Planning and Zoning Commission
December 6, 1966
CALL TO ORDER
The Regular Meeting of the Planning and Zon-
ing Commission was called to order at 7:30 P. M. , by Chairman Len Weber, in the
Council Chambers of Euless City Hall . The following members were present: Messrs.
Bill Tench, Bert Heyl , Paul Gates, Don Hastings and Chairman Weber.
Also present were City Inspector Jack
Bullard, Recording Secretary Mrs. Florence Murr and Mr. D. F. Pittman.
APPROVAL OF MINUTES
Chairman Weber suggested that the Conmissif.'
dispense with the reading of the minutes of the previous meeting, dated November 1 ,
1966 -- all of the members having copies before them, and called for a motion per-
taining to the approval of those minutes.
Mr. Hey! made the motion to approve the
Minutes of the Regular Meeting of November 1 , 1966, as written. Mr. Tench seconded
the motion, and the vote is as follows:
Ayes: Messrs. Tench, Hey) , Gates and Weber
Nays: None
Chairman Weber declared the motion carried.
COMMERCIAL PERMIT NO 44.
MR. D. F. PITTMAN -
Chairman Weber invited Mr. D. F. Pittman t..
come before the Commission, advising them of all of the details pertaining to his
request for a Commercial Permit.
Mr. Pittman stated that he is desirous of
obtaining a Commercial Permit, in order that he may expand his business by con-
structing a number of Kitchen Units, to be made a part of the 183 Motel , which he
now owns and operates -- said motel being located on Highway 183. Mr. Pittman
presented plans and elevations, stating that the proposed units will be located
directly West of the units now in existence. Mr. Pittman advised the Commission
that the proposed units will extend approximately 460 ft. from Highway 183 and
that the deepest portion of the tract of land is approximately 465 ft.
(Mr. Hastings arrived at 7:35 P. M.)
Mr. Pittman stated that this property ha.,
previously been zoned "C" Commercial , and that he is very anxious to obtain the
permit requested, as he would like to begin construction next week.
Ae,,, After a study of the City Zoning Map, it
was determined that a portion of Mr. Pittman's property is zoned "C" CoTmercir1 , but
that approximately 165 ft. has never been zoned -- that the last Commercial Penult
issued to Mr. Pittman, which was for the expanding of Motel 183, had been issuF:d in

error -- the Planning and Zoning Commission, nor Mr. Pittman, having been aware that
the property was improperly zoned.
Mr. Tench stated that, in his opinion, the
only logical solution is to have the property rezoned before proceeding with Mr.
Pittman's request for a Commercial Permit.
Mr. Pittman stated that it would be a great
inconvenience to him to have to go through the usual procedure for rezoning the
property -- that had he been made aware of this problem sooner, he would have de-
layed plans to start construction.
The City Inspector stated that he is in
sympathy with Mr. Pittman, realizing that a delay would be a determent to him and
feeling that he should have noticed the zoning discrepancy when Mr. Pittman first
presented his request at City Hall and that he and the Planning and Zoning Commis-
sion were in error in issuing a Commercial Permit previously. Mr. Bullard stated
that he was anxious to expedite the matter and he would suggest that, possibly,
the Commission might approve a Temporary Permit, providing that Mr. Pittman apply
for the rezoning of this property.
Mr. Heyl made the motion that the Planning
and Zoning Commission okay a Building Permit, providing Mr. Pittman has the proper-
ty zoned Commercial .
The City Inspector stated that, in his
opinion, there will be no objection from the surrounding property owners, to this
rezoning, due to the fact that all of the surrounding property has previously been
zoned "C" Commercial ---- that there is only one way that a permit can be obtained,
without rezoning the property -- that way being through the Zoning Board of Ad-
justments.
Mr. Weber informed Mr. Pittman that the
Planning and Zoning Commission does not object to this zoning, nor to the permit,
but that the Commission has ordinances which it must follow.
After lenghthy discussion, Mr. Gates made
the motion that the Planning and Zoning Commission : we the Commercial Permit,
subject to thD following:
1 . That Mr. Pittman first go before ti-ea %:or,i ng Board of Adjustments for
a Temporary Building Permit.
2, That Mr. Pittman proceed, at once , t ' itiate the necessary request
for rezoning.
Mr. Tench commented that Mr. Pittman must
realize that this will be done at his own risk.
Mr. Heyl stated that he wi sA&(to wi thdra‘.;
the motion which he made previously and to second the motion made by Mr. Gates.
The vote is as follows:
Ayes: Messrs. Heyl , Gates and Tench
Nays: None
Abstained: Mr. Hastings
Chairman Weber declared the motion carried.

4610 Mr. Pittman requested information as to the
procedure necessary in going before the Zoning Board of Adjustments. Mr. Bullard
advised Mr. Pittman of the customary procedure, stating that the hearing could be
held approximately fifteen (15) days after the procedure has been started -- that
Mr. Pittman must decide if he wishes to go before the Board of Adjustments at this
time or initiate regular procedure for rezoning his property.
Mr. Pittman stated that he does not want to
wait ninety (90) days, which is the approximate time involved in rezoning property.
Mr. Bullard advised that if the case is
started tomorrow (December 7, 1966) the tentative date of the hearing will be
January 3, 1967.
It was pointed out that City Ordinances are
not set up for or against any one or two people, but for everyone, and everyone
connected with the City is supposed to follow the ordinances that have been set up
for them to follow; that ordinances are for everyone's protection and must be fol-
lowed, or there is no point in having them.
Mr. Bullard stated that it was an over-
sight, when the permit to "add-on" to Motel 183 was granted -- that this zoning
problem should have been discovered at that time.
After further discussion, Mr. Pittman
thanked the Planning and Zoning Commission for their time and consideration.
II .
ELECTION OF SECRETARY,
PLANNING AND ZONING COMMISSION
Chairman Weber reminded the Members of the
Commission that Mr. Paul Gates has been serving as Temporary Secretary, following
the resignation of Mr. LaVern Lee and asked for nominations from the floor, for
someone to servo permanently in that capacity.
Mr. Heyl mad;: the motion that Mr. Gates be
elected by acclamation to serve as Secretary to the !'fanning and Zoning Commission.
Mr. Hastings °seconded the motion, and the vote is
