HomeMy WebLinkAbout2021-03-23 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, March 23, 2021 A regular meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:33 p.m. on Tuesday, March 23, 2021, in the Council Chambers of City Hall, 201 North Ector Drive. Mayor Linda Martin, Mayor Pro Tem Salman Bhojani, Council Members Tim Stinneford, Jeremy Tompkins, Eddie Price, Perry Bynum, and Harry Zimmer were present in the Council Chambers. During the Precouncil meeting: ➢ City Manager Loretta Getchell reviewed the regular agenda. She requested that Agenda Item No. 5 related to an alerting system at Fire Station No. 1 be tabled to a future meeting date to permit the Fire Chief to evaluate the quote further. ➢ Emergency Management Coordinator Suzanne Hendrickson provided an update regarding the COVID-19 pandemic, including the current statistics worldwide, statewide, and locally as well as hospitalization rates and the status of vaccine distribution. She advised that the vaccination rate for Euless residents who have received at least one dose of the vaccine is 20.06 percent and beginning March 29, 2021, the State of Texas will allow all adults access to a vaccine. Additionally, she announced that the American Rescue Plan Act is expected to allocate $12.47 million in funding directly to the City of Euless from the Treasury Department in two allocations (May 2021 and May 2022) to be spent by December 31, 2024. She encouraged hand washing, social distancing and mask wearing even as vaccine distribution becomes more widespread. • Director of Planning and Economic Development Mike Collins shared a "Then and Now" presentation for the Development update and provided a history of the developments that he has overseen in the City during his tenure. He acknowledged his staff for their support and input throughout the years. ➢ Finance Director Janina Jewell presented the financial report for the period ending February 28, 2021 , and advised that car rental tax collection was down 44 percent over the same period last year and down 47 percent year to date. CLOSED SESSION The City Council convened into closed session at 5:42 p.m. for deliberation regarding the following: Seek legal advice from the City Attorney as authorized by Section 551.071 of the Texas Government Code related to: • UDC land uses: 7997 Membership Sports and Recreation Clubs and 7999 Amusement and Recreation Services, Not Elsewhere Classified; and Council Minutes Page 2 of 12 March 23, 2021 • Chapter 95 of Euless Code of Ordinances, "Fair Overtime and Scheduling Standards." PLEDGES OF ALLEGIANCE Mayor Linda Martin led the pledges of allegiance to the flags of the United States and Texas. ITEM NO. 1. PRESENTATION OF EMPLOYEE OF THE MONTH FOR APRIL Mayor Martin recognized Teen Librarian Amber Alvarez as the April 2021 Employee of the Month. ITEM NO. 2. PRESENTATION OF CERTIFICATE OF APPRECIATION TO MIKE COLLINS FOR 20 YEARS OF SERVICE Mayor Martin presented Director of Planning and Economic Development Mike Collins with a Certificate of Appreciation as he leaves the City with 20 years of service. She wished him and his family well as he begins his next endeavor. Mike introduced his wife, Margaret, son, Adam, and mentioned his daughter, Emily, who is away at school. Former Council Member Charlie Miller spoke fondly of Mike and recounted a story about when he and Mike attended a Dallas Mavericks game. Senior Planner Stephen Cook and members of the City Council took turns in expressing their appreciation and fondness for Mr. Collins. ITEM NO. 3. PRESENTATION OF AWARD Mayor Martin presented the 2020 Excellence in Libraries Award to Library Director Sherry Knight. Library Board Chairman Barney Snitz joined Ms. Knight for the presentation. CONSENT AGENDA Mayor Martin advised that the Fire Chief has requested Agenda Item No. 5 be removed from the consent agenda and tabled for consideration to a future meeting date. ITEM NO. 5. TABLED AUTHORIZING PURCHASE OF A FIRE STATION ALERTING SYSTEM FOR FIRE STATION NO. 1 Council Member Bynum motioned to table consideration of authorizing the purchase of a fire station alerting system for Fire Station No. 1 to a future meeting date. Council Member Tompkins seconded the motion. APPROVED RENEWAL OF BID NO. 005-20 Approved award of Bid No. 005-20 for the purchase of plant protectants and fertilizers to be used at Texas Star Golf Course, The Parks at Texas Star, and various other City parks and properties to Simplot AB Retail, Inc., 1099 West Front Street, Boise, Idaho, for fertilizer, plant protectants, and chemical supplies. The original contract, as awarded in April 2020, contained an initial term of one year with an option for a one-year renewal. This represents the one-year renewal. The estimated expenditure is $103,000. ITEM NO. 6. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the regular meeting of March 9, 2021. REGULAR AGENDA ITEM NO. 7. APPROVED SITE PLAN NO. 21-01-SP Director of Planning and Economic Development Collins presented the case to the City Council. He advised that the applicant, Jason Nunley, Urban Logistics, was recently granted approval for a Planned Development (20-06-PD) on 22.07 acres located at the 1000 Block of South Industrial Boulevard. The proposed site plan complies with all development standards contained in the Planned Development and will enable 367,175 square feet of flex commercial space to be developed. The site will be developed with three buildings located on two lots. Buildings A and C will contain less square footage than Building B and have building heights of 38 and 39 feet, respectively. Building B is Council Minutes Page 5 of 12 March 23, 2021 located in the center and will have the largest square footage at 191,010 square feet and a height of 45 feet. The three buildings will be used for leased spaces for business offices. warehousing, light manufacturing, retail, and other commercial uses. The Planning and Zoning Commission considered this site plan at their regular meeting on March 2, 2021, and recommended approval by a vote of 6-0-0. Council Member Bynum motioned to approve Site Plan No. 21-01-SP, for a Commercial Development proposed to be located on 22.07 acres on the Greenland Square Addition, Block A, Lot 1 and AM Downen Survey, Abstract No. 415, Tracts 4B, 4B2, and 4B2A located at the 1000 block of South Industrial Boulevard. Mayor Pro Tern Bhojani seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Bhojani, Council Members Stinneford, Tompkins, Price, Bynum, and Zimmer Nays: None Mayor Martin declared the motion carried. ITEM NO. 8. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 21-02-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2273 Mayor Martin opened the public hearing at 7:30 p.m. Director of Planning and Economic Development Collins presented the case to the City Council. He advised that the applicant, Dylan Erwin, representing Big Nasty Performance & Service, LLC, is seeking a Specific Use Permit at 1361 West Euless Boulevard, Suites 106 and 108 for a motorcycle general repair facility in which to upgrade and enhance performance on Harley Davidson motorcycles in the Texas Highway 10 Multi-Use (TX- 10) zoning district. Big Nasty is also a retailer of performance accessories and gear for Harley Davidson motorcycles. The proposed location is within a mixed service commercial building which houses other vehicle repair facilities, a fitness center and offices. The units combine offices and storage/open spaces with roll-down doors which lend access for repair. The proposed business will have retail business hours of Monday through Friday from 9:00 a.m. to 6:00 p.m. and have three employees. Additionally, the Planning and Zoning Commission considered the Specific Use Permit on March 2, 2021, and recommended approval by a vote of 6-0-0 with the following conditions: 1) The Specific Use Permit is tied to the Business Name: Big Nasty Performance & Service, LLC; 2) The Specific Use Permit is tied to the Business Owner, Dylan Erwin; 3) All repair of vehicles, including but not limited to: mechanical repair and maintenance operations will be conducted within the building. No work will be conducted exterior to the building; 4) Outdoor storage of vehicles or exterior display of merchandise, including tires are not permitted; Council Minutes Page 6 of 12 March 23, 2021 5) All tires stored on site whether new or used, shall be stored in a manner that is screened from public view from the right- of-way and shall be stored under cover so as to not allow the collection of rainwater in the tires; 6) The services allowed at this facility are as follows: Sales and installation of parts for Harley Davidson motorcycles, Scheduled maintenance service, Oil Changes, Brakes/Tires, Motor Builds, Troubleshooting, Accessories, and Detailing. Auto/Motorcycle services not listed here are thereby prohibited; 7) No more than thirty (30) gallons of gasoline will be allowed within the permitted suites at a time; and 8) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Dylan Erwin, the applicant, 1406 Elmhurst Drive, Arlington, Texas, was present to address any questions. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:33 p.m. Council Member Tompkins expressed concern related to the proposed use and the impact to nearby tenants. He asked if additional ventilation is being added to dissipate any chemicals and/or any exhaust fumes so that neighboring business are not negatively impacted. Mr. Erwin stated that the roll-down doors will be open during business hours to help with ventilation. Mayor Pro Tem Bhojani inquired if there was opposition to the proposed Specific Use Permit. Mr. Collins confirmed that a nearby business owner had expressed concern regarding the potential noise and advised that the lease agreement has provisions for dealing with excess noise complaints. Council Member Price motioned to approve Ordinance No. 2273, for a Specific Use Permit on SH10 Business Center, Block A, Lot 2; 1361 West Euless Boulevard, Suites 106 and 108, for a General Motorcycle Repair Facility in the Texas Highway 10 Multi-Use (TX-10) zoning district. Council Member Stinneford seconded the motion. HELD A PUBLIC HEARING FOR PLANNED DEVELOPMENT CASE NO. 21-01-PD AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2274 Mayor Martin opened the public hearing at 7:37 p.m. Director of Planning and Economic Development Collins presented the case to the City Council. He advised that the applicant, Binay Aryal, representing the Nepali Cultural Center, is seeking to amend a Planned Development which was part of Case 20-01-PD and approved by the City Council on March 24, 2020. Since this approval, detailed engineering of the entire site has been completed and based on the detailed engineering, the site plan identified as Exhibit A of the original PD ordinance needed to be updated. The location of the mutual emergency access, drainage and utility easement (MEADUE), which serves as the fire lane, has been modified and meets the requirements of the City Fire Marshal's office. The efficiency of the drainage on the whole site has been enhanced as well. None of the buildings approved with the first PD have been modified or altered. Additionally, the Planning and Zoning Commission considered the Planned Development on March 2, 2021, and recommended approval by a vote of 6-0-0. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:40 p.m. Mayor Pro Tem Bhojani motioned to approve Ordinance No. 2274, a Planned Development to change the zoning of approximately 7.8 acres in the Park Center Addition, Lots 1B, and 1C, 2200 Block of West Euless Boulevard and International Regional Industrial Complex. portion of Block C and Block C, Lot 10, 1200 Block of Royal Parkway; from Planned Development (PD) zoning district to Planned Development (PD) zoning to allow Place of Worship and Community Center uses. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Bhojani, Council Members Stinneford, Tompkins, Price, Bynum, and Zimmer Nays: None Mayor Martin declared the motion carried. ITEM NO. 10. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 21-01-SUP AND DENIED FIRST AND FINAL READING OF ORDINANCE NO. 2275 Mayor Martin opened the public hearing at 7:41 p.m. Director of Planning and Economic Development Collins presented the case to the City Council. He advised that the applicant, SJ Pets, LLC, is seeking to lease a 4,000 square foot retail location within the Heritage Towne Crossing shopping center for a Miscellaneous Retail Use (Pet Store). The Texas 121 Gateway zoning district requires Council Minutes Page 8 of 12 March 23, 2021 all Miscellaneous Retail Uses be approved through the Specific Use Permit process. The business name of the proposed retail store is Petland., The applicant responded to a series of questions regarding the store operations and the practices related to the sale of dogs and cats. Staff has reviewed the information submitted by the applicant and recommends denial of the Specific Use Permit. Conditions for permit approval are identified in Section 84-153 of the Unified Development Code. At least two of the conditions identified as (8) and (9) have not been satisfied: (8) The proposed use will be compatible with and not injurious to the use and enjoyment of neighboring property, nor significantly diminish or impair property values within the vicinity; and (9) Adequate nuisance prevention measures have been or shall be taken to prevent or control offensive odors, fumes, dust, noise, vibration and visual blight. Additionally, the Planning and Zoning Commission considered the Specific Use Permit on March 2, 2021, and recommended denial by a vote of 6-0-0. Members of the applicant team, Gordon Atkinson, David Levinson, and David Martin were present to address any questions. Mayor Martin asked to hear from any proponents of the case. David Martin, 2728 North Harwood Street, Dallas, Texas, expressed his appreciation to staff for their assistance in bringing this project forward. He introduced Jay Suk, applicant and owner of SJ Pets; Lisa Abair, Petland Dallas General Manager; TJ Evans, Director of Construction (via Zoom); and Gordon Atkinson, representing The Retail Connection, property owner. Mr. Martin provided details about the property, an overview of Petland, and health measures and protocols that would be put in place. TJ Evans, 250 Riverside Street, Chillicothe, Ohio, introduced himself and his role within Petland. He provided additional information regarding sound mitigation, cleaning protocols, and the health of the animals. Gordon Atkinson, 4926 Mission Avenue, Unit 2311, Dallas, Texas, provided additional details regarding concerns of noise and Petland being a good tenant. David Levinson, 4401 Mira Vista Drive, Frisco, Texas, expressed his opinion that Petland would be a good tenant for Heritage Town Crossing. Mayor Martin next asked to hear from any opponents of the case. Lisa Cassell, 75 Morrow Drive, Bedford, Texas, advised that she is a volunteer with Trinity GAP Club and provided statistics regarding shelter pets and issues related to Petland stores nationwide. Council Minutes Page 9 of 12 March 23, 2021 Charlie Miller, 608 Creekside Drive, Euless, Texas, expressed his opposition to the case and urged the City Council to keep the uses approved for the shopping center already in place. Jaren Isbell, 1726 Magnolia Lane, Euless, Texas, expressed his opposition to Petland and their sourcing of animals. Diedra Leany, 414 East Whitener Road, Euless, Texas, agreed with the three previous speakers in opposition and expressed her opposition. Morvel; email: Louise Trainham, email; and Steffenie Vela; email; Mayor Martin closed the public hearing at 8:14 p.m. Council Member Stinneford advised that, in his professional capacity as a shopping center manager, he is opposed to this use in Heritage Town Crossing. Different types of retail are not always compatible with each other. In his opinion, the City Council's authority in this matter is to decide on land use and this is not the best use of the land. Mayor Pro Tem Bhojani provided a brief overview of the Unified Development Code and expressed concern regarding this type of use. Council Member Stinneford motioned to deny Ordinance No. 2275, for a Specific Use Permit on Heritage Towne Crossing Addition, Block B, Lot 1; 3001 State Highway 121, Suite 12 for a Miscellaneous Retail Use (Pet Store) in the Texas 121 Gateway (TX-121) zoning district. Council Member Bynum seconded the motion. ITEM NO. 11. APPROVED BOARD AND COMMISSION APPOINTMENT Council Member Tompkins motioned to appoint David Brown to Place 4 on the Planning and Zoning Commission to a term expiring December 31, 2022. Council Member Stinneford seconded the motion. PUBLIC COMMENTS Charlie Miller, 608 Creekside Drive, Euless, Texas, expressed his appreciation to the City Council and staff for the quick response in opening the warming center at the Euless Family Life Center during the recent winter storms. Additionally, he recognized Building Official Don Sheffield for assisting his daughter at her home when no inspectors were available, climbing into a small space to inspect a new water heater.
