Zoning Board of Adjustment
December 22, 1977
CALL TO ORDER
The meeting of the Zoning Board of
Adjustment was called to order at 7:30 p.m. in the Council Chambers of
Euless City Hall by Jim Banks, Acting Chairman. Members present were Messrs.
Lucian Holmes, Bob Eden, George Winter, and Don Calhoun.
Also present were Director of Planning
and Development Rick Barnes and Recording Secretary Becky Gunter.
VISITORS
Visitors in attendance were Messrs.
James and Gaylon Mayfield and Mrs. Helen Lightbody.
CONSIDER APPEAL - FOR A VARIANCE
TO ALLOW OWNER TO BUILD A HORSE
BARN ON LOTS 9, 10, 11 , 22, 23, &
24, J. E. WHITNER ESTATES - REQUEST
OF NORTEX BUILDING CORPORATION.
(PROPERTY LOCATED NORTH OF EAST
PIPELINE, EAST OF KNOB HILL MOBILE
HOME PARK)
Mr. Mayfield stated he is representing
Nortex Building Corporation in their request for a variance to allow a barn
to be constructed on the subject property. Three houses were build on Lots
9, 10, and 11 with an adjoining lot of the same size in back of those lots
to be sold with the house. A buyer for Lot 9 has already been located and
he is wanting to build a barn on the adjoining lot for his wife's show horses.
Since the two adjoining lots would be a total of about seven acres, most of
the prospective buyers have been people interested in horses as this would
allow considerable area for the horses to run. This is the reason they are
also requesting the variance for the other four lots.
Mr. Eden asked if there are any houses
to the North of this property.
Mr. Mayfield stated there are none at
this time.

Mr. Holmes asked what the zoning is of
the subject property.
Mr. Mayfield stated it is zoned "R-1".
Mr. Banks asked what the zoning is of
the property to the North.
Mr. Barnes stated it is zoned "R-1".
Mrs. Lightbody stated there are a few
items that should be considered before making a decision. First, there is
a proposed single family development on the seventy acre tract owned by
Mr. James immediately North of this property. A barn would be a deterant
to the development of this property. The barns could be used for other
animals other than horses, such as pigs or cows. It would not be restricted
to horses only. Next, the basic land usage would be changed on the
assumption that the other two property owners will be horse lovers, and
will adversly influence living conditions. Lastly, the variance should
not be granted merely because other property in the area is not developed.
It is zoned residential and this should be considered.
Mr. James stated he lives in Dallas
and is a co-partner of the seventy acre tract of land North of the subject
property. This is one of the largest undeveloped tracts of land left in
Euless. They are actively negotiating the development of the property;
they plan to plat the subdivision and then sell the lots to builders who
will build houses within the $65,000. to $85,000. price range. However,
he feels the location of one and possibly three barns immediately South
of his property would have a definite effect on the financing of his
property.
Mr. Mayfield stated that the ordinance
allows horses to run on the property now; only the barn is not allowed.
Mr. Barnes stated that the ordinance
does allow horses on residential property. However, they must be fenced
within 100 feet of the property line. Therefore, the request is actually
for a variance in the distance requirement.
Mr. Holmes made a motion to deny the
variance.
Mr. Calhoun seconded the motion and
the vote is as follows: '
Ayes: Messrs. Holmes and Calhoun.
Nays: Messrs. Eden and Winter.
Acting Chairman Banks declared the request
for the variance failed.
