HomeMy WebLinkAbout1970-06-08 Called Meeting of the Zoning Board of Adjustment June 8, 1970 CALL TO ORDER Acting Chairman Glenn Walker called the meeting to order at 8:00 P. M. in the Council Chambers of Euless City Hall , with the following members present: Messrs. Bob Jones, Norman Flanagan, alternate, Tim Hobbs, alternate, and Glenn Walker. (Absent: Messrs. Bob Baker and Bob Noonan.) Also present were City Inspector Jack Bullard, City Attorney James Cribbs and City Secretary Veda Ferris. VISITORS Visitors in attendance are listed, as follows: Messrs. and Mesdms. M. B. Rodgers, Edward J. Barnes, A. 0. Adkisson, Robert L. Meyer; Mrs. Robert Christensen; Messrs. E. E. Caygle, Jr. , Ken Allmond, James L. Hine and Councilman Harold Copher. PUBLIC HEARING, BOARD OF ADJUSTMENT CASE NO. 19, REQUEST OF MR, K. P. ALLMOND FOR I SSIJ"ANCE "0F 'A BUI LQI NG, PERMIT, LOTS 1 AND'2, ROCK IMBER- LINE ESTATES, 2000 MARLENE Chairman Walker opened the Public Hearing on Zoning Board of Adjustment Case No. 19 and called on City Inspector Jack Bullard to explain the case. Mr. Bullard advised that Mr. K. P. Allmond had applied for a Building Permit to construct a building on Lots 1 and 2, Block 3, Timberline Estates (2Q00 Marlene) , advising that the proposed structure, which could be used as Servants' Quarters or a Guest House, possibly for elderly parents, contains nine hundred and forty-one (941) square feet of living area. Mr. Bullard stated that the City's Zoning Ordinance requires a minimum of eleven hundred (1100) square feet; therefore, it was necessary for him to deny Mr. Allmond's request for a building permit. Mr. Bullard stated further that deed restrictions for this subdivision require more than nine hundred and forty-one (941 ) square feet, as proposed by Mr. Allmond; however, it would be the citizens ' 40, 400 40) 400 (Page Two, Called Meeting of the Zoning Board of Ad iustmento June 8, 1970) responsibility to see that the deed restrictions are enforced, if issuance of this building permit is authorized by the Zoning Board of Adjustment. Chairman Walker called. on Mr. K. P. Allmond, who explained that he desires to construct a building which will have a three car garage, with living quarters above the garage •- that actually, there are nine hundred and eighty-one (981) square feet in the pro- posed plans -- that he has not made any plans to alter his present residence. In reply to a question from Chairman Walker, Mr. Allmond advised that he does not have servants at the present time because he does not have accommodations for them. City Attorney Cribbs inquired concerning the distance of the proposed building from the existing residence. Mr. Allmond replied that, the proposed structure will be approximately thirty-four (34) feet from his residence that it will be built on a full street, fronting Evans, and he plans to tie onto existing utility lines. In reply to a question from an unidentified visitor in the audience, Mr. Allmond stated that the proposed building will be 80% brick veneer. Mr. Bob Meyer questioned the City Zoning Ordinance, stating that he is of the opinion this request will go before the City Council regardless of any action taken by the Board of Adjustment. The City Attorney explained the procedure and powers of the Zoning Board of Adjustment, to clarify Mr. Meyer's question, advising that Zoning Board of Adjustment cases are not presented to the City Council . Mr. Meyer stated that he is opposed to Mr. Allmond 's request because he does not approve of waiving an Ordinance. Mr. M. B. Rodgers stated that he purchased his residence approximately one and one-half (12) years ago -- that the property is very expensive -- that he moved into a restricted area and is of the opinion construction of servants ' quarters, as proposed by Mr. Allmond, will lower the value of the property. A gentleman stated that he lives near Mr. Allmond and would not object to this request if he was certain that Mr. Allmond would always own the property -- that Mr. Allmond keeps his property well , but there is a possibility the property might sell sometime in the future; there- fore, he would have to oppose it at this time. 4WW 4101 40) IWO (Page Three, Called Meeting of the Zoning Board of Adjustment. June 8 1970) Mr. Allmond stated that the property line will have to be erased -* that the two lots will beck one. Mr. Allmond stated further that he plans to live at this location for a long time. Chairman Walker inquired concerning location of the entrance to the garage. Mr. Allmond advised that the proposed build- ing faces Evans, and the garage entrance will be on Evans. In reply to a question, Mr. Allmond stated that his residence contains approximately 2,370 square feet v, that all of the homes in this area contain approximately this amount of floor space. Chairman Walker closed thf Public Hearing on Case No. 19 at 8:25 P. M. and advised that the Board of Adjustment will discuss the case further before reaching a decision -- that Mr. Allmond will be advised by letter of their decision concerning his request. Visitors retired from the Council Chambers. Councilman Harold Cophfr, who was invited by the City Attorney to stay for the remainder of the meeting, commented that he is present as an observer. II . DECISION: BOARD OF ADJUSTMENT CASE NO. 19 Members of the Board discussed City of Euless Zoning Ordinance No. 347, in relation to Mr. Allmond's request. In reply to a question from Mr. Flanagan concerning Deed Restrictions, the City Attorney explained that the citizens could enforce the Deed Restrictions if this permit is granted by the Zoning Board of Adjustment -- that they (the citizens) could aPPeal to the District Court for a decision. Mr. Cribbs stated further that the only thing this Board needs to do is to decide whether or not they want to waive the Ordinance and grant this permit. Mr. Jones asked if the proposed structure meets all City requirements with exception of the square footage. Mr. Bullard stated that, possibly, it does; however, the garage area has only two doors, yet there are three bays -* that the portion which does not have a door could be converted into living space. (Page Four, Called Meeting of the Zoning Board of Adjustment June 8, 1970) Mr. Jones moved to deny Mr. Allmond's request for issuance of a Building Permit to construct the proposed building on Lots 1 and 2, Block 3, Timberline Estates. Mr. Hobbs seconded the motion, and the vote is as follows: Ayes: Messrs. Jones, Hobbs, Flanagan and Walker Nays: None Chairman Walker declared the motion carried. II . CORRECTION OF MINUTES, CALLED MEETING DATED MARCH 12, 1970 Mr. Norman Flanagan advised that Item II , Page 2, Minutes of the Called Meeting dated March 12, 1970, indicates that he voted on the motion concerning Board of Adjustment Case No. 18. Mr. Flanagan stated that he did not vote on the motion -- that he arrived late. III . ADJOURNMENT The meeting was adjourned at 8:44 P. M. APPROVED: Chairman VF: ii
