HomeMy WebLinkAbout1999-04-29 MINUTES ZONING BOARD OF ADJUSTMENTS APRIL 29, 1999 The regular meeting of the Zoning Board of Adjustments was called to order by Chairman Bill Williams at 6:30 p.m. for consideration of scheduled items in the Council Chambers in Building "B" of the Municipal Building. The Pledge of Allegiance and Invocation was given by Board Member Gene Sloan. MEMBERS AND STAFF PRESENT: ABSENT: Chairman Bill Williams Eddie Price Vice-Chairman Gene Sloan John Deithloff Roger Bates Victor Blood Alex Wong Kevin Mercer, Development Services Manager Donna Brown, Admin. Secretary Dolores Tijerina, Staff Secretary VISITORS: Sadig Surani REGULAR AGENDA APPROVAL OF MINUTES Vice-Chairman Gene Sloan made the motion to approve the minutes of March 25, 1999, Zoning Board of Adjustments meeting as presented and the motion was seconded by Chairman Bill Williams. The vote was as follows: Ayes: Board Members Gene Sloan, Roger Bates, Bill Williams, Alex Wong. Nays: None Absent: Board Members: Price, Blood, Deithloff The motion carried. Zoning Board of Adjustments Page 2 April 29, 1999 ITEM I. PUBLIC HEARING REGARDING - #ZBA-99-02 - 610 West Euless Boulevard, Portion of Lot A, Tommy Peters Addition Public input regarding the request of Mr. Sadig and Salina Surani, for a variance to the sign ordinance side property line setback requirements for 610 West Euless Boulevard. Chairman Bill Williams opened the Public Hearing and asked Kevin Mercer, Development Services Manager, for the presentation. Kevin Mercer stated that Sadig and Salina Surani, are requesting a sign variance which would reduce the required side setback which is typically ten percent (10%) of the lot width, in this case that would equal 9.7 feet. He stated that the applicant is requesting a variance to the sideyard setback only, and that the applicant is asking for a deviation to the 9.7 feet required side yard setback, to allow the sign to be three (3) feet off the side property line. Chairman Bill Williams asked the applicant to come up and give his presentation. Mr. Sadig Surani, 610 W. Euless Blvd., Euless, Texas, stated that the parking lot of his business is small, and large vehicles have a difficult time turning in and out of the business. Mr. Surani stated that other areas had been considered for the placement and that on one side of the business the sign could not be placed because of the pea gravel. Chairman Bill Williams asked Mr. Surani if the current sign on the east side is by the property line and if its in violation of the ordinance. Mr. Surani stated that the current sign is in violation of the ordinance and that it will be removed and replaced by a new sign which Conoco Corporation wants to use stating "Image 2000". Alternate Board Member Alex Wong asked Mr. Surani that in his request he specifically asked for a three (3) feet setback, how was he going to make certain that if the variance was granted and when the installation was done he would not hit a gravel pit and did he want a range in case the three (3) feet requested did not work. Mr. Surani stated that if the three (3) feet did not work, then he would go eight (8) feet. Chairman Bill Williams asked Mr. Surani what the amount of space was between the property line and the new sign, and what is the closest he would have to get to that line to be able to install the sign that he needs. Mr. Surani stated three (3) feet and that if he went further than that he would hit a gravel pit. Alternate Board Member Roger Bates asked if anyone knew why the pea gravel was in that location. Mr. Surani stated that when the new tanks were installed the pea gravel was placed to keep the balance on the tanks. There being no opponents or proponents Chairman Bill Williams closed the Public Hearing and opened up discussion among the board members. Alternate Board Member Roger Bates stated that the situation did not seem to be self inflicted and that Mr. Surani had considered other areas on the property to try to comply with the ordinance. Chairman Bill Williams stated that Mr. Surani had presented some good information as to why other alternatives were not available and that he did not have a problem with the variance request. Vice-Chairman Gene Sloan made the motion to grant the variance as requested with the change that it not be granted for anything less than three (3) feet from the side property line. Alternate Board Member Alex Wong seconded the motion. The vote was as follows: Ayes: Board Members Sloan, Williams, Wong, Bates Nays: None Absent: Board Member Blood, Price, Deithloff The Motion Carried.
