M. In the Council Chambers of Euless City Hall , with Chairman Leonard Weber presiding. Members present are listed, as follows: Doctor Harold Half Mr, Bill Tench and Mr. Weber. (Absent: Doctor Richard Lande and Mr. Jack Browne) Also present were City Inspector Jack Bullard and Mrs. Florence Murr, Recording Secretary. VISITORS Visitors present are listed, as follows: Messrs. Ivan Gregory, Robert J. Bransfor¢, Piers Chance, Steve Elliott, Samuel M. Harrington and Roy Sanders. APPROVAL OF MINUTES Minutes of the regular meeting dated January 21 , 1969, were approved as written. i . PUBLIC HEARING TO CONSIDER REZONING A 1,o ACRE TRACT OUT OF Bt HARRINGTON SURVEY, A-808. FROM "R-1" SINGLE FAMILY REPID'ENCE TO "C-2" COMMUNITY BUSINESS k! TRICT, REQUESTED BY MRS. S i HARRINGTON (ZONING CASE' NO 186) Chairman Weber opened the public hearing to consider rezoning a 1 .0 acre tract of land out of the B. Harrington Survey, A-808, from "R-1" Single Family Residence to "C-2" Community Business District. Chairman Weber recognized Mr. Sam Harrington, who stated that he requests the rezoning of this property for the purpose of ope ating a vegetable, grocery and fruit stand at this location. Mr. Harrington pointed out the location of the property in question and advised that he, proposes to construct a brick structure to house this business operation, In reply to a question, Mr. Harrington advised that the tract in question is one hundred, eleven (111) feet wide and three hundred, ninety-one (391) feet deep -- that access to the proposed business will be from Highway 157. In a brief discussion of surrounding properties, Mr. Bullard advised that some property in the area has previously been rezoned; however, properties in the immediate vicinity of the tract in question are zoned for single family residences, It was determined that the adjacent pro- perty to the North is owned by Mr. Zolon Wilkins and the property South and East of the tract in question is one large tract. There were no opponents in this zoning case , and Chairman Weber declared the Public Hearing closed. (Page Two, Minutes of regular meeting, Plannrinq and Zoning Commission,February 18L 1,969.) Mr, Tench made the motion to recommend approval of Zoning Case No. 186, rezoning a i1O acre tract out of the B. Harrington Survey, A-808, from "R-1" Single Family Residence to "C-2" Community Business, as requested by Mrs. Sam Harrington. Doctor Hall seconded the motion, and the vote 1� as follows: Ayes: Messrs. Tench, Hall and Weber Nays: None Chairman Weber declared the motion carried. Iii PUBLIC HEARING TO CONSIDER REZONING 28,384 ACRD TRACT OUT OF J. P. HALFORD SURVEY, ABSTRACT NO. 711 , EXCLUSIVE OF THE WEST 400 FEET PRESENTLY ZONED "C-2" COMMUNITY BUSINESS DISTRICT, FROM "R-1" SINGLE FAMILY RESIDENCE TO "R-3" MULTI-FAMILY RESIDENCE, REU.UESTED BY MAYFLOWER INVESTMENT COMPANY (ZONING CASE NO, 1§j) Chairman Weber opened the Public Hearing on Zoning Case No. 187, to consider rezoning a 28.5384 acre tract out of the J. P. Haiford Survey, Abstract No. 711 , exclusive of the West 300 feet which is presently zoned "C-2" Community Business District, from "R-1" Single Family Residence to "R*3" Multi-Family Residence, as requested by Mayflower Investment Company. Chairman Weber recognized Mr. Piers Chance, who advised that Mayflower Investment Company Is in the process of selling the property in question, which is located at the Northeast corner of Midway Drive and Highway 157, and the sale is to be consummated upon approval of this rezoning. In reply to a question, Mr. Chance stated that ingress and egres will be from Highway 157 and/or Midway Drive; however, he has not seen plans for subdividing, therefore, Is unable to answer any questions perta:ping to that phase of development. Chairman Weber asked if there were others desiring to speak regarding this rezoning request and recognized Mr. Robert Bransford. Mr. Bransford stated that he desires to speak as a neutral part -- that he is not opposed to the rezoning; however, he owns residential lots East of the tract in question and requests assurance that the proposed apartment development will be properly screened. Mr. Bransford suggested that a greenbelt area could be planned to separate the apartments from his sub- division, or possibly, single story apartments might be planned for the area directly adjacent to the single family dwellings, Mr. Bransford advised that privacy is important to a homeowner and it is very difficult to obtain privacy with adjacent multi-story structures. Mr. Bransford advised that he is a developer, and when planning an apartment development , it is his practice to include a green- beit area for the protection of adjacent property owners -- that it is necessary to furnish a play area for apartment dwellers and, in his opinion, the greenbelt can be used for that purpose. In reply to a question, Mr. Bransford advised that he owns fourteen (14) lots on Lamar Street, on which he plans to construct single family residences. Chairman Weber stated that it has been the policy of this Board to recommend, at the time preliminary plans are presented , that either screening or some type of greenbelt be provided in this type of development. Mr. Bullard advised that the City's Zoning Ordinance requires a minimum of twenty-five (25) feet from the structure to the boundary line, for both front and rear yards, and that a screening wall or fence, not less than six (6) feet high, is required? Mr. Bransford commented that, in his opinion, twenty-five (25) feet is not sufficient distance between a single family residence and a two-story apartment house. Mr. Bransford inquired if minimum requirements are acceptable to the City. Chairman Weber stated that this depends on the type of structure which is proposed that he cannot answer in this case, be- cause plans for the proposed development have not been presented. Doctor Hall advised Mr. Bransford that it is the policy and intent of this Board to protect single family dwellings -- that it endeavors to avoid any encroachment on their areas. Mr. Bransford stated that he has certain commitments which must be fulfilled, and he has prospective homeowners which must be considered. Mr. Bullard asked Mr. Bransford what he considers a safe distance between single family dwellings and apartments. Mr. Bransford stated that a one hundred (100) foot greenbelt was left in an apartment development which he recently con, strutted in Lewisville -- that this area has a driveway through it, and it is the play area; therefore, in his opinion, the area Is not wasted. Mr. Bransford ad- vised that single story apartments or covered parking spaces in that area would be satisfactory. Chairman Weber declared the Public Hearing closed. Doctor Hall made the motion to recommend approval of Zoning Case No. 187, rezoning a 28.5384 acre tract out of the J. P. Halford Survey, Abstract No. 711 , exclusive of the West 300 feet which is zoned "C,2" Community Business District , from "R-1" Single Family Residence to "R-3" Multi-Family Residence, ps requested by Mayflower investment Company. Mr. Tench seconded the motion, and the vote is as follows: Ayes: Messrs . Hall , Tench and Weber Nays: None Chairman Weber declared the motion carried .
