CALL TO ORDER I,
tor The regular meeting of the Planning & Zoning Commission
was called to order by the Chairman, Henry Uselton, at 7:45 p.m. The fol-
lowing members were in attendance: Messrs. LaVern Lee and Don Hastings.
Also present, Messrs. Jack Bullard, City Inspector and
Kenneth English, Consulting Engineer, (Gregory, Knowlton & Ratliff).
Visitors present were Messrs. Walter Elliott, Jr., R. Lind-
ley Lucas, Fred Ball, Easy Jernigan, David C. Moak, James A Lucas and R. J.
Jernigan.
PRESENTATION C1 MINUTES II.
The Minutes of the previous meeting, dated February 1, 1966,
were read by the Secretary. The Minutes were approved as read.
NEW BUSINESS III.
A. Public Hearing - Zoning Case #147 - Messrs, James and Lindley Lucas -
ririon - mange of zu5hsng from "A" to "C" - tract out of the Ter-
tel Jasper Survey,
Mr. James Lucas presented the petition for rezoning stating that he
had no specific customer or type of business in mind for the particu-
lar tract of land, but was desirous of having it zoned Commercial so
that it could be shown as such on the plat of the Lucas Estates and
potential buyers would be aware of the Commercial property in rela-
tion to the other lots in Lucas Estates. A discussion f olIowed con-
cerning the exact tracts of land to be zoned.
Mr. Easy Jernigan was recognized by the Chairman. He questioned the
Commission concerning the term "tracts" and stated that there had
been a reference to two tracts and it was his understanding that
there was only one tract of land. Mr. Jernigan was informed by the
Commission that there was only one tract of land, however it was
divided by a street, hence the reference to two tracts of land,
Mr. Jernigan inquired whether or not the City had one of more Com-
mercial zoning catagories. City Inspector Jack Bullard explained
the City's commercial zoning designation to Mr. Jernigan, Mr. Jer-
nigan stated he wished to go on record as being in favor of the
zoning request.

Mr. Fred Ball, an adjacent property owner, was recognized by the
Chairman. Mr, Ball stated he was in favor of the rezoning request
and had talked with Mr. Earl Gee, a property owner on the East of
the property, who is also in favor of the request but was unable to
attend the meeting due to illness. Mr, Bullard confirmed this in-
formation as he had spoken to Mr. Gee by telephone,
There were no opponents of the rezoning request.
Mr. Kenneth English was asked to state his views concerning the
request for rezoning. Mr. English referred to the Engineers'
letter, dated February 11, 1966, and stated his main concern was
with the drainage on the East of the property. (Engineers' letter
hereby made a part of the Minutes)
After discussion, Don Hastings made a motion to recommend approval
of the petition for rezoning; motion seconded by LaVern Lee. The
vote as follows:
ayes Uselton, Hastings and Lee
nays None
The Chairman declared the motion carried. (Resolution #57)
Preliminary Plat - Lucas Estates
At this time, the Chairman was requested to consider the prelimi-
nary plat of Lucas Estates. (This item not on the Agenda) Mt,
David Moak presented the preliminary plat. After discussion, LaVern
Lee made a motion to recommend approval of the plat subject to
compliance with the Engineers' recommendations, i, e,, (1) the -
furnishing of a right-of..way and necessary drainage easements be-
tween lots 7 & 8 of Block 4 and participation in the cost of such-
drainage; (2) the possible participation or solution to the drain-
age problem on the East side of tract B; (3) developer to be re-
quired to furnish a detail of the proposed street cross section
prior to approval of the preliminary.
It was further recommended that' the property owner on the West,
in this instance, Mr. Fred Ball, submit a letter to the City detail-
ing his willingness rz '.lave the overflow Cain
onto his property,
The motion was seconded by Don Hastings, The vote as follows:
ayes UsUton, Hastings and Lee.
nays None
The Chairman declared the motion carried.

B. Resolution #58 - Set a Public Hearing date - Zoning Case-Cody& Cody-
tract of land out of the Levi Franklin Survey from "A" to "C".
LaVern Lee made a motion to set a Public Hearing date for March 15,
1966; motion seconded by Don Hastings; motion carried unanimously.
ADJOURNMENT IV,
The meeting was adjourned at 9:45 p.m, by general consent of the
members.
