Members present are listed, as follows: Messers. Richard Leggett, Harry Arth, Bill Tench, Jack Browne, E. E. Keplinger, and Weber. (Mr. Jack Cline arrived later in the evening.) APPROVAL OF MINUTES Mr. Tench moved to approve minutes of the regular meeting dated December 16, 1970, as written. Mr Leggett seconded the motion and the vote is as follows: Ayes: Messers. Tench, Leggett, Arth, Keplinger, Browne, and Weber Nays: None Chairman Weber declared the motion carried. 11 . PUBLIC HEARING, ZONING CASE NO. 197, REQUEST OF MR. TOM E. PURVIS FOR REZONING 41 .896 ACRES IN J. DOSS SURVEY, FROM "R-1" SINGLE FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT DISTRICT Chairman Weber opened the Public Hearing to consider the request of Mr. Tom E. Purvis for rezoning 41 .896 acres situated in the J. Doss Survey, from "R-1" Single Family Dwelling District to "PD" Planned Development District (Zoning Case 197) . { (Page Two, Minutes Regular Meeting, Planning and Zoning Commission, January 20, 1 Chairman Weber recognized Mr. Owen D. Long, twww who stated that he is the Consulting Engineer representing the Developers. Mr. Long introduced Messers. Tom Purvis and Jack York, Developers of the proposed Planned Development. Mr. Purvis presented an aerial photo of the area and pointed out the location of the subject property in relation to Cheek-Sparger Road, F . M. 157, and the proposed extension of 121A. Mr. Long stated that the Developers also own property which lies South of Cheek Sparger Road in the City of Bedford -- that plans for development and a request for rezoning are being submitted to that City also. Mr. Long presented plats indicating development proposed for that area, for review by Planning and Zoning Commission Members. Mr. Long advised that the proposed Planned Development is located two blocks North of the large tract located in Bedford, which was recently sold by Mr. Wisenbaker. Messers. York and Purvis presented an Architect ' s rendition of the proposed development and a plat , indicating the layout for a retail sales area, an office building, and highrise apartments (14 or 15 stories) , which will be constructed in phases. (Mr. Jack Cline arrived at 8: 17 p.m.) In reply to a question from Mr. Leggett, Mr. Purvis advised that the type of retail sales is indefinite at this time; however, the area next to Cheek Sparger Road will probably be used for commun- ity size retail sales. Mr. Tench inquired concerning the probable date for development. Mr. Purvis stated that he estimates it will be from twelve to eighteen months before ground in broken for the highway, and in his opinion, they cannot lease before the ground breaking; therefore, the first stage of development is probably three to four years away, and the second stage is from one to three years thereafter. Mr Purvis advised that this Planned Development is keyed to the development of the freeway -- that this freeway (121A) has priority at this time, and that is why he is sub- mitting plans now. In reply to a question from Mr. Browne, Mr. Purvis advised that the location for Cheek Sparger Road is definite -- that it will be within fifty feet of the area in question; however, a date for construction is indefinite at this time. Mr. Browne asked if this is in agreement with information furnished the City of Euless. The City Manager replied affirmatively. Mr. Tench asked if a Topo is available, and Mr. Long replied that he has one; however, he did not bring it with him. Mr. Long and Mr. Tench reviewed a plat of the tract, and Mr. Long pointed out the natural drainage areas. PUBLIC HEARING, ZONING CASE NO. 198, REQUEST OF HAROLD HALL, D.U.M. FOR REZONING 26.946 ACRES IN B. F. CORWLEY SURVEY FROM "R-1" SINGLE FAMILY DWELLING DISTRICT TO "R-3" MULTIPLE FAMILY DWELL- ING DISTRICT Chairman Weber opened the Public Hear- ing on Zoning Case No. 198, the request of Doctpr Harold Hall for rezoning Tract 4, B. F. Crowley Survey (26.946 acres) , from "R-1" Single Family Dwell- ing District to "R-3" Multiple Family Dwelling District. Chairman Weber recognized Mr. Bob Piltz, who stated that he is associated with Contemporary Properties , which rep- resents Doctor Hall in this rezoning request. Mr. Piltz advised that the main offices for Contemporary Properties is located in Dallas, and the firm consists primarily of Architects. Mr. Piltz presented a plat of the subject property, advising that four hundred, fifty-six units are proposed -- that the first three rows adjacent to Euless-Grapevine Road (North Main Street) will be single story structures and the remaining units to the East will be multi- story -- that the starting rate (rental ) will be from $225.00 to $240.00 per month. Mr. Piltz advised that, primarily, two and three bedroom units are proposed; however, there will be some one bedroom units -- that the proposed density of eighteen (18) units per acre is below average and will enable them to create an environment to live in, rather than to just exist -- that the development will serve as a buffer from commercial and industrial develop- ments. Mr. Piltz presented an architect 's sketch indicating multi-story structures. Mr. Piltz stated that this will be a quality project, primarily of brick construction with wood inserts (trim) and individual patios. In reply to a question from Chairman Weber, Mr. Piltz advised that a sketch of proposed single story units is not available at this time -- that a Topo has not been obtained; therefore, plans are not complete. Mr. Piltz called attention to ingress and egress, advising that the main flow will come from Euless-Grapevine Road (Main Street) . In a discussion, it was determined that the nearest commercially zoned property is the Animal Hospital , which is approximately 1500 feet from the subject property. LK, Mr. Cline asked if there is any benefit for zoning this tract from "R-1", when the City has ample property which is zoned "R-3". Mr. Piltz replied that poctor Hall owns (Page Five, Minutes Regular Meeting, Planning and Zoning Commission, January 20, 1970) the property in question and they consider it an ideal location for- apartments . (ipme that a survey made by his firm indicates that the City does not have this type of apartment development, and it is needed. Mr. Browne inquired concerning the noise from the airport. A lengthy discussion followed, and it was determined that the subject property is located approximately 3/4 miles out- side the decibel 2 line. At the request of Mr. Tench, Doctor Hall pointed out his property as shown on the City's Comprehensive Plan, which indicates the recommended zoning as "R-1" Single Family Dwelling District. Dc,-tor Hall stated that he is of the opinion an adjustment will be made in location of the proposed industrial area adjacent to the airport (East of his property) -- that the airport bound- aries were changed after the Comprehensive Plan was submitted by the City's Land Planner, and he is of the opinion a portion of the area so designated will be within the airport boundaries. Doctor Hall advised that, in his opinion, the proposed Industrial area should be extended Westward in order for the City of Euless to receive anticipated revenue from that area, and the apartment development which he proposes would serve as a buffer for single family residences in the area. Mr. Browne asked if F.H.A. has not advised that they will not approve anything East of Fuller Wiser Road. Mr. Arth asked who advised Doctor Hall that the proposed Industrial area is inadequate. Doctor Hall replied that it was Planners in the Dallas area. Mr. Piltz stated that this is the opinion of his firm. Mr. Cline asked what Doctor Hall proposes to do with his property if it is not rezoned. Doctor Hall stated that he will have to maintain it. Mr. Piltz advised that he has been in- formed that F.H.A. will not allow any financing East of Main Street at this time. In reply to a question, the City Inspector advised that he does not have an official record to this effect -- that he has received this information by word of mouth. Doctor Hall stated he had heard that his neighbor to the South tried to subdivide and this is the problem he encountered. (Page Six, Minutes Regular Meeting, Planning and Zoning Commission, January 20, 1970) Low it was determined that Mr. Walter l ?tit is the owner of that property, and in reply to a question, Mr. Elliott s, C: that his information is that you cannot get V.A. or F.H.A. financing in t• i „ area East of Main Street. Mr. Elliott stated that he has not applied and been turned down and suggested that, possibly, the City could obtain deFirl) tr. information in this regard; whereby, an individual cannot. Mr. Elliott stated that he considers it would be very unlikely that a developer could obtain financing East of Main Street. A lengthy discussion followed concerning the volume of sound created for this area as the result of the airport. Doctor Hall stated he is of the opinion at this time the decibel runs over 110 decibels -- that this is in the range of harm to an individual . Doctor Hall stated, further, that he is of the opinion F.H.A. is not financing in this area for that reason. In reply to a question from Chairman Weber, Mr. Piltz advised that this noise factor will have to be considered in the construction - that he does not know what will be done, at this tim , but it will be worked out on a scientific method. Doctor Hall stated, in reply to a question., that he is of the opinion the sound problems will be lessened upon completion of the new Regional Airport; however, there will still be some problems. Chairman Weber called for proponents in this rezoning request. There being none, he called for opponents. Mr. Archie McElveen, 1802 Shadow Lane, stated that he is opposed to the rezoning of this property, primarily, because of the devaluation of his and other property in the area. Mr. McElveen pre- sented petitions signed by owners of property within two hundred (200) feet pf the subject property and other property owners in the area. Mr. McElveen advised that the petitions carry approximately 175 names. Chairman Weber received the petitions and read, as follows: "We, the undersigned citizens of the City of Euless, all being qualified voters, and all living or owning property within 200 feet of the property lines of the tract proposed for a zoning change, heartily oppose the "R-3" Multiple Family Dwelling District request, and demand that same be passed in accordance with Section 16, Paragraph 105 of the zoning ordinances of the City of Euless, Texas," Chairman Weber stated that eight (8) names had been affixed to this petition. Chairman Weber stated that the re- mainder of the signers own property more than 200 feet from subject property, Lir and read from their petition, as follows: "We, the undersigned citizens of the City of Euless, all being qualified voters, heartily oppose the "R-3" Multiple Family Dwelling District request. Zoning Case 198." • ' (Page Seven, Minutes Regular Meeting, Planning and Zoning Commission, January 20, 1970) Mr. McElveen stated that there is a traffic problem in that area at this time, and until North Main Street is widened, it will be a hazard -- that there is a lack of recreational facil- ities, and he considers an apartment development will overcrowd the schools and over-load the water and sewer system. Mr. McElveen stated that he moved into that particular area because it is zoned for single family reside- nces -- that he would like to stay, but would rather not be situated adjacent to apartments. Mr. David Crow, 107 Shadow Lane, stated that he would rather not live in the area of apartments, Mr. Alex Scott, 105 Ash Lane, stated that he moved to that address last May, from North Dallas, because this is a nice City with good schools, and he enjoys the country atmosphere -u• that he is disappointed to learn the City is considering "down zoning". Mr. Scott stated that he considers this the nicest residential area and, in his opinion, if you can build on the West side of Main Street, you can build on the East side -- that the airport runways will be 4 1/2 miles from Ash Lane, and he does not consider this a problem. Mr. Earl Koeff, 200 Walnut Way, stated that, in his opinion, a density of eighteen (18) units to the acre is too great for apartments accommodating families -- that the average family is 3.5, which means you will have approximately six hundred (600) children in the area to crowd the schools -- that he considers the proposed green area inadequate for this type of development. Mr. Koeff recited the quotation "Density plus time equals slums." and stated that he is of the opinion this is true unless you get into the "ultra" apartments. Mr. Koeff predicted that, should the proposed development be permitted, it will be a liability within seven(7) to ten (10) years. Mr. Bruce Greensmith, 207 Ash Lane, expressed opposition to the proposed rezoning. Mr. Jack Ballas, 111 Trailwood, stated that the decibels which will affect the residents of Trailwood are affecting them now -_, that it is proven a person can withstand 85 decibels throughout an eight hour working day, and anything above that will cause decreased eff- iciency -- that the 110 decibels referred to by Doctor Hall is not continuous, but comes every thirty minutes or once an hour. • Mr. Larry Resh, 103 Shadow Lane, stated that he is of the opinion it is poor planning for a developer to come into an area without complete knowledge of the problems of the area. Mr. Piltz stated that this is why they propose to develop the land in phases, starting at North Main Street -- away from the airport area. Chairman Weber stated that he would like to clarify one point -- that Doctor Hall is the owner and developer of subject property, and Mr. Piltz's firm was employed by him. Doctor Hall explained that the proposed (Page Eight, Minutes Regular Meeting, Planning and Zoning Commission, January 20, 1970) development will act as a buffer from the industrial area rather than sour° - - Cow that the decibels were considered because he is already aware of this prchlm, having lived there for nine (9) years. Mr. Resh stated he is of the opincn an airline pilot is more aware of sound than the average person -- and he does not consider this to be a problem. Mr. Curt Dearing, Route 1 , Box 69, star€ that he is opposed to the apartments because of the traffic and parking prct1:.- Doctor Hall stated that Main Street w} i ' be improved -- that he is of the opinion money for this was included in th last Bond Issue, Mr. Marland Ernest, 105 Trailwood, styr .c he is of the opinion there is a gross misconception -- that he doesn 't think Dr, Hall is selling his land for the neighboring people -- that he thinks it is for his own interest as it should be. Mr. Wayne Sanderlin said if he had that property, and could get by with what the Doctor is trying to do, he would, but he hopes he (Dri Hall) doesn ' t get by with it. Mr. Bo Jones, 1803 Shadow Lane, stated that he bought his home for peace, quiet and seclusion and hates to see it go down the drain. Mr. Don Carne, 105 Shadow Lane, stated that he would like to keep the "R-1" zoning as the City originally planned it. Mr. Don Green, 107 Trailwood, stated that perhaps there is a funding problem now, but he would assume that, possibly, it is because of training flights -- that, possibly, F.H.A. will again consider financing East of Main after the training flights are removed -- that almost everyone in the area obtained conventional financing; therefore, the lack o' F,H.A, financing should not be a problem. A gentleman in the audience stated that the City of Euless has spent lots of money on the Master Plan, and he would hope this commitment would be honored and left this way. Chairman Weber stated that the Commission has an obligation to the residents of the City of Euless, but it also has to look at what would be best for the City "incomewise". Mrs. Jane Flanagan asked Doctor Hall if he plans to continue to live in the area after his property is developed. Doctor Hall stated that he will remain Low until after the first phase of construction -- that he is not selling the property -- that he is a part of this project. Mr. Don Green asked if apartment dwellers pay as much tax as single family residents. p . Mr. Arth stated that the City has which has been challenged as being out of date -- that he would like to s the airport map superimposed on the City's map before he votes on this cr.c,, posed zoning. Mr. Arth advised that the City Inspector is of the opinion it, possibly, will be thirty days before a map can be obtained. Mr. Arth moved to table the vote on Zoning Case No. 198 for a period of one month. Mr. Browne recalled that, at the Dece.mb=r meeting, the City Manager had been invited to discuss possible up-dating of the zoning plan, Mr. Browne seconded Mr. Arth 's motion, and the vote is as follows: Ayes; Messers. Arth, Browne, Keplinger, Cline, Tench, Leggett , and Weber. Nays: None Chairman Weber declared the motion carried, advising that this matter will again be considered at the regular meeting scheduled for February 17, 1970. Chairman Weber advised visitors that this matter will be considered by the City Council after a recommendation is made by the Planning and Zoning Commission. 111. RESOLUTION NQ. 154 CALLING PUBLIC HEARING ON ZONING CASE NO, 199, REQUEST OF MR. GEORGE GORDON FOR REZONING LOTS 1 AND 2, BLOCK 3, EULESS GARDENS. NO. 1 , FROM "C-1" NEIGHBORHOOD BUSINESS DISTRICT TO "C-2" COMMUNITY BUSINESS DISTRICT Mr. Tench moved to approve Resolution No. 154, setting February 3, 1970, as the date for Public Hearing on Zoning Case No. 199, the request of Mr. George Gordon for rezoning Lots 1 and 2, Block 3, Euless Gardens No. 1 , from ''Cl '- Neighborhood Business District to "C-2" COMMUNITY BUSINESS DISTRICT.
