Zoning Board of Adjustment
February 12, 1970
CALL TO ORDER
The Called Meeting of the Zoning Board
of Adjustment was called to order at 7:54 P. M. , in the Council Chambers
of Euless City Hall , with Chairman Henry Uselton presiding. Members present
are listed as follows: Messers. Bob Noonan, Bob Jones, Glenn Walker, Bob
Baker and Uselton.
Also present was City Inspector Jack
M. Bullard.
VISITORS
Visitors in attendance were Mr. and
Mrs. Jene G. Butler, Mr. C. W. Staff le and Mr. C. E. Fettinger, represent-
ing the Joy Corporation.

APPEAL FROM MR. C. E. FETTINGER,
REPRESENTING JOY CORPORATION, FOR
APPROVAL OF ADDITION CONSTRUCTED TO
EXISTING STRUCTURE AT 207 WEST
ALEXANDER
Chairman Uselton opened the Public
Hearing on Case No. 16, which was called to consider an appeal from Mr.
C. E. Fettinger, representing Joy Corporation, over a decision from the
City Building Inspector that a recently constructed addition to an existing
structure located at 207 West Alexander is in violation with Building Code
Ordinances No's, 28 and 39, and is also in violation with side yard set-
back requirements and uses permitted within a residential area, as set
forth in City of Euless Zoning Ordinance No. 347.
A discussion determined that a former
residence located at 207 West Alexander has been used as a rental office
for Oakwood Crest Apartments, and is presently being used for that purpose -
that owners of this building recently constructed an addition to this build-
ing without a building permit, said addition being of metal building materi-
als.
Mr. C. E. Fettinger, Appellant, advised
that he instructed the Manager of the apartments, owned by Joy Corporation,
to take care of the addition to the existing building and thought the Mana-
ger would comply with all City Ordinances in doing so -- that the Manager
apparently did not realize a building permit was required or that the pro-
posed addition would be in violation with City Ordinances. Mr. Fettinger
stated that he is hopeful the Board of Adjustment will approve the addition
to this building, in order that he may avoid total destruction of the impro-
vements.

and Messers. Jene Butler and C. W. Staffle advised that, in their opinions,
the existing structure should not be used as an office -- that it should
be used only as a single family residence.
Members of the Board reviewed City of
Euless Ordinances No' s. 28, 39, and 347, and determined that several viola-
tions are iniolved in this case, which are listed as follows:
1 . The addtion was constructed without a building permit;
2. Use of metal building materials for construction is prohibited
within a residential zoning district;
3. The side yard setback is inadequate to meet the City' s restric-
tions, and
4. Use of a residential building as storage for a business operation
is iri violation with the City's Zoning Ordinance.
Chairman Uselton asked if there were
others who wished to speak concerning Case No. 16. There being none, the
Public. Hearing was closed.
Chairman Uselton advised Mr. Fettinger
that a decision would be reached by the Board of Adjustment, and that he
(Mr. Fettinger) will be notified concerning the decision.
Mr. Fettinger left the Council Chambers at this time.
Mr. Jones moved to decline the varia-
tions of City Ordinances No' s. 28, 39, and 347, denying Mr. Fettinger 's
appeal for approval of the recently constructed addition to the existing
structure located at 207 West Alexander, ordering removal of the addition
and its contents by April 1 , 1970, and ordering further that, should the
residence located at this address sell at any future date, it shall cease
to be used as a rental office for the apartment complex. Mr. Walker
seconded the motion, and the vote is as follows:
Ayes: Messers. Jones, Walker, Noonan, Baker and Uselton
Nays: None
Chairman Uselton declared the motion carried.
