Planning and Zoning Commission
March 3, 1970
CALL TO ORDER
The regular meeting of the Planning and
Zoning Commission was called to order at 8:00 P. M. in the Council Chambers
of Euless City Hall , with Chairman Leonard Weber presiding. Members pre-
sent are listed, as follows : Messers. Richard Leggett, Bill Tench, Jack
Browne, Harry Arth, Jack Cline and Chairman Weber. (Absent : Mr. E. E.
Keplinger)
Also present were City Inspector Jack
Bullard and Recording Secretary Florence Murr.
VISITORS
Visitors in attendance were Mr. and
Mrs. C. H. Holland, Messers. David C. Moak and Carl Tyson.
APPROVAL OF MINUTES
Mr. Leggett moved to approve Minutes
of the regular meeting dated February 17, 1970, as written. Mr. Browne
seconded the motion, and the vote is as follows :
Ayes : Messers. Leggett, Browne, Tench, Arth and Cline
Nays : None
Chairman Weber declared the motion carried.

PUBLIC HEARING, ZONING CASE NO. 201 ,REQUEST
OF MR, CYRUS `H. HOLLAND FOR REZONING 1 .65
ACRES IN J.H.HAVENS SURVEY, FROM "R-1" SINGLE
FAMILY DWELLING DISTRICT TO "C-2" COMMUNITY
BUSINESS DISTRICT, WITH A SPECIFIC USE PERMIT
FOR SALE AND DISPLAY OF BOATS SLOCATED 25
FEET SOUTH OF GLADE ROAD, ON WEST SIDE OF F.M. 157)
Chairman Weber opened the Public Hear-
ing on Zoning Case No. 201 , to consider the request of Mr. Cyrus H. Holland
for rezoning a 1 .65 acre tract in the J. H. Havens Survey, from "R-1"
Single Family Dwelling District to "C-2" Community Business District, with
a Specific Use Permit to allow the sale and outside display of boats.

review by Members of the Commission, calling attention to the present zon-
ing classification of other properties in this area.
Chairman Weber reminded Commission Mem-
bers that, at the previous meeting held on February 17, 1970, Mr. Holland

advised that he has leased the property in question to some people who
want to get a boat dealership and plan to conduct a business consisting
of the sale and repair of boats and sale of fishing supplies. Chairman
Weber stated further that Mr. Holland's original request was for "I-1"
Light Industrial Zoning; however, his request was withdrawn and re-
submitted as a request for "C.,2" Zoning, with a Specific Use Permit.
Mr. Browne recalled that the Specific
Use Permit is necessary to allow outside storage.
Members of the Commission were in
agreement that they have adequate information from Mr. Holland concern-
ing his request.
Chairman Weber asked if there were
others present who desired to speak either for or against this rezoning
request.
There being none, the Public Hearing
was closed.
Mr. Browne moved to recommend ap-
proval of Zoning Case No. 201 , Mr. C. H. Holland's request that the
zoning classification of a 1 .65 acre tract situated in the J. H. Havens
Survey be changed from "R-l" Single Family Dwelling District to "C-2"
Community Business District, with a Specific Use Permit to allow the
sale and outside display of boats. Mr. Arth seconded the motion, and
the vote is as follows :
Ayes : Messers. Browne, Arth, Leggett, Tench and Cline
Nays : None
Chairman Weber declared the motion carried.
Mr. Browne stated that he has one
question in view of this action -- that he wonders if Mr. Sellers ' case
could not have been handled in about the same way.
Mr. Bullard advised that he has re-
quested that the City Manager ask the City Council if they will consider
zoning Mr. Sellers ' property "C-2", if Mr. Sellers is agreeable, because
this is not residential property.
III .
CONSIDERATION OF PLAT APPROVAL,
HUMBLE OIL COMPANY TRACT LOCATED
AT SOUTHWEST CORNER OF SPUR 3,50'
AND F.M.157
Chairman Weber advised that he has a
letter dated March 3, 1970, from the City's Consulting Engineers, concern-
ing the plat of Humble Oil Company's tract located at the Southwest corner
of Spur 350 and F,M. 157. Chairman Weber read from the letter, as follows:

iir "0n the East side of 157, we would recommend encasement (concrete
or steel) of the water line as it crosses under the Highway
drainage ditch.
We understand that the Engineers on the project use a sanitary
sewer beginning point based on plans which we prepared for
adjustment prior to construction of Interstate 350. We would
caution everyone that this sewer should be uncovered to verify
its location as the first item of construction.
On the East side of the tract in question, the water and sewer
lines are parallel and 5 ft. apart. Our understanding of State
Health Department requirements is that the sewer must be either
cast iron with watertight joints or encased in concrete when
such a parallel system is less than 10 ft. apart.
Also, we would recommend that the water line crossing Highway
157 shall be an 8" line, in a 33" casing, with a 12" line ex-
tending from the South property line to the North property
line, along Highway 157, and an 8" water line from the East
property line to the West property line, along Spur 350."
Mr. David Moak, who was present as a
representative for Humble Oil Company, advised that he is aware of the
Consulting Engineer's recommendations that, possibly, the recommenda-
tion for over-sizing of the casing will create a problem; however, he
will advise his client concerning the recommendations.
Mr. Moak proposed that an additional
easement can be dedicated for water and sewer lines, which will enable the
separation of the lines to meet the requirement that they must be at least
10 ft. apart.
In reply to a question from Mr. Browne,
as to whether or not the widening of F.M. 157 is involved, Mr. Bullard ad-
vised that this comes under the jurisdiction of the Texas Highway Department.
Mr. Browne asked if the plans meet all
City requirements with exception of the recommendations from the City's
Consulting Engineers.
Mr. Bullard advised that specification
sheets detailing the construction of manholes and sidewalks were omitted
and that the calculation of drainage was not included. Mr. Bullard stated
that he has advised Mr. Moak of this matter, and Mr. Moak has agreed to
add these sheets to the plans.
In reply to a question from Mr. Browne,
the City Inspector advised that the City will either participate in the
over-sizing of lines or do the work, if the Developers want to wait until
the City is ready to serve that area; however, if they want to over-size
before the City is ready, they can do so at their own expense. Mr. Bullard
stated, further, that, in this instance, an 8" line will be permitted, but
since they are boring under the highway, they must provide for an 18" line,
which is forthcoming. Mr. Bullard stated that there will be no recovery

to the Developers, in this case, as the line is crossing at their property.
In reply to a question, Mr. Moak advised
that Humble Oil Company proposes to start construction at this site im-
mediately.
Mr. Bullard stated that Humble Oil
Company purchased a Building Permit for construction at this site in
1962 -- that they were anxious to do some preliminary work in the area and,
at his suggestion, have furnished a letter stating that they will comply
with all City requirements -- that, as the result of this letter, permission
has been given for them to proceed with the site work.
Members of the Commission reviewed the
plat, and Chairman Weber commented that, in his opinion, the Engineer for
this project should have known what was required and submitted a complete
set of plans.
Mr. Moak apologized for the Engineer,
stating that it was his intention to add the comment that all City require-
ments would be complied with, but apparently he was pressed for time and
had failed to do so. Mr. Moak stated that he was informed tonight that
this statement is not acceptable to the City of Euless -- that' '''etail Sheets
must be furnished, and he is agreeable to furnish these sheets prior to
presentation to the City council -- that he would like to expedite this
matter but would respect the Commission's judgment.
Mr. Browne asked if Mr. Moak can furnish
this information to the City by Thursday, March 5, 1970.
Mr. Moak replied affirmatively, advising
that the detail sheets are available and can be reproduced by that date.
Mr. Tench moved to recommend approval
of the plat for Humble Oil Company's tract located at the southwest corner
of Spur 350 and F.M. 157 providing the recommendations outlined in the letter
dated March 3, 1970, from the City's Consulting Engineers, are complied with
and providing, further, that Detail Sheets are furnished the City of Euless
no later than Thursday, March 5, 1970, and if the information is not furnish-
ed by the designated date, that this case shall be tabled for further
consideration by the Planning and Zoning Commission. Mr. Browne seconded
the motion, and the vote is as follows:
Ayes: Messers. Tench, Browne, Arth, Leggett and Cline
Nays: None
Chairman Weber declared the motion carried.
