HomeMy WebLinkAbout1976-05-11Regular Meeting Euless City Council May 11, 1976 CALL TO ORDER The regular meeting of the Euless City Council was called to order at 8:00 P.M. in the Council Chambers of Euless City Hall by Mayor Harold Samuels. Members present were Mrs. Willie Mae McCormick, Messrs. Ray Ozebek, Charles Hunt, Glenn Walker, and Robert Pippin. Also present were City Secretary Della Houy, City Engineer B i 1 1 'Plowers, City Attorney Bob McFarland, and Planning and Development Director Lynn Shackelford. (City Manager was absent due to illness.) VISITORS Visitors present are as follows: Messrs. Jim Hickerson, Fred Valenta, Ken Taylor, D. F. Hammonds, Walter Elliott, W. G. Ragley, Neal Adams, Carl Tyson, Dick Wells, Leon Sheppard, and Sam Munir; and Mrs. Helen Lightbody. INVOCATION The invocation was given by Mr. B i 1 1 Flowers APPROVAL OF MINL IES The minutes of the regular meeting dated April 27, 1476 were approved as written. ELECTION OF MAYOR PRO -.TEM Mayor Pro —Tem, Mr. Ozebek nominated Mrs. McCormick as Mr. Pippin seconded the motion. Mr. Walker moved that nominations cease and Mrs. McCormick be elected by acclamation. Mr. Hunt seconded the motion and the vote is as follows: Ayes: Messrs. Walker, Hunt, Pippin, and Ozebek Nays: None Abstained: Mrs. McCormick Mayor Samuels declared the motion carried. (Page Two, Regular Meeting, Euless City Council, May 11, 1976) Mayor Samuels stated that Mrs. McCormick has been a great help to him in his duties since he has to be out of the City so often. II CONSIDERATION OF INSURANCE RATES FOR METRO-PLO( CAB COMPANY Mr. McFarland stated that Mr. Shackelford has made inquiries and the State Insurance Board has provided per unit prices on tax2 cabs, The cost of insurance, through a regulated agency, for two (2) vehicles is $1,742.00 and 2Ir. Hammonds stated his insurance agent will charge him $3,829.57 for the same amount of coverage. Mayor Samuels inquired if Mr. Hammonds had attempted to get insurance through a regulated agency. Mr. Hammonds stated no, that the agency he is using will charge him $3,829.57 and if he could go through the State Insurance pool, he can get insurance in the amount of $10,000, $20,000, and $5,000 for approximately $1,400.00. Mr. McFarland stated that Mr. Hammonds indicated he can get the rquired amount of insurance coverage from a non - regulated insurance company at approximately double the State Insurance price and i f he can get into the insurance p000l, he can get a reduced amount of insurance at a reduced cost. Mr. McFarland stated that, in his opinion, it is a policy decision for the City as to whether or not they want the citizens of Euless to ride as passengers in a community carrier, franchised by the City, to be covered by the minimum allotted by the State law; the Council established the amount of $25,000, $50,000, and $10,000 in the Certificate of Convenience and if the Council lowers these amounts they will have to amend the Certificate of Convenience. Mr. McFarland inquired of Mr. Hammonds if he can find a regulated company that will insure him for $25,000, $50,000 and $10,000 for $1,742.00, would he be agreeable to this. Mr. Hammonds stated he would be agreeable. Mayor Samuels stated the Council had promised Mr. Hammonds an answer by this meeting, but wi 11 delay action until the next Council meeting. III FINAL PLAT APPROVAL - TRACT 1, BLOCK D. INTERNATIONAL/ REGIONAL INDUSTRIAL COMPLEX Mayor Samuels recognized Mr. Walter Elliott who stated he is representing the owners of Tract 1, Block D, International /Regional Complex and located the property on the City's map. e Three Re:ula' Jeetin_, Euleaa Cit Council Ma 11, 1976) Mr. Elliott stated they are asking for approval and will meet Item 1 of the Engineer's letter and will comply with all regulationso. the City. Mrs. McCormick moved to concur with the recommendations of the Planning and Zoning Commission and approve the final plat of Tract 1, Block D, International /Regional Complex. Mr. Walker seconded the motion and the vote is as follows: Ayes: Mrs, McCormick, Messrs. Walker, Pippin, Ozebek, and Hunt Nays: None Mayor Samuels declared the motion carried. TV RECOMMENDATIONS OF CODE & ORDINANCE COMMITTEE - CHANGES IN ORDINANCE NO. 347 Mayor Samuels recognized Mr. Dick Wells, Chairman of the Code and Ordfnance Committee. Mr. Wells stated the Committee has had several meetings and are presenting their first recommendations. Mr. Wells presented the request as fo11ows4 8 -200 SCHEDULE OF MINLNIJM OFFS- STREET PARKING FOR DWELLINGS CONSTRUCTED PRIOR TO (Date of Final Council Approval) R -1 R -2 R -3 R -4 R -5 C -1 C -2 Single- Family Dwelling 1 1 1 1 1 1 1 (Detached) Single - Family Dwelling 1 1 1 1 1 1 1 (Attached) Two - Family Dwelling 1 2 2 2 2 2 Spaces per Dwelling Unit Multiple- Family Dwelling 2 2 2 2 2 Spaces per Dwelling Unit 8 -200 SCHEDULE OF MINIMUM OFF- STREET PARKING FOR DWELLINGS CONSTRUCTED AFTER (Date of Final Council Approval) A minimum of two off - street parking spaces shall be provided for each dwelling unit for single- family, two- family, or multiple - family dwellings in "R. -1 ", "R-2 ", "R -3 ", "R -4 ", "R -5 ", "C -1 ", "C-2 ", or Mobile Home Districts. (Page Four, Regular Meeting, Euless City Council, May 11, 1976) 8 -500 8 -501 (1) An off- street parking space shall be a striped area of not less than one hundred sixty -two (162) square feet, measuring approximately nine (9) by eighteen (18), not located on a public street or alley. Such parking space, aisles and maneuvering areas shall have an all- weather surfacing, en- closed or unenclosed, and shall be connected by an all - weather surfaced driveway to a street or alley. Head -in parking adjacent to a public street or alley wherein the ' maneuvering of the vehicle in parking or leaving a parking space is done on a public street or alley shall not be classified as off- street parking in computing any parking requirements herein specified; however, this does not apply to "R -1" and "R--2" Zoning Districts. No required off- street parking space shall be located in the required front yard in Multiple - Family Districts. Dwellings in Single - Family, Two - Family, or Mobile Home Districts can utilize the required front yard for off- street parking. In new dwellings requiring two off- street parking spaces, the parking area shall have minimum dimensions of eighteen (18) by eighteen (18) feet. 8 -502 DELETE Mr. Wells stated that these amendments were presented to the Planning and Zoning Commission for their review and they recommend approval. Mr. Pippin stated he is a member of this committee and he supports the recommendations fully, but he feels any changes to be made should come before the public in a public hearing. Mr. Hunt inquired if there was any par- ticular urgency in the passage of these amendments or could they have a public hearing on all the recommended changes at one time. Mr. Shackelford stated it is very urgent on these first changes as the City has had numerous applications for enclosing garages. Mr. Wells stated the committee first thought about reviewing Ordinance No. 347 and presenting recommendations on the complete package, but it would be approximately six (6) or eight (8) months before completion and a revision of that magnitude may require a four (4) or five (5) hours public hearing and they decided it would be more logical to present the amendments in sections and a public hearing would not be as lengthy. Mr. Ozebek seconded the motion and the vote is as follows: Ayes: Messrs. Hunt, Ozebek, Walker, Pippin, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. V CITY ENGINEER'S REPORT - BIDS ON MISCELLANEOUS WATER AND SEWER IMPROVE, MENTS Mr. Flowers stated that on May 4th they received bids on miscellaneous water and sewer extensions and nine (9) bids were submitted. He stated the specifications call for numerous material options and alternates for the miscellaneous water and sewer extensions, Mr. 'Plowers stated he recommends Ben Sira and Company be awarded the bid with. Option 3 in the amount of $262,829.05 authorizing A. C. pipe alternates and construct the proposed water line at Highway 183. pipe is used In Euless, Mr, Pippin inquired if any of this type Mr. 'Plowers stated affirmatively. Mr. Walker moved to accept the recommen- dation of the City Staff and City Engineer and award the bid to Ben Sira - and Company with Option 3 in the amount of $262,829.05. Mrs. McCormick seconded the motion and the vote is as follows; Ayes: Mr, Walker, Mrs. McCormick, Messrs. Pippin, Ozebek, and Hunt Nays: None Mayor Samuels declared the motion carried. (List of bids are on file in Office of City Secretary) VI CITY ATTORNEY'S REPORT Mr. McFarland stated he presented his report in an executive session at the pre- council meeting on litigation and land acquisition. 0 . 4 (Page Six, Regular Meeting, Euless City Council, May 11, 1976) VII AUDIENCE REQUESTED BY LEON SHEPPARD Mr. Leon Sheppard, 1109 Raider Drive, stated that he owns several acres on Raider Drive and is faced with a problem; that the City Ordinance states that when duplexes or four - plexes are constructed, fences will be built to separate the four - plexes from the residents. Mr. Sheppard inquired when a six (6) foot fence will be con- structed around the four - plexes, as he desires something be done about trash being dumped on his property. Mayor Samuels inquired when the four- plexes were constructed. Mr. Sheppard stated they were con- structed two (2) or three (3) years ago. Mr. Hunt inquired if a six (6) foot fence would be sufficient. Mr. Sheppard stated yes, as the people would then have to go and put their trash in a receptacle instead of throwing it in his yard. his property. Mayor Samuels inquired the zoning on Mr . Sheppard stated "C -2" Commercial. Mayor Samuels stated the Zoning Ordinance requires a screening fence between the residential and commercial, but does not require a screening fence between commercial prope -ty and even though he is living on this property, his property is till considered commercial. Mr. Sheppard inquired if he could erect a fence himself. Mr. Shackelford stated he could erect any type of fence except a barbed wire fence or an electric fence. VIII PASSENGER PICK UP AT AIRPORT Mayor Samuels recognized Mr. W. G. Ragley who stated he is President of the H -E -B Chamber of Commerce and is appearing before the Council to request a resolution to the Dallas /Fort Worth Airport Board in an attempt at reinstitution in relation to airport pick ups of hotel guests and rental car agencies from the lower level of the terminal, Mr. Ragley stated that it is not something the Council needs to do at this meeting, but the Chamber would appreciate it if they could consider it at the next meeting. (Wage $even, 'Regular Meetin p2 Euless City Council, May 11, 1976) IX DISCUSSION Mrs. McCormick stated she has had several calls from citizens concerning the spraying for mosquitoes in Euless. Mr. Shackelford stated that the City is beginning to spray tonight in the western section of Euless and will con- tinue until all the City is sprayed. Mrs. McCormick stated she received a letter from Mr. David Bayless who expressed his appreciation to the Council on Youth in Government Day. Mrs. McCormick stated she thinks Officer Rick Griffin should be given a great deal of thanks for his contribution to this project . Mr. Ozebek inquired if the Mayor has had any reply from Mr. Dean concerning airport over flights in Euless. Mayor Samuels stated the twin engine plates: are mail planes and Mr. Dean indicated they w i l l be talking to the carriers about rescheduling these flights to prevent this over flight. Mayor Samuels stated that he, some of the firemen', Fire Chief Livingston, and the Troy Ann Officers had their picture made with the new pumper fire truck to publicize the Bi- Centen- nial sidewalk fair on May 22nd. Mr. Hunt stated the firemen.. are going to have a public demonstration of the new pumper at the sidewalk fair. Mr. Pippin stated the Council should take, as utmost importance, to provide good ambulance service to the citizens and should place this as top priority and take action on it as soon as possible. Mayor Samuels stated the Hospital Can - mittee Board on emergency ambulance service has presented a report to the Council and are requesting a meeting of all three Council's next week. Mr, Sheppard stated he has a water well on his property and a member of the City Staff has advised him that he needs a permit or sign on his property. Mr. Shackelford stated that Mr. Sheppard does not need a permit for his well. 7 5 246 (Page Eight, Regular Meeting, Euless City Council, May 11, 1976) X T.R.A. WATER STUDY Mr. Shackelford stated that the City Manager has received a letter from Mr. Danny Vance of T.R.A. on the water supply study between T.R.A. and Tarrant County on T.R.A.'s Bedford - Euless plant. Mr. Shackelford stated that Mr. Vance would like a letter from the City to Mr. Murphy Kleuser advising him that Euless is in agreement with the arrangement of the financing of the study. The Council was in agreement for the City Manager to send a letter to Mr. Kleuser. XI LEASE OF BUS FOR RECREATION IMAM Mayor Samuels stated that St. John School has offered the City the use of their bus for the summer program with the following agreement: 1. The period of usage is to extend form June 1 - July 23, 1976. 2. In exchange for this privilege, the City of Euless agrees to the following: A. To place and maintain the bus in mechanically stable operation B. To license and insure the bus for the period of usage. C. The City will assume all liability during its usage.
