CALL TO ORDER Chr The regular meeting of the Planning & Zoning Commission was called to order at 7,45 by the Chairman, Edward Smith. The following members were in attendance, Messrs. Bert Hey]. and LaVern Lee. Commission members, Messrs, Don Hastings and Henry Uselton, arrived at ap- proximately 8100 p.m. Also present, Kenneth English, (Engineering firm, Gregory, Knowlton and Ratliff); Jack Bullard, City Inspector and Mrs. Fannie Gorman, recording secretary. Visitors present were Charles E. DeCuir, Wayne Stokes, P, D, Henry, Mrs. Flora E, Gray, Paul Crum and A, T. Sellers, II. PRESENTATIQN OF MINUTES The Minutes of the previous meeting were read by the Secretary and approved as read. III. OLD BUSINESS A, Wilshire Village West - Plat approval - John Barfield. (This item considered second on the ages , The Chairman read (he Planning & Zoning Minutes of February 16, 1965, Item I-B, as follows: Wilshire West - Plat - John Barfield . The Commission was ad- vised that the City Engineers had requested Mr. Barfield to re- plat Wilshire Village West, allowing an eighty (80) ft. R.O.W. on Barfield cut-off as this is a future proposed thoroughfare. This replatting preliminary has not been received in the office of the City Inspector to date. An excerpt from the City Council Minutes, dated May 13, 1965, Item XI, was read by the Chairman, (Excerpt certified and hereby made a part of the Minutes). The excerpt stated Mr. Barfields request for rezoning from "A" Residential to "C" Commercial had been tabled for further consideration and further that Mr. Barfield had presented a revised plat of the Wilshire Village West. There Were no opponents or proponents of the request. After discussion, Bert Heyl made a motion to recommend approval of the plat. The motion was seconded by Henry Uselton; the motion carried unanimously. NEW BUSINESS IV. A, Public Hearing No. 141 - Biddle and Crum - request for rezoning 10.2 Planning & Zoning Minutes, May 18, 19654 Page No. 2. ITEM IV, A con*t acres of land in the G. N, Matthews survey from A-i Residential to A-3 Multiple Family. Resolution No, 44. (This item considered first on the agenda). Mr, Paul Crum appeared as a proponent of the request. Mr. Crum stated he was aware of the City Council's decision of January 10, 1961, con- cerning the drainage easement. (Excerpt hereby made a part of the Min- utes). He further stated, they now thought it possible to put a park in this area and the pond might be an attractive factor; further apart- ment zoning would eliminate the Biddle Court cul de sac. The adjoin- ing property on South Main Street is presently zoned for local business andapertment dwellers prefer conveniences. A park site on the East would be a buffer zone; no area would be hurt by the A-3 Multiple family zoning. The Chairman asked if Mr, Crum was willing to pave a section of White- ner and Mr, Crum stated he would cooperate with the City in any way possible; there are presently three (3) easements across the property, granted to Mr, Wisenbaker. Mr. Crum has agreed to the extension and paving of South Main Street and further agreed to give five (5) ad- ditional feet on Whitener Drive, The Chairman inquired if any es- crow money had been mentioned, and Mr. Crum replied, he had not been approached concerning the matter, Mr. English inquired of the drainage in the area and Mr. Crum reiter- ated the property would be platted to eliminate the cul de sac and in lieu of the concrete drainage, the land would be landscaped and beautified. He stated there is presently an open ditch running through the local business zoning into the Lake. There were no opponents of the request. After discussion, Bert Heyl made a motion to recommend approval of the request. The motion was seconded by LaVern Lee; the motion carried unanimously, (Resolution No. 44) B. Public Hearin No. 13JA- Bertha Plisko - request for rezoning two (2) to s, 1'&` oc 14, Bell Ranch Terrace from "A" Residential to "C" Commercial. Resolution No, 45 Mrs. Flora Gray appeared as a proponent and representative of Mrs. Bertha Plisko, stating she had a potential buyer for the property contingent on the rezoning of the property. (Printers and Engravers) Mrs. Gray inquired as to the status of the adjacent property and was informed by Commission members that Western Hills Inn and sections East and West of Highway 157 are zoned Commercial. The area in ques- tion was indicated on the zoning map. Ilary The Chairman asked for proponents of the request. Mr. A, T. Sellers stated he was under the impression that eight or nine years ago, this property was all zoned commercial and was of the opinion the property is not suitable for residential use, The Zoning in the area was explained to Mr, Sellers, who then asked if it would be advantageous if the property owners in the area asked for blanket Planning and Zoning Minutes, May 18, 1965 - Page No. 3. item IV..0 cen=t 116,, commercial zoning in the area. The Chairman stated Mrs. Plisko had asked for rezoning on July 9, 1964 on lots 18 & 19, Bik 14, Bell Ranch Terrace and the request had been tabled on December 15, 1964; subsequently included in the Commission's request for rezoning lots 1-19, Block 14, Bell Ranch Terrace. This case (No. 137) was denied by the City Council. The Chairman stated this decision was precipitated by a single letter opposing the request, There were no opponents of the request. Don Hastings made a motion to recommend approval of the request, Af- ter discussion, commission member Hastings withdrew his motion. The motion was seconded by LaVern Lee; the motion passed unanimously. There were no opponents of the request. (Mrs, Plisko will be notified of the decision of the Commission). C. Public Hearin No 140 - Dr, Ralph Roberts - request for rezoning tract of lan out oche J. P, Halford Survey being 1316.6 feet South of the South R.O.W. line of Harwood Rd, and 300 feet East of Highway 157 from "A" Residential to "C" Commercial. Resolution No. 43. There were no opponents or proponents of the request, After discussion, LaVern Lee made a motion to recommend approval of the request. The motion was seconded by Don Hastings; the motion carried unanimously. V. OTHER BUSINESS A, Commercial Permit No. 17 - William Short & C,T. Beckham - Dairy Queen Request for Dairy ueen on-Lot 4 and 10-feet of Tot 5, Brock 2, S. W. Mills Subdivision and submission of plot plan, building plans and spec- ifications. Mr. Henry of Henry and Clark, realtors, appeared before the Commission and presented plans and specifications for the proposed Dairy Queen, Mr, Henry stated he had a term lease on the property. The Chairman asked if the drainage ditch running behind the property directly in- volved Mr. Henry and was informed by Mr, English that the drainage problem was on the S. W, Mills property. Bert Heyl made a motion to recommend approval of the request, The motion was seconded by LaVern Lee; the motion carried unanimously. B. The Planning and Zoning Chairman requested that the City Manager, Lee Cowell, set a date for a joint meeting of the Planning and Zoning Commission and the City Council to-discuss the proposed Zoning Ordi nance and Map.
