Zoning Board of Adjustment
June 2, 1971
CALL TO ORDER
Chairman Tim Hobbs called the meeting to
order at 8:05 P. M. in the Council Chambers of Euless City Hall , with the following
members present; Messrs. Bob Baker, Robert Noonan, Wayne Widner and James
Banks, Alternate. (Absent: Mr. Norman Flanagan and Tom Hochleutner, Alternate.)
Also present were John Bayuk, Public Works
Director, and City Secretary Vada Ferris.
Mr. Widner stated he will not participate
in the discussion or vote because he was formerly associated with Mr. Meine in
business and they are now competitors.
VISITORS
Visitors in attendance are listed as
follows: Messrs. Monte Mitchell , A. R. Meine, Jr. , R. T. Miles, A. C. Krause
and E. L. Harmer.
PUBLIC HEARING: BOARD OF ADJUSTMENT
CASE NO. 20, REQUEST OF MR. BUDDY MEINE
FOR ISSUANCE OF A SIGN PERMIT
Chairman Hobbs opened the Public Hearing
on Zoning Board of Adjustment Case No. 20 and recognized Mr. Buddy Meine.
Mr. Meine stated that he had applied for
a permit to erect a sign between the 1300 and 1400 block of West Euless Boulevard,
near the Wilshire Shopping Center, to advertise his television business. He
stated that the sign, an eight (8) foot marquee, has already been constructed
and is ready for installation, as he was not aware that there would be any
difficulty in obtaining a permit. Mr. Meine also stated that he proposes to
install the sign between the First State Bank and Fort Worth Savings and Loan
Building -- that he is of the opinion the sign is a general business sign to
be located on property on which his business establishment is located.
Mr. John Bayuk, City Public Works Director,
read from Section 9, City of Euless Zoning Ordinance No. 347, stating that the
City Building Inspector denied issuance of a permit for the sign because he is
of the opinion it is classified as an Advertising Sign, which is in violation
with the City's Zoning Ordinance. Mr. Bayuk stated that the property on which
the sign is to be constructed belongs to Mr. Herman Smith, and Mr. Meine is leasing
a portion of the property.

Mr. Bayuk presented drawings of Mr. Meine 's
sign and stated that the sign, if erected on the proposed site, would block
the view of First State Bank from the West and would also block certain businesses
on the East. Mr. Bayuk stated that Mr. Bullard, the City Building Inspector,
had recommended that Mr. Meine place the sign to the right of the Piggly
Wiggly sign -- that this would "bend" the Ordinance; however, Mr. Meine was
not in agreement with this recommendation.
Mr. R. T. Miles, Attorney representing
Mr. Meine, read definitions of grounds and premises from Webster 's Dictionary
and pointed out that there are several signs located on buildings in the area
and his client is requesting this sign in an effort to advertise his business
establishment which is located in Wilshire Shopping Center.
Mr. Bayuk pointed out that Mr. Bullard
did not know the location of the sign when Mr. Meine called and inquired about
a sign.
Chairman Hobbs recognized Mayor A. C.
Krause, who stated he is concerned about what constitutes ownership of property.
Mr. Meine stated that, at the time he
leased the property, the owner, Mr. Herman Smith, stated that a large sign
would be erected in the shopping center area advertising each business in the
area; however, this has not been done.
Mr. Meine stated further that he had
contacted Mr. Herman Smith, the Piggly Wiggly Store and a few other businesses,
and all of them stated that they have no objection to the sign.
Chairman Hobbs closed the Public Hearing
advising that the Board of Adjustment will consider the case further before
making a decision. (Members of the Board adjourned to the Conference Room
at this time.)
Mr. Noonan made a motion to approve
Mr. Meine 's request for a permit to construct the proposed sign.
Chairman Hobbs seconded the motion, and
the vote is as follows:
Ayes: Messrs. Noonan and Hobbs
Nays: Mr. Banks
Abstained: Mr. Baker
Chairman Hobbs declared the motion failed to carry.
Members of the Board discussed the matter
further.
Mr. Noonan made a motion to approve
Mr. Meine 's request for a permit to construct the proposed sign.

Chairman Hobbs seconded the motion, and
the vote is as follows:
Ayes : Messrs. Noonan, Hobbs, Banks and Baker
Nays : None
Chairman Hobbs declared the motion carried.
Mr. Banks commented that he voted in favor
of the motion with reservations.
(Members of the Board returned to the Council Chambers.)
Chairman Hobbs announced that the Zoning
Board of Adjustment has approved Mr. Meine 's request for a permit to construct
the proposed sign.
Mr. Meine thanked the Board for its
consideration.
