CALL TO ORDER I,
The regular meeting of the Planning & Zoning Commission
was called to order by the Chairman, Henry U9elton, at 7t40 p.m, with
the following members in attendance: Messrs. Don Hastings and LaVern Lee.
Not present, Messrs. L. J, Weber and Bert Hey'.
Also present, Jack Bullard, City Inspector,
Visitors present were Mr, & Mrs, Joe Pahl, Mrs. Ray Pruitt,
Marvin Carroll, Mr, & Mrs. H. D, Kennedy, Jack Nolen, Mrs, M, C. Boardway
Mrs. J. B. Norris, C, E. Godbey, Bill Waltrip, Z, L, Simpson and V, K.
Roberts.
PRESENTATION OF MINUTES II.
The minutes of the regular meeting of the Planning & Zoning
Commission, dated December 7, 1965, were read by the secretary and approved
as read.
OLD BUSINESS III.
A. Timberline Estates - plat
(This item deleted from the Agenda as the plat had not been received
in the office of the City Engineers.)
B. Northwest Boulevard
(This item submitted for consideration by the Planning & Zoning
Commission having been approved by the City Council at the regular
meetings, dated December 28, 19650
NEW BUSINESS IV,
A, Public Hearing - Zoning Case #144 a. Z. L, Simpson, Lots 1 & 2,
Block 6, Green Hills Park Addition - request for rezoning from "A"
Residential to Local Business for Nursery School,
The Chairman declared the Public Hearing opened and asked for pro-
ponents to the zoning request.
Mr. Z, L. Simpson presented the plans for the structure and explained
the structure would have the appearance of a house or residence,
would be fenced and would have a lot between the structure and the
adjoining residence.
Mrs, Joe Pahl, who proposes to operate the school, presented her
qualifications for operating the school, having been instrumental

in the development of the Hurst Hills Private School and the Euless
Private School. She further explained the School would be licensed
by the State and County and would comply with City specifications.
A 1700 square foot structure is planned observing the 22 foot set-back
from Harwood Road for future construction of the thoroughfare.
The Chairman asked for opponents to the request and several citizens
in the area and within 200 feet of the property were present to
oppose the request.,
A Petition containing fifty-one (51) names and protesting the request
was presented by Bill Waltrip, representing the property owners in
the area. (Petition hereby attached to Zoning Case No. 144)
The property owners listed such items as decrease in value of their
property, increase in traffic around a School, noise, narrow width
of the lots and the fact that local business zoning is not restricted
to Nursery Schools in the event the venture is unsuccessful.
Mrs. Pahl explained that most of the traffic would begin as early as
6:30 o'clock a.m. and that off-street parking would be provided. The

be adjacent to the school yard. She agreed with the property owners
that restrictive zoning is desirable.
Several property owners indicated they would be opposed to the request
whether or not restrictive zoning is imposed.
Mr, V. ". Roberts, representing Fantastic Homes, addressed the Chair-
man and stated he sold the lots to the petitioneer for residential
construction and expressed an opinion that Mr. Simpson would be de-
feating his purpose by constructing the School with the opposition
of the property owners. He further stated, "any land owner can stop
you from building a Day Nursery".
It was noted by the Chairman that the present Zoning Ordinance No.
33 does not have a restrictive zoning designation for Nursery Schools
and after considerable discussion by the Commission, the Chairman
entertained a motion to send the Zoning Case to the City Council
without a recommendation due to the lack of proper restrictive
zoning, Resolution #51.
The motion was made by Don Hastings; seconded by LaVern Lee. The
vote was as follows:

The Chairman declared the motion carried.

B, Commercial Permit #29 - Nursery School (relative to Zoning Case #144)
Mr,. Bullard, City Inspector, noted that the plat did not indicate
approaches or parking facilities.
The petitioner explained the omission of the approaches and parking
was deliberate in order to comply with requirements specified by
the City;
Mr4 Simpson agreed to furnish the City With a plan for driveway and
private parking facilities.
The Commission concurred that the building plans meet City Specifi-
cations'with the addition of the plans for driveway and private
parking, Sdbject to the City Council;s decision concerning zoning*
ADJOURNMENT V,
The meeting was adjourned at 9:15 p.m, by general consent of the
