HomeMy WebLinkAbout1967-08-15 Regular Meeting of the Planning and Zoning Commission August 15, 1967 CALL TO ORDER Chairman Len Weber called the Regu, 3r Meeting of the Planning and Zoning Commission for the City of Euless to order in the Council Chambers of Euless City Hall at 7:35 P. M. The following members were present: Messrs. Bill Tench, Richard Lande and Jack Browne. (Absent: Mr. Don Hastings.) Also present were Mr. Jack Bullard, City Inspector and Mrs. Florence Murr, Recording Secretary. VISITORS Visitors in attendance were: Messrs. Billy H. Boggs, Julius Murr, Fred Foote, III , Charles Foote and Mr. and Mrs. J. J. Morris. I . APPROVAL OF MINUTES Mr. Tench made the motion to dispense with the reading of the Minutes of the Regular Meeting of the Planning and Zoning Com- mission dated July 18, 1967, and approve as written. Doctor Lande seconded the motion, and the vote is as follows: Ayes: Messrs. Tench, Lande and Browne Nays: None Chairman Weber declared the motion carried. II . REQUEST FOR LOT REVISION- LOTS 1 , 2 AND 3, BLOCK 4, TIMBERLINE ESTATES, FIRST FILING Mr. Julius Murr stated that he is present to represent Mr. A. J. Winters, Developer of Timberline Estates, who requests this revision. Mr. Murr stated that Mr. Winters desires to eliminate Lot 2, which will increase the size of Lots 1 and 3 of Block J:, Timberline Estates, First Filing, in order to accomodate larger houses to be constructed on this property. Mr. Murr stated that there are no easements involved in the matter. Members of the Commission reviewed a re- vised plat of the lots in question. Mr. Browne made the motion to recommend approval of the revision of Lots 1 , 2 and 3 of Block 4, Timberline Estates, First Filing, as requested, eliminating Lot 2 and increasing the size of Lot 1-R to 130 ft. frontage and Lot 3-R to 109. 13 ft. frontage, based on the plat, as sub- mitted. Doctor Lande seconded the motion, and the vote is as follows: Ayes: Messrs. Browne, Tench and Lande Nays: Hone Chairman Weber declared the motion carried. A (Page Two, Minutes of Regular Meeting, Planning and Zoning Commission, /15if)7.) III . PUBLIC HEARING-ZONING CASE NO. 161 , LOT 32, BLOCK 4, PARK CRESTMOOR ADDITION REQUESTED BY MR. JAKE J, MORRIS Mr. Jake J. Morris advised the Commission that he is desirous of a change in the zoning classification of Lot 32, Block 4, Park Crestmoor Addition -- the zoning change to be from "A" Residential to "C" Commercial . Mr. Morris stated that he desires to open an upholstery shop on the property in question. He stated that he does not plan to construct a building for this purpose at the present time, but at a future date hopes to erect a building. Mr. Morris stated that the structure will be a nice, attractive build- ing similar to the one recently constructed by Mr. Herger Massey at L!.O1 Huffman. Mr. Morris stated that the building he plans to construct will face Huffman and will be approximately 50 ft. wide, with a depth of 25 ft. In reply to a question as to the type of structure located on the property at this time, Mr. Morris advised that it is a small residence. Mr. Tench inquired if a building permit for this structure is to be considered at this time. Chairman Weber replied negatively, but that in his opinion, a stipulation of time in which to construct the building should be made, if this rezoning request is granted. In reply to a question pertaining to the type of businesses which are covered by "C" zoning classification, Mr. Bullard replied that almost any type business which is allowed within the City of Euless can be covered by this classification. Chairman Weber inquired if the type of business planned by Mr. Morris can be covered under a "B" Local Business classi- fication. Mr. Bullard replied negatively -- that since there are so few zoning classifications in the City of Euless, anything in the "repairs" category is considered Commercial , and in his opinion, an upholstery shop is a type of repair shop. There being no others present who wished to speak in favor of this rezoning, Chairman Weber inquired if there were opponents who desired to speak in opposition to the question. Mr. Fred Foote, who resides at 107 Wind- ward Way, stated that his residence is located one block from the property in question. Mr. Foote inquired regarding the effect this proposed rezoning would have on his property. Mr. Foote stated that the School District has increased the evaluation of his property almost $900.00, and he is fearful that the re-sale value of his home would be decreased, should this request be granted. Mr. Foote stated that he is aware that, possibly, all of the property in this vicinity will be commercial at a future date, but should it become necessary for him to sell his residence within the next few years, he, possibly, would suffer a financial loss, due to the surrounding commercial property. Boggs, of 108 Ridgecrest, stated that his property is located directly behind Mr. Foote's residence that he is of the same opinion as Mr. Foote and has the same questions pertaining to the property evaluation. Chairman Weber inquired if Messrs. Foote and Boggs own the property on which they reside. Each of the gentlemen replied affirmatively. Chairman Weber stated that most anything to he said would speculative, but in his opinion, the property owners would not have anything to lose 'should Mr. Morris' request be approved. Chairman Weber stated further that with the future Spur coming through and commercial property creeping in, the surrounding residential property might depreciate in value; however, should all of the surrounding property become commercial , the property owners will not have anything to lose. Mr. Dullard, City Inspector, stated that so far as the tax structure is concerned this rezoning will not affect their property. It will still be evaluated as residential property and will remain the same, unless the school district increases the tax rate. Mr. Bullard stated that the taxes on Mr. Morris' property will be increased, because it will be zoned "C" Commercial . Mr. Bullard commented that the question of this rezoning causing a decrease in the value of the surrounding residential property is a matter of opinion or judgment -- in some cases, commercial property is near enough to resi- dential property to lower the value, but if you are fortunate enough to get into the commercial area, you have made money, so there is an element of chance in- volved. Mr. Foote stated that an upholstery shop would not be bad, but if the "C" zoning classification covers most everything, Mr. Morris might decide to sell his property to someone for a less desirable business. Mr. Dullard stated that, in his opinion, there is always an element of change. Even with residential property, you may acquire undesirable neighbors. Mr. Browne inquired if any of the surround- ing property is zoned "C" Commercial at this time. It was pointed out that the property across the street from that in question is zoned "C" Commercial and will accomo- date a service station (the corner of Huffman and Ridgecrest) , and that most of the property facing Huffman Drive is zoned commercial at this time. Mr. Foote inquired if this zoning request applies only to the property located on the corner of Huffman and Ridgecrest. Chairman Weber replied affirmatively. Mr. Foote stated that in most cases, a town is constructed around its City Offices. He inquired if that was anticipated in the City of Euless. Mr. Bullard stated that this is indefinite at this time, due to the number of property owners involved. Mr. Bullard stated that, in his opinion, this depends on the location and price asked for the (Pa•e Four Minutes of Re ular Meetin. Planni and Zoning Commission 3 1 . property. If the property is priced too high, this discourages the development for commercial useage. Mr. Tench inquired of Messrs. Foote and Boggs if this discussion had changed their opinion, in any way, pertaining to the possible rezoning of the property in question. Mr. Foote stated that he still objects, but not so strongly, if Mr. Morris' building is to be a well-constructed, modern building and since there is only one block involved and since the property across the street has already been rezoned to accomodate a service station. Mr. 'Boggs stated that his main concern was the increased traffic on Ridgecrest, but since the proposed building frontage will be on Huffman, this problem will be eliminated. Following a discussion by Members of the Planning and Zoning Commission, Mr. Browne made the motion to recommend approval of Zoning Case No lit , rezoning Lot 32, Block 4, Park Crestmoor Addition from "A" Residential to "C" Commercial , providing construction has been started within a period of eighteen months, and if construction has not been started within this period of time, the zoning classification of this property will revert to its original zoning status, which is "A" Residential . Mr. Tench seconded the motion, and the vote is as follows: Ayes: Messrs. Browne, Tench and Lande :days: None Chairman Weber declared the motion carried. IV. COMMERCIAL PERMIT NO. 52, SAFEWAY STORES. INC. Chairman Weber inquired if a representative for Safeway Stores, Inc. had arrived. There being none present, Doctor Lande made the motion that no action be taken on Safeway Stores, Inc. request for Com- mercial Permit No. 52 Because of the lack of representation. Mr. Tench seconded the motion, and the vote is as follows: Ayes: Messrs. Tench, Browne and Lande Nays: None Chairman Weber declared the motion carried. VI .
