING MINI - WAREHOUSES, OFFICES AND CARETAKER'S QUARTERS. (PROPERTY LOCATED ON THE NORTH SIDE OF SH183 BETWEEN WESTERN HILLS INN AND WILSHIRE SHOPPING CENTER.) ZONING CASE NO. 232. REQUEST OF MR. JOHN J. FREIBERGER Mayor Pro Tem Copher stated that members of the City Planning and Zoning Commission have requested to be recognized in order to inform the Council of their reason for requesting denial of the rezoning for the mini - warehouses, offices, and caretaker's quarters. Mr. Copher recognized Mr. Carl Tyson representing the City Planning and Zoning Commission. Mr. Tyson gave reasons for re'commendi ng denial as follows: 1. Mini - warehouses are just what they name implied' and should be in L-1, 1 -1 , and 1 -2, and they should not be located in a commercial zoning district. 2. City Engineers recommended connecting Sagebrush and Benbow Drive and there should be an outlet to Hwy. 183. 3. This location, as presented, is a fire hazard because fire hydrants will be completely enclosed by a fence. Owners can not control stored items, therefore, there is a danger of combustible items. Mr. Tyson stated that basically these are the objections of the Planning and Zoning Commission members in this case. Mayor Pro Tem Copher recognized Mr. Bart Bradford, representing Mr. Freiberger. Mr. Bradford stated that all of these items had been discussed previously and resolved and that he has nothing further to add, unless members of the Council have questions. Mr. Samuels stated that the Council did not discuss items to be stored. Mr. Freiberger stated that the contract signed by persons using the storage facilities has certain limitations -- one is for non - combustible items. He stated that there i s control of items stored; there is twenty -four hours supervision of the storage facilities. He stated that he could not say that something could not be stored without their knowledge, but it would be difficult for this to be done. 151 (Page Three, Regular Meeting Euless City Council, August 14, 1973) In reply to a question by Mr. Samuels, Mr. Freiberger stated the contract permits his personnel to break the lock in suspicious circumstances. Mr. Copher asked for a briefing on Sagebrush connecting to Benbow Drive. . Mr. Bradford stated that basically fifty percent of the adjacent property is vacant = -there are no water and sewer lines - -no one lives in that area and therefore, no traffic would be generated. He stated that he does not think it is feasible to build a street fhrough the property to Hwy. 183, where there is no traffic signal; that if the street is extended, i t w i l l chop the property up and part of i t w i l l be unusable. Mr. Dunn stated that much time has been spent on this zoning case; that the Council had a very complete presentation by Mr. Bradford and Mr. Freiberger and this is an area of a long narrow piece of property. He stated that the City Council is appreciative of the fine work of the City Planning and Zoning Commission, but personally, he thinks this is a good project for the City. Mr. Dunn moved to approve second and final reading of Ordinance No. 450. Mr. Benson seconded the motion and the vote is as follows: Ayes: Messrs. Dunn, Benson, Samuels and Copher Nays: Mrs. McCormick Mayor Pro Tem Copher declared the motion carried. (Ordinance w i l l require buildings placed on property as presented on Plat, eight foot fence around the project and trees and english ivy placed as agreed by Mr. Freiberger as outlined in Item 3, Council Minutes, July 24, 1973.) FINAL PLAT - TRACT C, BLOCK 1, J. E. WHITENER ESTATES (PORTION OF TRACT A BLOCK 1, J. E. VHITENER ESTATES) LOCATED EAST SIDE OF SOUTH MAIN STREET AT INTERSECTION CF SUNSET DRIVE Mr. Samuels inquired about a letter from Mr. Leon Hodges addressed to Mr. Bernstein concerning an agreement on the use of the parking lot at the Spring Valley Apartment Complex. The City Attorney stated that an agreement between Mr. Bernstein and Mr. Hodges does not have any connection with the plat. Dunn, Benson, Samuels, and Copher Nays: None Mayor Pro Tem Copher declared the motion carried. PUBLIC HEARING - REQUEST CF MR. HERMAN SMITH FOR A SPECIFIC USE PERMIT IN "C -2" ZONING FCR AN ICE SKATING RINK. (PROPERTY LOCATED IN THE WILSHIRE SHOPPING CENTER.)" ZONING CASE NO. 233. Mayor Pro T e m Copher opened the p u b l i c hearing and recognized Mr. Ronnie Meer, representing Mr. Herman Smith. Mr. Meer stated that his request is for a Specific Use Permit in a "C -2" zone for an ice skating rink. He stated that there are 22,650 square feet and the parking spaces meet the City's criterial. This r i n k w i l l be used for ice hockey, ice skating lessons; it w i l l not be used for spectacular productions. He stated that there w i l l be an entrance from Sagebrush to the property. Mayor Pro Tem Copher inquired if there were proponents or opponents, and being none, he declared the public hearing closed and advised Mr. Meer that the City's policy is to take action at the meeting following the public hearing. Iv. PUBLIC HEARING - ZONING CASE NO. 234 - REQUEST OF MR. TROY FULLER FCR CHANGE CF ZONING FIRCM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT. (PROPERTY LOCATED ON NORTHEAST CORNER CF WESTPARK WAY AND PIPELINE ROAD \AEST) Mayor Pro Tem Copher stated that the City Engineer, Mr. Ratl iff, had advised that hi -s firm, Knowlton -Raul iff- English- Collins, is the architect on this project and; therefore, will not review the site plans. (Page Five, Regular Meeting Euless City Council, August 14, 1973) Mayor Pro Tem Copher opened the p u b l i c hearing and recognized Mr. Troy Fuller. Mr. Fuller stated that he is representing Mr. Ronald Godbey and Mr. Wallace Craig, who requested this zoning of 2.7 acres for the purpose of building a very plush dinner restaurant. Mr. Wallace Craig was recognized and advised t h i s w i 1 1 be a smorgasbord restaurant named, The Graff Zeppelin, with an aviation motif. IVI. Craig introduced Mr. Huey Ball. Mr. Ball stated that he i s Vice- president in charge of the architectural division of Knowlton - Ratliff - English - Collins. He located the property on a map and stated that the property w i 1 I be developed to preserve the site because of its many large beautiful trees which w i 11 enhance the environment. He stated the parking lot will. be located on the west side of the building, hopefully to accomodate 150 cars, which w i l l exceed the City's parking requirements by at least 50 percent or more. He reviewed several colored architect drawings pointing out upper and lower level seating and stated that some seating will be in an outdoor area. He located on the drawing a promenade deck and stated that a bar will be isolated from traffic and visual contact with diners. Mr. Samuels inquired if the small lake on this tract is to be left and Mr. Ball stated the architects are hoping to develop the lake. Replying to a question by Mr. Benson, Mr. Ball 'explained there are -rooms of various sizes and some can be used as meeting areas. Mr. Fuller stated that the developers desire to have perpetual care on the drainage area and therefore, do not wish it to be concreted. Mayor Pro Tem Copher inquired if there were proponents or opponents, and being none, he declared the public hearing closed. RECEIVE PETITION FRCIV1 OWNERS ON YORKSHIRE DRIVE REGARDING SOLICITING ICE CREAM BUSINESS BY MEANS CE NOISY MUSIC Mayor Pro Tem Copher recognized Mrs. Ronnie Barton who presented a petition with seventeen names of residents on Yorkshire Drive who request the City of Euless to prevent all snow cone and ice cream 154 (Page Six, Regular Meeting Euless City Council, August 14, 1973) vending vehicles from soliciting business on Yorkshire by means of noisy music. . Mrs. Barton stated that the majority of the residents in her neighborhood considered these vendors a nuisance rather than a service. She stated that the snow cone vendor has a speaker with loud recordings and the volume is so great it can be heard for several blocks. Mr. Samuels advised Mrs. Barton that the Council is now working on an anti -noise ordinance. Mrs. Barton stated that she requests the Council take some immediate action. Replying to a question, Mrs. Barton stated that she would be agreeable to sigrn.ia complaint to-be hdafrd' inMMunic:ipalrCourt; that the snow cone vendor has been very disagreeable and has been cautioned by the Police. However, he has not made any effort to control the volume of the recordings. The Council agreed the City Attorney should review the present City Ordinance fo r vendors and discuss this matter with Chief Sustaire and Mrs. Barton and report to the Council. VI. BIDS RECEIVED FOR PURCHASE OF ONE NEW T R A C T O R - L O A D E R WITH SCAR I F I E R SCRAPER FCR PUBLIC WORKS The Council had been presented b i d tabulations for a 1973 Tractor - Loader with Scarifier Scraper -as follows: Alternate Bidder Sid Bid Clemons Tractor Co. $6,200.00 $6,675.00 International Harvester Co. 4,802.52 5,579.30 Village Creek Equipment 5 ,250.00 6,150.00 Riney Tractor Sales, Inc. 4,955 .00 5,995.00 The Council had also been presented a recommendation for purchase of the low bid submitted by International Harvester Sales and Service of Fort Worth in the amount of $5,714.30. Mr. Samuels moved to concur with the recommendation and approve the low bid. Mr. Benson seconded the motion and the vote i s as follows: Ayes: Messrs. Samuels, Benson, Copher, and Mrs. McCormick Nays: None carried. Mayor Pro Tem Copher declared the motion 155.. ORDINANCE NO. 451: AMENDING ORDINANCE NO. 1i/i7 - CREATING A COUNCIL OF SOCIAL CONCERNS The Council was advised that this amendment i s necessary t o clarify the number of persons on the Social Concerns Council and provides the Chairman of the Social Concerns Council shall vote only where there shall otherwise be a tie vote among" the other members in attendance. Mr. Samuels moved to suspend the require- ment of two separate ordinance readings and approve Ordinance No. 451 on first and final reading. Mrs. McCormick seconded the motion and the vote is as follows: Ayes: Mr. Samuels, Mrs. McCormick, Messrs. Benson, Dunn, and Copher Nays: None carried. Mayor Pro Tem Copher declared the motion VIII. ORDINANCE NO. 452 - FIRST AND FINAL READING - AMENDING ORDINANCE NO. 268 PERTAINING TO ABATEMENT CF JUNKED VEHICLES The Council had been presented a copy of a letter from the Texas State Highway Department requesting amendment of City Ordinance No. 268, regulating inoperative and junked vehicles, to bring it in line with state requirements. Mr. Benson moved to suspend the requirement of two separate ordinance readings and approve Ordinance No. 452 on first and final reading. Mr. Dunn seconded the motion and the vote is as follows: Ayes: Messrs. Benson, Dunn, Samuels, Copher and Mrs.McCormick Nays: None Mayor Pro Tem Copher declared the motion carr ied. The City Secretary was instructed to forward a copy of Ordinance No. 452 to the Texas Highway Department. 156 (Page Eight, Regular Meeting Euless City Council, August 14, 1973) IX. DALLAS COMMUTER TAX OPPOSED The Council discussed a letter from Mr. Dave Denison, Mayor of Lewisville, in which he requested the Euless City Council join with the Lewisville Council in opposing the proposed Dallas Commuter Tax. Councilman Dunn stated that he is in favor of notifying the City of Dallas that the Euless City Council opposes the Commuter Tax. Mr. Copher stated that perhaps the City of Euless can assess charges for "trucks from Dallas delivering to the City of Eul'ess. The City Attorney and City Manager stated that it would be very difficult to administer such a tax. Mr. Dunn moved to advise the Dallas City Council that the Euless- City Council opposes the propose'd Dallas Commuter Tax. Mr. Benson seconded the motion and the vote is as follows: Ayes: Messrs. Dunn, Benson, Copher, Samuels and Mrs. McCormick Nays: None Mayor Pro Tem Copher declared the motion carried. The City Secretary was instructed to notify, by letter, the City of Euless opposition of the Commuter Tax to the following: Mayor Dave Denison, the Mayor of Dallas, and members of the Dallas City Council. X. COUNTY WIDE SOIL SURVEY - MR. CLIFF DAVIDSON, COUNTY PLANNING DEPARTMENT Mayor Pro Tem Copher recognized Mr. Davidson who presented a slide program as an introduction to a proposed soil survey program for Tarrant County. The Council had received a letter advising that such a survey would: 1. help planners in locating landfills and solid waste disposal sites; 2. save taxpayers large sums of money when used by road builders and highway construction engineers in planning routes and structures; 157. August 14, 1973) 3. help developers in locating problems associated with housing sites, shopping center, or industrial parks based on the safety and costs involved with a site's particular soils and their favorability for foundations; 4. help planners in identifying possible floodways, drainage potentials of sites and the best areas of landscaping; 5. increase public utility companies' understanding of the corrosive characteristics, the consistency of the area's soils, and the depth to rock for their underground work (50% of Tarrant County is underlain at shallow depths by hard rock); 6. help identify those soils particularly well- suited for agri- cultural uses - -urban expansion in the form of housing developments, superhighways, airports, shopping centers and industries are burying some of ,our best farmland at the rate of more than a million acres a year throughout the U. S. Mr. Davidson stated that the County Planning Department is not asking for funding at this time. He stated that a report w i l l be made f o l l o w i n g the survey which w i l l be p r i n t e d by the County and w i l l be available to a11`theCCities. In reply to a question he stated that this program w i l l be presented to the Commissioner's Court and to several other Cities and the total figure for the City of Euless for two years is $2,950.00 Mr. Coffee, a representative of the Soil Conservation Service, stated that a study of this nature would require many years of work before completion, if it is assumed by only one entity; however, if several Cities and the County Commissioners participate, the project could be finished in a very short time and made available to the Cities. Mr. Davidson stated that a survey of this type would provide information that would be helpful to developers and the City; that it would make problems of the soil known; that it would provide information of soil most suitable to plant life. Mayor Pro Tem Copher suggested that the City Manager disucss this proposal with the City Engineers and present a recommendation to -the City Council. Mr. Davidson stated that he would like to have a letter of the City's intent as soon as possible. The City Secretary was instructed to schedule this item for the n -ext City Council Agenda. XI. RECOMMENDATIONS OF-C ITY•PLANN ING AND ZON ING COMMISSION FCR CERTAIN REVISIONS TO THE TEXT CF ZON ING ORDINANCE NO. 347 Mayor Pro Tem Copher recognized Mr. Carl 158 (Pape Ten, Regular Meeting - Euless City Council, August 14, 1974) Tyson who stated that these recommendations were made in an effort to eliminate discrepancies in the zoning ordinance. The Council reviewed the recommended changes as follows: Changes to off - street parking space requirements for motels and hotels: 1.2 parking spaces per living or rental unit plus one parking space per 100 square feet of ballroom or meeting room area. Replying to a question by Mr. Samuels, Mr. Tyson stated that restaurants are in the zoning ordinance and therefore, do not need to be included. Mr. Dunn commented that he is in agreement with the recommendation for 1.2 parking spaces. CHANGES F C R S I D E YARDS I N "R -1" SINGLE - FAMILY DWELLING DISTRICTS (7-102(3) There shall be two side yards for each structure in "R -1" dwelling district, one on each side of each structure, one o f which w i l l be not less than five feet in width and one not less than twelve feet in width. Mr. Tyson stated that this is recommended to allow property owners the opportunity to have a drive way to their back yard and that it does not matter which side is twelve feet or five feet. CHANGE IN "C -1" NEIGHBORH00D BUSINESS DISTRICT IN SECTION 7 -401, USES PERMITTED Any uses permitted in the foregoing "R -1" dwelling district, except that no dwelling or living quarters shall be constructed in the "C -1" Neighborhood Business District. Mr. Tyson stated that this recommendation is proposed to limit high density; that they want to limit apartment construction to apartment districts. CHANGE I N "C -2" COMMUNITY BUSINESS DISTRICT - SECTION 7-501, USES PERMITTED AND SECTION 7 -502, SET BACK REQUIREMENTS Any uses permitted in "C -1" neighborhood business district and section 702, subsection (1) front yard to read all b u i l d i n g s s h a l l be set back a minimum twenty feet from a l l dedicated streets. Several members of the Council suggested that time be allowed to study this recommendation; however, they were in agreement t o approve a I I recommendations except schedule of sign standards. City Manager requested that the Planning and Zoning Commission's recommendation to amend Ordinance No. 206 by adding a paragraph to read, "no permit shall be issued for a beacon or flashing light ", included in the Ordinance with the other recommendations. The City Attorney was instructed to prepare an amendment to include: 1. Off - street parking spaces requirements for motels and hotels - 1.2 parking spaces per ;living or rental unit, plus one parking space per one hundred square feet of ballroom or meeting room area. 2. Side yards in "R -1" Single Family Dwelling Districts - There shall be two side yards fo r each structure i n "R -1" Dwelling District, one on each side of each structure, one of which shall be not less than five feet in width and one not less than twelve feet in width. 3. "C -1" Neighborhood Business District - Section 7 -401 - Uses Permitted -Any uses permitted in the foregoing "R -1" Dwelling District except that no dwellings or living quarters shall be constructed in the "C -1" Neighborhood Business District. 4. "C -2" Community Business District - Section 7 -501 - Uses Permitted and Section 7 -502 - Set Back Requirements - Any uses permitted in the "C -1" Neighborhood Business D i s t r i c t and Section 7 -502 Sub- section ( 1 ) f r o n t yard to read - a l l buildings shall be set back a minimum twenty feet from a l l dedicated streets. and to prepare an amendment to include signs and beacons as an amendment of Ordinance No. 252 and submit to the Planning and Zoning Commission for approval before the Council makes final approval. XII. ORDINANCE NO. 453 - FIRST AND FINAL READING AMENDING ORDINANCE NO. 252 SIGNS AND BILLBOARDS Mr. Bob McFarland presented an amendment of Ordinance No. 252 and pointed out that it provides that no billboard signs shall be allowed on Minters Chapel Road, State Highway 360 and State Highway Spur 350 for a distance of 3,000 feet on eight side of the rights -of -way. ORDINANCE NO. 454 - FIRST AND FINAL READING PROVIDING FOR LEVY ASSESSMENT AND COLLECTION CF A LICENSE TAX AND FEE FROM ALCOHOLIC BEVERAGE PERMITS Mr. McFarland informed the Council that this Ordinance w i l l permit the City to collect a fee for off - premise sale of beer immediately and collect a tavern fee at the beginning of the fourth year of tavern operation. Mr. McFarland stated that he will have a draft of this ordinance available to the Council shortly. CITIZEN REQUEST REPORT ON DRAINAGE STUDY ON KOEN LANE XIV. Mayor Pro Tem Copher recognized Mr. Cureton. Mr. Cureton stated that he is present to inquire if the City's engineers have a report on the solution to the flooding problem on Koen Lane. (Engineer's instructed on July 24, to investigate and report to the Council.) (Page Fifteen, Regular Meeting Euless City Council, August 14, 1971) Mayor Pro Tem Copher stated that Mr. Ratliff, the City Engineer, has advised that the engineers are investigating this matter. Mr. Cureton inquired if he might have a copy of the report from the engineers. The City Manager stated that he would have the City Engineer send a copy of the report. XV.
