Members present were: Frank Douglass, Ed Smith, Alter Horton, Henry Uselton, and Bert Heyl. Also present were: City Attorney, James Cribbs, City Engineers, Paul Gregory and Bill Ratliff and City Inspector, Jack Bullard. Visitors present were: Pat Everett, Zolon Wilkins, Perry C. Nash, Mr. & Mrs. J,H, Stone, Mr. & Mrs. M.B. Allen, Jack Apwisch, Herman Smith, Vern Rogers, Elizabei. Eagon, L.F. Mullinax, J.L. Wilcox, Mr. & Mrs. R.C. Eaton, S.W, Milis,W.E, Perry, Edwin Millican, W. H. Way, Buck Brisbon, Mr. & Mrs. Harrison Thomas, Mr. & Mrs. Sherrill B. Robertson, Mr. & Mrs. H. F. Willis, Mr. & Mrs, W. F. Fletcher, Mrs. L.M. Young and Effie McCoy. The minutes of the previous meeting were read and the following additions were made before approval: Amend minutes of March 3, 1964 to reflect that the motion in item III was seconded by Bert Heyl and that the motion in item IV was seconded by Ed. Smith. I. There was no representative at the meeting to present Zoning Case #119. A motion was made by Bert Heyl and seconded by Henry Uselton to approve the zoning change request on 13 acres of W, L, Byers property from residential to commercial. The motion carried unanimously. II. Public Hearing - Zoning Case #120, a request for a change in zoning designatior from residential to commercial of part of the S. W. Mills tract was presented by Jack Apwisch, Twenty minute time limits were set on proponent arguments and also equal time to oponents in the case with five minute rebutal periods respectively. Proponents: Jack Apwisch and Mr. Sam Mills. Although no plans were immediately being considered their contention was that best land useage could be obtained through commercial zoning. Oponents: Mr. & Mrs. H.E. Thomas, Mr. & Mrs. Harold Stone, L. F. Mullinax, Mr, & Mrs. Richard Eaton, Sherrill Roberts, and Mr. & Mrs. M.B. Allen voiced opposition to rezoning without knowing the specific development plans. A motion was made by Bert Heyl and seconded by Henry Uselton to request of the developer a topographkcai map of the area, showing the proposed improvements as to drainage problems and that it be submitted to the City Engineers for their study and approval. The motion carried unanimously. ihr III. Public Hearing - Zoning Case #115, a request for a zoning change on Tract A, Blk. 1, Tract A, Blk. 2 and Tract A, Blk, 3, Wilshire Village, from "A" Single Family Dwelling to "A-3" Multiple Family Dwelling, was presented by Herman Smith. A motion was made by Bert Heyl and seconded by Alter Horton that the request for rezoning as presented in Case #115 be approved. The motion carried unanimously. IV, Public Hearing - Zoning Case #121, a request for rezoning on certain lots in Cedar Hill Estates from "A" Single Family Dwelling to "A-2" and "A-3" Multiple Family Dwellings was presented by Pat Everett for Zolon Wilkins, (twenty minute argument time, five minute rebutal), Proponents: Pat Everett stated that apartments and duplexes would not harm neighborhood and that they had built multiple family dwellings on certain lots and expended moneys under the asumption that they were legally compatable with existing deed restrictions. City Attorney, James Cribbs explained the deed restrictions concerning the property in question and its aspects after being brought into the City of Euless. Oponents: Mr. & Mrs. H.P. Willis, 909 Vine Street, presented a petition with 24 names (petition attached to these minutes) opposing the rezoning. Brought out in opposition also was the possible traffic hazzard and the fact that they understood they were living in a single family dwelling neighborhood and duplexes had been built without proper zoning. Also opposed for the same reasons were: Mr. Nash, J.R. Wilcox; W.F. Fletcher, W.E. Perry, Bill Way, M,E, Millican, Elaine Young, and Mr. Sellers, of Pt. Worth, property owner in Euless. The error in issuing building permits was explained by the City Attorney. Bert Hey]. moved that the lots already containing the multiple family dwellings being lots 2 thru 9 of Blk. 11 and lot 15 of block 5, Cedar Hill Estates, be rezoned as "A-2" Multiple Family Dwelling, and only these lots. The remainder of lots to remain "A" Single Family Dwellings,. The motion was seconded by Henry Uselton and carried unanimously. V. 411, A motion was made by Alter Horton and seconded by Bert Heyl that Zoning Case #124, a request by William L, Minnelli to change zoning designation of lot 17, blk, 10 of Cedar Hill Estates from "A" Single Family Dwelling to "A-2" Multiple Family Dwelling be denied without public hearing owing to its unsuitability for such usage and further more that the City Secretary notify the applicant by mail of this decision. The motion carried unanimously. V/, The motion was made by Henry Uselton, seconded by Ed Smith that arrangements be made to have the City Secretary or City Manager present to take minutes and notes of future Zoning & Planning Commission meetings, due to the fact that long drawn out items on the agenda prevent the Secretary of said board from participatinf in the due process of the board. The motion passed unanimously. VII, A motion was by Henry Uselton to set a Public Hearing on April 21, 1964, on strip zoning suggested as amended (attached). The motion was seconded by Bert Heyl and carried unanimously. The meeting adjourned at 11:30 P.M. Minut-f approved: Atte Ciairman /~ GCS Secretary SUGGESTED STRIP ZONING ALONG HIGH^'JAY #183: Due to spots of land along Highway #183 not being in the City at the time Ordinance #33 was put into effect and the remainder of Highway #183 being strip 410,' zoned by Ordinance #33, it is recommended that an ordinance be drawn to strip zone the remaining property described as follows: First Section: BEGINNING at the City of Euless west City Limits; THENCE east by north along the north right-of-way of the north boundary line of Highway 183 for a distance of 1,133 ft. to intersection of Raider Drive and Highway 183. THENCE north 300 feet along Raider Drive; THENCE west by south in line with north right-of-way line of Highway 183 for 1250 ft to city limits; THENCE south 300 ft. to point of beginning. Second Section: BEGINNING at the southeast corner of the W.G. Fuller property already zoned commercial; THENCE east by north along north right-of-way of Highway 183 for 2,375 ft. to the west end of commercial strip; THENCE north 300 ft. along end of strip; THENCE west by south in line with north right-of-way line of 183 for 2,375 ft. to the east side of the W. G. Fuller property; THENCE south 300 ft. to the point of beginning. Third Section: That all the property known as Western Hills Inn not already zoned commercial because of its present non-conforming use, be zoned commercial described as follows: BEGINNING at a point in the west right-of-way line of Highway 157, 300 ft. north of the north right-of-way of Highway 183 THENCE west by south in line with the north right-of-way of 183 for a distance of 1000 ft. to the east side of the property owned by Western Hills Inn previously zoned commercial; THENCE north 385 ft. to the north side of property; THENCE east 832 ft. to point of beginning. Fourth Section: BEGINNING at the east city limits of the City of Euless and the north right-of-way line of Highway 183; THENCE north for 300 ft. along city limits; THENCE west 12,875 ft. to the northeast corner of the property owned by Jim Puckett, zoned Local Business; THENCE south 300 ft. to the north right-of-way line of Highway 183 THENCE east 12,875 ft. along the north right-of-way line of Highway 183 to the point of beginning It is suggested that the land in the southeast corner of Vine Huffman be zoned commercial, being a small portion of land not included in the 300' strip zoning of 183, Page 2 BEGINNING at the south corner of Vine ond Huffman Drive; THENCE east along Huffman for 325'; THENCE west by south along the north edge of 300' strip zoning, 362' to Vine St. THENCE north 250* to point of beginning.
