HomeMy WebLinkAbout1972-02-03 (1104 41110' NW) Called Meeting Zoning Board of Adjustment February 3, 1972 CALL TO ORDER Chairman Tim Hobbs called the meeting of the Zoning Board of Adjustment to order at 7:35 P. M. in the Council Chambers of Euless City Hall , with the following members present: Messrs. Wayne Widner, Robert Noonan, Tom Hochleutner, Robert Baker and Jim Banks. (Absent was Alternate Norman Flanagan.) Also present were City Secretary Vada Ferris and City Attorney James Cribbs . VISITORS Visitors present were Mr. Donald McIntosh and Mr. Coy B. Moon. PUBLIC HEARING: BOARD OF ADJUSTMENT CASE NO. 22, REQUEST OF MRS. DARLENE MCINTOSH FOR ISSUANCE OF A CERTIFICATE OF OCCUPANCY FOR A MOBILE HOME Chairman Hobbs opened the Public Hearing of the Zoning Board of Adjustment Case No. 22 to consider the request of Mrs. Darlene McIntosh for appeal of the building Inspector 's decision to deny issuance of a certificate of occupancy for a mobile home, located on 32 acres East of North Main Street on Harwood Road, to be used as living quarters for Mrs. McIntosh's family. Mr. Hobbs recognized Mr. McIntosh, who stated that he purchased this mobile home in November, 1971 , because the house he leased on the 32 acres is old, uninsulated and very cold. He stated that there are seven (7) children in the family -- one of whom is an asthmatic and that the central heating system in the mobile home is very essential to her health. He stated he has leased the property from Mr. Bob Eden, who has no objection to the mobile home being located on the property. The mobile home has three (3) bedrooms, two (2) baths, and is so much more comfortable than the house. Mr. McIntosh stated they have two babies -- one two years old and one a year old, and the open heaters in the old house are, in their opinion, dangerous to small children. City Attorney Cribbs arrived at 7:45 P. M. and in answer to a question by a member of the Zoning Board of Adjustment, advised that the mobile home is a non-conforming use and is in violation of the City's Zoning Ordinance. M. ) (6110( kimoy (Page Two, Called Meeting of the Zoning Board of Adjustment, February 3, 1972) Mr. McIntosh stated that his family enjoys living in this rural area and that he raises almost all of their food -- also he has a cow, he butchers two calves and hogs, in order to help feed his family -- that with a family as large as his he would find it very difficult to purchase all the items necessary. In reply to a question from one of the Zoning Board Members, Mr. McIntosh stated that it would not be desireable for his family to live in a mobile home park -- that he would experience difficulty in finding a mobile home park that would accept seven children -- also that he owns several large pieces of equipment and trucks which he uses in his work, and a modern mobile home park would not allow him to park this equipment near his mobile home. Chairman Hobbs recognized Mr. Moon, who stated he and his wife are very proud to have Mr. and Mrs. McIntosh and their family as neighbors -- that they have made the acreage in the area most presentable and a desireable place to live. He also stated that the old house that Mr. and Mrs. McIntosh formerly lived in is not insulated and is very cold and drafty and inadequately heated and that it is not a place to raise children. There were no further questions and the chairman declared the Public Hearing closed. The members of the Zoning Board of Adjustment adjourned to the Conference Room. Members of the Board expressed concern that allowing the mobile home would set a precedent; however, they also were concerned of the plight of Mr. and Mrs. McIntosh and their seven children. Mr. Hochleutner suggested that Mr. McIntosh be allowed a reasonable time to move his family to another location, following the closing of the school term this year. Mr. Noonan suggested that possibly it should be sometime during the summer and the Board agreed to allow the mobile home to remain in its present location until September 1 , 1972. The Board also expressed an opinion that the Zoning Ordinance should be applied to all of the mobile homes in violation of the ordinance in the City of Euless. The Zoning Board of Adjustment re-convened in the Council Room and Mr. Hochleutner inquired of Mr. McIntosh if he is aware that the Board can deny the request and order that the mobile home be moved immediately or that they can allow him a reasonable length of time to move the mobile home in order not to enforce a hardship on his family. Mr. McIntosh stated that he understood the Board had this right and expressed his appreciation for their consideration. Mr. Noonan moved to deny the request for the Certificate of Occupancy for the mobile home as submitted by Mrs. McIntosh and that the mobile home must be moved from these premises by September 1 , 1972. 4M0000 '01011) (Page Three, Called Meeting of the Zoning Board of Adjustment, February 3, 1972) Mr. Banks seconded the motion and the vote is as follows: Ayes: Messrs. Wayne Widner, Robert Noonan, Tom Hochleutner, Robert Baker, Jim Banks, and Tim Hobbs. Nays: None Chairman Hobbs declared the motion carried. Mr. McIntosh expressed his appreciation to the Board. II .
