HomeMy WebLinkAbout1974-07-0997 Regular Meeting Euless City Council July 9, 1974 CALL 10 ORDER The regular meeting of the Euless City Council was called to order at 8 :10 p.m. in the Council Chamber of Euless City H a l l by Mayor A. C. Krause. Members present were Mrs. W i I I i e Mae McCormick; Messrs. Harold Copher, Wayne Wright, and Harold Samuels. Also present were City Secretary Vada Ferris, City Engineer B i l l Ratl iff, and City Attorney Bob McFarland. VISITORS Visitors present were as follows: Messrs. Jeff Power, Robert Power, Larry Owen, Troy M. Fuller, Marty Case, Buddy Ragley, Kenneth Taylor; Mesdms. Kay Leeth, Helen Harvey, Geneva M. Armstrong, Kay Fuller, Candy Tuttle, Mid - Cities News. INVOCATION Mr. Harold Samuels. APPROVAL CF MINUTES The invocation was presented by The minutes of the regular meeting dated June 25, 1974 were approved with the following correction: Item II "salary for additional l i b r a r y person w i t h L i b r a r y Science degree from an accredited school w i l l not exceed $500.00 monthly ". FIRST READING CF ORDINANCE: REZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT 10 "R -5" MULTI - FAMILY DWELLING DISTRICT ON LOT A -1, BLOCK 1, OAKWOOD TERRACE ADDITION, (PROPERTY LOCATED SOUTH CF SH 183, BETWEEN VINE STREET AND NORMAN DRIVE.) REQUEST CF LAWLER CORPORATION, ZONING CASE NO. 242 Mr. Wright moved to approve first reading of ordinance rezoning Lawler Corporation property as requested. Mrs. McCormick seconded the motion and the vote is as follows: Ayes: Messrs. NATIONAL FLOOD INSURANCE UNDER THE UNITED STATES FLOOD DISASTER PROTECT 10 N , ACT CF 1973 Resolution No. 339A: Assuring the Federal Insurance Administration that Adequate Land Use and Control Measures will be Enforced in Con- sistence with the Criteria a the National Flood Insurance Proaram Requlation- Mr. Samuels moved to approve Resolution No. 339 as presented. Mrs. McCormick seconded the motion and the vote is as follows: Ayes: Mr. Samuels, Mrs. McCormick; Messrs. Copher and Wright Nays: None Mayor Krause declared the motion carried. Resolution No. 340: Indicating the Building Permit System which has been Adopted and the Review Proce- dure for the System Mr. Samuels moved to approve Resolution No. 340 as presented. Mrs. McCormick seconded the motion and the vote i s as follows: Ayes: Mr. Samuels, Mrs. McCormick; Messrs. Copher .and Wright Nays: None Mayor Krause declared the motion carried. DRAINAGE PROBLEM - 510 HUNTINGTON DRIVE, MRS, HARVEY Mayor Krause stated that he has a letter dated July 1, 1974- from the City Consulting Engineers concerning (Page Three, Regular Meeting, Euless City Council, July 9, 1974) the drainage problem of Mrs. Helen Harvey - 510 Huntington Drive. Mayor Krause stated that he feels that Mrs. Harvey's criticisms of the flood problem is valid'and that the'City created this problem. Therefore, in his opinion, the City should take necessary steps to correct the situation. Mayor Krause stated that he suggest that the City Engineer be instructed to make a study of the drainage problem and present his study and estimated costs at the next regular council meeting. Members of the Council concurred with the Mayor's suggestion and the City Engineer was so instructed. IV. SCHEDULE CF CITY COUNCIL AND CIVIL SERVICE COMMISSION MEETING Members of the council agreed to meet in called session with the Civil Service Commission on Wednesday, July 10 at 1+ p.m. to discuss employee benefits. V. SULPHUR. •BRANCH DRA I NAGE AND BLUEBONNET DRIVE BRIDGE Mayor Krause recognized Mr. Marty Case, who stated that he had attended the Hurst City Council meeting earlier this evening, and it had been announced that the Bluebonnet Bridge Crossing improvements will be included in the next bond program for the city of Hurst. Mayor Krause advised Mr. Case that Mrs. Ferris has been attempting to schedule a joint meeting of the Euless City Council and Hurst City Council with County Commissioner, Mr. Dick Lewis, to discuss the Bliuebonnet Bridge Crossing. Mayor Krause stated that the City is hopeful that the county will participate in these improvements. Mr. Case inquired what the City Council has decided to do about Sulphur Branch in the Morrisdale area, It was explained to Mr. Case that the City cannot do anything about the improve- ments to Sulphur Branch until all easements have been acquired from abutting property owners. Mr. Ratliff explained that the City has a problem of access to the area south of the bridge crossing Sulphur Branch on Woodvine Drive -- that to move in equipment, the cost would be out of portion compared to the construction cost of the project. Mr. Case stated that if access is a problem the City could go through his property to the creek. Mr. Case stated that he does not understand why the area north of the Woodvine Bridge could not be included in this project -- that the silt under the bridge has built up tremendously and w i l l continue to do so. He also stated that the willow trees have grown in the channel, which further creates a flooding problem and that the sewer line near the Woodvine Bridge should be removed; that it is a blockage which also creates a problem, 100 (Page Four, Regular Meetinq Fiiless City Council July 9.. 1974) Mr. Ratliff stated that the sewer line near Woodvine Bridge is in good condition and that the sewer line further down the creek is being repaired because of its deteriorating con- dition. Mr. Case stated that one of the property owners who had not - signed an easement has sold his house; -and he has not talked with the new owner to learn if he will sign an easement for the improvements. However, he does not understand why the City could not attach a rider to the property in this area stipulating that the easement w i l l revert to the City in case the property should sell. Mr. McFarland, City Attorney, stated that, at this time, he would not say this is legal. Replying to a question by Mr. Samuels, Mr. R at l i ff stated that there would be some maintenance if. the channel is concrete lined. Mr. Ratliff stated that the City Council asked the Engineer the most urgent matter to be considered in Sulphur Branch and their response was that Bluebonnet Bridge is the first priority and that if there i s money l e f t then a d d i t i o n a l work w i l l be done on the channel. Mr. Gopher stated that the City is following steps as listed by Mr. Ratl iff. The first step is to try to get the Bluebonnet Bridge problem solved and repair the deteriorating sewer line. Mayor Krause stated t h a t he would l i k e to have a figure on the cost of the condemnation of the property that w i l l not give easements for these improvements. The City Attorney stated that condem- nation cost might not be too great considering the flooding in the area and the fact that the City has all other easements for improvements to the drainage channel.
