PLANNING & ZONING COMMISSION
August 18, 1964
CALL TO ORDER
The regular meeting of the Planning &
Zoning Commission was called to order at 7:30 p.m. by the chairman, Edward
Smith. The following members were in attendance: Bert Heyl, J. A. Horton,
and Henry Uselton. Not present, taVern Lee, secretary.
Also present were Jack Bullard, City
Inspector and Fannie Gorman, recording secretary.
Visitors present were Bill Halby, Jim
Cash, Dorothy Claunch, Bill Fuller and Roy McGlothlin..
APPROVAL OF MINUTES
The minutes of the previous meeting
were read by the recording secretary in the absence of the secretary.
The minutes were approved as read.
OLD BUSINESS (129) I.
A request by the First Baptist Church for rezoning property as specified in
Exhibit "A" was considered. A Public Hearing date was set for Septeiiber 1,
1964. (Resolution No. 18).
NEW BUSINESS II.
The final plat for Section 8 of Wilshire Village was presented to the Com-
mission. It was noted by the chairman, that the Engineers had not studied
the final plat and there were no recommendations from them on streets,
drainage or plans for the construction of a bridge. A motion was made
by Henry Uselton to table the request until such time as the Engineers
had been presented a plat and profile and made their recommendations to
the Commission. The motion was seconded by Bert Heyl. The motion carried
unanimously.
DISCUSSION III.
The following lessees, Bill Halby, Jim Cash, Dorothy Claunch, Bill Fuller,
of the Oakwood Plaza Shopping Center, appeared in regards to the proposal
by the Commission that the property owner or interested persons meet with
John Morgan or his representative concerning the proposed land usuage ad-
jacent to the Shopping Center. (minutes, August 4, 1964, Item 3). Roy Mc-
Glothlin appeared in behalf of John Morgan, who had a recent heart attack
and was unable to attend. The concern of the lessees is an easement on
the East side oW their property to allow them sufficient room to have gar-
bage pickup and in the case of Bill Fuller, to allow a truck to unload
furniture at the rear of his store. There is presently a five foot (5)
utility easement on both properties. Several proposals were suggested
to acquire sufficient easement, however Roy McGlothlin stated his client,
John Morgan, was in competition with the lessees and could not feasibly
give an easement, but he felt a price could be put on an easement or for

the whole tract. Mr. McKenzie owner of the Oakwood Plaza Shopping Cen-
ihrter was not present as he was reported to be out of town. The lessees
concluded that they were interested in the two property owners working
out some arrangement to allow them alley-way, if they were to continue
in business. Bill Fuller commented that he had several thousand dollars
invested, liked the City of Euless and would not like to contemplate mov-
ing his business. Roy McGlothlin commented that to give footage on the
present frontage would limit the good useage of the land. Bert Heyl sug-
gested the two men work out some plan together. Roy McGlothlin said this
was impossible at the present time due to the state of John Morgan's health,
but he would do whatever possible to represent John Morgan in the matter,
if another party would do the same for Mr. McKenzie. The chairman stated
he felt it was up to the property owners to agree to some solution, as it
was not the duty of the Commission to tell a property owner how to use his
land, as long as the Ordinances of the City were complied with. The matter
was dropped at this point.
OTHER BUSINESS IV.
Jack Bullard, City Inspector, who attended the recent Third Annual Insti-
tute, Building Officials Association of Texas , August 9-12, reported on
the recommendations to City Planning by Mr. Odle, City Planner for the
City of Beaumont, Texas. Telescopic Zoning, which allows for lower zoning
in Commercial District was not recommended and the speaker suggested taking
Apartments out of the business areas completely. He further stated that
Planning & Zoning Commissions give intense study to the master plan for
zoning, following it as nearly as possible, eliminating "spot zoning".
He emphasized zoning ahead of a city's building progress.
ADJOURNMENT V.
The meeting was adjourned at 9:00 p.m by general consent of the members,
