HomeMy WebLinkAbout1965-01-19 M � REGULAR MEETING of the PLANNING & ZONING COMMISSION ihw January 19, 1965 CALL TO ORDER The regular meeting of the Planning & Zoning Commission was called to order by the chairman at 7:30 p.m. Members in attendance were Messrs. J. A. Horton, Henry Uselton, LaVern Lee and Bert Heyl. Also present, Jack Bullard, City Inspector; Lee Cowell, City Manager; Bill Ratliff, (Engineering firm, Gregory, Knowlton and Ratliff) and Fannie Gorman, recording secretary. Visitors present were J. R. Cartwright, Mr. and Mrs. M. S. Duvall, J. A. Brown, J. C. Davis, R. J. Thomeson, Earl Ash, Sanford Ing, Jeff Ball, Mr. and Mrs. Robert Cherry, Mr. and Mrs. Chas. Hudel, Lillian M, Kele, Tex Jones, Joyce Maloney, J. S. Anderson, James H. Shelton, Richard J, Themes, Mr. Magee, A, T. Sellers, Gene Schrickel and Doc Hyde,. PRESENTATION OF MINUTES The minutes were tabled to the last item on the agenda. (Minutes approved as read) OLD BUSINESS I. A. Public Hearing - Zoning Case #137 - Commission, request for rezoning Lots 1 thru 19, Block 14, Bell Ranch Terrace from "A" Residential to "C" Commercial. The chairman called for opponents to the request, J. S. Anderson stated he was not opposed to the zoning request, but inasmuch as, Block 13, Bell Ranch Terrace contained similar lot de- minsions, should be included in the request for rezoning to "C" Com- mercial. James H. Shelton opposed the zoning request, stating it was t an enroachment on residential property, his property on Benbow Drive thereby becoming a no-manta land, Mrs. L, S. Duvall spoke as a pro- ponent, stating the City Ordinance limitations on building on less than a 65t lot rendered it impractical for residential building and she would like to see it zoned commercial, Mr. A. T. Sellers quest- ioned the limitation to 65t stating the property was sub-divided be- fore being annexed to the city, thus by State law allowed Milani on the 55t lots. The chairman presented Mr. Anderson a copy of Ordinance 33, stating use regulations in a Commercial district. As there were no further opponents or proponents, Henry Uselton made a motion to recommend approval of the request. LaVern Lee seconded the motion. Thome* - Zoning Case #138, request for swung a tract in the Ray Shelton Subdivision from "A' Residential to "C" Commercial. Dr. Thames was asked by the chairman to present law his request. Dr, Thames stated he had owned the land since February 1961, prior to annexation by the City of Euless, the present building on the property contained 1760 square feet. He wished to practice Veterinay on a full time basis and to improve the interior of the building and add a brick facing to the exterior, He was presently treating animals on the property, but wished to establish an animal hospital. Opponents to the request were called by the chairman. Mr. Earl D. Ash stated he acquired a $15,000. home from Dr. Themes to the North of the property in question and he was opposed to the request. Lillian Kele, a property owner, stated she did not believe the zoning would enhance her property. Mrs. Robert Cherry stated there was no point in changing from residential zoning, she bought with the intent of residential zoning and was opposed to Commercial zoning, Joyce Maloney, an interested party, asked who owned the property Northeast of Harwood Rd, Mr. Magee, representing Mayflower Investment Company, acknowledged ownership of the property and said he would be opposed to the zoning. (Mr. Magee later stated, he was lamilar with the way Dr. Thomas ran his animal clinic and would re- commend him as as asset to the community.) Mrs. M. S. Hudel objected to zoning a small area commercial in a residential area. Dr. Thome* then stated he had been told by his attorney he could use the pro- perty as it is, but he wished to improve the building and would be willing to withdraw the request for rezoning if he could secure a building permit for that purpose, The chairman then presented the option to the Hearing, to rezone the property commercial or obtain an adjustment on the zoning through the Board of Adjustment. In view of the opposition, J. A. Horton made a motion to reconutemd denial of the request and present it to the Board of Adjustment. LaVern Lee seconded the motion. The motion carried unanimously. The Chairman stated he would be available as a representative at the Board of Adjustment meeting. (Resolution No. 37) II. NEW BUSINESS A. Zoning Case #139 - Zolon Wilkins, request for rezoning Lots 21 and 22, Block 12, Cedar Hills Estates from "A" Residential to A-2 Mul- tiple family and Lot 15 and 7i' of Lot 16, Block 12, Cedar Hills Estates from "A" Residential to A-3 Multiple family. After discuss- ion, the Chairman stated the general consensus of opinion on the previous request, (Zoning Case #121) would indicate considerable op- position to the request. The request was tabled until such time as Mr. Wilkins could be contacted and informed of the Commission's action allowing him further petition in the matter if he so desired. (see attached sheet) Item A-1 4s, B. Commercial Permit #11, J. R. Cartwright, request for commercial per- mit for addition to the Euless Furniture Company, 108 West Euless Blvd. The chairman read an esrccrpt from the City Council minutes, Jahuarjc 1,1, 1965 approving the request. It was noted 45 feet was P&Z Page 3, January 19, 1965 allowed from the back of curb to the front of building. Henry Usel- ton made a motion to approve the request. The motion was seconded by LaVern Lee. The motion carried unanimously. C. Commercial Permit #12 - Tex Jones, request for Cafe on tract of land in the S. D. Graves Survery. Excerpt from the City Council minutes, �Teueu�y 22, 196&, was read by the Chairman referring the request to the Commission. Teat Jones presented plans and specifications. Bill Ratliff requested a five (5) 'foot easement on Raider Drive in lieu of 'the 4i feet originally requested. Mr. Jones agreed with this request. Henry Uselton made a motion to recommend approval of the request fdr a cafe and restaurant type building. Bert Heyl sec- onded the motion. The motion carried unanimously. (This request goes to City Council for further consideration) D. Cormerci.ai. Permit #13 - J. R. Cartwright ..'Plot Plan & Building Permit. A request for 4-plexes on tract of land beginning 456' East of South Main and fronting South Pipeline Rd. A motion was made by Bert Heyl to recommend approval of the Commercial permit. J.A. Horton seconded the motion. The motion carried unanimously. III. OTHER BUSINESS A. Parks and Recreation - Gene Schrickel. Mr. Gene Schrickel presented a progress report on Parks and Recreation stating as his objective the correlation of School and City land and facilities using an es- tablished criteria for a projected aggressive park and recration plan. B. Pipeline Road - Bill Ratliff, Mr. Ratliff presented a preliminary plan to cancel thoroughfare work on Pipeline Road (West) and con- struct a new Street East of Morrisdale Estates to Highway 183 West of Euless City Limits. The Commission expressed unanimous agree- ment with the proposal. ADJOURNMENT -The meeting was adjourned by general consent of the members at 10:30 p.m. APPROVED: ATTEST: Chairman .... Secretary lbw
