Zoning Board of Adjustment
February 2, 1978
CALL TO ORDER
The meeting of the Zoning Board of
Adjustment was called to order at 7:40 p.m. in the Council Chambers of Euless
City Hall by Acting Chairman George Winter. Members present were Messrs.
Lucian Holmes, Carroll Davis, and Billy Owens.
Also present were Director of
Planning and Development Rick Barnes, City Attorney Bob McFarland, and Record-
ing Secretary Becky Gunter.
VISITORS
Visitors in attendance were Messrs.
Troy Fuller, C. E. Cauttrell , Kenneth C. Whiteley, Don Wooldridge, Ron Addison,
Michael P. Clinton, W. T. Geer, Kenneth Swindell , Jerry Waldon, Charles Hunt,
Joe F. Moreland, Marvin Webster, and Mesdms. Troy Fuller, Jewell Cauttrell ,
L. B. Holmes, and Jackie Waldon.
CONTINUATION OF HEARING - FOR A VARIANCE
TO THE SETBACK REQUIREMENT FOR A HORSE
BARN ON LOTS 9, 10, 11 , 22, 23, AND 24,
J. E. WHITNER ESTATES - REQUEST OF
NORTEX BUILDING CORPORATION. (PROPERTY

Acting Chairman Winter requested
the proponents for the variance to identify themselves to the chair and outline
any new materials they wish to present.

Mr. Fuller, with offices located
at 1004 West Euless Blvd. , stated he is representing Nortex Building Corpor-
ation. He stated he visited with Mr. Tom James, a part owner of the property
immediately North of the subject property, who was very much opposed to the
variance at the previous meeting. Mr. James had a topo map made of his property
and is considering some type of residential development within the next two
years. He arrived late at the previous meeting on this variance and was under
the impression that the barn would house about one hundred horses, which he
would be opposed to. However, after being informed that the barn would be for
an individual owner and not part of a commercial enterprise, he no longer is
opposed to the variance. Mr. Fuller read a letter from Mr. James, which is
made a part of the minutes, stating that he and the other owners of the property
adjacent to the subject property withdraw their objection to the variance. Mr.
Fuller stated that Mr. James indicated to him the intended price range for the
houses to be built on the seventy acres to the North is from $60,000.00 to
$75,000.00, whereas the tracts on which the variance is requested contain three
houses and 3.5 acres of land each with an appraised value of $79,000.
Mr. Fuller presented the slides of
a similar subdivision in Orange County, California. He showed an aerial photo-
graph of the subject property indicating the creek which goes through the
property at the North end.
Acting Chairman Winter asked if
there is a restriction on the number of horses allowed in each stable.
Mr. Barnes stated the restriction
is on the square footage required per horse.
Mr. McFarland stated the Animal
Ordinance provides that any lot containing a horse must contain at least
7,200 square feet, and once that requirement is met, there must be an additional
1 ,000 square feet per additional animal . Mr. McFarland pointed out that the
variance does not vary the Animal Ordinance. He asked what the total number of
square feet is per lot.
Mr. Davis each lot contains
151 ,200 square feet. He asked if this would allow 145 horses ontheproperty
based on the requirement of 7,200 square feet for the first horse and 1 ,000
square feet for each additional horse.
Mr. McFarland stated there are
additional restrictions within the Zoning Ordinance which allows a maximum
of four horses in this zoning category.
Mr. Holmes asked if there is a
possibility of the barns being used as a commercial enterprise.
Mr. Fuller stated there is not;
not that he is aware of. He stated he believes the couple that were consider-
ing buying the house are no longer interested.

Mr. Wooldridge stated this is
Mr. Holmes asked how the police
would be able to patrol the limitation of only four horses.
Mr. McFarland stated it would be
the same as with other animals; when there is a complaint, the animal control
officer investigates and takes necessary action. There is not a sufficient
number of animal control officers to do otherwise.
Mr. Owens asked if the developer
or the owner would be building the barn.
Mr. Fuller stated the owner would.
Mr. Owens stated there are no plans
of what the barns would be like.
Mr. Fuller stated this is correct
as the lots have not been sold yet.
Acting Chairman Winter asked if
there were any other proponents.
Mr. Whiteley stated he has been
a Euless resident for about two months and has been a third owner in the sub-
ject property for about seven or eight years. The property at one time was in
the City of Fort Worth with an Industrial zoning. However, it later became
within the city limits of the City of Euless. At this time, they began con-
sidering different uses for the property and, when they finally decided on the
present use, the property on which the houses are located was actually zoned
for multi-family. He later discovered that if the zoning had remained multi-
family, the variance would not be necessary. However, the property is zoned
R-1 at the present time and, basically, he just wanted to assure the Board
members that their intentions are not to locate a commercial business on the
lots.
Acting Chairman Winter asked if
there were any other proponents.
Mr. McFarland requested Mr. Wool -
dridge to give his address for the records.
Mr. Wooldridge stated his address
is 1832 Southpark Drive in Arlington.
Acting Chairman Winter requested the
Recording Secretary to read the letter from Mr. Gerdts stating his opposition,
which is to be made a part of the minutes.

Mr. McFarland asked if the Board
members know the location of Mr. Gerdts' property.
Mr. Barnes located Mr. Gerdts'
property immediately West of the subject property.
Acting Chairman Winter asked if
there were any other opponents to the variance.
Mr. Webster stated he is represent-
ing the citizens of Knob Hill Mobile Home Park and lives at 90 Kevin Drive within
the park. He stated the slides were impressive, however they were of a sub-
division designed to appeal to horse lovers, whereas this is only three houses.
He stated there seemed to be several hundred feet between the homes in the slides,
whereas here there is less than 100 feet between the houses, as the lots are
only about 100 to 120 feet wide. Concerning the creek that goes through the
North end of the property, equipment is available to make it suitable for develop-
ment if the developer wanted to develop it. Also, there is no guarantee that the
barns built on this property will be as nice as those shown in the slides.
Mrs. Cauttrell , of 16 Kenneth Drive,
stated she is opposed to the horse barns for sanitation reasons, as there is a
school , swimming pool , and a park in the immediate area. She has lived at this
location for five years and is against the variance because she feels the horse
barns will take away from her property.
Mr. Addison stated he is an attorney
with offices located at 132 Bedford-Euless Road in Hurst and represents Nortex
Building Corporation. The variance is to allow the construction of a horse barn;
animals are allowed on the property without the variance. They are only request-
ing permission to construct a horse barn on the property if the purchaser so
desires, which if he does not desire to do so, the variance would not be used.
If the City desires to put a limitation on the size of the barn, the number of
horses allowed or the setback, this would be agreeable with Nortex Building
Corporation.
Mrs. Holmes asked if it was stated
that horses are allowed on any lot within the City of Euless.
Mr. Addison stated this is correct
if the square footage requirements are met.
Mrs. Cauttrell stated a barn would
be for more than one horse, which is what she is opposed to.
Acting Chairman Winter asked if
there were any other opponents.
Mr. Waldon, of 62 Kelly Circle,
asked that it be clarified that the 3.5 acres being discussed includes the
property on which the house is located; the barn and horses would not be on
the total 3.5 acres but only on the portion behind the houses.

Mr. Holmes made a motion to close
the public hearing.
Mr. Owens seconded the motion and
the vote is as follows:
Ayes: Messrs. Holmes, Owens, Winter, and Davis ,
Nays: None
Acting Chairman Winter declared the
motion carried.
A five minute recess was called.
After the meeting was reconvened,
Mr. Davis made a motion that the variance to the setback requirement for a horse
barn on Lots 9, 10, 11 , 22, 23, and 24, J. E. Whitner Estates as requested by
Nortex Building Corporation be denied.
Mr. Holmes seconded the motion and
the vote is as follows:
Ayes: Messrs. Davis, Holmes, Winter, and Owens
Nays: None
Acting Chairman Winter declared the
motion carried.
